Decree No. 162/2017/ND-CP detailing a number of provisions and measures for the implementation of the Law on Belief and Religion

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree specifies certain provisions of the Law on Belief and Religion (hereinafter referred to as the Law) regarding the right to use religious books, express belief and religion for persons under temporary detention, persons under pretrial detention as prescribed by laws on the enforcement of temporary detention and pretrial detention; persons serving custodial sentences; persons undergoing compulsory educational measures at specialized training centers, compulsory education facilities, and compulsory drug rehabilitation centers; procedures and formalities for registering non-commercial legal entities for religious organizations subordinate to others; procedures and formalities for dissolving religious organizations and subordinate religious organizations; procedures and formalities for dissolving religious training institutions; procedures and formalities for approving and registering matters involving foreign elements in the ordination, appointment, election, and selection of religious personnel; the activities of religious organizations and subordinate religious organizations in receiving and managing financial donations from foreign organizations and individuals; fundraising activities of belief sites, religious organizations, and subordinate religious organizations, and measures to implement the Law.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals in ensuring and implementing the right to freedom of belief and religion as prescribed by the Law.

Article 3. Explanation of Terms

1. A belief construction is a construction project built for belief purposes.

2. A religious construction is a construction project built for religious purposes, including religious statues, memorial stones, and religious towers.

3. Ancillary constructions are constructions not used for worship activities at belief sites and religious facilities, including residential buildings, guesthouses, dining halls, kitchens, fences surrounding the premises of belief sites and religious facilities, and similar constructions.

Chapter II

USE OF RELIGIOUS BOOKS, EXPRESSION OF BELIEF AND RELIGION; CHANGE OF REPRESENTATIVE, PLACE OF CONCENTRATED RELIGIOUS ACTIVITIES; CHANGE OF NAME, HEADQUARTERS OF RELIGIOUS ORGANIZATIONS, SUBORDINATE RELIGIOUS ORGANIZATIONS

Article 4. The use of religious books and expression of belief and religion as stipulated in Clause 5 of Article 6 of the Law

1. Persons under temporary detention, persons under pretrial detention as prescribed by laws on the enforcement of temporary detention and pretrial detention; persons serving custodial sentences; persons undergoing compulsory educational measures at specialized training centers, compulsory education facilities, and compulsory drug rehabilitation centers (hereinafter referred to as persons under management and detention) are allowed to use published religious books in printed form and legally distributed to meet their personal needs for belief and religious activities and may express their belief and religion through speech or actions in accordance with laws governing temporary detention facilities, pretrial detention centers, prisons, specialized training centers, compulsory education facilities, and compulsory drug rehabilitation centers (hereinafter referred to as management and detention facilities).

2. The use of religious books and expression of belief and religion by persons under management and detention at management and detention facilities must not affect the freedom of belief and religion and the freedom not to believe of other persons and must not contravene relevant laws.

3. The Ministry of Public Security, the Ministry of National Defense, and the Ministry of Labor, Invalids, and Social Affairs shall be responsible for guiding the management of religious books, the time and place for using religious books, and the expression of belief and religion for persons under management and detention at management and detention facilities.

Article 5. Procedure for Changing the Representative of a Concentrated Religious Activity Group

1. Before changing the representative, the concentrated religious activity group shall be responsible for submitting registration files to the People's Committee of the commune where the place of concentrated religious activities is located.

The registration documents include:

a) The registration document clearly states the name of the religious organization or the organization that has been granted registration for religious activities; the name of the religion; the name of the group, the full name and place of residence of the old and new representatives of the group; the reason and the expected date of change;

b) Curriculum vitae of the new representative;

c) Approval document from the religious organization or the organization that has been granted registration for religious activities regarding the change of representative for the concentrated religious activity group registered by the organization;

d) Minutes of the meeting electing the new representative (if applicable).

2. The People's Committee of the commune shall be responsible for replying in writing within 15 days from the date of receiving complete valid registration files; in case of refusal to register, it must reply in writing and specify the reasons.

Article 6. Procedure for Changing the Place of Concentrated Religious Activities

1. Before changing the place of concentrated religious activities within the territory of a commune, the representative of the group shall be responsible for submitting request files to the People's Committee of the commune.

