Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain provisions of Decree No. 54/2003/NĐ-CP;
Considering the proposals of the Rectors of the Science and Technology Management Vocational School and the Director of the Personnel Department,
DECISION:
Article 1. This Decision promulgates the Charter on Organization and Operation of the Science and Technology Management Vocational School.
Article 2. This Decision shall take effect 15 days from the date of publication in the Official Gazette and shall replace Decision No. 1283/TCCBKH dated July 4, 1996 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on Organization and Operation of the Science and Technology and Environmental Management Training School (now the Science and Technology Management Vocational School).
Article 3. The Heads of the Office, the Director of the Personnel Department, the Rector of the Science and Technology Management Vocational School, and the Heads of related units are responsible for implementing this Decision./.
CHARTER
Organization and Operation of the Science and Technology Management Vocational School

PART I
GENERAL PROVISIONS
Article 1The Science and Technology Management Vocational School (referred to as the School) is a unit under the Ministry of Science and Technology, with the function of assisting the Minister in conducting training and capacity building activities in science and technology management for officials, civil servants, and employees in the fields managed by the Ministry.
The English name is: MOST Management Training Institute (referred to as MTI).
Article 2.The School is a public service entity with revenue, having legal personality, using its own seal, and opening accounts at the State Treasury and banks.
PART II
TASKS AND POWERS
Article 3.The Science and Technology Management Vocational School has the following main tasks and powers:
1. Organizing and implementing training and capacity building activities in science and technology management and issuing certificates for civil servants and employees according to its functions, according to the classification and plans assigned.
2. Conducting scientific research to serve training work and consulting on science and technology management.
3. Organizing the compilation of textbooks, vocational materials, and reference materials to serve training and capacity building for officials, civil servants, and employees according to its functions.
4. Organizing conferences and seminars to serve training and capacity building for officials, civil servants, and employees according to its functions.
5. Signing and implementing consultancy, service, and teaching contracts on vocational management of science and technology.
6. Cooperating in postgraduate education in accordance with current laws.
7. Participating in recruitment and promotion activities for officials, civil servants, and employees according to the assignment of the Minister.
8. Participating in international cooperation activities in the fields assigned.
9. Managing the organization, personnel, files, financial resources, and assets of the School according to the classification of the Ministry of Science and Technology and current state regulations.
Chapter III
ORGANIZATIONAL STRUCTURE
Article 4.The Science and Technology Management Vocational School operates under the directorate system.
The Rector of the Science and Technology Management Vocational School is responsible to the Minister for all activities of the School and manages its operations according to the Charter on Organization and Operation of the School.
The School has several Deputy Rectors who assist the Rector in leading the School's activities, are assigned by the Rector to be responsible for certain aspects of the School's activities, and are accountable to the Rector for the tasks assigned. They have the authority to decide on matters within their scope of responsibility, but the Rector remains accountable for these decisions.
In the absence of the Rector, a Deputy Rector is authorized to manage and direct the School's activities.
Article 5.The organizational structure of the Science and Technology Management Vocational School includes the following units:
1. Civil Servant and Public Service Department;
2. Business and Development Department;
3. Training and International Cooperation Department;
4. Office;
5. Dosoan Scientific Conference House.
Depending on the requirements of the work, the School may propose to the Minister to establish representative offices to organize training and capacity building activities in southern provinces.
The specific tasks of the subordinate units are defined by the Rector.
The School establishes a Scientific and Training Council to advise the Rector on issues related to the implementation of the School's functions and tasks according to current laws.
Article 6.The human resources of the School include:
1. Staff within the annual quota allocated by the Ministry;
2. Staff from units inside and outside the Ministry working at the School on a part-time basis;
3. Employees signing employment contracts with the School according to the Civil Servants and Civil Servants Law; workers signing labor contracts with the School according to the Labor Law;
4. Staff working at the School as consultants and guest lecturers.
Article 7.The Rector of the Science and Technology Management Vocational School is responsible for managing labor, paying salaries and wages, other income, and implementing social insurance policies for staff within the state quota, staff working under contractual terms, in accordance with current state regulations and those of the Ministry of Science and Technology. Implementing current state policies for part-time staff, consultants, and guest lecturers at the School.
Chapter IV
FINANCIAL MANAGEMENT
Article 8.The School applies the financial management mechanism for public service entities with revenue.
1. Sources of revenue for the School include:
a) Revenue from the State Budget;
b) Revenue from training, capacity building, services, and consulting activities;
c) Sponsorship from organizations and individuals both domestically and internationally.
2. Expenditures of the School include:
a) Expenditure for regular tasks related to training, capacity building, and scientific research;
b) Expenditure for constructing physical facilities for the school;
c) Expenditure for consulting and training activities according to signed contracts;
d) Expenditure for hiring labor.
e) Other expenditures as prescribed.
Article 9.The Rector is responsible for managing and using effectively the allocated financial resources, strictly implementing the current legal regulations on financial management for units with income.
CHAPTER V
WORK RELATIONSHIPS
Article 10.The Rector of the Science and Technology Management Vocational School implements the working system and work relations with the Heads of units under the Ministry of Science and Technology according to the working regulations of the Ministry and the provisions decided by the Minister.
Article 11The Rector of the Science and Technology Management Vocational School establishes work relations with the Departments of Science and Technology of provinces and centrally governed cities, functional departments of ministries and agencies under the Government to organize training and capacity building for cadres, civil servants, and public officials managing science and technology at local levels or sectors.
Article 12.The Science and Technology Management Vocational School has relations with state management agencies and specialized agencies for training and capacity building for cadres, civil servants, and public officials at the central level according to the current national regulations.
CHAPTER VI
IMPLEMENTING PROVISIONS
Article 13.The Rector of the Science and Technology Management Vocational School coordinates with the Director of the Cadre Organization Department to implement these Bylaws.
Article 14Any amendments or supplements to these Bylaws shall be proposed by the Rector of the Science and Technology Management Vocational School in coordination with the Director of the Cadre Organization Department for consideration and decision by the Minister of Science and Technology./.
