Hai Thuong Lan Ong Award for Traditional Medicine Work

Pursuant to the Law on Competition and Reward dated November 26, 2003; the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward dated June 14, 2005; the Law Amending and Supplementing Certain Articles of the Law on Competition and Reward dated November 16, 2013;

Pursuant to the Government Decree No. 91/2017/NĐ-CP dated July 31, 2017 detailing the implementation of certain articles of the Law on Competition and Reward;

Pursuant to the Government Decree No. 75/2017/NĐ-CP dated June 20, 2017 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

At the proposal of the Director of the Department of Traditional Medicine Management,

The Minister of Health issues this Circular on issuing standards and guidelines for awarding the Hai Thuong Lan Ong Award for Traditional Medicine Work.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the criteria, files, procedures, and funding for the awarding of the Hai Thuong Lan Ong Award for the work of inheriting, preserving, developing traditional medicine, and combining traditional medicine with modern medicine (hereinafter referred to as the Hai Thuong Lan Ong Award).

Article 2. Applicability

This Circular applies to individuals within Vietnam and foreigners working in Vietnam who have made significant contributions to traditional medicine activities, combining traditional medicine with modern medicine; related individuals and organizations.

1. The Hai Thuong Lan Ong Award shall be awarded once to eligible subjects according to the provisions of this Circular, and posthumous awards will not be considered.

2. The awarding of the Hai Thuong Lan Ong Award must ensure the following principles:

a) Accurate target, criteria, procedures, and steps as prescribed in this Circular;

b) Accuracy, transparency, democracy, secret ballot, and majority decision;

c) Gender equality in the awarding process;

d) Priority given to individuals directly involved in labor and those with many innovations in their work, achievements obtained under difficult conditions, and wide-ranging impact.

3. Individuals currently undergoing disciplinary action from a warning or higher level; penalized administratively for professional or technical violations within two years from the date of nomination for the award or violating medical ethics; or being pursued for criminal responsibility shall not be nominated for the Hai Thuong Lan Ong Award.

4. If an individual nominated for the award participates in multiple fields of work, they shall be prioritized based on meeting specific criteria in a particular field of work.

The Hai Thuong Lan Ong Award is awarded every two years, in even-numbered years, and announced on the anniversary of the death of Great Doctor Hai Thuong Lan Ong Le Huu Trac (the full moon of the first lunar month).

Article 5. Authority to Award

The Minister of Health has the authority to award the Hai Thuong Lan Ong Award based on the recommendation of the Ministry of Health's Award Review Board.

Individuals receiving the Hai Thuong Lan Ong Award shall be granted:

1. A certificate of the Hai Thuong Lan Ong Award issued by the Minister of Health (Annex 01 - Form No. 01);

2. An emblem of the Hai Thuong Lan Ong Award (Annex 02 - Form No. 01);

3. Their name recorded in the Golden Book of the Hai Thuong Lan Ong Award managed by the Ministry of Health;

4. Money or tangible items (if any).

Chapter II

CRITERIA FOR AWARDING THE AWARD

Article 7. General Criteria

2. Being introduced to participate in the award selection process by an agency, organization, political organization, political-social organization, or occupational social organization.

1. For individuals working in the field of traditional medicine in regions B, C, and K; in the defense of the southwestern border, the northern border war, and volunteer troops of Vietnam in Laos and Cambodia, each year of work counts as one year and six months.

2. For individuals working in the field of traditional medicine in remote, mountainous, extremely difficult, border, and island areas, each year of work counts as one year and two months.

3. In cases where individuals change positions or have interrupted periods of work in different regions, their working times will be accumulated to meet the criteria for the award.

4. Individuals who are sent by agencies for study and upgrading their qualifications will still be counted towards their working time to meet the criteria for the award.

Article 9. Specific Criteria

1. For individuals working in healthcare facilities

a) Meeting the general criteria stipulated in Article 7 of this Circular;

- Summarizing at least one prescription or treatment method or technical innovation in the field of herbal medicine and traditional medicine that has been applied in provincial traditional medicine hospitals and recognized by the Department of Health or the Department of Science and Technology;

- Leading at least one research project, program, or project in the field of traditional medicine or combined traditional and modern medicine at the facility level or participating in at least one such project at the ministry, provincial, or municipal level which has been accepted.

