Regarding the issuance of criteria for appointing leadership positions at treatment facilities under the Administrative Violations Handling Ordinance

THE MINISTER OF LABOR, WAR INVALIDS AND SOCIAL AFFAIRS

Pursuant to the Government Organization Law dated December 25, 2001;

Pursuant to the Administrative Violation Handling Ordinance dated July 2, 2002;

Pursuant to Decree No. 25/CP dated May 23, 1993 of the Government stipulating the temporary salary system for civil servants, administrative and public service officials, and armed forces personnel;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 29/2003/NĐ-CP dated March 31, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Pursuant to Circular Joint Circular No. 05/2002/TTLT-BLDTBXH-BTCCBCP dated February 6, 2002 of the Ministry of Labor, Invalids and Social Affairs and the former Civil Service Personnel Department of the Government (now the Ministry of Home Affairs) guiding the functions, tasks, organizational structures, and personnel of local treatment facilities;

Pursuant to the Agreement Letter No. 1503/BNV-CCVC dated July 3, 2003 of the Ministry of Home Affairs on the application of civil servant ranks for positions at treatment facilities under the Administrative Violations Handling Ordinance;

At the proposal of the Director of the Anti-Social Evils Prevention Bureau, the Director of the Cadre and Civil Servant Organization Department,

Article 1. The criteria for appointing fifteen leadership positions at treatment facilities under the Administrative Violations Handling Ordinance (referred to as Social Education and Labor Centers) are hereby issued together with this Decision.

Article 2. The leadership position of security guard at the center shall be applied as follows:

1. Civil servants, officials, and employees holding the position of Deputy Head of Security at the Center shall apply the rank of Civil Servant Officer, code 01.004, pay scale 01 - Administrative.

2. Civil servants, officials, and employees holding the position of Head of Security at the Center shall apply the rank of Civil Servant Specialist, code 01.003, pay scale 01 - Administrative.

Article 3. The criteria for appointing leadership positions serve as the basis for treatment facilities to implement planning, appointment, training, and development for cadres, civil servants, and officials working at Social Education and Labor Centers.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Chief of the Ministry's Office, the Director of the Cadre and Civil Servant Organization Department, the Director of the Anti-Social Evils Prevention Bureau, heads of related units, Directors of Departments of Labor, Invalids and Social Affairs, and Directors of treatment facilities under the Ministry of Labor, Invalids and Social Affairs are responsible for implementing this Decision.
