Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;
Considering the proposal of the Head of Department I and the Head of the Department of Organization and Cadres;
DECISION:
Article 1. The attached Decision promulgates "Regulations on the functions, tasks, powers, and organization and operation of the Department for Economic Sector Inspection."
Article 2. This Decision takes effect from the date of signature and replaces the provisions in Decision No. 1075/QĐ-TTCP dated September 8, 2003 of the State Inspector General promulgating the Regulations on the functions, tasks, powers, working systems of Departments, Office, and affiliated organizations under the State Inspectorate.
Article 3. The Heads of the Office, the Head of the Department of Organization and Cadres, the Head of Department I, and the Heads of units under the Government Inspectorate shall be responsible for implementing this Decision./.

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE DEPARTMENT FOR ECONOMIC SECTOR INSPECTION (DEPARTMENT I)

Chapter I.
FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES
Article 1. Position and Functions
The Department for Economic Sector Inspection (referred to as Department I) is an entity under the Government Inspectorate, having the function of advising the State Inspector General on state management of inspection work, handling complaints and grievances concerning the Ministries and sectors: Information and Communications, Industry and Trade, Transport, Construction, Agriculture and Rural Development, Natural Resources and Environment; it is responsible for performing inspection, complaint, and grievance resolution tasks within its jurisdiction.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1- Implementing state management functions.
a) Taking the lead or participating in drafting strategies, programs, plans for long-term, five-year, annual periods, and other programs and plans regarding inspections, complaint and grievance resolution, and anti-corruption measures of the Government Inspectorate;
b) Assisting the State Inspector General in guiding and supervising the Ministries and sectors in the economic sector to implement legal regulations on inspections, complaint and grievance resolution; strategies, programs, and plans for inspections, complaint and grievance resolution of the inspection sector;
c) Assisting the State Inspector General in guiding the Ministries and sectors in the economic sector to develop and implement inspection programs and plans; directing and guiding professional inspection and complaint and grievance resolution work for inspection organizations assigned by the State Inspector General;
d) Assisting the State Inspector General in requesting Ministers, Heads of ministerial-level agencies, and Heads of government agencies in the economic sector to conduct inspections or re-inspections of matters within their responsibility; resolving issues not agreed upon between the Heads of inspection agencies and their counterparts at the same level regarding inspection work;
đ) Assisting the State Inspector General in resolving overlaps and conflicts in time and content of inspections and audits conducted by inspection teams decided by Ministers, Heads of ministerial-level agencies, and Heads of government agencies;
e) Advising the State Inspector General to recommend that the Minister suspend or revoke regulations issued by the Ministry that contravene national laws, decrees, and regulations on inspection work, complaint and grievance resolution;
f) Cooperating with inspection agencies in the economic sector to monitor the situation of inspections, complaint and grievance resolution, and promptly proposing solutions to the State Inspector General when there are signs of complex issues arising;
g) Cooperating with the Legal Affairs Department to provide opinions on draft laws initiated by the Government Inspectorate or other ministries and sectors;
h) Summarizing practical experience; participating in theoretical and professional research on inspections, complaint and grievance resolution, prevention, and combating corruption; proposing amendments and supplements to mechanisms, policies, and laws.
2- Directly conducting inspections and resolving complaints and grievances.
a) Implementing inspection plans; directly inspecting the implementation of policies, laws, duties, and responsibilities of management of ministries, ministerial-level agencies, government agencies, and other entities when assigned;
b) Assisting the State Inspector General in handling complaints and grievances within the authority of the State Inspector General or the Prime Minister in the fields and sectors assigned; coordinating with Division I to receive citizens who come to the Government Inspectorate to file complaints and grievances for cases assigned to Department I;
c) Assisting the State Inspector General in organizing, monitoring, and inspecting the activities of inspection teams and complaint and grievance resolution teams led by the Department or by staff members of the Department; compiling results and preparing comprehensive reports on wide-scale inspections assigned;
d) Monitoring, inspecting, and urging the implementation of conclusions and recommendations for handling, decisions on resolving complaints and grievances through the activities of inspection teams and complaint and grievance resolution teams led by the Department and cases assigned by the State Inspector General.
3. Performing administrative reform, international cooperation, and scientific research tasks as assigned by the State Inspector General.
4. Managing cadres and civil servants and assets allocated according to the law and the delegation of the State Inspector General.
