Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Considering the proposal of the Director of the Organization and Cadre Affairs Department and the Director of the Complaint Resolution and Inspection Office for Region 2,

DECISION:

Article 1. Issuing along with this Decision "Regulations on the functions, tasks, powers, and organization and operation of the Complaint Resolution and Inspection Office for Region 2".

Article 2. This Decision takes effect from the date of signature and replaces Decision No. 1075/QĐ-TTNN dated September 8, 2003 of the State Inspector General promulgating regulations on the functions, tasks, powers, and working procedures of Departments, Offices, and affiliated organizations under the State Inspectorate (now the Government Inspectorate).

Article 3. The Head of the Office, Directors of the Organization and Cadre Affairs Department, the Complaint Resolution and Inspection Office for Region 2 (Office II), Heads of units under the Government Inspectorate shall be responsible for implementing this Decision./.

REGULATIONS

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE COMPLAINT RESOLUTION AND INSPECTION OFFICE FOR REGION 2
(Issued together with Decision No.: 1583/2008/QĐ-TTCP dated August 6, 2008 of the State Inspector General)

Chapter I.
FUNCTIONS, TASKS, POWERS, AND PRINCIPLES OF OPERATION

Article 1. Position and Functions

The Complaint Resolution and Inspection Office for Region 2 (hereinafter referred to as Office II) is an entity under the Government Inspectorate, assisting the State Inspector General in managing state administrative affairs regarding complaint resolution, accusation handling, and inspection in Region 2, which includes 18 provinces and centrally governed cities: Thanh Hoa, Nghe An, Ha Tinh, Quang Binh, Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Lam Dong, Kon Tum, Gia Lai, Dak Lak, Dak Nong, Khanh Hoa, Ninh Thuan; it is responsible for performing tasks related to complaint resolution, accusation handling, and inspection within its jurisdiction.

Office II has its own seal.

Article 2. Tasks and Authorities

1. Assist the State Inspector General in performing state management functions:

a) Take the lead or participate in drafting proposals, strategies, programs, annual plans, and other plans concerning inspection, complaint resolution, and accusation handling by the Government Inspectorate;

b) Coordinate with Departments and units under the Government Inspectorate to draft and submit to the State Inspector General legal documents on inspection work, complaint resolution, and accusation handling;

c) Assist the State Inspector General in guiding regions in Region 2 to develop and implement inspection programs and plans; direct and guide specialized and professional work in inspection, complaint resolution, and accusation handling for provincial inspectors assigned by the Government Inspectorate;

d) Assist the State Inspector General in urging Chairpersons of People's Committees in regions in Region 2 to conduct inspections of matters within their local management responsibility; resolve issues not agreed upon between the Chief Inspectors of provinces in Region 2 and the Chairpersons of People's Committees at the same level regarding inspection work, complaint resolution, and accusation handling;

e) Assist the State Inspector General in advising the Prime Minister to suspend or revoke regulations issued by People's Committees and their Chairpersons in Region 2 that contravene national laws, decrees, and regulations of the State Inspector General on inspection work, complaint resolution, and accusation handling, and public reception;

f) Assist the State Inspector General in conducting inspections and evaluations of the responsibilities of Chairpersons of People's Committees in Region 2 in implementing laws on inspection, complaints, and accusations;

g) Coordinate with provincial inspectors in Region 2 to monitor the situation of inspections and complaint resolution, and promptly propose solutions to the State Inspector General when there are signs of complex issues arising;

h) Participate in legal project reviews conducted by the Legal Affairs Department;

i) Summarize practical experience; participate in theoretical and professional research, and propose amendments and supplements to improve mechanisms, policies, and laws on inspection and complaint resolution;

2. Directly conduct inspections and resolve complaints and accusations:

a) Implement the annual inspection and complaint resolution plan after approval by the State Inspector General; directly carry out inspections of the implementation of policies and laws, and duties of Chairpersons of People's Committees in Region 2 according to the plan or inspect other cases when assigned by the State Inspector General;

b) Assist the State Inspector General in investigating and resolving complaints and accusations arising in Region 2 in accordance with the law;

c) Organize, monitor, and inspect the activities of inspection teams led by the Office or by staff members of the Office serving as team leaders;

d) Monitor, urge, and inspect the implementation of conclusions, recommendations, and decisions on inspections and complaint resolutions made by the Government Inspectorate and the Prime Minister in the assigned area.

3. Coordinate with Office I to receive citizens at the Central Party and State Citizen Reception Office in Hanoi for complaints and accusations handled by Office II.

