DIRECTIVE
Regarding the organization and implementation of the National Security Law
To implement the National Security Law adopted at the sixth session of the eleventh National Assembly on December 3, 2004, which takes effect from July 1, 2005, the Prime Minister requests the Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities to carry out the following tasks:
1. Ministry of Public Security
a) Urgently complete specialized training on the National Security Law and enhance legal knowledge on national security protection for officers and soldiers in units under the Ministry and local Public Security forces, with a focus on the staff of security, intelligence, and protective units of the People's Public Security and officers and soldiers of the People's Public Security working in key areas of national security.
b) Take the lead and coordinate with the Ministry of Justice and the Ministry of Defense to compile publicity materials, disseminate guidelines for implementing the National Security Law for cadres, civil servants, and the general public to ensure clarity, ease of understanding, and convenience for consistent implementation of the law.
c) Take the lead and coordinate with the Ministry of Justice and related ministries, agencies to draft and submit to the Government for promulgation Decrees detailing and guiding the implementation of certain provisions of the National Security Law; Decrees ensuring conditions for national security protection activities; procedures and authorities for executing powers of specialized agencies and personnel responsible for national security protection; education on national security protection within the national education system; rewards for agencies, organizations, and individuals with outstanding achievements in national security protection activities; restoration of honor, compensation, and assistance for agencies, organizations, and individuals suffering losses due to participation in national security protection.
d) Take the lead and coordinate with the Ministry of Defense, the Ministry of Foreign Affairs, and related ministries, agencies to draft and promulgate or submit to competent authorities for promulgation normative legal documents specifying the scope of responsibilities and coordination relationships between national security protection agencies under the People's Public Security and the People's Armed Forces; between the Ministry of Public Security and the Ministry of Foreign Affairs and other agencies in national security protection work.
đ) Take the lead and coordinate with related ministries, agencies to develop plans to improve the organizational structure of specialized agencies responsible for national security protection under the People's Public Security, and promulgate or submit to competent authorities for promulgation normative legal documents regulating the organization and operation of these agencies in accordance with the provisions of the National Security Law.
e) Combine the organization and implementation of the National Security Law with the continued implementation of Party and Government directives on national security protection, enhancing the quality and effectiveness of public security officers' work.
g) Take the lead and coordinate with the Ministry of Planning and Investment and related ministries, agencies to develop proposals, projects, and plans to strengthen investment in material infrastructure and technical equipment to ensure the operation of the People's Public Security force in national security protection work.
Directing and guiding functional agencies to coordinate with the Environmental Crime Prevention Police Force
a) Urgently complete specialized training on the National Security Law and enhance legal knowledge on national security protection for officers and soldiers in units under the Ministry and local Military Command Departments, focusing on units responsible for military security, military intelligence, Border Guard, Coast Guard; officers and soldiers of the People's Armed Forces stationed in key areas of national security.
b) Take the lead and coordinate with related ministries, agencies to improve the organizational structure of specialized agencies responsible for national security protection under the People's Armed Forces; study and promulgate or submit to competent authorities for promulgation normative legal documents regulating the organization and operation of these agencies in accordance with the provisions of the National Security Law.
c) Take the lead and coordinate with the Ministry of Planning and Investment and related ministries, agencies to develop proposals, projects, and plans to strengthen investment in material infrastructure and technical equipment to ensure the operation of the armed forces in national security protection work.
3. The Ministry of Foreign Affairs
Direct Vietnamese representative offices abroad and agencies under its jurisdiction to perform national security protection tasks as prescribed by the National Security Law.
4. The Ministry of Justice
Coordinate with the Ministry of Public Security and the Ministry of Defense to determine the content of the nationwide dissemination program for the National Security Law; coordinate in organizing the compilation and review of publicity materials for the National Security Law.
5. The Ministry of Culture and Information
Take the lead and coordinate with the Ministry of Public Security, the Ministry of Defense, the Ministry of Justice, the Inter-Ministerial Steering Committee for Legal Dissemination and Education of the Government, and the Central Committee for Propaganda and Ideology to direct and guide news agencies, radio, and television stations at central and local levels to increase broadcasting time for the National Security Law and guiding documents for its implementation among cadres and the general public.
6. The Ministry of Education and Training
Take the lead and coordinate with the Ministry of Public Security and the Ministry of Defense to develop and implement plans to incorporate national security education into the national education system.
7. The Ministry of Planning and Investment
a) Take the lead and coordinate with the Ministry of Finance to allocate budget plans for proposals, projects, and plans to strengthen investment in material infrastructure and technical equipment serving the operation of the People's Public Security and the People's Armed Forces in national security protection work.
b) Take the lead and coordinate with the Ministry of Finance to allocate funds from the national reserve for the Ministry of Public Security and the Ministry of Defense to have resources ready for urgent tasks serving national security protection work.
8. The Ministry of Finance
Ensure funding for specialized training and capacity enhancement for personnel directly implementing tasks under the National Security Law according to approved plans.
9. Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities
a) Organize propaganda and dissemination of the National Security Law in accordance with the guidance of the Ministry of Public Security; link the implementation of the National Security Law with the implementation of the Party's policies and State laws on national security protection and maintaining social order and safety to enhance legal awareness and responsibility of officials and people in national security protection work.
b) Direct and guide agencies and organizations under their authority to effectively perform tasks and measures for national security protection, incorporate national security protection tasks into programs, plans, and specialized activities of agencies and organizations.
Within the scope of their responsibilities and authorities, they shall have plans to meet requirements for material infrastructure, mobilize human resources, and serve national security protection tasks according to the Prime Minister's directives and the Ministry of Public Security and the Ministry of Defense's proposals.
10. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government shall have specific plans to implement assigned tasks; periodically review and summarize the implementation of this Directive.
The Ministry of Public Security is responsible for assisting the Prime Minister in monitoring, guiding, urging, inspecting, and periodically reporting to the Prime Minister on the implementation of this Directive.
