THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Crop Cultivation Department is an agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister in managing state affairs in the specialized sector and executing state management tasks in the field of crop cultivation within the scope of the Ministry's state management.
The Crop Cultivation Department has legal personality, its own bank account and seal, and operates with funds allocated according to the law.
The headquarters of the Department is located in Hanoi and a permanent office in the South region, Central region, and Northwest region.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Ministry draft projects for laws, ordinances, and draft normative legal documents in the specialized field according to the annual program and plan for legislative development of the Ministry and other projects and programs assigned by the Minister. Submit to the Minister draft decisions, directives, and other documents within the Minister’s authority to direct and manage.
2. Submit to the Ministry strategies, plans for long-term, five-year, and annual development; regional strategic plans, inter-regional, and inter-provincial plans; and important programs, projects, and works in the specialized field managed by the Department as assigned by the Minister.
3. Issue individual documents and provide professional guidance on the specialized field and area entrusted with management. Announce detailed implementation plans for programs, projects, and proposals managed by the Ministry for each locality and unit after the overall plan for the field under the Department's management has been approved by the Ministry.
4. Submit to the Ministry for publication strategies, plans for development, and organize direction, guidance, and inspection of the implementation of normative legal documents, strategies, plans, programs, projects, proposals, standards, technical regulations, procedures, norms, and economic-technical quotas in the specialized field that have been approved; direct and organize the dissemination, popularization, and education of laws in the specialized field under the Department's management.
5. Regarding agricultural crop seeds:
a) Lead in developing strategies, plans for seed crop development in line with the overall national socio-economic development planning and each agricultural ecological zone;
b) Submit to the Ministry regulations on the use and exchange of crop genetic resources; national technical standards for various seed levels; decisions recognizing, granting, or revoking protection certificates for new agricultural crop varieties;
c) Issue lists of major crops, permitted seed production and trading varieties; lists of rare crop genetic resources requiring conservation; lists of crops prohibited from export and allowed to be exchanged with foreign countries; seed propagation procedures and procedures for rejuvenating super-pure hybrid seeds; production procedures for industrial, short-cycle fruit, ornamental, and other crop seeds; testing, selection, and creation procedures for new crop varieties; production procedures for crop seeds that must be certified to meet national technical standards as authorized by the Minister;
d) Manage and implement seed testing and recognition work for new crop varieties; direct the implementation of variety and progeny garden certification work. Manage activities related to seed quality testing and inspection; perform tasks to protect new crop varieties;
đ) Recognize seed testing laboratories, inspectors, samplers, and seed testing units;
e) Issue and revoke permits for importing crop seeds not listed in the permitted production and trading varieties list according to the law;
g) Submit to the Ministry matters concerning the establishment, supplementation, and utilization of the national seed reserve according to the law and guide the export and import of crop seeds.
6. Regarding land use management and fertilizers:
a) Manage planning, solutions for the use, protection, and enhancement of agricultural soil fertility; review land use planning and conversion plans for agricultural purposes;
b) Manage fertilizer quality and usage, raw materials for fertilizer production according to the law; manage fertilizer production, export, and import according to regulations;
c) Submit to the Ministry national technical standards for fertilizers;
d) Submit to the Ministry regulations on testing. Decide on the recognition of new fertilizers; issue lists of fertilizers required to publish quality standards, permitted for production, trading, and use in Vietnam;
đ) Manage testing and decide on the recognition of new fertilizers; name and rename fertilizers. Manage testing units, laboratories, and samplers. Designate, recognize, and organize certification for testing laboratories and samplers;
e) Issue and revoke permits for producing, exporting, and importing fertilizers not listed, and certificates for fertilizer testing according to the law.
7. Direct crop cultivation production:
a) Develop, direct implementation, and conclude evaluations of annual and multi-year crop production plans;
b) Direct the development and monitor the implementation of regional crop concentration area development plans and safe food production;
c) Direct the implementation of production structures and crop cultivation techniques; propose measures to mitigate natural disasters and pests in crop cultivation production.
8. Manage product quality and food safety in the crop cultivation sector from the production input stage:
a) Develop and submit to the Ministry for issuance and implementation programs and plans for production activities to ensure product quality and food safety in the crop cultivation sector;
b) Develop and submit to the Ministry normative legal documents and policies to ensure crop product quality. Propose the development of national standards and technical regulations to ensure crop product quality;
c) Propose projects and plans for building and developing safe food production material regions in the crop cultivation sector.