4. Perform administrative reform, international cooperation, and scientific research tasks as assigned by the State Inspector General.

5. Compile and report on the results of inspection, complaint resolution, and other tasks within the assigned functions and responsibilities as stipulated by the Government Inspectorate.

6. Manage cadres and civil servants, files, documents, assets, and seals in accordance with the law and regulations of the State Inspector General.

7. Perform other tasks assigned by the State Inspector General.

Article 3. Principles of Operation

1. The Bureau II operates under the head system, ensuring the principle of democratic centralism, transparency, and openness as prescribed by law; emphasizing individual responsibility and discipline, promoting the strengths, initiative, and creativity of all officials and civil servants in their work, and enhancing the effectiveness of the Bureau's activities.

2. Officials and civil servants of the Bureau must also comply with the "Regulation on the Organization and Operation of Inspection Teams" issued by the Chief Inspector when participating in inspection teams, complaint resolution, and accusation handling.

Chapter II.
ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 4. Organizational Structure and Staffing

1. The organizational structure of Bureau II includes:

a) Bureau leadership consisting of the Director and Deputy Directors.

b) Units directly under the Bureau include:

+ General Affairs Department;

+ Complaint Resolution and Inspection Department 1;

+ Complaint Resolution and Inspection Department 2;

2. The tasks and authorities of the departments are defined by the Director of Bureau II.

3. The staffing of the Bureau is determined by the Chief Inspector based on the proposal of the Personnel Department Head and the Director of Bureau II.

Article 5. Responsibilities and Scope of Work of the Bureau Director

1. Leading, directing, and organizing the implementation of the Bureau’s tasks as stipulated in Article 2 of this Regulation and other tasks assigned by the Government Inspectorate leadership; being responsible before the law and the Chief Inspector for the results of the assigned work.

2. Assigning and supervising the implementation of tasks by Deputy Directors, units directly under the Bureau, and officials and civil servants within the Bureau.

3. Directing the development of inspection plans, complaint resolution plans; coordinating with the Personnel Department Head to arrange personnel for inspection teams and complaint resolution teams organized by the Bureau; personally serving as the Team Leader for large-scale inspections with complex content upon assignment by the Chief Inspector.

4. Monitoring, urging, and inspecting the activities of inspection teams assigned to the Bureau to ensure compliance with approved plans and schedules; participating in the drafting of reports and inspection conclusions for teams led by Bureau staff before submitting them to the Chief Inspector.

5. Implementing tasks delegated by the Chief Inspector; signing on behalf of the Chief Inspector for certain documents within his authority according to the Working Regulations of the Government Inspectorate. Signing documents: introducing, appointing survey teams to grasp situations in regions 2 and related agencies to serve the development of inspection programs and plans; urging the implementation of inspection conclusions; exchanging professional knowledge with inspectors from regions 2; internal management documents of the Bureau.

6. Cooperating with heads of other units under the Government Inspectorate to handle issues related to the Bureau's functions and tasks and implementing common tasks of the agency as prescribed in the Working Regulations of the Government Inspectorate.

7. Being responsible for managing and using the Bureau's seal; managing officials and civil servants and assets allocated according to the law and the Chief Inspector's delegation; maintaining work discipline, managing, evaluating, and implementing commendation and reward systems, policies for officials and civil servants of the Bureau; developing and implementing cadre planning, training, and capacity-building plans for officials, civil servants, and employees in the Bureau.

8. Implementing information and reporting systems as prescribed by the Government Inspectorate. Promptly reporting to the Government Inspectorate leadership on the results of work tasks and proposing issues requiring resolution, mechanisms, programs, and plans that need revision and supplementation to meet the requirements of the Government Inspectorate.

9. Performing other tasks assigned by the Chief Inspector.

Article 6. Responsibilities and scope of work for Deputy Directors

1. Assist the Director in managing and directing the operations of the Bureau; directly manage and oversee certain localities and fields of work as assigned by the Director. When necessary, a Deputy Director may be authorized by the Director to direct the activities of the Bureau.

2. Perform duties and exercise powers within the scope assigned and delegated by the Director. Implement reporting procedures to the Director on the situation and results of assigned tasks.

3. Assist the Director in monitoring, urging, and inspecting the activities of inspection and complaint resolution teams when assigned by the Director. Serve as the Head of Inspection Team when appointed by the Chief Inspector General.

