GENERAL INSPECTOR
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Considering the proposal of the Director of the Cadre and Civil Service Department,
DECISION:
Article 1. Issued together with this Decision are the "Regulations on functions, tasks, powers and organization and operation of the Cadre Organization Department".
Article 2. This Decision takes effect from the date of signature and replaces the provisions in Decision No. 1075/QĐ-TTNN dated September 8, 2003 of the State Inspector General regarding regulations on functions, tasks, powers, working systems of Departments, Offices, and affiliated organizations under the State Inspectorate.
Article 3. The Government Inspectorate Office Director, the Organization and Cadres Department Director, and the heads of units under the Government Inspectorate are responsible for implementing this Decision./.
REGULATIONS
FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE CADRE AND CIVIL SERVANT ORGANIZATION DEPARTMENT

Chapter I.
FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES
Article 1. Position and Functions
The Cadre and Civil Servant Organization Department is an entity under the Government Inspectorate, with the function of advising the State Inspector General on state management matters concerning organization and civil servants of the Inspectorate and the inspection sector.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Building institutional frameworks:
a) Drafting for the State Inspector General to issue or for the Government, Prime Minister to issue legal normative documents on cadre and civil servant work of the inspection sector and the Government Inspectorate;
b) Assisting the State Inspector General in drafting and submitting to the Government for issuance of a decree on the functions, tasks, powers, and organizational structure of the Government Inspectorate;
c) Advising the State Inspector General on submitting to the Government, Prime Minister for consideration of policies and benefits for civil servants in the inspection sector;
d) Taking the lead in coordinating with units to draft and submit to the State Inspector General for issuance of regulations on the functions, tasks, powers, and operations of departments and units under the Government Inspectorate;
đ) Coordinating with relevant agencies to assist the State Inspector General in drafting and issuing joint circulars guiding the functions, tasks, powers, and organizational structures of inspection agencies;
e) Drafting and submitting to the State Inspector General for issuance of guidelines on training, capacity building for cadres, and examinations for promotion to higher ranks within the inspection sector;
f) Assisting the State Inspector General in defining models and guidelines for managing and using inspection badges, insignias, and emblems;
g) Assisting the State Inspector General in drafting and submitting to the Ministry of Home Affairs for issuance of standards for inspection ranks;
h) Drafting and submitting to the State Inspector General for issuance of regulations on professional standards for Chief Inspectors of ministries, sectors, and localities;
i) Drafting and submitting to the State Inspector General for issuance of regulations on cadre work and training and capacity building for cadres of the Government Inspectorate.
2. Leading the development of programs, plans, and projects on cadre and civil servant work of the inspection sector and the Government Inspectorate.
3. Coordinating with the Inspection Cadre Training School to develop and implement annual plans for training and capacity building for inspection staff throughout the inspection sector.
4. Assisting the State Inspector General in organizing examinations for promotion to senior inspector, and from senior inspector to high-ranking inspector.
5. Assisting the State Inspector General in reviewing and agreeing with the Ministers, Heads of ministerial-level agencies, Chairmen of provincial People's Committees on the proposed candidates for Chief Inspectors of ministries, sectors, and centrally-administered cities based on proposals from ministries, sectors, and localities.
6. Monitoring the situation and compiling statistics on the quantity and quality of professional skills of the cadre and inspector workforce in the inspection sector to serve the construction and development of the sector.
7. Inspecting and supervising the implementation of legal provisions concerning inspectors according to the level of management authority.
