CIRCULAR
Regulations on the Conditions for Operation of Sports Facilities Organizing Fitness and Bodybuilding Activities

Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006;
“1. Position
Article 1. Other types of artistic performances
Pursuant to Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environmental activities;
The Ministry of Culture, Sports and Tourism hereby stipulates the professional conditions for operation of sports facilities organizing fitness and bodybuilding activities as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
These Circulars detail the professional conditions regarding infrastructure, equipment, and specialized staff of sports facilities organizing fitness and bodybuilding activities.
Article 2. Applicability
These Circulars apply to organizations and individuals organizing fitness and bodybuilding activities in Vietnam.
Article 3. Issuance of Certificate of Compliance with Operating Conditions
1. A sports facility organizing fitness and bodybuilding activities must be a business entity that has been issued a certificate of compliance with operating conditions according to the procedures prescribed in Article 55 of the Law on Physical Education and Sports when conducting operations.
2. When organizing training and competition activities in fitness and bodybuilding, a sports facility must ensure the conditions stipulated in Article 43 of the Law on Physical Education and Sports and the competition regulations.
Chapter II
SPECIFIC PROVISIONS
Article 4. Conditions Regarding Infrastructure and Equipment
1. The location for fitness and bodybuilding activities must meet the following requirements:
a) The training area for fitness and bodybuilding must have a roof, an area of at least 60 square meters, and a distance of at least 1 meter between each piece of exercise equipment;
b) The floor must be flat, non-slippery, and not prone to deformation;
c) There must be a lighting system with an illuminance of at least 150 lux;
d) There must be a ventilation system ensuring good air circulation;
đ) Sound levels must not exceed 90 dBA;
e) There must be a first aid cabinet, changing areas, clothing storage, sanitation facilities, and parking spaces;
g) A notice board displaying training hours, safety rules during training, prohibition of smoking and drinking alcohol;
h) Ensuring operational time, security, hygiene, environmental protection, labor safety, and fire prevention measures in accordance with regulations.
2. Training equipment must have a certification from the competent state management agency regarding measurement standards and quality, ensuring it meets the training needs of users without causing danger or adverse changes to the development of the human body. The list of equipment and tools provided at sports facilities organizing fitness and bodybuilding activities is attached as an appendix to this Circular.
Article 5. Conditions concerning specialized staff
Sports facilities organizing fitness and bodybuilding activities must have professional instructors meeting the criteria specified in Point 1 of Section I of Circular No. 05/2007/TT-UBTDTT dated July 20, 2007 of the Sports Committee guiding the implementation of certain provisions of Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding the implementation of certain articles of the Law on Physical Education and Sports.
Chapter III
IMPLEMENTATION
Article 6. Responsibilities of Management Authorities
1. The General Department of Physical Education and Sports shall be responsible for guiding and inspecting the implementation of this Circular.
2. Provincial Departments of Culture, Sports and Tourism under the central government are responsible for implementing these Circulars; inspecting and handling organizations and individuals organizing fitness and bodybuilding activities that violate the professional operating conditions within their jurisdiction.
Article 7. Effective Date
This Circular takes effect forty-five days from the date of signature.
During implementation, if any issues arise, organizations and individuals are advised to promptly report them to the Ministry of Culture, Sports and Tourism for timely resolution./.