2. For individuals engaged in scientific research

a) Meeting the general criteria stipulated in Article 7 of this Circular;

3. For individuals involved in training

a) Meeting the general criteria stipulated in Article 7 of this Circular;

- Leading or participating in the compilation of at least one textbook on traditional medicine or leading at least one reference book in the field of traditional medicine or participating in the compilation of at least two reference books in the field of traditional medicine; or having at least two innovative teaching methods recognized by the school's Scientific and Technological Council and implemented in teaching;

- Leading at least one research project, program, or project in the field of traditional medicine or combined traditional and modern medicine at the facility level; or two scientific and technological innovations in the field of traditional medicine; or participating in a research project, program, or project in the field of traditional medicine at the ministry, provincial, or municipal level or equivalent which has been accepted.

4. For individuals working in units cultivating, harvesting, processing, producing, and trading medicinal herbs, herbal medicines, and traditional medicines

a) Meeting the general criteria stipulated in Article 7 of this Circular;

- Proposing at least one useful solution in the production and processing of traditional medicines and herbal medicines recognized by the Department of Health or the Department of Science and Technology;

- Establishing at least three production processes for traditional medicines and herbal medicines;

- Leading at least one research project, program, or project in the field of cultivation, harvesting, processing, production, and trade of medicinal herbs, herbal medicines, and traditional medicines at the facility level or participating in such projects at the ministry, provincial, or municipal level which have been accepted.

5. For individuals involved in management

a) Meeting the general criteria stipulated in Article 7 of this Circular;

- Participating in the formulation and implementation of policies, laws, and regulations aimed at developing traditional medicine approved by competent authorities, specifically: at least one Law or one Decree or four Circulars on the development of the health sector or Traditional Medicine; or at least one Resolution, Directive, Program, Project issued by the central government; or at least two of the following documents: Directive, Plan, Program, Project in the field of traditional medicine or combined traditional and modern medicine and effectively implementing them at the local level (from district level upwards); or at least four professional documents in the field of traditional medicine approved by the Ministry of Health.

- Participating in the formulation of at least two of the following documents: Resolution, Directive, Plan, Program, Project in the field of traditional medicine or combined traditional and modern medicine and effectively implementing them at the local level (from district level upwards).

- Proposing management solutions that are effectively implemented in the field of traditional medicine recognized by management agencies at the district level or above.

6. For Traditional Doctors, Traditional Pharmacists, Practitioners Using Family Prescriptions and Treatment Methods

a) Meeting the general criteria stipulated in Article 7 of this Circular;

b) Hold a practice certificate issued by the competent state management agency; be a member of a professional association in the field of traditional medicine, confirmed by the provincial or municipal professional association regarding professional ethics and vocational expertise.

- Participate in compiling at least one teaching material, reference book, or compile at least one book on guidelines for using traditional herbal medicines, traditional prescriptions, and local medicinal plants according to the theory of traditional medicine, recognized by the Department of Health and applied locally;

- Have at least one prescription or treatment method based on the theory of traditional medicine that has been effectively applied locally and recognized by the Department of Health.

a) Have worked in the field of traditional medicine in Vietnam for a minimum of ten years;

b) Have made significant contributions with many outstanding innovations, particularly distinguished achievements, and have effectively applied them in the field of traditional medicine, recognized by authorized agencies at the Ministry level, provincial, or municipal levels.

8. Other subjects

Cases eligible for consideration for the Ha Thanh Lan Ong Award without applying the provisions of Clause 1, Clause 3 Article 7 and the provisions from Clause 1 to Clause 7 of this Article include:

a) Individuals, including foreigners or private practitioners of traditional medicine who have made extraordinary distinguished contributions or have engaged in numerous charitable activities, making substantial material contributions to the preservation and development of traditional medicine, contributing many valuable prescriptions and hereditary treatment methods to the State, introduced by organizations such as government bodies, political organizations, social-political organizations, and occupational associations to participate in the award selection process, and recommended by the People's Committee of the province or the Ministry of Health;

Chapter III

APPLICATION PROCEDURES FOR AWARD CONSIDERATION

The Ha Thanh Lan Ong Award Selection Council is organized at both the grassroots council level and the Ministry of Health Council level.

