ON ANNOUNCING THE OPENING OF THE HON LA SEAPORT IN QUANG BINH PROVINCE

PROVINCE OF QUANG BINH

MINISTER OF TRANSPORT

Pursuant to the Maritime Code of Vietnam dated June 14, 2005; WHEREAS, Decree No. 51/2008/ND-CP dated April 22, 2008 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Transport;

WHEREAS, Decree No. 71/2006/ND-CP dated July 25, 2006 of the Government on seaport management and maritime channels;

BASED ON THE APPLICATION FOR ANNOUNCING THE OPENING OF THE HON LA SEAPORT IN QUANG BINH PROVINCE SUBMITTED BY THE PEOPLE'S COMMITTEE OF QUANG BINH PROVINCE AT DOCUMENT NO. 1328/UBND DATED JUNE 18, 2008;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

DECISION:

Article 1. NOW, WE ANNOUNCE THE OPENING OF THE HON LA SEAPORT IN QUANG BINH PROVINCE TO RECEIVE DOMESTIC AND FOREIGN VESSELS FOR LOADING AND UNLOADING GOODS AND PERFORM OTHER MARITIME SERVICES AS FOLLOWS:

1. PORT NAME: Hon La Seaport, including Pier No. 1, which is invested by the Department of Transport of Quang Binh Province;

2. PORT LOCATION: Quang Dong Commune, Quang Trach District, Quang Binh Province;

3. AREA FOR MEETING PILOTS AND QUARANTINE: The circular water area limited from 450 to 2250 with a radius of 01 nautical mile, with the center located at coordinates:

Latitude: 17054'55''N, Longitude: 106031'47''E;

4. TYPES OF VESSELS: For Pier No. 1, vessels up to 10,000 DWT are allowed.

Article 2. The Quang Binh Maritime Branch shall be responsible for the following:

1. State management in the maritime sector within the Hon La Seaport area and collect fees as prescribed by law;

2. Based on actual conditions, depth limits of the water area before the pier, port channel, and relevant laws, allow vessels with technical specifications suitable for the pier design to enter for loading and unloading goods and perform other maritime services ensuring maritime safety, maritime security, and environmental pollution prevention.

Article 3. The investor shall organize the operation of the pier within the Hon La Seaport according to this Decision, relevant laws, and operational conditions, ensuring maritime safety, maritime security, environmental pollution prevention, and collecting fees as prescribed by law.

Article 4. Relevant specialized state management agencies shall organize business activities within the Hon La Seaport based on this Decision and relevant laws.

Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 6. The Head of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments under the Ministry, Director of the Vietnam Maritime Administration, Director of the Department of Transport of Quang Binh Province, Director of the Quang Binh Maritime Branch, Director of the Hon La Port, Heads of related agencies, organizations, and individuals are responsible for implementing this Decision.