5. Performing other tasks assigned by the State Inspector General.
Article 3. Principles of Operation
1. Department I operates under a chief executive system, ensuring democratic centralism, transparency, and openness in accordance with the law; emphasizing individual responsibility and discipline, promoting the capabilities, strengths, initiative, and creativity of cadres and civil servants, and enhancing the effectiveness of the Department's operations.
2. Cadres and civil servants of the Department must also comply with the "Regulations on the Organization and Operation of Inspection Teams" issued by the State Inspector General when participating in inspection teams and complaint and grievance resolution teams.
Chapter II.
ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING
Article 4. Organizational Structure and Staffing
1. The organizational structure of Department I includes:
a) Leadership of the Department consists of the Director and Deputy Directors.
b) Departments under the Department:
+ Room for Monitoring the Transport, Construction, Industry and Trade, and Information and Communications Sectors (referred to as Room I).
+ Room for Monitoring the Agriculture and Rural Development, Natural Resources and Environment Sectors (referred to as Room II).
+ Comprehensive Room.
2. The tasks and powers of the rooms are defined by the Director.
3. The staffing of Department I shall be determined by the Chief Inspector based on the proposal of the Department Heads of the Cadre and Civil Servant Organization Department and Department I.
Article 5. Responsibilities and Scope of Work of the Director
1. Lead, direct, and organize the implementation of the tasks of the Department as stipulated in Article 2 of this Regulation and other tasks assigned by the Government Inspectorate leadership; bear legal responsibility before the law and before the Chief Inspector for the results of the assigned work.
2. Delegate tasks, coordinate activities, and monitor the implementation of tasks by Deputy Directors, departments under the Department, and staff members within the Department.
3. Direct the drafting of inspection outlines, plans, complaints, and denunciation resolution when assigned; personally serve as the Head of Inspection Team for large-scale inspections with complex contents upon assignment by the Chief Inspector; propose the allocation of cadres to participate in inspection teams and complaint and denunciation resolution teams assigned to implement, after consulting with the Department Head of the Cadre and Civil Servant Organization Department.
4. Assist the Chief Inspector in monitoring, urging, and inspecting the activities of inspection teams and complaint and denunciation resolution teams assigned to implement, ensuring compliance with approved inspection schedules and progress; participate in providing opinions during the process of compiling reports and inspection conclusions, complaint and denunciation resolutions for inspection teams chaired by the Department or led by cadres from the Department before submitting to the Chief Inspector.
5. Coordinate with the Department Heads, Bureau Chiefs, and heads of other units under the Government Inspectorate to handle issues related to the functions and tasks of the Department and to perform common tasks of the agency as prescribed in the Working Regulations of the Government Inspectorate.
6. Manage civil servants and assets allocated according to the law and the classification of the Chief Inspector; maintain work discipline, manage, evaluate, and carry out commendation and reward systems, policies, and benefits for civil servants of the Department; develop and implement cadre planning, training, and development plans for civil servants of the Department.
7. Perform tasks delegated by the Chief Inspector to resolve; sign on behalf when authorized by the Chief Inspector to sign certain documents within his authority according to the Working Regulations of the Government Inspectorate.
8. Fully comply with information and reporting systems as prescribed by the Government Inspectorate. Timely report to the leadership of the Government Inspectorate on the results of assigned tasks and propose solutions to issues that need to be resolved, mechanisms, policies, programs, and work plans that require modification and supplementation to meet the requirements of the Government Inspectorate and the Government.
9. Perform other tasks assigned by the Chief Inspector.
Article 6. Responsibilities and Scope of Work of Deputy Directors
1. Assist the Department Head in managing and directing the operations of the Department; directly manage certain areas of work according to the division of labor by the Department Head. When necessary, a Deputy Department Head may be authorized by the Department Head to oversee the activities of the Department.
2. Carry out duties and powers within the scope assigned and delegated by the Department Head. Report to the Department Head on the situation and results of assigned and delegated tasks.
3. Assist the Department Head in monitoring, urging, and inspecting the activities of inspection teams and complaint and denunciation resolution teams assigned to implement, when tasked by the Department Head. Personally serve as the Head of Inspection Team when assigned by the Chief Inspector.
4. Bear personal responsibility before the Department Head, the leadership of the Government Inspectorate, and the law for proposals, progress, quality, and effectiveness of implemented tasks, content, form, format, procedure, and process of issuing documents and handling assigned tasks.
5. Sign on behalf of the Department Head for documents authorized by the Department Head.
Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department
1. The Head of the Division is responsible for leading, directing, managing, and overseeing the activities of the Division and bears responsibility before the Department Head and the law for all activities of the Division and the completion of assigned tasks.