The grassroots council (referred to as the grassroots council) implements the selection procedures, completes the dossier, and proposes to the Ministry of Health Council (referred to as the Ministry Council) through the permanent office of the Ministry Council (Traditional Medicine Management Bureau) to consolidate, organize the selection process, report to the Chairman of the Council and the Minister of Health for consideration and decision to confer the Ha Thanh Lan Ong Award.

1. Grassroots Council

a) The grassroots council is established as follows:

- At the Ministry of Health (including central offices of professional associations in the field of traditional medicine);

- At the Provincial Departments of Health;

- At units under the Ministry of Health;

- At health management agencies of other ministries and sectors.

The grassroots council is established by the Minister of Health, the Director of the Provincial Department of Health, the Head of units under the Ministry, the Head of health management agencies at other ministries and sectors, or the Head of health facilities under other ministries and sectors.

b) The composition of the grassroots council includes from seven to ten members, comprising:

- The Chairman of the Council is the head of the units authorized to establish the grassroots council;

- The Vice-Chairman of the Council is the person responsible for commendation work in the agencies and organizations specified in point a clause 1 of this Article;

- Members of the grassroots council established at the Ministry of Health include representatives from the leadership of the Traditional Medicine Management Bureau; the Department of Communication and Commendation; the Department of Organization and Cadres; the Legal Affairs Department; the Science, Technology, and Training Bureau; the Drug Administration Bureau; the Medical Examination and Treatment Management Bureau; representatives from the Central Association of Traditional Medicine, the Central Association of Acupuncture; the Vietnam Medical Workers' Union. The Traditional Medicine Management Bureau serves as the permanent office and secretary of the Council;

- Members of the grassroots council at the Provincial Departments of Health include heads of some departments within the Provincial Department of Health, the Director of the Provincial Traditional Medicine Hospital, representatives from the commendation organization at the same level; representatives from the Traditional Medicine Association, the Acupuncture Association, the Medical Workers' Union, and other relevant units in the field of traditional medicine (if necessary). The unit managing traditional medicine at the Provincial Department of Health serves as the permanent office and secretary of the Council;

- Members of the grassroots council established at units under the Ministry of Health include leaders of the unit, representatives from the union, representatives from the heads of departments, divisions, and units within the unit, and representatives from other relevant units in the field of traditional medicine (if necessary);

- Members of the grassroots council established at health management agencies of other ministries and sectors: determined by the Chairman of the grassroots council and implemented according to the regulations of the main managing ministry/sector.

c) Responsibilities of the grassroots council

- The grassroots council is responsible for receiving and selecting individuals who have made significant contributions in the field of traditional medicine and are worthy of being proposed for the Ha Thanh Lan Ong Award.

- The grassroots council is accountable to the Ministry Council for the decisions made by the grassroots council.

- The grassroots council is responsible for organizing information dissemination and promotion of exemplary models awarded the Ha Thanh Lan Ong Award through appropriate forms.

- The grassroots council of the Ministry of Health is responsible for receiving dossiers, organizing the review, and submitting a written report (attached with the dossier) to the Ministry Council through the permanent office of the Ministry Council (Traditional Medicine Management Bureau) for individuals currently working in departments, bureaus, and general administrations under the Ministry of Health, and central professional associations in the field of traditional medicine.

- The grassroots council of the Provincial Departments of Health is responsible for receiving dossiers, organizing reviews, advising the Director of the Provincial Department of Health to submit lists and dossiers of individuals under their management to the Ministry Council through the permanent office of the Ministry Council (Traditional Medicine Management Bureau).

- The grassroots Councils of units under the Ministry of Health have the duty to receive applications, organize reviews, and advise the Heads of Units to submit written documents (attached with the application) to the Ministry Council through the Standing Body of the Ministry Council (Traditional Medicine Management Department) for approval in cases related to such matters.

