JOINT CIRCULAR
Guidelines for Decision 72/2008/QD-TTg amending Decision
234/2005/QD-TTg on special regimes for workers, staff, and civil servants in certain
industries and occupations in state-owned enterprises industries in state-owned enterprises

Implementing Decision No. 72/2008/QD-TTg dated May 30, 2008 of the Prime Minister regarding amendments and supplements to some Articles of Decision No. 234/2005/QD-TTg dated September 26, 2005 of the Prime Minister on special regimes for workers, staff, and civil servants in certain industries and occupations in state-owned enterprises, the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance jointly issue these guidelines to amend and supplement Circular No. 35/2005/TTLT-BLDTBXH-BTC dated December 16, 2005 as follows:
1. Amend Clause 2, Section I of Circular No. 35/2005/TTLT-BLDTBXH-BTC as follows:
“2. The daily meal allowance calculated in monetary terms based on actual working days shall be as follows: Level 1: 50,000 VND/day; Level 2: 60,000 VND/day; Level 3: 70,000 VND/day; Level 4: 110,000 VND/day (equivalent to 5 USD/day); and Level 5: 150,000 VND/day (equivalent to 7 USD/day).
These meal levels replace those applicable to the subjects specified in Clauses 1, 2, 3, 4, and Clause 5 of Appendix No. 01 issued together with Circular No. 35/2005/TTLT-BLDTBXH-BTC.”
2. Amend Clause 2, Section IV of Circular No. 35/2005/TTLT-BLDTBXH-BTC as follows:
“2. Allowance level: 150,000 VND/day (equivalent to 7 USD/day).”
3. Amend Clause 4 of Section VI of Circular No. 35/2005/TTLT-BLDTBXH-BTC as follows:
“4. When the food price index published by the General Statistics Office increases by 10% or more compared to the last adjustment, the Ministry of Labour, Invalids and Social Affairs shall take the lead, in coordination with the Ministry of Finance and relevant ministries, to guide adjustments to the daily meal allowance not exceeding the increase in the food price index.”
4. Effective date
a) This Circular takes effect 15 days from the date of publication in the Official Gazette.
Abolish Clause 2, Section I and Clause 2, Section IV of Circular No. 35/2005/TTLT-BLDTBXH-BTC dated December 16, 2005 of the joint issuance of the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance.
b) The provisions set forth in this Circular shall apply from June 26, 2008 (the date when Decision No. 72/2008/QD-TTg of the Prime Minister took effect).
Any issues arising during implementation should be reported to the Ministry of Labour, Invalids and Social Affairs and the Ministry of Finance for consideration and resolution.
