CIRCULAR

Regulations on organizing cultural and artistic activities for students in vocational training institutionsstudentin vocational training institutions 

Pursuant to the Vocational Training Law dated November 29, 2006;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

Pursuant to Decree No. 70/2009/NĐ-CP dated August 21, 2009 of the Government stipulating the responsibilities for state management of vocational training;

At the proposal of the Director General of the Vocational Training Administration;

The Minister of Labor - War Invalids and Social Affairs issues this Circular regulating the organization of cultural and artistic activities for students in vocational training institutions.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the organization of cultural and artistic activities for students in vocational training institutions.

2. This Circular applies to organizations and individuals participating in cultural and artistic activities for students in vocational training institutions.

Article 2. Objectives of organizing cultural and artistic activities

1. Contributing to nurturing personality, political and ideological education, lifestyle, and comprehensive aesthetic development for students.

2. Building a healthy cultural environment in vocational training institutions.

3. Enhancing the spiritual cultural life of students.

4. Contributing to preventing social evils from infiltrating educational institutions.

Article 3. Principles of organizing cultural and artistic activities

1. In accordance with the Party's guidelines, state policies and laws, suitable to the specific conditions of vocational training institutions, ministries, sectors, and localities, avoiding waste and formalism; ensuring the basic functions of culture are fulfilled.

2. Suitable to the age group of students while ensuring harmony within the overall cultural and artistic activities of vocational training institutions.

3. Implementing the policy of socializing the organization of cultural and artistic activities for students.

Chapter II

REGULATIONS ON ORGANIZING CULTURAL AND ARTISTIC ACTIVITIES FOR STUDENTS IN VOCATIONAL TRAINING INSTITUTIONSFOR STUDENTS AND STUDENTS IN VOCATIONAL TRAINING INSTITUTIONS

Article 4. Content of cultural and artistic activities

1. The Party's viewpoints and guidelines, state policies and laws.

2. Patriotism traditions, revolutionary traditions, and national cultural traditions combined with the finest elements of world culture; educating moral principles, sense of responsibility, civic duties, ethics, lifestyle, and aesthetics for students.

3. Praising the homeland, country, and Vietnamese people; praising and highlighting exemplary models, positive factors, and outstanding students and skilled workers contributing positively to the country's industrialization and modernization.

4. Criticizing negative phenomena, preventing, and combating social evils among students.

Article 5. Forms of organizing cultural and artistic activities

Cultural and artistic activities for students are expressed through several forms as follows:

1. Organizing students to study history and national culture through library systems, reading rooms; through books, newspapers, magazines, historical sites, and mass media.

2. Organizing students to listen to current affairs, political, cultural, and social reports, political and ideological activities; organizing contests to understand various fields of culture and society.

3. Organizing artistic performances for students; organizing student clubs to participate in literary, musical, painting, theater, film, and other artistic activities; organizing cultural and artistic exchanges with students in the national education system and other agencies and units.

4. Organizing cultural and artistic competitions or festivals at different scales and levels (hereinafter referred to as Competitions).

Article 6. Competitions

1. The grassroots level competition is organized annually by vocational training institutions to build and maintain cultural and artistic movements within such institutions; to select teams to participate in provincial-level competitions.

2. Provincial-level competitions (hereinafter referred to collectively as provincial-level competitions) are organized every two years by the Department of Labor, Invalids and Social Affairs for students and trainees from vocational training institutions located within the province to choose individuals and groups of students and trainees from vocational training institutions to participate in national-level competitions.

3. National-level competitions are organized every three years by the General Department of Vocational Training. Individuals and groups that have participated in provincial-level competitions held between two national-level competition periods and achieved high results (First, Second, Third Prizes and Encouragement Awards) are eligible to participate in national-level competitions.

4. Competitions not organized according to regular schedules as stipulated in Clauses 1, 2, and 3 of this Article shall be initiated and organized by the management authorities of vocational training institutions at all levels or political organizations, political-social organizations, social organizations, and occupational social organizations for students and trainees in vocational training institutions to implement political tasks at a specific time.

Article 7. Requirements for Organizing Competitions

1. Ensure that the competition is a healthy cultural and artistic activity in accordance with the customs and traditions of the nation.

