Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Considering the proposal of the Head of Department II and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. This Decision promulgates the "Regulations on the functions, tasks, powers, organization, and operations of the Internal Affairs and Comprehensive Economic Inspection Department" attached hereto.

Article 2. This Decision takes effect from the date of signing and replaces the provisions in Decision No. 1075/QĐ-TTCP dated September 8, 2003 of the State Inspector General regarding regulations on functions, tasks, powers, and working systems of Departments, Office, and affiliated organizations under the State Inspectorate.

Article 3. The Director of the Office, the Heads of the Department of Organization and Cadres, Department II, and the Heads of units under the Government Inspectorate are responsible for implementing this Decision./.

REGULATIONS

FUNCTIONS, TASKS, POWERS AND ORGANIZATION AND OPERATIONS OF THE INTERNAL AFFAIRS AND COMPREHENSIVE ECONOMIC INSPECTION DEPARTMENT (DEPARTMENT II)
(Issued together with Decision No. 1591/2008/QĐ-TTCP dated August 6, 2008 of the State Inspector General)

Chapter I.

FUNCTIONS, TASKS, AUTHORITIES, AND WORKING PRINCIPLES

Article 1. Position and Functions

The Internal Affairs and Comprehensive Economic Inspection Department (referred to as Department II) is a unit under the Government Inspectorate, having the function of advising the State Inspector General on state management of inspection work, handling complaints and denunciations concerning the Ministries and sectors: Finance, Planning and Investment, State Bank of Vietnam, Public Security, Defense, Justice, Home Affairs, and the Office of the Government; responsible for performing inspection and complaint resolution tasks within its jurisdiction.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Implement state management functions.

a) Take the lead or participate in drafting long-term strategies, five-year programs, annual plans, and other programs and plans related to inspection, complaint resolution, and anti-corruption activities of the Government Inspectorate;

b) Assist the State Inspector General in guiding and supervising the internal affairs and comprehensive economic sectors' ministries and agencies in implementing legal documents on inspection, complaint resolution; strategies, programs, and plans on inspection and complaint resolution of the inspection sector;

c) Assist the State Inspector General in guiding the internal affairs and comprehensive economic sectors' ministries and agencies in formulating and organizing the implementation of inspection programs and plans; direct and guide specialized and professional inspection and complaint resolution work for organizations assigned by the State Inspector General;

d) Assist the State Inspector General in requesting Ministers, Heads of ministerial-level agencies, and Heads of government agencies in the internal affairs and comprehensive economic sectors to conduct inspections or re-inspections of matters within their responsibility; resolve issues not agreed upon between the Heads of inspection agencies and the Heads of the same level regarding inspection work;

đ) Assist the State Inspector General in resolving overlaps and conflicts in time and content of inspections and audits conducted by inspection teams decided by Ministers, Heads of ministerial-level agencies, and Heads of government agencies;

e) Advise the State Inspector General to recommend that the Minister suspend or revoke regulations issued by the Ministry that contradict national laws, State Inspector General's regulations on inspection, complaint resolution;

f) Coordinate with inspection agencies in the internal affairs and comprehensive economic sectors to monitor the situation of inspections and complaint resolutions and promptly propose solutions to the State Inspector General when there are signs of complex issues arising;

g) Coordinate with the Legal Affairs Department to provide opinions on draft laws initiated by the Government Inspectorate or other ministries and sectors;

h) Summarize practical experience; participate in theoretical and professional research on inspection, complaint resolution, prevention, and anti-corruption efforts; propose amendments and supplements to mechanisms, policies, and laws;

2. Directly conduct inspections and resolve complaints and denunciations.

a) Organize the implementation of inspection plans; directly inspect the implementation of policies, laws, duties, powers, and management responsibilities of ministries, ministerial-level agencies, government agencies, and other units when assigned;

b) Assist the State Inspector General in handling complaints and denunciations within the authority of the State Inspector General or the Prime Minister in the assigned fields and sectors; coordinate with Department I to receive citizens who come to the Government Inspectorate to complain or denounce matters assigned to Department II;

c) Assist the State Inspector General in organizing, monitoring, and inspecting the operations of inspection and complaint resolution teams led by the Department or by Department staff serving as team leaders; compile results and prepare summary reports on wide-scale inspections assigned;

d) Monitor, inspect, and urge the implementation of conclusions and recommendations for handling, decisions on resolving complaints and denunciations through the activities of inspection and complaint resolution teams led by the Department and matters assigned by the State Inspector General;

3. Perform administrative reform, international cooperation, and scientific research tasks as assigned by the State Inspector General.

