Bộ trưởng Bộ Khoa học và Công nghệ ban hành Thông tư quy định tặng Cờ thi đua, Bằng khen của Bộ trưởng Bộ Khoa học và Công nghệ và Kỷ niệm chương “Vì sự nghiệp khoa học và công nghệ”.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Thông tư này quy định về tặng Cờ thi đua, Bằng khen của Bộ trưởng Bộ Khoa học và Công nghệ và Kỷ niệm chương “Vì sự nghiệp khoa học và công nghệ” cho tập thể, cá nhân không thuộc Bộ Khoa học và Công nghệ.

Article 2. Applicability

Thông tư này áp dụng đối với tập thể, cá nhân người Việt Nam, người Việt Nam ở nước ngoài và tập thể, cá nhân người nước ngoài tại Việt Nam có thành tích và đóng góp trong lĩnh vực khoa học và công nghệ của Việt Nam và các cơ quan, tổ chức khác có liên quan.

Điều 3. Nguyên tắc khen thưởng

1. Khen thưởng được thực hiện theo quy định tại Điều 3 Nghị định số 91/2017/NĐ-CP ngày 31/7/2017 của Chính phủ quy định chi tiết thi hành một số điều của Luật thi đua, khen thưởng.

2. Việc khen thưởng phải bảo đảm trên cơ sở đánh giá đúng thành tích và kết quả đạt được của tập thể, cá nhân.

Điều 4. Quyền và trách nhiệm của tập thể, cá nhân được khen thưởng

Tập thể, cá nhân được khen thưởng hưởng quyền lợi và chịu trách nhiệm theo quy định tại Nghị định số 91/2017/NĐ-CP ngày 31/7/2017 của Chính phủ quy định chi tiết thi hành một số điều của Luật thi đua, khen thưởng.

Chapter II

TIÊU CHUẨN, HỒ SƠ ĐỀ NGHỊ TẶNG CỜ THI ĐUA CỦA
MINISTRY OF SCIENCE AND TECHNOLOGY

Article 5. Tiêu chuẩn

Cờ thi đua của Bộ Khoa học và Công nghệ được tặng cho Sở Khoa học và Công nghệ các tỉnh, thành phố trực thuộc Trung ương đạt tiêu chuẩn theo quy định của Điều 26 Luật thi đua, khen thưởng và đạt một trong các tiêu chuẩn sau:

1. Triển khai và hoàn thành xuất sắc công tác quản lý nhà nước về khoa học và công nghệ, có kết quả thiết thực đóng góp cho sự phát triển khoa học và công nghệ của địa phương.

2. Được bình chọn thông qua Hội nghị khoa học và công nghệ vùng.

Article 6. Hồ sơ đề nghị

Hồ sơ đề nghị tặng Cờ thi đua của Bộ Khoa học và Công nghệ gồm 01 bộ (bản chính) được gửi trực tiếp hoặc qua bưu điện về Bộ Khoa học và Công nghệ (qua Vụ Thi đua - Khen thưởng), bao gồm:

1. Văn bản đề nghị của Giám đốc Sở Khoa học và Công nghệ (đối với trường hợp đạt tiêu chuẩn quy định tại Khoản 1 Điều 5) hoặc Giám đốc Sở Khoa học và Công nghệ chủ trì Hội nghị khoa học và công nghệ vùng (đối với trường hợp đạt tiêu chuẩn quy định tại Khoản 2 Điều 5).

2. Biên bản họp Hội đồng Thi đua - Khen thưởng của Sở Khoa học và Công nghệ hoặc Biên bản họp thông qua của các Sở Khoa học và Công nghệ thành viên thuộc vùng.

3. Báo cáo thành tích của tập thể được đề nghị khen thưởng (theo Mẫu 01 ban hành kèm theo Thông tư này).

4. Văn bản của Ủy ban nhân dân tỉnh, thành phố trực thuộc Trung ương hiệp y việc tặng Cờ thi đua của Bộ Khoa học và Công nghệ cho Sở Khoa học và Công nghệ.

