CIRCULAR
Guidelines for importing goods subject to import quota tariff management in 2009

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
Pursuant to Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Trade guiding certain contents stipulated in Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
The Ministry of Industry and Trade hereby provides specific guidelines for importing goods subject to import quota tariff management in 2009 as follows:

II. PRINCIPLES FOR ISSUING PERMITS FOR IMPORTING UNDER QUOTA TARIFF REGIME
The principles for issuing permits under the quota tariff regime, the entities eligible to be allocated quota tariffs, and the procedures for issuing permits under the quota tariff regime shall be implemented in accordance with Circular No. 04/2006/TT-BTM dated April 6, 2006 of the Ministry of Trade guiding certain contents stipulated in Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries.
The Ministry of Industry and Trade issues permits for importing refined sugar and raw sugar under the quota tariff regime to traders using sugar as raw material for direct production purposes.
III. IMPLEMENTATION PROVISIONS
This Circular takes effect fifteen days from the date of publication in the Official Gazette and remains effective until December 31, 2009./.