4. Manage civil servants and assets allocated according to the law and the delegation of the State Inspector General.

5. Perform other tasks assigned by the State Inspector General.

Article 3. Principles of Operation

1. Department II operates under the head system, ensuring democratic centralism, transparency, and openness in accordance with the law; emphasizing individual responsibility and discipline, promoting the capabilities, strengths, initiative, creativity of civil servants in their work, and efficiency in the Department's activities.

2. Civil servants of the Department must also comply with the "Regulations on the Organization and Operation of Inspection Teams" issued by the State Inspector General when participating in inspection and complaint resolution teams.

Chapter II.

ORGANIZATIONAL STRUCTURE, RESPONSIBILITIES, AND SCOPE OF WORK HANDLING

Article 4. Organizational Structure and Staffing

1. The organizational structure of Department II includes:

a) Department leadership consists of the Department Head and Deputy Department Heads.

b) Departments under the Department:

+ Financial-Banking Supervision Division (referred to as Division I).

+ Internal Affairs, Government Office, Planning and Investment Supervision Division (referred to as Division II).

+ Consolidation Division.

2. Specific tasks and authorities of each department shall be defined by the Director.

3. The staffing of Department II is determined by the State Inspector General based on the proposals of the Department Head of the Cadre and Civil Servant Organization Department and the Department Head of Department II.

Article 5. Responsibilities and Scope of Work of the Director

1. Lead, direct, and organize the implementation of the tasks of the Department as stipulated in Article 2 of this Regulation and other tasks assigned by the leadership of the Government Inspectorate; bear responsibility under the law and to the Chief Inspector for the results of the assigned work.

2. Delegate tasks, coordinate activities, and monitor the implementation of tasks by Deputy Directors, departments under the Department, and staff members within the Department.

3. Direct the development of inspection outlines, plans, complaint and accusation resolution when assigned; personally serve as the Head of Inspection Team for large-scale inspections with complex contents when assigned by the Chief Inspector; propose the allocation of cadres to participate in inspection teams and complaint and accusation resolution teams that are assigned to implement, after discussing with the Director of the Organization and Cadres Department.

Coordinate with the Department Directors, Bureau Chiefs, and heads of other units under the Government Inspectorate to handle issues related to the tasks within the Department's functions and to perform common tasks of the agency as prescribed in the Working Regulations of the Government Inspectorate.

9. Perform other tasks assigned by the Chief Inspector.

Article 6. Responsibilities and Scope of Work of Deputy Directors

1. Assist the Department Director in managing and directing the Department's operations; directly manage certain areas of work according to the division of labor by the Department Director. When necessary, a Deputy Department Director may be authorized by the Department Director to oversee the Department's activities.

2. Carry out duties and powers within the scope assigned and delegated by the Department Director; report to the Department Director on the situation and results of the assigned and delegated tasks.

3. Assist the Department Director in monitoring, urging, and inspecting the activities of inspection teams and complaint and accusation resolution teams that the Department is assigned to implement, when assigned by the Department Director; personally serve as the Head of Inspection Team when assigned by the Chief Inspector.

4. Bear personal responsibility before the Department Director, the Government Inspectorate's leadership, and the law for proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

5. Sign on behalf of the Department Director for documents authorized by the Department Director.

Article 7. Responsibilities and scope of work for the Head of Department and Deputy Head of Department

1. The Room Director is directly responsible for leading, directing, managing, and overseeing the Room's activities and bears responsibility before the Department Director and the law for all Room activities and the implementation of assigned tasks.

2. The Deputy Room Director assists the Room Director and bears responsibility before the Room Director, the Department's leadership, and the law for the area of work assigned; performs other tasks directly assigned by the Department's leadership. When necessary, they may be authorized by the Room Director to oversee the Room's activities.