2. Ceremonies must be conducted in accordance with the scale of the competition and ensure economy, preventing waste.

3. Ensure necessary material conditions and equipment according to the professional requirements of the competition.

4. Ensure security, safety, fire prevention, and environmental hygiene during the organization of the competition.

5. Ensure fairness, accuracy, and objectivity in directing and managing.

Article 8. Preparing Competitions

1. Establish an organizing committee and a judging council to manage and carry out the competition's tasks; the organizing committee decides on the establishment of sub-committees (teams) to assist in the competition.

2. Develop a competition plan including: objectives, contents of tasks to be performed, procedures for implementation (preparation work to ensure conditions such as facilities, personnel, awards, funds, and other necessary conditions, opening and closing ceremonies, other activities of the competition), and organizational implementation.

3. Issue the Competition Regulations.

4. Mobilize sponsorship (if necessary).

5. Other necessary tasks.

Article 9. Building and Issuing the Competition Regulations

1. The organizing committee builds and issues the Competition Regulations.

2. The basic content of the Competition Regulations includes:

a) Name of the competition;

b) Objectives and requirements;

c) Time and location of the competition;

d) Content of the competition;

đ) Participants and conditions for participation in the competition; registration procedures (application form and registration period);

e) Regulations on competition attire and format;

g) Regulations on scoring and ranking;

h) Regulations on awards;

i) Regulations on commendation, discipline, and complaint resolution;

k) Budget;

l) Other regulations (if any);

m) Implementation clauses.

3. Based on the scale of the grassroots-level competition, the head of the organizing committee decides to seek opinions from competent state management agencies on culture and art before issuing the Competition Regulations.

4. The provincial-level Competition Regulations must seek the opinions of provincial-level state management agencies on culture and art before issuance; the national-level Competition Regulations must seek the opinions of the Ministry of Culture, Sports and Tourism before issuance.

5. Provincial-level and national-level Competition Regulations must be issued at least one month before the opening ceremony of the competition; grassroots-level and other Competition Regulations must be issued at least twenty days before the opening ceremony of the competition. Competition Regulations are publicly announced.

6. Other Competitions: Based on the scale and level of the competition, the head of the organizing committee decides to seek opinions from state management agencies on culture and art according to their jurisdiction before issuing the Competition Regulations.

Article 10. Opening and Closing of the Competition

1. The opening and closing ceremonies shall be organized solemnly; decorations for the opening and closing ceremonies may include the national flag and banners, slogans with content appropriate to the Competition, the logo of the Competition, and the names of the organizing units and sponsoring units (if any).

2. Content of the opening ceremony of the Competition:

a) The ceremonial part, directed by the Organizing Committee, includes: Flag-raising (national anthem singing); declaration of purpose, introduction of representatives, opening speech, announcement of the program and activities of the Competition, presentation of commemorative flags and flowers to the delegations (if any);

b) The welcoming activities depend on the conditions of the organizing unit to carry out other activities.

3. Content of the closing ceremony of the Competition includes the final summary work, awards for collectives and individuals ensuring honor, practicality, effectiveness, and suitability with the nature and scale of the Competition.

Article 11. Budget for Cultural and Artistic Activities

1. The budget for organizing cultural and artistic activities for students and trainees is ensured by the following sources:

a) State budget; National-level cultural and artistic activities for students and trainees are funded by the Ministry of Labor, Invalids, and Social Affairs according to the approved budget estimate;

b) Self-generated funds of vocational training institutions;

c) Sponsorship and support from organizations and individuals both domestically and internationally as prescribed by law;

d) Other legitimate revenue sources of vocational training institutions.

2. Management and use of the budget for organizing cultural and artistic activities for students and trainees shall be carried out in accordance with current financial regulations.

Chapter III

REGULATIONS ON REPORTING, REWARDING AND HANDLING VIOLATIONS

Article 12. Reporting System on Organizing Cultural and Artistic Activities

1. Annually, vocational training institutions report on the organization of cultural and artistic activities for students and trainees at their units to the Department of Labor, Invalids, and Social Affairs and the competent management agencies of the vocational training institutions before November 15.

2. The Department of Labor, Invalids, and Social Affairs compiles and evaluates the implementation situation of vocational training institutions in its jurisdiction, reports to the People's Committee of the province and the Ministry of Labor, Invalids, and Social Affairs before November 30.

