Guidelines on positions of civil servants in specialized fields of science and technology in agencies and organizations under the science and technology sector

Pursuant to Decree No. 28/2023/NĐ-CP dated June 2, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants;

At the proposal of the Director of the Personnel Department and the Director of the Legal Department;

The Minister of Science and Technology issues this Circular guiding positions of civil servants in specialized fields of science and technology in agencies and organizations under the science and technology sector.

Article 1. Scope of Regulation

This Circular guides the list of positions, job descriptions, and competency frameworks for positions of civil servants in specialized fields of science and technology from central to local levels in administrative agencies and organizations under the science and technology sector.

Article 2. Applicability

This Circular applies to administrative agencies and organizations under the science and technology sector from central to local levels, including:

1. Administrative agencies and organizations under Ministries and ministerial-level agencies assisting Ministers and Heads of ministerial-level agencies in managing state administration in the science and technology sector;

2. Specialized agencies performing advisory functions to assist People's Committees at provincial level in managing state administration in the science and technology sector;

3. Specialized agencies performing advisory functions to assist People's Committees at district level in managing state administration in the science and technology sector.

Article 3. Principles and bases for determining positions of civil servants in specialized fields of science and technology

1. Positions of civil servants in specialized fields of science and technology are determined based on the principles stipulated in Article 3 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.

2. Bases for determining positions of civil servants in specialized fields of science and technology shall be implemented according to the provisions of Clause 1, Article 4 of Decree No. 62/2020/NĐ-CP dated June 1, 2020 of the Government on positions and staffing of civil servants.

Article 4. List of positions of civil servants in specialized fields of science and technology

1. The list of positions of civil servants in specialized fields of science and technology includes 10 groups with 31 positions as prescribed in Appendix I attached hereto.

2. Agencies and administrative organizations shall base on Article 3 of this Circular; the list of positions of civil servants in specialized fields of science and technology prescribed in Clause 1 of this Article; the job descriptions and competency frameworks for positions of civil servants in specialized fields of science and technology prescribed in Article 5 of this Circular, and the actual implementation of assigned tasks to select and determine positions of civil servants in specialized fields of science and technology of their agencies and organizations, and submit them to competent authorities for approval in accordance with the law.

Article 5. Job descriptions and competency frameworks for positions of civil servants in specialized fields of science and technology

1. Job descriptions and competency frameworks for positions of civil servants in specialized fields of science and technology are prescribed in Appendix II attached hereto.

2. The competency framework for positions of civil servants in specialized fields of science and technology includes: common competency group, professional competency group, and management competency group. The level framework determines the requirements for competencies for positions of civil servants in specialized fields of science and technology as prescribed in Appendix III attached hereto.

3. Based on the job descriptions and competency frameworks for positions of civil servants in specialized fields of science and technology prescribed in Appendix II; the level framework determining the requirements for competencies for positions of civil servants in specialized fields of science and technology prescribed in Appendix III attached hereto, agencies and administrative organizations shall develop specific job descriptions and competency frameworks for each position of civil servants in specialized fields of science and technology in their agencies and organizations, and submit them to competent authorities for approval in accordance with the law.

Article 6. Implementation Organization

1. Pursuant to this Circular, agencies and administrative organizations mentioned in Article 2 of this Circular shall develop Position Plans for their agencies and organizations and submit them to agencies and organizations entrusted with organizational cadres' tasks at the same level for review, and submit them to competent authorities for approval in accordance with the law.

2. In cases where the regulatory documents referred to in this Circular are changed, supplemented, or replaced, they shall be implemented according to the newly issued documents.

Article 7. Transitional Provisions

In cases where civil servants hold higher ranks than those required by the positions specified in this Circular, they shall be retained until new guidelines on salary systems are issued.

Article 8. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from September 25, 2023.

2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Heads of organizations established by the Government,

3. During the implementation process, if there are any difficulties, please reflect them to the Ministry of Science and Technology for guidance and resolution./.
