REGULATIONS ON THE ESTABLISHMENT AND ORGANIZATION AND OPERATIONS OF THE ANIMAL DISEASE CONTROL DIRECTORATES AT ALL LEVELS

Pursuant to the Law on Government Organization on June 19, 2015;

Pursuant to the Law on Veterinary Medicine dated June 19, 2015;

At the request of the Minister of Agriculture and Rural Development,

The Prime Minister issues this Decision to regulate the establishment and organization and operations of the Animal Disease Control Directorates at all levels.

Article 1. Scope and Objects Regulated

This Decision regulates the establishment and organization and operations of the Animal Disease Control Directorates at all levels, including:

1. The National Steering Committee for Animal Disease Prevention and Control at the central level (hereinafter referred to collectively as the National Steering Committee).

2. The Animal Disease Control Directorate at the local level (hereinafter referred to collectively as the Local Steering Committees at various levels).

Article 2. Establishment of the Animal Disease Control Directorates at all levels

1. When animal diseases are announced according to Articles 26 or 34 of the Law on Animal Health, the Prime Minister or the Chairpersons of People's Committees at all levels shall be responsible for establishing and organizing and operating the Animal Disease Control Directorates at all levels.
2. The Animal Disease Control Directorates at all levels shall dissolve themselves upon completion of their tasks.

Article 3. Composition of the Animal Disease Control Directorates at all levels

1. The composition of the National Steering Committee includes:

a) The Minister of Agriculture and Rural Development is the Chairman.

b) The Deputy Ministers of Agriculture and Rural Development and the Deputy Minister of Health are the Vice Chairmen.

c) Members include:

- Representatives from the leadership of the following Ministries: Science and Technology, Industry and Trade, Public Security, Foreign Affairs, Finance, Planning and Investment, Information and Communications, Transport, Natural Resources and Environment, Defense;

- Representatives from the leadership of the Office of the Government, Vietnam Television, Voice of Vietnam Radio;

- Representatives from the leadership of: the Central Committee of the Vietnam Fatherland Front, the Central Vietnam Farmers' Union, and the Central Vietnam Red Cross Society.

d) The Department of Animal Health is the permanent office of the National Steering Committee for Animal Disease Prevention and Control.

2. The composition of the Animal Disease Control Directorate at the provincial level includes:

a) A representative from the leadership of the Provincial People's Committee is the Chairman.

b) The Director of the Department of Agriculture and Rural Development and the Director of the Department of Health are the Vice Chairmen.

c) Members:

- Representatives from the leadership of the Departments of Science and Technology, Industry and Trade, Public Security, Finance, Planning and Investment, Information and Communications, Transport, Natural Resources and Environment, and other relevant agencies of the locality;

- The Provincial Border Guard Command (for provinces with borders);

- Representatives from the leadership of: the Provincial Vietnam Fatherland Front Committee, the Provincial Farmers' Union, and the Provincial Red Cross.

d) The provincial specialized animal health management agency is the permanent office of the Provincial Animal Disease Control Directorate.

3. The composition of the Animal Disease Control Directorate at the district level includes:

a) A representative from the leadership of the District People's Committee is the Chairman.

b) The Heads of the District Departments of Agriculture and Rural Development and Health are the Vice Chairmen.

- Representatives from the leadership of the State Management Agencies: Public Security, Market Management, Finance, Planning, Culture, Information, Natural Resources and Environment, Border Guard (for border areas).

- Representatives from the leadership of the Departments of Science and Technology, Industry and Trade, Public Security, Finance, Planning and Investment, Information and Communications, Transport, Natural Resources and Environment, and other relevant agencies of the locality;

- Representatives from the leadership of: the District Vietnam Fatherland Front Committee, the District Farmers' Union, and the District Red Cross.

d) The district specialized animal health management agency is the permanent office of the District Animal Disease Control Directorate.

4. The composition of the Animal Disease Control Directorate at the commune level includes:

a) The Chairman of the Commune People's Committee is the Chairman.

b) The Deputy Chairman of the Commune People's Committee is the Vice Chairman.

c) Members: Head of Public Security; Military Service Commander; Land Administration - Construction - Urban Environment (for communes, towns, and wards) or Land Administration - Agriculture - Construction - Environment (for communes); head of the commune health station, ward health station, and veterinary officer of the commune;

d) Representatives of local political-social organizations.

5. Based on specific circumstances of animal diseases, the Prime Minister,

Chairpersons of People's Committees at all levels shall decide on the composition of the Steering Committee as appropriate.

Article 4. Tasks and Authorities of the Steering Committee for Animal Disease Prevention and Control at All Levels

1. The National Steering Committee has the following tasks and authorities:

a) Assist the Prime Minister in directing, coordinating, and coordinating among ministries, ministerial-level agencies, government agencies, and related agencies in resolving important issues in urgent animal disease prevention and control nationwide.

b) Assist the Prime Minister in coordinating among ministries, ministerial-level agencies, government agencies with Party agencies, the Vietnam Fatherland Front, and people's mass organizations to mobilize resources to participate and support the implementation of urgent plans for animal disease prevention and control.

c) Organize the implementation and supervise inspections of ministries, sectors, and localities in implementing urgent plans for animal disease prevention and control.

d) Perform other tasks assigned by the Prime Minister.

2. The Steering Committee for Animal Disease Prevention and Control at the local level has the following tasks and authorities:

a) Assist the Chairman of the People's Committee in directing, coordinating, and coordinating among relevant agencies in implementing measures for urgent animal disease prevention and control within their jurisdiction.

b) Assist the Chairman of the People's Committee in building and organizing the implementation of urgent plans for animal disease prevention and control; inspect, urge, and monitor the implementation of measures for urgent animal disease prevention and control within their jurisdiction.

c) Assist the Chairman of the People's Committee in coordinating among departments and sectors with Party agencies, the Vietnam Fatherland Front, and people's mass organizations to mobilize resources to participate and support the implementation of urgent plans for animal disease prevention and control.

d) Perform other tasks assigned by the Chairman of the People's Committee.

Article 5. Operating Budget of the Steering Committee for Animal Disease Prevention and Control at All Levels

The operating budget of the Steering Committee for Animal Disease Prevention and Control at all levels is guaranteed by the state budget and allocated within the regular operating budget of the specialized veterinary management agency responsible for the permanent duties of the Steering Committee, support funds, and other lawful sources as prescribed by law.

Article 6. Working System

1. The Steering Committee for Animal Disease Prevention and Control at all levels operates under a collective system.

2. Members of the Steering Committee for Animal Disease Prevention and Control at all levels work on a part-time basis, are responsible before the law and the Chairperson.

3. The Chairperson and Deputy Chairpersons may use the seal of their working agency.

4. The permanent office of the Steering Committee, members of the Steering Committee for Animal Disease Prevention and Control at all levels may use their own organizational structure and seals to perform tasks as assigned by the Chairperson.

5. The Chairperson stipulates the working system and specific tasks of members.

Article 7. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from July 1, 2016.

2. Decision No. 13/2004/QĐ-TTg dated January 28, 2004 of the Prime Minister on the establishment of the National Steering Committee for Avian Influenza Prevention and Control ceases to be effective from the date this Decision takes effect.

3. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial and centrally-administered city People's Committees, Heads of related agencies and organizations are responsible for implementing this Decision./.