3. In addition to the regular reports mentioned above, the Department of Labor, Invalids, and Social Affairs and vocational training institutions have the responsibility to report promptly on the organization of cultural and artistic activities for students and trainees to serve management according to the requirements of leaders with authority.

4. The content, format, and form of reporting on organizing cultural and artistic activities follow the guidelines of the Vocational Training General Administration.

Article 13. Rewards and handling of violations

1. Based on the results of participating in cultural and artistic activities for students and trainees, the heads of vocational training institutions and the heads of management agencies within their authority shall promptly reward collectives and individuals with outstanding achievements in Competitions or those who effectively contribute to participating in and organizing cultural and artistic activities for students and trainees.

2. The head of the vocational training institution decides on granting bonus points in evaluating the training outcomes of students and trainees who win prizes at Competitions.

3. Organizations and individuals who violate regulations will be disciplined according to current provisions depending on the severity of the violation.

Chapter IV

IMPLEMENTING PROVISIONS

Article 14. Responsibilities of the Vocational Training General Administration

1. Inspect the organization of cultural and artistic activities for students and trainees.

2. Draft and submit to the Minister of Labor, Invalids, and Social Affairs for approval the plan to organize the national-level Competition.

3. Take the lead and coordinate with relevant ministries, sectors, provincial People's Committees, and municipal People's Committees under the central government where the national-level Competition is held to implement the approved Competition Plan.

4. Establish the Organizing Committee and the Competition Judging Board for the national-level Competition.

5. Organize fundraising and mobilize other legitimate financial resources to organize the national-level Competition.

6. Annually, develop plans and organize training courses to update knowledge on culture, art, and management skills for organizing cultural and artistic activities for staff working with students and trainees, youth league cadres, and specialized teachers and lecturers in culture and art in vocational training institutions.

Article 15. Responsibilities of the Department of Labor, Invalids and Social Affairs

1. Advise the People's Committee of the province or centrally governed city on directing, guiding, urging, and inspecting the implementation of cultural and artistic activities at vocational training institutions within their jurisdiction; regularly organize mid-term and final reviews of cultural and artistic activities.

2. Advise the People's Committee of the province or centrally governed city to allocate funds for organizing provincial-level competitions, and encourage units and individuals to participate in national-level competitions.

3. Proactively coordinate with the Department of Culture, Sports and Tourism and related units and organizations at the local level in implementing this Circular.

4. Draft and submit to the Chairman of the People's Committee of the province or centrally governed city for approval the plan to organize provincial-level competitions.

5. Establish the Organizing Board and the Competition Judging Panel for provincial-level competitions.

6. Take the lead and coordinate with relevant departments, agencies, and units to implement the approved provincial-level competition plan.

7. Establish and organize teams to participate in national-level competitions.

8. Perform other tasks as required.

Article 16. Responsibilities of Vocational Training Institutions

1. Annually develop plans to organize cultural and artistic activities for students and school-level competitions that are appropriate, practical, and effective; allocate reasonable funds to organize such activities for students; conduct self-inspection and evaluation of the implementation results.

2. Closely cooperate with local cultural management agencies, associations, and mass organizations within the vocational training institution to mobilize and encourage students to actively participate in cultural and artistic activities.

3. Create favorable conditions for students to participate in cultural and artistic activities and competitions at various levels.

4. Establish and organize teams to participate in provincial-level and national-level competitions.

5. Enhance material and equipment infrastructure to support cultural and artistic activities within the institution.

6. Perform other tasks as required.

7. Approve annual plans for organizing cultural and artistic activities for students at the vocational training institution.

8. Approve plans for organizing school-level competitions.

9. Decide on the establishment of the Organizing Board and the Competition Judging Panel for school-level competitions.

10. Be responsible for organizing cultural and artistic activities for students within the institution.

Article 17. Staff Members Involved in Student Affairs, Youth Union Cadres, Full-Time Lecturers and Teachers Specialized in Cultural and Artistic Activities

Propose and directly participate in organizing cultural and artistic activities for students; propose and organize the selection and training of students to participate in provincial-level and national-level competitions.

Article 18. Effective Date

1. This Circular takes effect from October 12, 2013.

2. During its implementation, if there are any difficulties, they should be promptly reported to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
