JOINT CIRCULAR

Guidelines for Implementing Extracurricular Teaching Activities for Teachers at Public Secondary Schools

In accordance with Decision No. 242/TTg dated May 24, 1993 of the Prime Minister on extracurricular teaching activities for teachers at public secondary schools, the Ministry of Education and Training and the Ministry of Finance provide guidelines for such extracurricular teaching activities and the fees for additional classes as follows:

I. REGULATIONS ON THE ORGANIZATION AND MANAGEMENT OF EXTRACURRICULAR TEACHING ACTIVITIES

1. Extracurricular teaching activities for teachers at public secondary schools are educational activities that are not included in the regular curriculum hours as prescribed by the professional regulations for each level/grade and subject.

2. From now on, extracurricular teaching activities shall not be organized collectively (for all students in a class). Teachers must fulfill the content of teaching according to the plan, program, and textbooks prescribed during regular class hours. If it is necessary to organize make-up classes (to ensure the completion of the program due to reasons from the school or teacher), these additional classes shall not charge fees.

3. In public secondary schools, extracurricular teaching activities may only be conducted in a supplementary nature (within a specific period) for the following groups of students:

a) Students who are underperforming (average score below 5 points in a subject), to help these students improve their academic performance to reach the average level.

b) High-performing students (average score from 8 to 10 points), to identify and nurture talents, prepare for student excellence exams, and entrance exams to specialized schools and selective classes.

c) Students in the final grade/level (fifth grade in primary school, ninth and twelfth grades in secondary school), to review and prepare for graduation exams.

4. The principal of public secondary schools is responsible for organizing and managing extracurricular teaching activities and must fully implement the following requirements:

a) Extracurricular classes must be organized based on the voluntary participation of students and the agreement of their parents. It is strictly prohibited for teachers to use coercive measures to force students to participate (such as favoring students who attend extracurricular classes, discriminating against those who do not, withholding knowledge from regular class hours for extracurricular classes, leaking test questions in extracurricular classes, etc.). Students and parents have the right to choose their extracurricular teachers freely. Each student participating in extracurricular classes must submit a request form and a parent's recommendation; when discontinuing participation, they must also submit a withdrawal request.

b) Primary school teachers or subject teachers (for secondary school) must collect the extracurricular class request forms from students and compile them into a list; the principal is responsible for reviewing and approving the list to organize extracurricular classes.

c) Teachers conducting extracurricular classes are responsible to the principal for the organization and management of the group/class, the content of the program, and the quality of extracurricular teaching.

d) The number of extracurricular classes per week is regulated as follows:

- For primary school students, not more than 2 sessions per week.

- For secondary school students (grades 6-9 and 10-12), not more than 3 sessions per week.

e) The principal is responsible for inspecting and evaluating the results of teaching in extracurricular classes: promptly correcting negative behaviors; commending and rewarding teachers who perform well in extracurricular classes.

II. REGULATIONS ON THE COLLECTION AND USE OF FEES FOR EXTRACURRICULAR CLASSES

1. Regarding the collection of fees for extracurricular classes:

Schools are permitted to collect fees from the groups of students specified above as follows:

- Primary school students: fee range from 4,000 to 6,000 dong per student per month.

- Secondary school students:

+ Grades 6-9: fee range from 6,000 to 8,000 dong per student per month per subject.

+ Grades 10-12: fee range from 8,000 to 10,000 dong per student per month per subject.

2. Methods of collecting and managing the use of extracurricular class fees:

a. The collection of extracurricular class fees from students is organized by the school principal through teachers or the school finance department and is used as follows:

- 80% for payment of remuneration to the direct instructors.

- 15% for management and organization of extracurricular classes, purchasing materials for extracurricular teaching.

- 5% for electricity and water expenses, depreciation of assets serving extracurricular teaching (considered as a supplement to the regular budget of the school).

b. The school uniformly manages the collection and expenditure of the extracurricular class fund, publicly settling accounts before the parents of the students. The principal is responsible for reporting annually to the District Education Office and the Department of Education and Training, which will consolidate and report to the Ministry of Education and Training.

III. IMPLEMENTATION PROVISIONS

This Circular takes effect from the 1993-1994 academic year.
