Circular No. 16/2016/TT-BCT stipulates the application of tariff quotas for the importation of tobacco leaves and poultry eggs originating from member countries of the Eurasian Economic Union in 2016.

CIRCULAR

REGULATIONS ON THE APPLICATION OF QUOTA DUTY IMPORT LICENSES FOR TOBACCO LEAF AND POULTRY EGGS FROM MEMBER COUNTRIES OF THE EUROASIAN ECONOMIC UNION IN 2017, 2018 AND 2019

Pursuant to Decree No. 95/2012/NĐ-CP dated November 12, 2012, of the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government Decree number Decision No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Commercial Law on international trade activities and related agency buying, selling, processing, and transiting goods with foreign countries;

Implementing Free Trade Agreement Vietnam - Eurasian Economic Union, officially signed on February9 the 5 Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government on assigning tasks, procurement or tendering for the supply of products and services using state budget from regular operating expenses;15, 2015 in the Republic of Kazakhstan and was approved by the President of the Socialist Republic of Vietnam through Decision No. 1805/QĐ-CTN dated August 19, 2015;

At the proposal of the Director of the Import-Export Department,

The Minister of Industry and Trade issues this Circular to stipulatethe application of tariff quotas for the importation of tobacco leaves and poultry eggs originating from member countries of the Eurasian Economic Union in 2016.

Article 1. Scope of Regulation

1. Apply tariff quotas for the importation of two categories of goods originating from member countries of the Eurasian Economic Union: tobacco leaves, poultry eggs.

2. The commodity codes and total quantities of tariff quotas for 2016 for the categories of goods subject to tariff quotas as specified in Clause 1 of this Article are set forth in the Appendix attached to this Circular.

Article 2. Applicability

1. Tobacco leaves: Enterprises holding a production license for cigarettes issued by the Ministry of Industry and Trade and having a need to use a certain proportion of imported tobacco leaves for cigarette production shall be confirmed by the Ministry of Industry and Trade.

2. Poultry eggs: Enterprises holding a Business Registration Certificate/Business Operation Registration Certificate/Investment Registration Certificate and having a need to import poultry eggs.

3. Individuals and organizations involved in the importation of tobacco leaves and poultry eggs under tariff quotas from member countries of the Eurasian Economic Union in 2016.

Article 3. Principles for applying import duty rates within tariff quotas

Imported goods must have a Certificate of Origin issued by the competent authority of the member countries of the Eurasian Economic Union (abbreviated as C/O Form EAV).

Specifically, for tobacco leaves, Vietnamese enterprises holding an import license for tobacco leaves under tariff quotas issued by the Ministry of Industry and Trade according to Circular No. 04/2014/TT-BCT dated January 27, 2014 of the Ministry of Industry and Trade detailing certain provisions of Decision No. 187/2013/NĐ-CP dated November 20, 2013 of the Government detailing the implementation of the Commercial Law on international trade activities and related agency buying, selling, processing, and transiting goods with foreign countries are only permitted to import (directly or through entrusted imports). The quantity imported shall be deducted from the tariff quota for imports as specified in the license issued by the Ministry of Industry and Trade.

This Circular takes effect from January 18, 2017 to December 31, 2017./.

The import procedures for tobacco leaves and poultry eggs shall be handled at the customs office where the import procedures are carried out, following the principle of automatic backward deduction until the end of the quantity of the tariff quota for each item as specified in the Appendix attached to this Circular.

Article 5. Provisions on import duty rates

The import duty rates within tariff quotas and outside tariff quotas for imported tobacco leaves and poultry eggs from member countries of the Eurasian Economic Union shall be implemented in accordance with the regulations of the Government.

Article 6. Effectiveness

This Circular takes effect from October 5, 2016 to December 31, 2016./.
