DECISION OF THE MINISTER OF FINANCE

Regulations on the functions, tasks, powers, and organizational structure of the Ministry of Finance's Office

 THE MINISTER OF FINANCE

- Based on Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

- Based on Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

- Based on Circular No. 1912/BNV-TCBC dated August 15, 2003 of the Ministry of Home Affairs regarding agreement to establish rooms at some units under the Ministry of Finance;

Considering the proposal of the Director of the Ministry of Finance's Office and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1: The Ministry of Finance's Office (hereinafter referred to as the Office) is a unit within the state management machinery of the Ministry of Finance, with the function of advising, summarizing, and assisting the Minister of Finance in directing and coordinating the activities of organizations and units under the Ministry to implement the program, plan of work, and working regulations of the Ministry; organizing administrative work, archival management; press and propaganda, competition, and commendation work of the Ministry of Finance.

Article 2: The Office has the following tasks:

1/ Advising and summarizing to assist the Minister of Finance in directing and coordinating the activities of organizations and units under the Ministry:

a. Summarizing, building the program, plan of work, and working regulations of the Ministry of Finance; organizing coordination, urging, and inspecting organizations and units under the Ministry to implement the program and plan of work; reporting regularly and urgently on the implementation of the plan of work and working regulations; serving as the focal point for cooperation with units to implement the activities of the Ministry.

b. Proposing issues related to mechanisms, policies, laws that need to be organized for research, construction, amendment, and supplementation to be appropriate.

c. Conducting final legality review and suitability with the Party's guidelines and policies of the State of documents drafted by organizations and units under the Ministry for submission to the leadership of the Ministry for consideration and decision.

d. Preparing the agenda, content, urging relevant organizations and units under the Ministry to prepare materials for meetings and work sessions of the leadership of the Ministry with the leadership of Party and State agencies, central ministries and localities, and units within the financial sector; organizing minutes and archiving records of meetings.

đ. Coordinating with organizations and units under the Ministry to guide and inspect the implementation of Directives and Decisions of the Minister; compliance with administrative discipline, information systems, reporting, and working regulations of the Ministry, and recommending solutions to the Minister of Finance to ensure the effectiveness of Directives, Decisions, and other regulations of the Ministry.

e. Submitting projects and proposals assigned by the Ministry; summarizing and evaluating the implementation of the Party's Resolutions, the Government's action programs, the Ministry of Finance, and the implementation and results of financial mechanisms and policies already issued.

g. Chairing meetings with relevant organizations and units under the Ministry to unify the resolution of issues with differing opinions; chairing morning meetings authorized by the Minister of Finance.

h. Implementing and urging organizations and units under the Ministry to implement regulations on information and reporting to Party agencies, National Assembly, Government, and Prime Minister.

i. Organizing regular and urgent provision of information to the leadership of the Ministry on prominent domestic and international economic and social situations; issues related to work being handled by the leadership of the Ministry.

2/ Administrative and clerical work:

a. Organizing the implementation of administrative and clerical work at the Ministry according to the provisions of the law.

b. Guiding and inspecting organizations and units under the Ministry to uniformly implement national and Ministry of Finance regulations on clerical work and other administrative procedures.

c. Organizing printing of materials to serve the work of the Ministry.

d. Inspecting and being responsible for the administrative procedures of documents issued by the Ministry of Finance.

đ. Guiding and inspecting organizations and units under the Ministry in implementing legal regulations on keeping confidential information and documents related to the Ministry's state management functions.

3/ Archival work:

a. Organizing the implementation of archival work at the Ministry according to the provisions of the law.

b. Guiding and inspecting organizations and units under the Ministry to uniformly implement national and Ministry of Finance regulations on archival work.

4/ Press and propaganda work, competition work:

a. Implementing the competition and commendation work of the Ministry of Finance; guiding and inspecting organizations and units to implement competition and commendation work throughout the sector.

b. Managing the press and publication activities of the Ministry of Finance; serving as the focal point for organizing press conferences and providing information about the activities of the Ministry of Finance to news agencies authorized by the Minister of Finance.

c. Weekly conducting press reviews and informing the leadership of the Ministry of their guidance on issues raised by the press for relevant organizations and units to check and report back to the leadership of the Ministry.

d. Organizing the implementation and guiding organizations and units under the Ministry to collect, study, summarize, and manage historical and traditional documents of the financial sector.

5/ Performing the standing tasks of the Steering Committee for Administrative Reform of the Ministry of Finance; serving as the standing member of the Competition Council of the Ministry of Finance.

6/ Managing the Motor Vehicle Unit in accordance with the regulations of the Ministry.

Article 3: The Director of the Ministry of Finance's Office has the authority:

1/ Requesting organizations and units under the Ministry to provide information and materials for assigned tasks.

2/ Returning, requesting units to perfect proposals, files, and materials submitted to the Ministry but not meeting the requirements of the Ministry's leadership.

3/ Signing documents to guide, inspect, and request units to strictly comply with national and Ministry regulations on specialized work programs, competition and commendation, information, propaganda, administrative, archival, and document preservation work of the financial sector.

4/ Signing documents to announce the guidance of the Ministry's leadership; documents related to work with external agencies authorized by the Minister of Finance.

5/ The Director of the Office is the spokesperson for the Minister, authorized by the Minister to announce financial-budgetary activities to news agencies in accordance with regulations.

Article 4: The Ministry of Finance's Office has a Director and several Deputy Directors. The Director is responsible for comprehensively managing civil servants of the Office in accordance with the regulations of the Ministry; organizing training and enhancing the competence of civil servants; being accountable to the Minister of Finance for all activities of the Ministry of Finance's Office.

The Deputy Director of the Office is responsible to the Director of the Office for the tasks assigned.

The Ministry's Office includes the following departments:

1/ Administrative Department

2/ Archive Department

3/ Press and Propaganda - Competition Department

The specific duties of each department are defined by the Director of the Office.

The Ministry's Office operates under a system combining individual specialists with departmental organization. For tasks carried out by individual specialists, the Director of the Office is responsible for organizing work and assigning tasks to each civil servant in accordance with their position, standards, capabilities, and trained expertise to fulfill the tasks.

The staffing of the Ministry's Office is determined by the Minister of Finance.

Article 5: This Decision takes effect from the date of signature. The Decision number 277 TC/QĐ/TCCB dated March 14, 1996 issued by the Minister of Finance on the Charter of Organization and Operation of the Ministry of Finance's Office is hereby repealed.

The Director of the Ministry of Finance's Office, the Heads of the Cadre and Civil Service Department, the Financial and Administrative Management Department, and the Heads of organizations and units under the Ministry are responsible for implementing this decision./.