Chapter III

TIÊU CHUẨN, HỒ SƠ ĐỀ NGHỊ TẶNG BẰNG KHEN CỦA
BỘ TRƯỞNG BỘ KHOA HỌC VÀ CÔNG NGHỆ

Article 7. Criteria for Groups

The Minister of Science and Technology's Certificate of Merit shall be awarded to exemplary groups that conscientiously implement the Party's guidelines, State policies and laws, and meet one of the following criteria:

1. Advising and proposing effective mechanisms and policies to promote the development of science and technology at ministries, sectors, and localities;

2. Effectively implementing mechanisms, policies, and laws on science and technology management, including managing assigned scientific and technological tasks well;

3. Managing and coordinating the effective implementation of scientific and technological activities at ministries, sectors, and localities, contributing to serving management activities and socio-economic development;

4. Organizing scientific research and technological development with results or applying science and technology to achieve high economic efficiency, serving production and socio-economic development;

5. Participating and implementing activities to promote cooperation in science and technology, contributing to the development of science and technology in Vietnam;

6. Achieving outstanding results in scientific research or technological development or applying technology to achieve high economic efficiency, contributing to socio-economic development;

7. Meeting the criteria set forth in specific topics organized and implemented by the Ministry of Science and Technology;

8. Achieving remarkable achievements with significant influence in the field of science and technology.

Article 8. Criteria for Individuals

The Minister of Science and Technology's Certificate of Merit shall be awarded to exemplary individuals who conscientiously implement the Party's guidelines, State policies and laws, and meet one of the following criteria:

1. Advising and proposing the construction of effective mechanisms and policies in management and coordination in scientific and technological activities at ministries, sectors, and localities;

2. Achieving accomplishments in scientific research, training scientific and technological human resources, or applying science and technology;

3. Proposing initiatives recognized by competent authorities as having significant economic and social benefits, worthy of being exemplary models in ministries, sectors, and localities;

4. Achieving results in scientific research or technological development or applying technology to achieve high economic efficiency, contributing to production and socio-economic development;

5. Actively participating in implementing activities to promote cooperation in science and technology, contributing to the development of science and technology in Vietnam;

6. Having scientific and technological products published or applied in production and daily life, achieving economic benefits;

7. Meeting the criteria set forth in specific topics organized and implemented by the Ministry of Science and Technology;

8. Achieving remarkable accomplishments with significant influence in the field of science and technology.

Article 9. Hồ sơ đề nghị

The application dossier for the Minister of Science and Technology's Certificate of Merit includes one original copy (sent directly or via postal service to the Ministry of Science and Technology through the Department of Mobilization and Awards), specifically:

1. For outstanding achievements in the field of science and technology

a. The recommendation letter from the head of the agency accompanied by a summary list of achievements of the group or individual recommended for commendation, specifically:

- Recommendation letter from Ministries, agencies equivalent to Ministries, or government agencies regarding groups or individuals under Ministries, agencies equivalent to Ministries, or government agencies;

- Recommendation letter (or confirmation in the achievement report) from the People's Committee of provinces or centrally-administered cities regarding Science and Technology Departments and their Directors; Science and Technology Departments regarding groups or individuals under Science and Technology Departments;

- Recommendation letter from Ministries, agencies equivalent to Ministries, or government agencies or the Chairman of the People's Committee of provinces or centrally-administered cities (based on the proposal of subordinate state agencies) regarding groups or individuals not covered by the above cases.

b. Achievement report of the group or individual recommended for commendation (according to Model 02 issued together with this Circular).

2. For commendation according to special topics

a. Recommendation letter from the main organizing unit of the special topic;

b. Recommendation letter from the head of the agency or organization recommending commendation;

c. Achievement report of the group or individual recommended for commendation (according to Model 03 issued together with this Circular).

3. For commendation of sudden achievements in the field of science and technology

a. Recommendation letter from the authorized head of the agency recommending commendation;

b. Achievement report of the group or individual recommended for commendation detailing the content, level, and scope of impact of the achieved accomplishment (according to Model 04 issued together with this Circular).

Chapter IV

CRITERIA AND APPLICATION DOSSIER FOR THE AWARD OF THE MEMORIAL MEDAL "FOR THE CAUSE OF SCIENCE AND TECHNOLOGY"
The Memorial Medal "For the Cause of Science and Technology" is regularly awarded annually to each individual meeting one of the following criteria:

Article 10. Basic standard

1. The individual must have worked in the field of science and technology for at least 20 years for males and 15 years for females.

In cases where an individual has been awarded a Meritorious Title or a national-level commendation, the requirement period can be reduced by three years compared to the aforementioned regulation.

