Regulations on the organization of technical safety inspections and environmental protection for police force motor vehicles and specialized motorcycles

Based on the Road Traffic Law 2008;

Based on Decree No. 136/2003/NĐ-CP dated November 14, 2003 stipulating the functions, tasks, powers, and structure of the Ministry of Public Security;

The Ministry of Public Security stipulates the organization of regular technical safety inspections and environmental protection (hereinafter referred to as vehicle inspection) for motor vehicles and specialized motorcycles of the People's Police Force as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. Scope and Applicability

This Circular stipulates the organization of regular technical safety inspections and environmental protection (hereinafter referred to as vehicle inspection) for various types of motor vehicles and specialized motorcycles (hereinafter referred to as vehicles) of the People's Police Force.

2. Inspection Authority

2.1. The Highway and Railway Traffic Police Corps (Department guiding registration and management of road traffic vehicles).

2.2. The Motor Vehicle Inspection Center under the Highway and Railway Traffic Police Corps (hereinafter referred to as the Inspection Center).

2.3. Traffic Police Department or Motor Vehicle Inspection Center under provincial public security organs directly under the central government.

3. Functions and Tasks of the Inspection Authority

3.1. The Highway and Railway Traffic Police Corps (Department guiding registration and management of road traffic vehicles) organizes the initial inspection of vehicles of agencies subordinate to the Ministry of Public Security registered and managed by the Corps.

3.2. The Inspection Center under the Highway and Railway Traffic Police Corps organizes subsequent inspections for vehicles of agencies subordinate to the Ministry of Public Security registered and managed by the Corps. The Inspection Center is headed by the Director of the Department guiding registration and management of road traffic vehicles. The Inspection Center has its own seal for use in the inspection work of the People's Police Force vehicles.

3.3. The Traffic Police Department or Motor Vehicle Inspection Center under provincial public security organs directly under the central government organizes the inspection of vehicles of units within their jurisdiction according to the assignment of the Provincial Public Security Chief. The Inspection Center has its own seal for use in the inspection work of the People's Police Force vehicles.

4. Inspection Methods

Depending on the actual conditions of local public security organs, inspections may be organized using mechanical methods or semi-mechanical methods.

4.1. Mechanical inspection is carried out on the mechanical inspection assembly line at the Inspection Center.

4.2. Semi-mechanical inspection must be arranged in a separate area, not affecting public traffic, and must ensure safety. There must be a flat paved or concrete road about 200 meters long for brake testing and a slope test ramp or bridge with a 20% incline for undercarriage and handbrake testing.

5. Inspection Cycle

The inspection cycle is the time interval between two inspections.

5.1. New vehicles not yet in use: 24 months;

5.2. Used vehicles up to 7 years old: 18 months;

5.3. Repaired vehicles and those over 7 years old: 6 months.

5.4. Driving training and examination vehicles: 6 months;

6. Inspection Documents:

Attached to this Circular are the inspection documents for People's Police Force vehicles, including:

6.1. The Certificate Book for Technical Safety and Environmental Protection Inspection of Road Traffic Vehicles of the People's Police Force (Form No. 01) hereinafter referred to as the Inspection Certificate Book;

6.2. The Certificate for Technical Safety and Environmental Protection Inspection of Road Traffic Vehicles of the People's Police Force (Form No. 02) hereinafter referred to as the Inspection Certificate;

6.3. The Inspection Seal for Technical Safety and Environmental Protection of Road Traffic Vehicles of the People's Police Force (Form No. 03) hereinafter referred to as the Inspection Seal;

6.4. The Inspection Form (Form No. 04);

6.5. The Record of Inspection Certificate Book Preparation (Form No. 05) hereinafter referred to as the Record of Inspection Certificate Book Preparation;

Forms No. 01, 02, 03 are uniformly managed and issued by the Highway and Railway Traffic Police Corps; Forms No. 04, 05 are printed by local public security organs according to the model.

7. Responsibilities of Vehicle Management Units.

7.1. Units managing and using vehicles have the responsibility to fully implement requirements for maintenance and repair to ensure that the vehicles always meet the technical safety and environmental protection standards specified in Section B Part II of this Circular.

7.2. Units managing and using vehicles and drivers bear the responsibility to maintain the technical condition of the vehicles according to the prescribed standards during road traffic between two inspection periods.

II. SPECIFIC PROVISIONS

A. PROCEDURE FOR INSPECTION

1. When applying for vehicle inspection, the driver must present the following documents:

1.1. Letter of introduction.

1.2. Vehicle registration certificate.

1.3. Driver's license.

1.4. Inspection Certificate Book (if issuing the Inspection Certificate Book for the first time, fill out the Record of Inspection Certificate Book Preparation).

1.5. Fill out the Inspection Form.

2. Document and Fee Collection

2.1. Accept and check the vehicle and driver's documents as stipulated in Point 1 Section A Part II of this Circular.

2.2. Collect inspection fees.

2.3. Enter vehicle inspection data into the computer system.

3. Vehicle Inspection and Result Processing

3.1. Check the technical parameters of the vehicle according to the Record of Inspection Certificate Book Preparation (in case of issuing the Inspection Certificate Book for the first time) and inspect the technical safety and environmental protection of the vehicle according to the vehicle inspection procedures specified in Section B Part II of this Circular.

3.2. Inspection officers must record the inspection data, transmit the results of each stage to the main server, sign off on "pass" or "fail" for each stage in the Inspection Form.

3.3. Upon completion of the inspection, the Inspection Team Leader oversees, completes all contents, and signs off on the Inspection Form "pass" or "fail", and requests the driver to sign the Inspection Form.