4. Bear personal responsibility before the Director, before the leadership of the Government Inspectorate, and before the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

5. Sign on behalf of the Director for documents assigned and delegated by the Director.

Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department

1. The Department Head is responsible for leading, directing, managing, and operating the Department and bears responsibility before the Director and the law for all activities of the Department and the completion of assigned tasks.

2. The Deputy Department Head assists the Department Head and bears responsibility before the Department Head, Bureau leadership, and the law for the field of work assigned; performs other tasks directly assigned by Bureau leadership. When necessary, they may be authorized by the Department Head to direct the activities of the Department.

3. Specific duties and powers of the Department Heads under Bureau II shall be stipulated by the Director.

Article 8. Responsibilities and scope of work for civil servants under Bureau II

1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.

2. Proactively study and advise on the specialized field assigned; complete assigned tasks according to prescribed procedures, formalities, and deadlines. Timely report to the immediate supervisor when encountering difficulties or new issues during task execution.

3. Adhere to speaking discipline, Code of Conduct for Inspectors, Work Regulations, Office Culture Rules of the Government Inspectorate, and other regulations concerning civil servants; implement reporting systems and file management procedures as stipulated by the Government Inspectorate. Bear personal responsibility before the Department Head, the Director, and the law regarding proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

4. Civil servants assigned to lead inspection and verification teams bear responsibility for directing, monitoring, urging, and inspecting the activities of team members; report to the Director on the progress and results of inspections; regularly inform the Department Head about the management of inspectors participating in inspection teams.

Chapter III.
WORK RELATIONSHIPS

Article 9. Implementing the directives of the Government Inspectorate's leadership

The Bureau is subject to leadership and direction from the Chief Inspector General and Deputy Chief Inspector Generals; has the responsibility to strictly fulfill assigned tasks, promptly report to the Government Inspectorate leadership on the results of task implementation as prescribed; when necessary, propose solutions to the Government Inspectorate leadership regarding issues that need resolution during task implementation.

Article 10. Relations with units under the Government Inspectorate

1. The relations between the Second Bureau and other Bureaus, Departments, and units under the Government Inspectorate are cooperative, exchange, and mutual support to fulfill tasks.

2. Cooperation with other Departments, Bureaus, and other units during the performance of tasks shall be carried out in accordance with the Working Regulations of the Government Inspectorate issued by the Chief Inspector.

Article 11. Relations with provincial inspectors in Region 2

1. Regularly inspect, urge, guide, and grasp the implementation of work programs of provincial inspectors directly under the central government in Region 2; periodically every quarter, actively work with inspection agencies within their jurisdiction to fully understand general activities and specific inspection, complaint resolution activities; in case of emergencies, specific documents must be issued to request meetings.

2. Timely report and reflect to the Chief Inspector or Deputy Chief Inspector in charge about requests and recommendations from provincial inspectors directly under the central government in Region 2 for the leadership of the Government Inspectorate to consider and resolve.

Article 12. Relations between Bureau leadership and Party committees and leadership of mass organizations within the Bureau

1. Bureau leadership creates conditions for the Party organization and mass organizations to operate according to their charters, purposes, and objectives; cooperate with the Party committee and leadership of mass organizations to create conditions for Party members, officials, and civil servants in the Bureau to study and improve political and professional qualifications; ensure democratic regulations in the operation of the agency, build office culture, administrative discipline.

2. Bureau leadership has the responsibility to provide full and timely information on the activities and benefits of officials and civil servants to the Party committee and leadership of mass organizations; seek opinions from the Party committee and leadership of mass organizations before deciding issues related to methods of leading political education, internal protection, strengthening unity, caring for the lives of officials and civil servants in the Bureau; organizational and personnel matters in the Bureau.

Chapter IV.
IMPLEMENTATION

Article 13. Responsibility for Implementation

1. The Director, Deputy Directors, Heads, Deputy Heads of all officials and civil servants of the Second Bureau have the responsibility to implement this Regulation.

2. Other contents related to the functions, duties, powers, and operational activities of the Bureau that are not reflected in this Regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws and regulations on inspections, complaints, and appeals.

3. Based on current regulations and this Regulation, the Director of the Second Bureau is responsible for formulating and issuing the Working Regulations of his unit to perform assigned functions and duties.

Article 14. Amendment and Supplement to the Regulation

During the implementation of this Regulation, if any difficulties arise, the Director of the Second Bureau will coordinate with the Department Head of Organization and Cadres to promptly research and propose solutions to the Chief Inspector for amendments and supplements to ensure that this Regulation meets the requirements of the Second Bureau and the Government Inspectorate's operations./.