- The grassroots Councils of health management agencies of other ministries and sectors have the duty to receive applications, organize reviews, and submit written documents (attached with the application) to the Ministry of Health Council through the Standing Body of the Ministry Health Council (Traditional Medicine Management Department) for individuals currently working at health agencies and units under their management.

2. The Central Council

a) The Ministry Council shall consist of 11 to 13 members, established by the Minister of Health's Decision.

b) Composition of the Council

- Chairman of the Ministry Council: Head of the Ministry of Health.

- Deputy Chairmen of the Council: Director of the Traditional Medicine Management Department; Head of the Communication and Competition Department.

- Members of the Council: representatives from the leadership of the Traditional Medicine Management Department; the Communication and Competition Department; the Cadre and Civil Servant Organization Department; the Legal Affairs Department; the Science, Technology and Training Department; the Drug Administration Department; the Medical Examination and Treatment Management Department; representatives from the Central Association of Traditional Medicine, the Central Association of Acupuncture and Moxibustion; the Vietnam Medical Trade Union, and representatives from the leadership of relevant agencies and units and some experts in the field of traditional medicine and pharmacy. The Traditional Medicine Management Department serves as the Standing Body and Secretary of the Council.

c) Duties of the Ministry Council

- The Ministry Council shall review, examine, and evaluate the applications of individuals transferred from grassroots Councils within 30 days from the date of receiving complete applications.

- Ensuring the principle of awarding prizes according to the provisions of Article 3 of this Circular.

- Organizing the presentation of awards solemnly and meaningfully.

3. Principles of Operation of the Council

a) The Council operates on the principles of transparency and democracy, deciding by majority vote.

b) Grassroots Councils only consider cases proposed by grassroots meetings.

c) The Ministry Council only considers cases proposed by grassroots Councils.

d) Council sessions are valid when at least two-thirds of the Council members attend and vote. Opinions of absent Council members will be solicited via ballots and compiled into the voting results.

Individuals proposing to be considered for the Hai Thượng Lan Ông Award shall submit applications directly or by post, which include:

1. A request form for consideration of the Hai Thượng Lan Ông Award;

2. A report on achievements: The achievement report must clearly state compliance with Party policies, State laws, the practice process and years of service, capabilities, and achievements in traditional medicine work, confirmed by the workplace (Model No. 01 - Appendix 02);

3. Certificates or proof of meeting the standards prescribed in Article 9 of this Circular (certified copies or confirmed by acceptance organizations or introducers);

4. An introduction letter from an agency, mass organization, political organization, political-social organization, or occupational social organization recommending participation in the award consideration (photocopies);

5. A confirmation letter from the competent authority regarding the individual's period of service as stipulated in Article 8 of this Circular (if applicable).

Article 12. Announcement for Award Consideration

2. Based on the announcement issued by the Traditional Medicine Management Department under the Ministry of Health, heads of units shall disseminate and publicly announce the award consideration process for the Hai Thuong Lan Ong Award to all officers, civil servants, employees, and other related parties so that they understand the criteria, standards, and procedures for the award consideration.

Article 13. Selection Process at Directly Managing Units

The deadline for individuals to submit their application files to the directly managing unit (hereinafter referred to as the unit) is before October 10 of even-numbered years.

2. Step 2. Organize introduction and trust vote at the unit

a) After studying, discussing, and understanding the established criteria and conditions, the head of the unit shall organize for individuals to self-nominate or for officers, civil servants, employees of the unit to nominate and recommend candidates.

c) Only those individuals who receive at least 80% of the trust votes from the total number of participants will be submitted to the grassroots council specified in point a, Clause 1, Article 10 of this Circular for review.

d) Publicly announce the list of individuals who have received at least 7 working days of trust votes at the unit so that officers, civil servants, employees, and workers can be informed and provide feedback, after which the list will be compiled and submitted to the grassroots council for review.

đ) All complaint and accusation letters must be resolved before the grassroots council convenes.

e) The unit's file to be submitted to the grassroots council includes:

- The proposal document of the unit with the individual applying for the award;

- Individual application files for the award in accordance with Article 11 of this Circular;

- Minutes of the full meeting of the unit's officers, civil servants, employees, and workers proposing the award.