3.4. In case the vehicle fails, the inspection officer informs and requires the driver to repair and maintain the vehicle to meet the required standards before re-inspection.

3.5. In case the vehicle meets the standards, proceed as follows:

3.5.1. Print or fill in the vehicle and owner information in the Inspection Certificate Book (in case of issuing the Inspection Certificate Book for the first time), the Inspection Certificate, and the Inspection Seal.

3.5.2. Complete the documents and submit them for leadership signature and stamping of the Inspection Certificate Book (in case of issuing the Inspection Certificate Book for the first time), the Inspection Certificate, and the Inspection Seal.

3.5.3. Affix the Inspection Certificate to the Inspection Certificate Book.

4. Deliver Results and Archive Documents

4.1. Affix the inspection stamp to the upper right corner of the inside windshield of the front of the vehicle;

4.2. Return the Inspection Book to the driver and request signature for receipt.

4.3. Manage and store records in accordance with regulations.

+ 2.0 mm (for passenger cars over 9 seats).

+ 1.0 mm (for trucks).

7. For driving training vehicles and examination vehicles, additional inspections of auxiliary braking systems and safety devices must be conducted according to technical requirements for primary braking systems and safety devices.

C. REGULATIONS ON MANAGEMENT AND INSPECTION

1. Regulations on bringing vehicles for inspection

1.1. At least 07 days before the expiry date recorded on the Certificate of Inspection, the vehicle management unit is responsible for bringing the vehicle to the inspection authority managing that vehicle for inspection. Before bringing the vehicle for inspection, the driver must self-inspect to ensure the vehicle's technical condition meets the inspection requirements, and the vehicle must be washed and cleaned thoroughly inside and out.

1.2. In cases where the vehicle is due for inspection but is damaged and unable to participate in traffic or is parked and not in circulation, the management unit must notify the inspection authority in writing. After repairs are completed, a request for inspection must be submitted in writing.

1.3. In cases where the vehicle must operate for an extended period in another location due to work requirements, when the inspection deadline arrives, the vehicle management unit must submit a written request to the local traffic police authority where the vehicle is operating for inspection and issuance of the Certificate of Inspection. After the inspection, the traffic police authority conducting the inspection must inform the inspection authority managing the vehicle of the results.

2. Inspection of vehicles transferred from other locations.

When vehicles are reassigned to other units or locations, along with the procedures for transferring ownership and registration, the traffic police authority managing the vehicle must adjust the Inspection Record Book. The traffic police authority where the vehicle is transferred to must conduct the inspection and issue the Certificate of Inspection according to the provisions in Section A, Part II of this Circular.

3. Replacement and reissue of the Certificate of Inspection:

3.1. When the vehicle undergoes modification changing its usage function, replacing major assemblies, changing the paint color, or changing ownership, the vehicle management unit must bring the vehicle to the inspection authority for inspection procedures and update the Inspection Record Book.

3.2. In cases where the Inspection Record Book or the Inspection Label is torn, damaged, or lost, the vehicle management unit must submit a written explanation to the inspection authority requesting replacement of the Inspection Record Book or Label.

If more than one-third of the inspection period remains (but not less than three months), it shall be issued for the remaining period. In other cases, the vehicle must be inspected and the Inspection Certificate issued according to the prescribed cycle for each type of vehicle.

3.3. In the case where the Vehicle Inspection Book is seized by an authorized agency, the vehicle management unit must immediately inform the vehicle inspection agency to coordinate in handling the situation. It is strictly prohibited to make false declarations to request reissuance of the Vehicle Inspection Book.

4. Authority to sign various documents

4.1. The Head of the Registration and Traffic Management Department under the Highway and Railway Traffic Police Corps shall sign the Vehicle Inspection Book, Inspection Certificate, Inspection Sticker, and related documents when inspecting vehicles of agencies subordinate to the Ministry of Public Security for the first time.

4.2. The Director of the Motor Vehicle Inspection Center under the Highway and Railway Traffic Police Corps shall sign the Vehicle Inspection Book, Inspection Certificate, Inspection Sticker, and related documents when inspecting subsequent periods for vehicles of agencies subordinate to the Ministry of Public Security for the first time.

4.3. The Head of the Traffic Police Department or the Director of the Motor Vehicle Inspection Center under the provincial or municipal public security organs shall sign the Vehicle Inspection Book, Inspection Certificate, Inspection Sticker, and related documents concerning the inspection work of motor vehicles of public security units within their jurisdiction as assigned by the Provincial Public Security Chief.

III. IMPLEMENTATION

1. This Circular takes effect from July 1, 2009, and replaces the relevant provisions on the inspection of police motor vehicles in Chapter II "Regulations on the registration, issuance of license plates for special-purpose motorcycles, and periodic safety and environmental inspections of automobiles and special-purpose motorcycles" issued together with Decision No. 18/2002/QĐ-BCA(C11) dated January 7, 2002, of the Minister of Public Security.

2. The Director of the General Administration of Police shall direct, guide, and supervise the implementation of this Circular.

3. The Heads of the Highway and Railway Traffic Police Corps and the Directors of provincial and municipal public security organs shall guide, supervise, and urge the strict implementation of the provisions of this Circular and other relevant laws pertaining to vehicle inspection work.

4. The Directors of the General Administrations, Deputy Ministers, and Directors of the Ministries and Departments directly under the Minister of Public Security, and the Directors of provincial and municipal public security organs shall instruct the units entrusted with the management and use of vehicles to comply with the regulations on the inspection of police motor vehicles stipulated in this Circular./.
