Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Chairman of the Board of Directors of the Social Policy Bank and the Minister of Planning and Investment,

DECISION:

Article 1. Approves the Project "Investment in Construction of Office Premises within the Social Policy Bank System for the Period 2008-2012", with the main contents as follows:

1. Name of the Program: "Project on Investment in Construction of Office Premises within the Social Policy Bank System for the Period 2008-2012".

2. Managing Unit: The Social Policy Bank.

3. Objectives of the Project:

By 2012, ensure that all units of the Social Policy Bank system from central to district level have stable office premises meeting the standards of a bank office, thereby facilitating service to the people and ensuring the safety of funds.

4. Bases for Determining the Scale of Investment:

Based on the Prime Minister's Decisions regarding the establishment of the Social Policy Bank; approval of the Charter on the organization and operation of the Social Policy Bank; standards and norms for the use of office premises at state agencies and public institutions, and other relevant legal documents.

5. Scale of Investment:

a) District-level Bank: VND 2,000 million per office, including:

- Class IV working building, two floors, reinforced concrete frame structure, floor area 450 m²2.

- Auxiliary building: Class IV, one floor, reinforced concrete frame structure, floor area 100 m²2.

b) Provincial-level Bank: VND 7,100 million per office, including:

- Class II working building, three floors, reinforced concrete frame structure, floor area 1,500 m²2.

- Auxiliary building: Class IV, two floors, reinforced concrete frame structure, floor area 200 m²2.

c) Head Office (comprising 15 departments), Trading Department (referred to as Head Office): VND 150,000 million, including:

- Class II working building, fifteen floors, reinforced concrete frame structure, floor area 10,000 m²2.

- Auxiliary building: Class III, three floors, reinforced concrete frame structure, floor area 1,500 m²2.

The above is the maximum scale for the office premises of the Social Policy Bank at various levels. In the process of planning, reviewing, and approving investment for each specific project (office), the Social Policy Bank is responsible for accurately determining the investment scale based on the basic functions of each level of bank, actual conditions where the offices are located, long-term operational needs of each level of bank, and current laws (the list of investment in construction of office premises within the Social Policy Bank system for the period 2008-2012 as attached to this Decision).

6. Basic Bases for Compiling the Investment Budget for Office Premises of the Social Policy Bank at Various Levels:

Based on the capital investment cost for constructing office premises, the principle of classification of buildings and structures, and the requirements and regulations on classifying office premises issued by competent authorities; design solutions; fire prevention and firefighting; technical lighting, electrical, sanitation... requirements of TCVN 4601-1988 standard for office premises design and the scale of areas for various levels of banks.

The cost of investment in construction of office premises of the Social Policy Bank at various levels includes: costs for constructing working rooms, trading floors, public service rooms and technical rooms (meeting rooms, reception rooms, computer system management rooms, vaults, data storage rooms, auditoriums...), auxiliary rooms (bathrooms, kitchens, stamp storage rooms, parking spaces...).

7. Total Estimated Capital Investment Need: VND 772,900 million, including:

a) Estimated new construction investment capital for 203 offices (including Head Office, 15 provincial-level banks, and 187 district-level banks), specifically:

b) Estimated investment capital for repairing, renovating, and upgrading 123 old offices transferred to the Social Policy Bank as office premises (including 70 offices handed over in 2007 and 53 additional offices expected to be handed over in the future), (20 provincial-level banks and 103 district-level banks), specifically:

8. Implementation Measures:

a) Continue implementing the Prime Minister's Directives: No. 05/2003/CT-TTg dated March 18, 2003 on directing the activities of the Social Policy Bank and Directive No. 09/2004/CT-TTg dated March 16, 2004 on enhancing the capacity and effectiveness of the Social Policy Bank, and other related documents; the Social Policy Bank will work with ministries, sectors, and relevant localities to accept surplus office premises according to the Prime Minister's guidance in Document No. 4141/VPCP-KTTH dated July 25, 2007 of the Government Office and other related documents;

b) The Social Policy Bank will work with provincial and district-level localities with conditions to support the Social Policy Bank in constructing office premises locally. For localities not receiving financial support from the central budget, they are responsible for: in addition to investing in external infrastructure (roads, electricity, water supply and drainage, etc.), contributing a minimum of 15% of the total investment capital for office premises from the perimeter fence inward;

c) Implement planning, review, approval, and execution of investment in construction of projects (offices) that have clearly determined the ability to balance capital according to current laws.

