At the proposal of the Minister of Transport;
The Prime Minister issues this Decision to regulate the implementation schedule for emission standards for motor vehicles participating in traffic and used motor vehicles imported.
This Decision regulates the implementation schedule for emission standards for motor vehicles participating in traffic and used motor vehicles imported.
Article 1. Scope of Regulation
1. This Decision applies to organizations and individuals using, managing, inspecting, and testing motor vehicles participating in traffic and used motor vehicles imported.
Article 2. Applicability
2. This Decision does not apply to military and police motor vehicles serving national defense and security purposes.
The emission standard levels (Level 1, Level 2, Level 3, Level 4) are the maximum allowable limits for pollutants and smoke in the exhaust emissions of motor vehicles as specified in TCVN 6438:2018 "Road Transport Vehicles - Maximum Allowable Limits for Exhaust Emissions."
Article 3. Explanation of Terms
Article 4. Implementation Schedule for Emission Standards for Motor Vehicles Participating in Traffic
1. Motor vehicles with forced combustion engines and compression ignition engines participating in traffic produced before 1999 continue to apply Level 1.
2. Motor vehicles with forced combustion engines and compression ignition engines participating in traffic produced from 1999 to 2008 apply Level 2 from January 1, 2021.
3. Motor vehicles with forced combustion engines and compression ignition engines participating in traffic produced after 2008 apply Level 2 from January 1, 2020.
Article 5. Implementation Schedule for Emission Standards for Used Motor Vehicles Imported
2. In cases where used motor vehicles have their customs declaration opened according to the Customs Law or have arrived at Vietnamese ports or border gates before the date this Decision takes effect, they may continue to apply the provisions set forth in Decision No. 249/2005/QĐ-TTg dated October 10, 2005 of the Prime Minister regarding the implementation schedule for emission standards for road transport vehicles.
Article 6. Implementation
1. Ministry of Transport
a) Based on actual conditions, continue to study and develop regulations to enhance emission standards for motor vehicles participating in traffic and used motor vehicles imported, and submit them for approval.
b) Organize and mobilize resources to research and test the application of exhaust gas treatment technology to establish mechanisms and policies, improve technical standards and norms, and enhance the effectiveness of managing pollutant emissions from motor vehicles participating in traffic.
2. Ministries, agencies equivalent to ministries, and government agencies shall, based on their functions and tasks, coordinate with the Ministry of Transport and provincial People's Committees in implementing the control of exhaust emissions from motor vehicles participating in traffic and used motor vehicles imported.
1. This Decision takes effect from May 15, 2019.
Article 7. Effectiveness and Responsibility for Implementation
2. Abolish Point b Clause 1, Clause 2 Article 6; Article 7 of Decision No. 249/2005/QĐ-TTg dated October 10, 2005 of the Prime Minister regarding the implementation schedule for emission standards for road transport vehicles.
3. Ministers, heads of agencies equivalent to ministries, heads of government agencies, Chairmen of provincial People's Committees, organizations, and individuals related to this matter are responsible for enforcing this Decision./.
The ministers, heads of ministerial-level agencies, heads of government agencies, chairpersons of provincial and centrally governed city people's committees, and related organizations and individuals are responsible for implementing this Decision./.
