Directive No. 16/2004/CT-BCN on Promoting Activities to Encourage the Development of Rural Industry

DIRECTIVE

On Promoting Activities to Encourage the Development of Rural Industry.

In order to create a legal framework for unified guidance and encouragement, creating favorable conditions for the accelerated development of rural industry (also referred to as promoting industry activities), on June 9, 2004, the Government issued Decree No. 134/2004/NĐ-CP on encouraging the development of rural industry. This is a particularly important legal document for the industrialization cause in general and the development of rural industry in particular. To expedite the implementation of the main contents of the Decree and contribute to successfully implementing the Resolution of the Ninth National Party Congress, the Ministry of Industry requests the People's Committees of provinces and centrally governed cities (hereinafter referred to as provinces), Departments of Industry, Bureaus, Institutes, Corporations, and enterprises in the industry sector to implement the following matters well:

1. Organize research, study, and implement Decree No. 134/2004/NĐ-CP of the Government, creating favorable conditions to mobilize all domestic and foreign resources to participate in investment in developing rural industry production, supporting rural industrial production establishments and organizations providing promotion services to accelerate the process of economic structure adjustment and labor structure transformation in rural areas towards industrialization and modernization.

2. The Local Industry Bureau shall take the lead, coordinate with the Ministries' Departments and Provincial Departments of Industry to urgently develop and submit to the Ministry or joint ministries for issuance guiding documents for the implementation of Decree No. 134/2004/NĐ-CP; organize conferences to disseminate and train Provincial Departments of Industry after the issuance of guiding documents for the Decree.

3. The Department of International Cooperation (Ministry of Industry) shall take the lead, coordinate with related agencies within and outside the Ministry to actively seek financial support from international organizations for promoting industry activities.

4. The People's Committees of provinces shall direct the early establishment or consolidation and improvement of Promotion Centers as stipulated in Circular Joint No. 02/2003/TTLT-BCN-BNV dated October 29, 2003 of the Ministry of Industry - Ministry of Home Affairs guiding the functions, tasks, and organizational structure of specialized agencies assisting the People's Committee in managing industry at the local level to assist the Provincial Departments of Industry in implementing promoting industry activities according to Decree No. 134/2004/NĐ-CP.

5. In the short term, while there is no national promoting industry fund to support promoting industry activities of provinces according to approved programs, plans, and projects as provided in point b) Clause 2 Article 8 of Decree No. 134/2004/NĐ-CP, the People's Committees of provinces need to proactively balance and allocate a portion of the provincial budget combined with mobilizing sponsorships and contributions from organizations and individuals both domestically and internationally and other lawful sources to implement promoting industry activities organized and implemented by the locality.

6. While awaiting the issuance of Circular Joint guiding procedures for the establishment, management, and use of the national promoting industry fund and the local promoting industry fund to be uniformly applied nationwide, to ensure the normal implementation of promoting industry activities (especially in places that have been and are implementing these activities), the People's Committees of provinces need to direct relevant agencies to proactively coordinate to review, supplement, and perfect existing regulations on the management and use of the local promoting industry fund in accordance with the spirit of Decree No. 134/2004/NĐ-CP, Decree No. 60/2003/NĐ-CP dated June 6, 2003 detailing and guiding the implementation of the Law on State Budget and other related regulatory legal documents.

7. Encourage all organizations and individuals, especially those in rural industrial production establishments belonging to industries specified in Article 6 of Decree No. 134/2004/NĐ-CP and consistent with specific requirements for socio-economic development at the local level.

8. Encourage all organizations and individuals, especially scientific research-industrial organizations, training institutions (Institutes, schools, centers), and enterprises organizing promoting industry services to implement the contents of promoting industry activities as stipulated in Article 3 of Decree No. 134/2004/NĐ-CP.

Request the People's Committees of provinces, Departments of Industry, Institutes, Training Schools under the Ministry, Corporations, and enterprises to organize research and implement this Directive./.