9. Implementation Plan:

a) Progress Schedule:

Based on the investment objectives of the Project: by 2012, ensure that all units of the Social Policy Bank system (from central to district level) have stable office premises meeting the standards of a bank office, thereby facilitating service to the people and ensuring the safety of funds.

Among the remaining 203 units without office premises include: Head Office, 15 provincial-level banks, and 187 district-level banks in newly divided regions, remote areas, and particularly difficult regions. The Social Policy Bank will implement investment according to the priority order of projects as follows:

- For new construction offices: VND 630,500 million.

In 2008, priority investment will be made to construct office premises for three newly separated provincial-level banks (Lai Chau, Dak Nong, Hau Giang), 49 newly separated county-level banks, counties in remote and extremely difficult areas that have not been able to accept surplus houses according to the Prime Minister's directives and headquarters.

In 2009, continue investment to complete office premises for three newly separated provincial-level banks (Lai Chau, Dak Nong, Hau Giang), 42 county-level banks in newly separated areas, remote areas, extremely difficult areas, and headquarters.

In 2010, invest in constructing 40 county-level bank offices in remote areas, extremely difficult areas, and headquarters.

In 2011, invest in constructing 41 county-level bank offices in remote areas, extremely difficult areas, and headquarters.

In 2012, invest in constructing office premises for 12 provincial-level banks and the remaining 15 county-level banks.

Capital Plan:

In 2008: 117,000 million VND.

In 2009: 146,300 million VND.

In 2010: 140,000 million VND.

In 2011: 112,000 million VND.

In 2012: 115,200 million VND.

For premises received and transferred from ministries, sectors, and localities: plans and budget estimates for repair, renovation, and upgrading will be immediately established upon receipt.

b) Sources of capital:

- The capital for repairing and renovating projects will be sourced from annual operating expenses within the management costs allocated by the Ministry of Finance;

- The capital for constructing new premises will be sourced from central government budget, funds reserved for development investment of the Social Policy Bank, local government budget, and other lawful sources.

10. Implementation Organization:

a) The Chairman of the Board of Directors of the Social Policy Bank shall be responsible before the Prime Minister for directing the organization and implementation of the Project in accordance with current state regulations;

b) The General Director of the Social Policy Bank shall be responsible before the Chairman of the Board of Directors of the Social Policy Bank for organizing the implementation of the Project in accordance with its objectives and plan; monitoring and supervising the use of investment capital for the correct purpose, ensuring economy and compliance with current state regulations;

c) The Chairman of the Board of Directors, the General Director, and units under the Social Policy Bank system shall be responsible for organizing the implementation of the Project in accordance with laws on investment construction, specific regulations of the sector, fully decentralizing management of investment construction projects, ensuring timely completion and effectiveness of the Project, while not affecting specialized work of the sector.

11. Responsibilities of agencies coordinating the implementation of the Project:

a) The Social Policy Bank is the main implementing agency of the Project:

- Organize the implementation of the Project in accordance with its objectives, ensuring progress and investment efficiency, consistent with current laws on investment and construction. Report regularly every six months to the Prime Minister, the Ministry of Planning and Investment, and relevant ministries and sectors on the progress of the Project, difficulties and advantages during implementation;

- Coordinate with the Ministry of Planning and Investment, the Ministry of Finance, and relevant ministries and sectors to develop special mechanisms to mobilize sufficient resources to implement the Project and submit it for approval by the Prime Minister;

- Proactively coordinate with ministries, sectors, and localities with surplus premises not fully utilized to repair, renovate, and upgrade them as bank premises to minimize actual investment capital for the Project. Repair, renovation, and upgrade costs for received premises shall be included in the annual operating expenses of the bank.

b) The Ministry of Planning and Investment, the Ministry of Finance, and relevant ministries and sectors shall cooperate with the Social Policy Bank in developing special mechanisms and policies to mobilize sufficient resources to implement the Project.

c) Provincial-level cities directly under the Central Government:

- Create favorable conditions for the Social Policy Bank to construct premises on their territory: investment and construction procedures; transfer surplus premises no longer needed; allocate land funds, infrastructure, and land clearance for new bank premises construction at the local level;

- For localities not receiving support funding from the central government budget, they shall be responsible for: in addition to investing in technical infrastructure outside the fence (roads, electricity, water supply, drainage, etc.); contributing a minimum of 15% of the total investment cost of the premises inside the fence.

Article 2. This Decision takes effect 15 days after its publication in the Official Gazette.

Article 3. Ministers, heads of ministerial-level agencies, heads of governmental agencies, Chairmen of People's Committees of provinces and centrally governed cities, and heads of related agencies and units are responsible for implementing this Decision./.