8. Advising the State Inspector General on managing the organization and personnel of the Government Inspectorate:
a) Leading and coordinating with units within the Government Inspectorate to draft and submit to the State Inspector General for issuance and guidance on implementation: Cadre planning, training and capacity building plans for the cadre, civil servant, and employee workforce of the Government Inspectorate;
b) Submitting to the State Inspector General for decision-making within their authority on issues related to appointment, removal, reappointment, rotation, resignation of leading cadres; recruitment, hiring, acceptance, transfer, secondment, assignment, promotion, transfer of rank, salary increase, dispatch for work, study, and training both domestically and internationally, commendation, discipline, termination of employment, retirement of cadres and civil servants;
c) Leading and coordinating with departments and units to assist the State Inspector General in drafting annual staffing plans, submitting to the Ministry of Home Affairs for review and allocation; submitting to the State Inspector General for approval and allocation of staffing for departments and units under the Government Inspectorate and implementing annual staffing and salary plans of the Government Inspectorate;
d) Implementing regulations on evaluation and assessment of cadres, civil servants, and employees; summarizing the results of annual performance evaluations of cadres, civil servants, and employees under the Government Inspectorate according to general regulations of state agencies and regulations of the State Inspector General;
đ) Organizing and coordinating with units under the Government Inspectorate to implement Party and state regulations and regulations of the agency on measures to strengthen discipline, combat corruption, waste, bureaucracy, and negative phenomena among cadres and civil servants of the Government Inspectorate;
e) Inspecting and supervising the implementation of regulations on organization and personnel of affiliated entities under the Government Inspectorate;
f) Coordinating with departments and units related to propose personnel for participation in inspection teams, complaint resolution, and overseas missions;
g) Implementing personnel file management work in accordance with state regulations and regulations of the State Inspector General.
9. Advising on the work of competition and rewards of the Government Inspectorate and the inspection sector.
10. Implementing internal political security protection work as directed by the State Inspector General.
11. Implementing office work of the Party Cadre Committee.
12. Implementing office work of the Party Committee, managing party member files of the Government Inspectorate.
13. Implement political-social mass work activities in accordance with the directives of the Inspector General.
14. Carry out administrative reform tasks, international cooperation, and scientific research as assigned by the Inspector General.
15. Manage cadres, civil servants, and assets allocated to the Department in accordance with the law and the分级授权的总审计长的规定。

Article 3. Principles of Operation
The Cadre and Civil Service Organization Department operates under a chief executive system, ensuring democratic centralism, transparency, and openness in compliance with the law; emphasizing individual responsibility and discipline, leveraging strengths and capabilities, promoting initiative and creativity among cadres and civil servants, and enhancing the effectiveness of the Department's operations.
Chapter II.
ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING
Article 4. Organizational Structure and Staffing
1. The organizational structure of the Cadre and Civil Service Organization Department includes:
a) Department leadership consisting of the Director and Deputy Directors.
b) Four specialized divisions directly subordinate to the Department:
+ Division of Organization and Staffing.
+ Cadre Division.
+ Party, Mass Organizations, and Internal Political Security Division.
+ Awards and Honors Division.
2. The duties and powers of the specialized divisions shall be assigned by the Director.
3. The staffing of the Cadre and Civil Service Organization Department shall be decided by the Inspector General based on the proposal of the Director of the Cadre and Civil Service Organization Department.
Article 5. Responsibilities and Scope of Work of the Director
1. Lead, direct, and organize the implementation of the Department's tasks as stipulated in Article 2 of this Regulation and other tasks assigned by the Government Inspectorate leadership; bear legal responsibility before the Inspector General for the results of the assigned tasks.
2. Delegate tasks, coordinate activities, and monitor the implementation of tasks by Deputy Directors, departments under the Department, and staff members within the Department.
3. Fulfill tasks delegated by the Inspector General; sign on behalf when authorized to issue certain documents within the Inspector General's authority as provided in the Government Inspectorate's Working Regulations.

6. Fully comply with information and reporting systems as prescribed by the Government Inspectorate. Timely report to the Government Inspectorate leadership on the results of work tasks and propose issues requiring resolution, mechanisms, policies, programs, and plans that need revision and supplementation to meet the requirements of the Government Inspectorate and the Government.
7. Perform other tasks assigned by the Inspector General.
Article 6. Responsibilities and Scope of Work for Deputy Directors
1. Assist the Director in managing and directing the Department's operations; directly manage certain areas of work as assigned by the Director.
2. Fulfill duties and powers within the scope assigned and delegated by the Director.
3. Report to the Director on the situation and results of the assigned and delegated tasks.
4. Bear personal responsibility before the Director, Government Inspectorate leadership, and the law for proposals, progress, quality, and effectiveness of tasks, content, form, format, procedures, and processes for issuing documents and handling assigned tasks.