2. Special cases with significant contributions in the field of science and technology when awarding the Memorial Medal do not need to meet the time requirement stipulated in Clause 1 of this Article but must meet one of the following criteria:

a. Having been conferred one of the National Honorary Titles;

b. Having been awarded a Meritorious Title or national-level commendations;

c. Being the author/co-author of works/clusters of works awarded the Ho Chi Minh Prize for Science and Technology or the State Prize for Science and Technology;

d. Having an invention effectively applied in Vietnam;

đ. Individuals working in the field of science and technology who sacrifice while performing their duties;

e. Individuals currently working in state agencies, people's armed forces units, public institutions, political organizations, political-social organizations, and occupational associations from central to local levels who have made significant contributions to the development of science and technology.

e) Individuals currently working at state agencies, people's armed forces units, public service organizations, political organizations, political-social organizations, and social-professional organizations from central to local levels who have made special contributions to the cause of scientific and technological development;

g) Overseas Vietnamese individuals and foreign individuals who have made significant special contributions to the development of science and technology in Vietnam.

Article 11. Those not eligible for and not yet considered for awarding amended and supplemented by Law No. 87/2025/QH15; 3 ||| awarding

1. Individuals who have been disciplined at a level higher than a warning shall not be considered for the Commendation Medal.

2. Individuals currently under investigation for disciplinary action or criminal prosecution shall not be considered for the Commendation Medal.

3. Individuals who have been disciplined may only be considered for the Commendation Medal after the disciplinary period has expired. The disciplinary period shall not be counted towards consideration for the Commendation Medal.

Article 12. Application Documents

The application documents for the Commendation Medal consist of one set (original copy), which must be sent directly or via postal service to the Ministry of Science and Technology (through the Department of Mobilization and Reward), specifically:

1. A recommendation letter from the head of the agency accompanied by a list of the individuals being recommended, specifically:

a) The Minister of a ministry equivalent to a minister, a government agency, or the head of a political organization, political-social organization, or occupational social organization at the central level recommending the Minister of Science and Technology to award the Commendation Medal to individuals working in state agencies, people's armed forces units, public service organizations, political organizations, political-social organizations, and occupational social organizations at the central level;

b) The Director of the Provincial Department of Science and Technology recommending the Minister of Science and Technology to award the Commendation Medal to individuals working in state agencies, people's armed forces units, public service organizations, political-social organizations, and occupational social organizations at the local level;

c) The authority with the power stipulated in point a or b of this clause recommending the Minister of Science and Technology to award the Commendation Medal to overseas Vietnamese individuals, foreign individuals, and other individuals who have made significant special contributions to the development of science and technology in Vietnam based on the proposal of the relevant agency, unit, or organization.

2. A report on the achievements of the individual being recommended (according to Model 05 issued together with this Circular).

Chapter V

PROCEDURES AND REQUIREMENTS FOR RECOGNITION AND AWARDING

Article 13. Procedures and Requirements

1. The Department of Mobilization and Reward seeks the concurrence opinion of related agencies for cases of rewarding organizations and individuals who are foreigners; concurrence opinions from subordinate units of the Ministry of Science and Technology for cases of rewarding that involve areas under their supervision.

2. Based on the content of the reward recommendation, the concurrence opinions, and the results of the file review, the Department of Mobilization and Reward will submit to the Minister of Science and Technology for a decision to award the Flag of Excellence of the Ministry of Science and Technology and the Certificate of Merit of the Minister of Science and Technology.

Based on the results of the file review for the Commendation Medal recommendation, the Department of Mobilization and Reward will submit to the Minister of Science and Technology for a decision to award the Commendation Medal.

Article 14Notification of commendation results

The Department of Mobilization and Reward will notify the results of the award to the recommending agency or organization within seven working days from the date the Minister of Science and Technology signs the Award Decision.

Chapter VI

IMPLEMENTING PROVISIONS

Article 15. Effective date

This Circular takes effect from February 10, 2020, and replaces Circular No. 18/2015/TT-BKHCN dated October 12, 2015, of the Minister of Science and Technology on competition and rewards in the field of science and technology.

Article 16. Responsibility for Implementation

The Head of the Department of Mobilization and Reward, heads of related agencies and units are responsible for implementing this Circular. During implementation, if there are any difficulties, agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Science and Technology for examination and resolution./.
