Regulations on the conditions for operating fitness beauty sports facilities

Pursuant to the Law on Physical Education and Sports No. 77/2006/QH11 dated November 29, 2006;

Pursuant to Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Physical Culture and Sports;

Pursuant to Decree No. 185/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

Pursuant to Decree No. 69/2008/NĐ-CP dated May 30, 2008 of the Government on policies encouraging socialization in education, vocational training, healthcare, culture, sports, and environmental activities;

The Ministry of Culture, Sports and Tourism hereby provides detailed regulations on the conditions for operating fitness beauty sports facilities as follows:

Article 1. Scope of Regulation

This Circular specifies the professional conditions regarding infrastructure, equipment, and specialized staff of fitness beauty sports facilities.

Article 2. Applicability

This Circular applies to organizations and individuals organizing fitness beauty activities in Vietnam.

Article 3. Issuance of Certificate of Compliance with Operating Conditions

1. A fitness beauty sports facility that conducts business operations must obtain a certificate of eligibility for business operations according to the procedures stipulated in Clause 5, Article 55 of the Law on Physical Education and Sports.

2. When organizing training and competition activities in aesthetic gymnastics, a sports facility must ensure the infrastructure and equipment standards for training and competition as prescribed in Article 43 of the Law on Physical Education and Sports.

Article 4. Conditions Regarding Infrastructure

1. Size:

a) Training floor area of at least 60 square meters;

b) Distance from the training floor to the ceiling of at least three meters;

c) The training floor must be flat and covered with soft mats or padding.

2. Conditions concerning space, sound, and lighting:

a) Ensuring ventilation and comfortable space;

b) Having a sound system ensuring quality; sound intensity during operation shall not exceed 120 dBA;

c) Ensuring illumination of at least 150 Lux.

3. The training density on the floor must be at least two square meters per person.

4. Ensuring security, hygiene, environment, labor safety, fire prevention, and explosion prevention in accordance with the provisions of the law.

3. There must be equipment serving the arbitration team of the competition including: walkie-talkies, flags, whistles, clocks, time boards, loudspeakers, starting tapes, finishing tapes, safety testing equipment, measuring tools for the size and weight of competition vehicles.

1. There must be a restroom, locker room, and first aid cabinet for those participating in training.

2. Seating and mirrors must be arranged appropriately in accordance with the scale and location of the training.

3. There must be a notice board specifying training hours, safety measures during training, and other relevant rules.

4. It is encouraged to provide supplementary equipment such as treadmills, weights, platforms, and sticks to assist participants.

Article 6. Conditions Regarding Specialized Staff

1. A fitness beauty sports facility must have a trainer with expertise in aesthetic gymnastics meeting one of the criteria specified in Point 1, Section I of Circular No. 05/2007/TT-UBTDTT dated July 20, 2007 of the Sports Committee guiding the implementation of certain provisions of Decree No. 112/2007/NĐ-CP dated June 26, 2007 of the Government detailing and guiding the implementation of certain articles of the Law on Physical Education and Sports.

2. Each specialized trainer shall not guide more than thirty people in one hour of training.

Article 7. Implementation Organization

1. The General Department of Physical Education and Sports shall be responsible for guiding and inspecting the implementation of this Circular.

2. The Cultural, Sports and Tourism Inspectorate shall conduct inspections and handle violations of professional conditions when organizing fitness beauty activities within their authority.

3. Departments of Culture, Sports and Tourism of provinces and centrally-administered cities are responsible for implementing this Circular.

Article 8. Effective Date

This Circular takes effect from January 1, 2012.

During implementation, if any issues arise, organizations and individuals are advised to promptly report them to the Ministry of Culture, Sports and Tourism for timely resolution./.