3. Specific duties and powers of the Room Director and Deputy Room Director are prescribed by the Department Director.

Article 8. Responsibilities and scope of work for officials and civil servants under the Bureau

1. Adhere to labor discipline, regulations of the Government Inspectorate, and the Bureau.

2. Proactively study and advise on the specialized field assigned; resolve assigned tasks according to the prescribed procedures, formalities, and deadlines. Report promptly to the immediate supervisor when encountering difficulties or new issues arising during task execution.

3. Adhere to speaking discipline, Code of Conduct for Inspectors, Work Rules, Office Culture Regulations of the Government Inspectorate, and other regulations concerning cadres and civil servants; implement reporting systems and file management systems as prescribed by the Government Inspectorate. Bear personal responsibility before the Room Director, the Department Director, and the law for proposals, progress, quality, and effectiveness of task implementation, content, form, format, procedure, and process of issuing documents and handling assigned tasks.

4. Cadres and civil servants assigned to lead inspection and verification teams have the responsibility to direct, monitor, urge, and inspect the activities of team members; report to the Department Director on the progress and results of inspections and verifications; regularly inform the Room Director about the management of cadres and civil servants participating in inspection and verification teams.

Chapter III.

WORK RELATIONSHIP OF THE BUREAU

Article 9. Implementing the directives of the Government Inspectorate's leadership

The Department is subject to the leadership and direction of the Chief Inspector, Deputy Chief Inspectors; it is responsible for strictly performing assigned tasks, promptly reporting to the Government Inspectorate's leadership on the results of task implementation as prescribed; when necessary, it may make recommendations to the Government Inspectorate's leadership regarding issues needing resolution during task implementation.

Article 10. Relations with departments, bureaus, and units under the Government Inspectorate

1. The relationship between Department II and other departments, bureaus, and units under the Government Inspectorate is one of coordination, exchange, and mutual support to effectively complete tasks.

2. Coordination with other departments, bureaus, and units in task implementation is carried out according to the Working Regulations of the Government Inspectorate issued by the Chief Inspector.

Article 11. Relations with the Inspectorate of Ministries and Agencies

1. Regularly inspect, urge, guide, and grasp the implementation situation of the work program of the Inspectorate of the Ministry or Agency under their responsibility; must proactively meet with the Inspectorates of ministries and agencies quarterly to fully understand the general operation and inspection activities.

2. Timely reflect to the Chief Inspector or Deputy Chief Inspector in charge the requirements and recommendations of the Inspectorate of the Ministry or Agency for the leadership of the Government Inspectorate to consider and resolve.

Article 12. Work relations between the leadership of the Department and the Party Committee and the leadership of mass organizations

1. The Department leadership creates conditions for the Party organization and mass organizations to operate in accordance with the Charter, objectives, and purposes; cooperate with the Party Committee and the leadership of mass organizations to create conditions for Party members, officials, and civil servants in the Department to study and improve political and professional qualifications, work effectively and at high quality; ensure democratic regulations in the operation of the agency, build office culture and administrative discipline.

2. The Department leadership has the responsibility to provide full and timely information about the work activities of the Department and the rights of officials and civil servants to the Party Committee and the leadership of mass organizations; seek opinions from the Party Committee and the leadership of mass organizations before deciding on issues related to measures for leading political education, internal protection, strengthening unity, caring for the life of officials and civil servants in the Department; organizational and personnel matters in the Department.

Chapter IV.

IMPLEMENTATION

Article 13. Responsibility for Implementation

1. The Director, Deputy Directors, Heads, Deputy Heads of all officials and civil servants of Department II have the responsibility to implement this Regulation.

2. Other contents related to the functions, tasks, powers, and organization of the Department that are not reflected in this Regulation shall be implemented according to the Working Regulations of the Government Inspectorate, the Inspection Team Regulations, and current laws and regulations on inspection, complaints, denunciations, and anti-corruption.

3. Based on current regulations and this Regulation, the Director of Department II has the responsibility to establish and promulgate the Working Regulations of his unit.

Article 14. Amendment and Supplement to the Regulation

The Director of Department II and the Director of the Organization and Cadre Department are responsible for monitoring, inspecting, urging the implementation of this Regulation; compiling comments, researching and promptly proposing supplements and amendments to the Regulation in line with the work requirements of Department II and the Government Inspectorate./.
