JOINT CIRCULAR
Guidelines for Coordinating the Implementation of Compulsory Civil Liability Motor Vehicle Insurance

Pursuant to Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on urgent measures to curb traffic accidents and traffic congestion;
Pursuant to the provisions of the law regarding the implementation of compulsory civil liability motor vehicle insurance;
The Ministry of Public Security and the Ministry of Finance issue guidelines for coordinating the implementation of compulsory civil liability motor vehicle insurance as follows:
This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

These Circulars provide guidance on the coordination regime between the Ministry of Public Security and the Ministry of Finance in implementing public awareness campaigns, education; supervision, inspection; investigation and resolution of traffic accidents; handling enterprises and motor vehicle owners who violate the compulsory civil liability motor vehicle insurance regulations.
2. Principles of Coordination
Within their respective functions and duties, the Ministry of Public Security and the Ministry of Finance shall direct agencies under their management to coordinate in properly implementing the legal provisions on compulsory civil liability motor vehicle insurance; not causing inconvenience or damage to organizations and individuals participating in this type of insurance.
II. SPECIFIC PROVISIONS
1. Responsibilities of the Ministry of Public Security
The Ministry of Public Security directs agencies under its management to implement the following contents:
1.1. Traffic police forces and other relevant police forces shall inspect and control through patrols and administrative violations against vehicle owners and drivers participating in traffic without carrying the certificate of compulsory civil liability motor vehicle insurance as prescribed by law.
1.2. When a traffic accident occurs, traffic police and criminal investigation forces shall be responsible for notifying insurance companies to cooperate in resolving the aftermath, providing related documents concerning the accident (copies) to insurance companies, such as:
1.2.1. Accident scene examination report;
1.2.2. Examination report of the involved vehicles;
1.2.3. Diagram of the accident scene;
1.2.4. Photographs of the accident scene (if available).
After completing the investigation and handling, traffic police and criminal investigation forces shall provide the accident resolution report with fault determination of each party, the investigation conclusion, and other investigation materials (if any) to insurance companies for the basis of compensation according to regulations.
1.3. Timely notify insurance companies of cases where insurance salespeople and agents violate the legal provisions on compulsory civil liability motor vehicle insurance.
1.4. Coordinate with the Ministry of Finance in monitoring and checking to prevent organizations and individuals from profiting and fraudulently claiming insurance benefits.
2. Responsibilities of the Ministry of Finance
The Ministry of Finance is responsible for directing units under its management to implement the following contents:
2.1. Direct and guide the Vietnam Insurance Association, insurance companies, and related agencies to organize publicity, dissemination, and full explanation of the content, significance, and purpose of compulsory civil liability motor vehicle insurance so that vehicle owners understand their rights and obligations when participating in insurance.
2.2. Direct insurance companies to create favorable conditions for motor vehicle owners to participate in insurance through widely organizing the provision of compulsory civil liability motor vehicle insurance, and promptly settling claims.
2.3. Regularly provide traffic police and other relevant police forces with new legal documents related to compulsory civil liability motor vehicle insurance for coordinated implementation.
2.4. Administer administrative penalties against insurance companies violating compulsory civil liability motor vehicle insurance according to legal provisions.
2.5. Take the lead and coordinate with the Ministry of Public Security in monitoring and checking to prevent organizations and individuals from profiting and fraudulently claiming insurance benefits.
3. Regarding Funding Support for Coordination Activities Between Units Under the Management of the Ministry of Public Security and the Ministry of Finance
3.1. Insurance companies are responsible for paying the costs of copying documents related to traffic accidents provided by the police according to Clause 1.2, Part II of these Circulars.
3.2. The Ministry of Finance is responsible for directing insurance companies to cooperate with the Vietnam Insurance Association to contribute funds from the Traffic Safety Promotion Fund (referred to as the Fund) to support the coordination activities of traffic police.
3.2.1. The level of contribution to support the inspection and handling of organizations and individuals violating compulsory civil liability motor vehicle insurance and to support the traffic safety maintenance activities of traffic police and other relevant police forces shall not exceed 20% of the total amount contributed annually to the Fund by non-life insurance companies operating compulsory civil liability motor vehicle insurance.
3.2.2. The support funds shall be used as follows:
- Supporting the organization of mid-term and final reviews on traffic safety; promoting and disseminating knowledge about compulsory civil liability motor vehicle insurance and traffic safety.
- Supporting rewards for organizations and individuals directly performing or participating in coordinating inspections and supervising the implementation of compulsory civil liability motor vehicle insurance and maintaining traffic order and safety.
- Supporting the repair of equipment and means to ensure traffic order and safety.
3.2.3. By no later than January 15th each year, the Ministry of Finance shall direct the Vietnam Insurance Association to notify the Ministry of Public Security (Traffic Police General Department) of the total amount of funds expected to be allocated from the Traffic Safety Promotion Fund to support the coordination activities of traffic police and complete the procedures for transferring funds to the Ministry of Public Security (Traffic Police General Department) in accordance with regulations.
3.2.4. The General Bureau of Police shall receive, manage, and utilize the financial resources in accordance with the contents stipulated in point 3.2.2, Section II of this Circular, and shall be responsible for reporting to the Ministry of Finance (Insurance Department) on the utilization of the allocated financial resources for the year (in detail according to each expenditure item) no later than January 15 of the following year.
III. IMPLEMENTATION
1. This Circular takes effect fifteen days from the date of publication in the Official Gazette.
2. Units under the traffic police force, other police forces related thereto, and insurance enterprises shall be responsible for coordinating to implement this Circular.
3. The Ministry of Public Security and the Ministry of Finance shall organize interim reviews, summaries, and evaluations of the results of cooperation between the two Ministries, and shall organize commendations for organizations and individuals who have achieved success in implementing the compulsory civil liability motor vehicle insurance regime and the provisions of this Circular.
4. During the implementation process, if any difficulties arise, they should be promptly reflected to the General Bureau of Police (Ministry of Public Security) and the Insurance Department (Ministry of Finance) for timely guidance./.
