Decree No. 161/2017/ND-CP amends Article 12 of Decree No. 21/2016/NĐ-CP dated March 31, 2016, concerning the implementation of specialized inspection functions regarding social insurance contributions, health insurance, and unemployment insurance by the Social Insurance Agency.

DECREE

AMENDING ARTICLE 12 OF THE DECREES ISSUED ON MARCH 31, 2016 NUMBERED 21/2016/NĐ-CP REGARDING THE IMPLEMENTATION OF SPECIALIZED INSPECTION FUNCTIONS FOR SOCIAL INSURANCE CONTRIBUTIONS, UNEMPLOYMENT INSURANCE, AND HEALTH INSURANCE BY THE SOCIAL INSURANCE AGENCY

WHEREASthe Law on Government Organization dated June 19, 2015;

the Law on Inspection dated November 15, 2010;

WHEREASthe Social Insurance Law dated November 20, 2014;

WHEREASthe Health Insurance Law dated November 14, 2008 and the Law Amending Certain Provisions of the Health Insurance Law dated June 13, 2014; WHEREAS

the Employment Law dated November 16, 2013;

At the proposal of the Minister of Labor, Invalids and Social Affairs;

The Government promulgates this Decree amending Article 12 of Decree No. 21/2016/NĐ-CP dated March 31, 2016 issued by the Government regarding the implementation of specialized inspection functions for social insurance contributions, unemployment insurance, and health insurance by the Social Insurance Agency./2016/NĐ-CP dated March 31, 2016 of the Government stipulates the implementation of specialized inspection functions regarding social insurance contributions, unemployment insurance contributions, and health insurance contributions by the social insurance agency.

ARTICLE 1. Amending Article 12 of Decree No. 21/2016/NĐ-CP dated March 31, 2016 issued by the Government regarding the implementation of specialized inspection functions for social insurance contributions, unemployment insurance, and health insurance by the Social Insurance Agency.

Amend Article 12 as follows:

"ARTICLE 12. Ensuring operating funds for the Social Insurance Agency in implementing specialized inspection functions for social insurance contributions, unemployment insurance, and health insuranceThe operating funds of the Social Insurance Agency for implementing specialized inspection functions for social insurance contributions, unemployment insurance, and health insurance shall be allocated within the budget for management costs of social insurance, unemployment insurance, and health insurance as prescribed by laws on financial management applicable to the Vietnam Social Security."

The operating expenses of the social insurance agency in carrying out specialized inspection functions concerning social insurance contributions, unemployment insurance contributions, and health insurance contributions are allocated within the budget for management costs of social insurance, unemployment insurance, and health insurance as prescribed by laws governing financial management for the Vietnam Social Security.

ARTICLE 2. Implementation Provisions

This Decree takes effect from February 15, 2018.

ARTICLE 3. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies and other government agencies, Chairpersons of provincial and centrally-administered city People's Committees, organizations, and individuals concerned are responsible for implementing this Decree./.