2. The Deputy Head of the Division assists the Head of the Division and bears responsibility before the Head of the Division, the Department Leadership, and the law for the area of work assigned; performs other tasks directly assigned by the Department Leadership. When necessary, may be authorized by the Head of the Division to oversee the activities of the Division.
3. Specific duties and powers of the Head of the Division and Deputy Head of the Division under the Department are defined by the Department Head.
Article 8. Responsibilities and scope of work for officials and civil servants under the Bureau
1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.
2. Proactively study and advise on the specialized field assigned; resolve assigned tasks according to prescribed procedures, formalities, and deadlines. Promptly report to the direct supervisor when encountering difficulties or new issues arising during task execution.
3. Adhere to speaking discipline, Code of Conduct for Inspectors and Civil Servants, Work Rules, Office Culture Regulations of the Government Inspectorate, and other regulations concerning civil servants; implement reporting systems and file management systems as prescribed by the Government Inspectorate. Bear personal responsibility before the Head of the Division, the Department Head, and the law for proposals, progress, quality, and effectiveness of implemented tasks, content, form, format, procedure, and process of issuing documents and handling assigned tasks.
4. Civil servants assigned to lead inspection and verification teams have the responsibility to direct, monitor, urge, and inspect the activities of team members; report to the Department Head on the progress and results of inspections and verifications; regularly inform the Head of the Division about the management of civil servants participating in inspection and verification teams.
Chapter III.
WORK RELATIONSHIP OF THE BUREAU
Article 9. Implementing the directives of the Government Inspectorate's leadership
The Department is subject to the leadership and direction of the Chief Inspector and Deputy Chief Inspectors; strictly fulfill assigned tasks, promptly report to the leadership of the Government Inspectorate on the results of task implementation as prescribed; when necessary, propose solutions to issues that need to be resolved during task execution to the leadership of the Government Inspectorate.
Article 10. Relations with departments, bureaus, and units under the Government Inspectorate
1. Relations between Department I and bureaus, units under the Government Inspectorate are cooperative, exchange, and support each other to effectively complete tasks.
2. Coordination with bureaus, units in task implementation is carried out according to the Working Regulations of the Government Inspectorate issued by the Chief Inspector.
Article 11. Relations with the Inspectorate of Ministries and Agencies
1. Regularly inspect, urge, guide, and grasp the situation of implementing the work program of the Inspectorate of Ministries and Agencies under their responsibility; must proactively meet with the Inspectorates of ministries and agencies quarterly to fully understand the general situation and specific inspection activities.
2. Timely reflect to the Chief Inspector or Deputy Chief Inspector in charge the requirements and recommendations of the Inspectorate of Ministries and Agencies for the leadership of the Government Inspectorate to consider and resolve.
Article 12. Relations between the leadership of the Department and the Party Committee and the leadership of mass organizations
1. The Department leadership creates conditions for the Party organization and mass organizations to operate in accordance with the Charter, aims, and purposes; coordinates with the Party Committee and the leadership of mass organizations to create conditions for Party members, officials, and civil servants in the Department to study and improve their political and professional qualifications, work effectively and efficiently; ensure democratic regulations in the operation of the agency, build a culture of office, and administrative discipline.
2. The Department leadership has the responsibility to provide full and timely information about the activities and rights of officials and civil servants to the Party Committee and the leadership of mass organizations; consult the opinions of the Party Committee and the leadership of mass organizations before deciding on issues related to measures for coordinating leadership in political education, internal protection, strengthening solidarity, caring for the lives of officials and civil servants in the Department; and organizational matters.
Chapter IV.
IMPLEMENTATION
Article 13. Responsibility for Implementation
1. The Director, Deputy Directors, Heads, Deputy Heads of Room I, and all officials and civil servants of Room I are responsible for implementing this Regulation.
2. Other contents related to the functions, tasks, powers, and organization of the Department that are not covered in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws on inspection, complaints, denunciations, and anti-corruption.
3. Based on current regulations and this Regulation, the Director of Room I is responsible for drafting and promulgating the Working Regulations of his unit.
Article 14. Amendment and Supplement to the Regulation
The Directors of Room I and the Personnel Organization Room have the responsibility to monitor, inspect, and urge the implementation of this Regulation; compile and promptly study suggestions for supplementing and amending the Regulation in accordance with the requirements of Room I and the Government Inspectorate./.
