THE MINISTER OF HEALTH

          Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

          Pursuant to Decree No. 188/2007/ND-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

          Considering the proposal of the Director of the Personnel Department and the Director of the Department of Medical Examination and Treatment, Ministry of Health,

DECISION:

Article 1. Position and Function.

1. The Department of Medical Examination and Treatment is a specialized department under the Ministry of Health, assisting the Minister of Health in performing state management functions over medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination throughout the country.

2. The Department of Medical Examination and Treatment has legal personality, its own seal, and separate bank accounts, with headquarters in Hanoi. The operating budget of the Department is funded from the state budget and other legitimate sources.

Article 2. Tasks and Authorities

1. To take the lead or cooperate in drafting, amending, and supplementing laws, ordinances, and other regulatory legal documents concerning medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination for submission to competent authorities for promulgation.

2. To take the lead or cooperate in drafting strategies, plans, programs, and projects related to medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination for submission to competent authorities for approval.

3. To take the lead in drafting national technical standards for submission to competent authorities for publication; to draft regulations on technical tiers, professional rules, and national technical standards concerning medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination for submission to the Minister of Health for issuance.

4. To participate in drafting policies on hospital fees, health insurance, self-management mechanisms, and other policies in medical examination and treatment; to direct, guide, and organize the implementation of such mechanisms and policies.

5. To participate in drafting regulations on conditions, standards, establishment, merger, restructuring, and dissolution of medical examination and treatment facilities.

6. To cooperate in drafting criteria for ranking medical examination and treatment facilities, nursing care facilities, rehabilitation facilities, medical examination facilities, forensic medical examination facilities, and forensic psychiatric examination facilities; to participate in ranking facilities directly under the Ministry of Health.

7. To direct, guide, inspect, and organize the implementation of laws, ordinances, and other regulatory legal documents, strategies, plans, professional regulations, and national technical standards concerning medical examination and treatment facilities, rehabilitation facilities, medical examination facilities, forensic medical examination facilities, and forensic psychiatric examination facilities.

8. To direct, guide, inspect rational and safe drug usage in treatment, including activities of the Drug and Treatment Council; prescription and drug usage practices; to take the lead in compiling lists of essential drugs for use in medical examination and treatment facilities.

9. To take the lead or cooperate in reviewing conditions for the application of new and advanced techniques, organ and tissue transplantation techniques in medical examination and treatment facilities, nursing care facilities, and rehabilitation facilities in accordance with the law.

10. To review and issue, suspend, or revoke practice certificates for private medical practitioners and certificates of eligibility for private medical practice for private hospitals, including those with foreign investment, in accordance with the law.

11. To direct, guide, and inspect the management of medical waste, infection control, and environmental protection in medical examination and treatment facilities.

12. To direct medical examination and treatment facilities to organize rescue operations, reception, and treatment of victims in disease outbreaks, natural disasters, and catastrophes.

13. To direct and organize the implementation of national health target programs and projects according to the division of labor by the Minister of Health.

14. To serve as the focal point for organizing specialized committees to resolve professional and technical issues in medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination.

15. To participate, direct, and guide scientific research and international cooperation in the fields of medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination.

16. To direct, guide, and enhance the capacity of state management and professional skills of managers in the fields of medical examination and treatment, nursing care, rehabilitation, medical examination, forensic medical examination, and forensic psychiatric examination.

17. To direct and guide the implementation of administrative reform in the field of medical examination and treatment, and the application of information technology in managing medical examination and treatment.

18. To compile statistical data on medical examination and treatment activities, and build a database on medical examination and treatment.

19. To manage personnel, civil servants, assets, and allocated funds in accordance with the law and the delegation of the Minister of Health.

20. To perform other tasks and powers delegated or authorized by the Minister of Health.

Article 3. Organization and operational mechanism

1. Leadership of the Bureau.

The leadership of the Bureau for Medical Examination and Treatment includes the Director and Deputy Directors appointed and relieved from duty by the Minister of Health.

The Director is responsible to the Minister of Health and to the law for all activities of the Bureau.

The Deputy Directors assist the Director, and are responsible to the Director and to the law for the tasks assigned to them.

2. Organizational structure.

a) Bureau Office (Organization, administration, management, accounting)

b) Department of Operations and Legal Affairs;

d) Department of Rehabilitation and Appraisal;

đ) Department of Nursing and Cost Control;

e) Department of Private Practice;

g) Public Service Unit: Center for Developing Management Capacity in Medical Examination and Treatment.

3. Operational mechanism

a) The Bureau for Medical Examination and Treatment operates under the head system;

b) The functions, duties, and authorities of the Bureau Office, Departments, and public service units under the Bureau shall be defined by the Director based on the functions, duties, and authorities of the Bureau delegated by the Minister of Health. The relationship between the Bureau Office, Departments, and public service units under the Bureau shall be defined by the Director;

c) The appointment and removal of leadership positions in the Bureau Office, Departments, and public service units under the Bureau shall be carried out in accordance with the provisions of the law and the delegation of the Ministry of Health;

d) Leaders of the Bureau, Bureau Office, Departments, and public service units under the Bureau shall receive allowances as prescribed by law.

4. Staffing

The staffing of the Bureau for Medical Examination and Treatment is determined by the Decision of the Minister of Health and adjusted annually based on work needs proposed by the Director.

Article 4. Effective date

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. The Heads of the Ministry's Office, Inspectorate, Bureau Directors, Department Heads of the Ministry of Health, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.
