PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Ordinance on Protection of State Secrets No. 30/2000/PL-UBTVQH10 dated December 28, 2000 of the Standing Committee of the National Assembly, Term X;

At the proposal of the Minister of Commerce and the Minister of Public Security,

DECISION:

Article 1. The list of state secrets of the "Top Secret" level in the commerce sector includes information within the following scope:

- Party and State policies on commerce related to foreign relations, national defense, and homeland defense; - Party and State policies on commerce concerning each country, market, region, and partner in economic and commercial relations with foreign countries and foreign political relations.

Article 2. The list of state secrets of the "Very Secret" level in the commerce sector includes information within the following scope:

1. Party and State policies on commerce related to market policy and key commodities not yet announced.

2. Documents of the Ministry of Commerce sent to Party and State leaders for their guidance on trade policy and prices of certain key commodities not yet announced.

3. Plans, guidance opinions of Party and State leaders, negotiation preparation plans and documents serving negotiations to sign agreements and treaties on economy and commerce and resolving trade disputes and complaints between our country and other countries and international organizations.

4. Negotiation process and contents of signed economic and commercial agreements that have not been announced.

5. Export and import plans for key commodities of the state, aggregated data and important assessments on export and import not announced or not yet announced.

Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and replace Decision No. 731/TTg dated December 1, 1994 of the Government Chairman on the list of state secrets in the commerce sector.

Article 4. The Minister of Commerce and the Minister of Public Security are responsible for supervising the implementation of this Decision.

Article 5. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision.