5. Sign on behalf of the Director for documents authorized by the Director.
Article 7. Duties and Authorities of the Department Head and Deputy Department Heads
1. The Department Head manages and directs the work of the department, and is responsible to the Inspector General and Deputy Inspector General in charge for the implementation of assigned tasks.
2. The Deputy Department Head assists the Department Head in managing and directing the work of the department, and is responsible to the Department Head and leadership of the Inspectorate for the implementation of assigned tasks.
3. Specific duties of the Department Head and Deputy Department Head shall be assigned by the Inspector General.
Article 8. Responsibilities and Scope of Work of Professional Staff Members
1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.
2. Proactively study and advise on the specialized field assigned; resolve assigned tasks according to prescribed procedures, formalities, and deadlines. Report promptly to the direct supervisor when encountering difficulties or new issues arising during task execution.
3. Adhere to speaking discipline, Code of Conduct for Inspectors and Civil Servants, Working Regulations, Government Inspectorate Office Workplace Culture Regulations, and other regulations concerning civil servants; implement reporting systems and file management systems as prescribed. Bear personal responsibility for proposed opinions, progress, quality, effectiveness of task execution, content, form, format, procedure, and formalities of issued documents, and the process of resolving assigned tasks.
Chapter III.
WORK RELATIONSHIP OF THE BUREAU
Article 9. Implementing the directives of the Government Inspectorate's leadership
The Department is under the leadership and direction of the Chief Inspector, Deputy Chief Inspectors; it must strictly fulfill assigned tasks, report promptly to the Inspectorate leadership on the results of task execution as prescribed; when necessary, propose recommendations to the Inspectorate leadership regarding issues that need resolution during task execution.
Article 10. Relations with departments, bureaus, and units under the Government Inspectorate
1. The relationship between the Organization and Cadres Department and other departments, bureaus, units under the Inspectorate is one of coordination, exchange, and mutual support to effectively complete tasks.
2. Coordination with other departments, bureaus, units in task execution is carried out in accordance with the Working Regulations of the Government Inspectorate.
Article 11. Relationship with Sectoral, Ministry, and Local Inspectors
1. Regularly inspect, urge, guide, and monitor the organizational and cadre situation of inspectorates at ministries, sectors, and localities; quarterly, actively meet with inspectorates at ministries, sectors, and localities to fully understand their operational activities and organizational cadre work.
2. Promptly reflect requirements and proposals from inspectorates at ministries, sectors, and localities regarding organizational cadre work to the Chief Inspector or Deputy Chief Inspector in charge for leadership consideration and resolution.
Article 12. Work Relations Between Department Leadership and Party Committees and Mass Organizations' Leadership
1. Department leadership creates conditions for the Party organization and mass organizations to operate in accordance with their charters, purposes, and objectives; coordinate with the Party committee and mass organizations' leadership to create conditions for cadres and civil servants in the department to enhance political and professional qualifications, achieve high-quality work performance; ensure democratic regulations in the operation of the agency, build workplace culture and administrative discipline.
2. Department leadership has the responsibility to provide timely and comprehensive information about the department's operations and the rights of cadres and civil servants to the Party committee and mass organizations' leadership; seek their opinions before deciding on measures for political ideological education, internal protection, consolidation of unity, and care for the living standards of cadres and civil servants in the department; regarding organizational cadre work in the department.
Chapter IV.
IMPLEMENTATION
Article 13. Responsibility for Implementation
1. The Department Head, Deputy Department Heads, Department Section Chiefs, Deputy Section Chiefs, and all cadres and civil servants of the Organization and Cadres Department have the responsibility to implement this Regulation.
2. Matters related to the functions, duties, authorities, and organization of the Department not covered in this Regulation shall be implemented in accordance with the Working Regulations of the Government Inspectorate and current laws and regulations.
3. Based on current regulations and this Regulation, the Department Head of the Organization and Cadres Department is responsible for drafting and promulgating the Working Regulations of the unit to fulfill assigned functions and duties.
Article 14. Amendment and Supplement to the Regulation
The Department Head of the Organization and Cadres Department is responsible for monitoring, inspecting, urging the implementation of this Regulation; compiling and researching suggestions for timely supplementation and amendment of the Regulation, in line with the work requirements of the Organization and Cadres Department and the Government Inspectorate.