Article 14. Selection Process at Grassroots Council

Units permitted to establish a grassroots council in accordance with point a, Clause 1, Article 10 of this Circular shall implement the selection process as follows:

In cases where individuals do not meet the criteria, the council shall issue a document to notify the individual proposing the award through the council chairperson.

Within 15 working days from the date of the trust vote results, the grassroots council must submit the results for review by the ministry-level council.

2. Files of the grassroots council to be submitted to the ministry-level council

The grassroots council is responsible for compiling the results and submitting the files to the ministry-level council as stipulated in Clause 2, Article 10, including:

a) Proposal letter to the ministry-level council (Form No. 02 - Appendix 02);

b) List of proposed Hai Thuong Lan Ong Award recipients (Form No. 5 - Appendix 02);

c) Minutes of the secret ballot results of the grassroots council (Forms No. 03, No. 04 - Appendix 02);

d) Achievement report of each individual confirmed by the grassroots council; documents proving the achievements of individuals in the field of traditional medicine.

Article 15. Examination Procedure at the Ministry-level Council

2. Based on the results of the dossier review by the permanent council, the Ministry-level Council shall convene to examine and vote secretly on the dossier submitted by the grassroots council. Only individuals who receive at least eighty percent of the votes of confidence from the total number of members of the Ministry-level Council as stipulated in the decision on establishment shall be proposed to the Minister of Health for consideration and decision.

3. The permanent council shall prepare the dossier to submit to the Minister of Health for signing the Decision awarding the Hai Thuong Lan Ong Award. In cases where the award is not granted, the permanent council shall notify the grassroots council in writing about the individual who was proposed.

Article 16. Organization of the Award Presentation Ceremony

1. After the Minister of Health issues the decision to award the Hai Thuong Lan Ong Award, the permanent award agency shall submit to the Minister of Health for consideration and decision regarding the organization of the award presentation ceremony.

2. The award presentation ceremony must be organized solemnly to honor individuals who have made significant contributions to the field of traditional medicine.

3. The award shall be widely publicized through mass media.

Chapter IV

AWARDS FUNDING

Article 17. Sources of Funding

2. No fees shall be collected from individuals or groups being proposed for the award under any form.

Article 18. Principles of Fund Usage

1. The funding for organizing the award selection, the award presentation ceremony, and promotional activities shall be established and utilized according to current regulations.

2. The Traditional Medicine Management Department - Permanent Council of the Ministry of Health shall be responsible for establishing, mobilizing, managing, and using the award fund in accordance with the provisions of the law and this Circular.

1. Developing and implementing the selection plan of the Council.

2. Reviewing nomination dossiers.

3. Organizing Council meetings.

4. Announcing information about the selection on mass media.

5. Promotional activities about the award.

6. Holding press conferences on the selection results.

7. Organizing the award presentation ceremony.

8. Printing and photographing materials for the selection process; Certificates of Recognition; certificate frames; award badges.

9. Other activities as prescribed by law.

Chapter V

IMPLEMENTING PROVISIONS

Article 20. Effective Date

1. This Circular takes effect from December 12, 2020.

2. Decision No. 1488/QĐ-BYT dated May 5, 2010 of the Minister of Health promulgating the Regulation "Awarding the Hai Thuong Lan Ong Award for Traditional Medicine Work" ceases to be effective from the date this Circular takes effect.

Article 21. Responsibility for Implementation

1. The Traditional Medicine Management Department; the Department of Communication and Motivation; the Department of Planning and Finance; the Department of Organization and Cadres; the Legal Affairs Department; the Science and Technology and Training Department; the Drug Administration; the Medical Examination and Treatment Management Department; the Vietnam Medical Association; units directly under the Ministry of Health; health sector units; provincial Health Departments; professional associations in the field of traditional medicine; and related individuals and organizations are responsible for implementing this Circular.

2. The Traditional Medicine Management Department shall organize and guide individuals and organizations to implement this Circular based on its assigned functions and tasks, regularly compile and report to the Minister of Health.

3. During implementation, if there are difficulties, individuals and organizations are requested to promptly reflect them to the Ministry of Health (Traditional Medicine Management Department) for examination and resolution./.