d) Designate, recognize, and manage the activities of certification organizations, testing laboratories, and individuals responsible for sampling the quality of agricultural products and safe agricultural products;
đ) Supervise and inspect the implementation of regulations governing the management of safe agricultural production areas and facilities (GAP); technical standards concerning food safety in agricultural production;
9. Propose to the Ministry a list of investment programs and projects in crop production. Lead the review and undertake the role of the main investor for programs and projects assigned by the Ministry to the Bureau. Participate in the management of agricultural product storage and processing;
10. Organize the direction of investigation, statistics, and database management on crop production in accordance with regulations;
11. Science, technology, and environment:
a) Propose to the Ministry scientific research programs, plans, and topics; applications of technological advancements and specialized techniques;
b) Lead the review of research outlines and topics; commission organizations and individuals to implement them; accept and manage the results, and direct the implementation of research outcomes and technological advancements within the Bureau's jurisdiction;
c) Manage scientific and technological information and databases related to the specialized field;
d) Participate in drafting national standards and technical regulations within the Ministry's jurisdiction according to the Minister's assignment;
đ) Lead and organize the review and decide to recognize the results of trials and experimental production of new agricultural crop varieties, fertilizers, and planting techniques;
e) Monitor and inspect the implementation of national environmental standards and technical regulations in crop production. Coordinate with other environmental agencies to assess environmental quality and propose solutions for environmental protection in crop production;
12. Direct the implementation of agricultural extension activities in crop production according to the Minister's assignment;
13. Participate in trade promotion activities in the specialized field of crop production according to the Minister's assignment;
14. Regarding international cooperation:
a) Develop and propose to the Ministry international cooperation programs and projects within the Bureau's jurisdiction;
b) Organize the implementation of international cooperation, programs, and projects funded according to the Minister's classification;
15. Regarding administrative reform:
a) Develop and implement plans for administrative reform according to the Ministry's plan and the Minister's directives;
b) Direct the review, systematization, and proposal for the development of institutional and legal systems within the Bureau's jurisdiction;
c) Direct the improvement of functions, tasks, and authorities of subordinate organizations within the Bureau towards delegation and decentralization; propose the Ministry to delegate state management tasks and fields to local authorities;
d) Direct the implementation of regulations on self-management and responsibility for fulfilling tasks, organizational structure, staffing, finance, and administrative procedure reform, modernizing office operations, and applying information technology to serve the Bureau's activities;
16. Regarding state management of organizations providing public services within the Bureau's jurisdiction:
a) Propose to the Ministry mechanisms, policies, and technical standards for providing public services; regarding the socialization of public service provision activities within the industry and field;
b) Issue economic and technical norms, timeframes for providing public services within the industry and field;
c) Guide, inspect, and support organizations providing public services within the industry and field according to legal provisions;
17. Regarding state management of the activities of associations and non-governmental organizations within the Bureau's jurisdiction according to the Minister's assignment:
a) Guide and create conditions for associations and non-governmental organizations to participate in activities within the Bureau's jurisdiction; organize the collection of opinions and absorption of proposals and critiques from associations and non-governmental organizations to improve state management regulations within the industry and field;
b) Recommend measures to address violations of laws by associations and non-governmental organizations operating within the industry and field;
18. Regarding organizational structure, staffing, and cadres, civil servants, and public officials:
a) Draft proposals for the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations within the Bureau;
b) Decide on the establishment of working groups within the Bureau; specify the autonomy, organizational charters, and operational rules for state-owned enterprises under the Bureau according to regulations;
c) Propose to the Ministry annual staffing plans for the Bureau; decide on the allocation of administrative positions for units under the Bureau;
d) Decide on sending cadres, civil servants, and public officials abroad for study and work according to the Ministry's cadre management classification;
đ) Specify the authority and responsibilities of heads of organizations under the Bureau;
e) Decide and implement specific measures to strengthen administrative discipline; organize the implementation of anti-corruption, waste prevention, and bureaucratic, harsh, and arbitrary practices within units under the Bureau;
g) Implement recruitment, utilization, transfer, retirement, salary systems, rewards, and other regulations for cadres, civil servants, and public officials under the Bureau's jurisdiction according to legal provisions and the Ministry's classification; provide professional training according to the Minister's assignment;
h) Develop professional standards for civil servant and public official ranks within the industry and field according to the Minister's assignment;
i) Report on the implementation of organizational and personnel work and staffing according to regulations;
19. Regarding inspection and supervision:
a) Guide and inspect the implementation of policies and laws within the Bureau's jurisdiction according to regulations;
b) Resolve or participate in resolving complaints, accusations, and suggestions from organizations and citizens related to the Bureau's management; organize citizen reception according to legal provisions;
c) Inspect and supervise the implementation of delegated management within the Bureau's jurisdiction and handle violations according to legal provisions;
20. Regarding financial and asset management:
a) Propose to the Ministry the annual budget estimate and medium-term budget plan for the Bureau;
b) Be responsible for finalizing accounts of financial sources directly managed by the Bureau; manage and be responsible for state assets entrusted to the Bureau according to the分级授权的部长规定和法律规定。
21. Carry out other tasks as prescribed by specialized laws and the division of responsibilities assigned by the Minister.
Article 3. Organizational Structure
1. Leadership of the Bureau:
The leadership of the Bureau consists of the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development in accordance with regulations.
The Director oversees the operations of the Bureau, and is accountable to the Minister of Agriculture and Rural Development and to the law regarding the activities of the Bureau.
Deputy Directors assist the Director in supervising and directing certain aspects of work as assigned by the Director, and are accountable to the Director and to the law regarding the tasks delegated to them.
2. Management Structure:
a) Crop Food and Food Plants Department;
b) Industrial and Fruit Trees Department;
c) Land Use and Fertilizer Department;
d) Office for Protection of New Plant Varieties;
đ) Planning and Finance Department;
e) Bureau Office;
g) Inspection and Legal Affairs Department;
h) Permanent Unit in the South, Central Region, and Northwest.
3. Affiliated Units:
a) Revenue-generating public service unit: National Center for Seed and Agricultural Product Testing and Fertilizer;
b) Other public service units established based on proposals developed by the Bureau and approved by the Ministry.
The Director of the Crop Production Bureau shall define the functions and responsibilities of the management structure and affiliated units of the Bureau, appoint staff according to the分级授权的部规定, and issue the Bureau's operational regulations.
Article 4. Effective date
This Decision shall take effect fifteen days after its publication in the Official Gazette. Decree No. 70/2005-QĐ-BNN dated November 10, 2005, issued by the Minister of Agriculture and Rural Development concerning the functions, responsibilities, authorities, and organizational structure of the Crop Production Bureau, and any previous provisions of the Ministry that conflict with this Decision are hereby repealed.
Article 5. Responsibility for Implementation
The Director of the Crop Production Bureau, the Head of the Ministry's General Office, the Heads of Departments, the Directors of Bureaus, the Inspector General of the Ministry, and the Heads of relevant agencies and units are responsible for implementing this Decision./.