The application documents include:

a) The request document clearly states the name of the religious organization or the organization that has been granted registration for religious activities; the name of the religion; the name of the group; the full name of the group's representative; the reason and the expected date of change; the current place of religious activities of the group and the proposed new location;

b) Documents proving the existence of a legal new location for religious activities;

c) Approval document from the religious organization or the organization that has been granted registration for religious activities regarding the change of location for the concentrated religious activity group registered by the organization.

2. Before changing the place of concentrated religious activities to another commune, the representative of the group shall be responsible for submitting request files to the People's Committee of the commune where the new location is situated.

The request file shall comply with the provisions of Clause 1 of this Article, accompanied by a certified copy of the registration approval document for concentrated religious activities issued by the People's Committee of the commune where the initial place of religious activities is located.

3. Authority to Approve Changes in the Place of Concentrated Religious Activities:

a) The People's Committee of the commune where the new location for concentrated religious activities is planned, as stipulated in Clause 1 of this Article, shall be responsible for replying in writing about the change of location within 15 days from the date of receiving complete valid request files; in case of non-approval, it must reply in writing and specify the reasons.

b) The People's Committee of the commune where the new location for concentrated religious activities is planned, as stipulated in Clause 2 of this Article, within five working days from the date of receiving complete valid request files, shall be responsible for seeking opinions from the People's Committee of the district on the change of location for concentrated religious activities.

Within ten days from the date of receiving the valid opinion-seeking document from the People's Committee of the commune, the People's Committee of the district shall be responsible for replying in writing. Within five working days from the date of having the opinion of the People's Committee of the district, the People's Committee of the commune shall be responsible for replying in writing about the change of location; in case of non-approval, it must reply in writing and specify the reasons.

4. Not later than ten days from the date of approval of the new location, the concentrated religious activity group must cease religious activities at the old location and be responsible for notifying in writing to the People's Committee of the commune where the previous place of religious activities is located. In case the concentrated religious activity group moves the place of religious activities to another commune, the representative of the group also has the responsibility to submit along with a certified copy of the approval document from the People's Committee of the commune where the new place of religious activities is located.

The notification document clearly states the name of the religious organization or the organization that has been granted registration for religious activities; the name of the group; the full name of the group's representative; the date of change; the new place of concentrated religious activities; the date of ceasing religious activities at the old location.

Article 7. Procedure and formalities for changing the name of religious organizations, affiliated religious organizations

1. Before changing the name of a religious organization or an affiliated religious organization, the religious organization shall be responsible for submitting a request document to the competent state agency as stipulated in Clause 2 of this Article.

The request document shall clearly specify the name, headquarters, representative of the religious organization; the name of the religious organization or the affiliated religious organization before and after the change; reasons, proposed time of change accompanied by a certified copy of the decision recognizing the religious organization by the competent state agency in cases of changing the name of a religious organization; a certified copy of the approval document for establishment, division, separation, merger, consolidation of affiliated religious organizations by the competent state agency and the establishment, division, separation, merger, consolidation document of affiliated religious organizations by the religious organization or the directly managing affiliated religious organization in cases of changing the name of an affiliated religious organization.

2. Authority to approve changes in the name of religious organizations, affiliated religious organizations:

a) The People's Committee of the province shall be responsible for responding in writing to the request for changing the name of a religious organization or an affiliated religious organization operating within one province within thirty days from the date of receipt of a valid request document; in case of non-approval, it must respond in writing and clearly state the reasons.

b) The central state management agency on belief and religion shall be responsible for responding in writing to the request for changing the name of a religious organization or an affiliated religious organization operating across multiple provinces within thirty days from the date of receipt of a valid request document; in case of non-approval, it must respond in writing and clearly state the reasons.

Article 8. Procedure and formalities for changing the headquarters of religious organizations, affiliated religious organizations

1. Before changing the headquarters, religious organizations or affiliated religious organizations operating across multiple provinces shall be responsible for submitting a request file to the People's Committee of the province where the new headquarters will be located.

The application documents include:

a) The request document shall clearly specify the name, headquarters, representative of the religious organization or the affiliated religious organization; reasons, proposed time of change; headquarters of the religious organization or the affiliated religious organization before and after the change;

b) A certified copy of the decision recognizing the religious organization in cases of changing the headquarters to another province or a certified copy of the approval document for establishment, division, separation, merger, consolidation of affiliated religious organizations by the competent state agency and the establishment, division, separation, merger, consolidation document of affiliated religious organizations by the religious organization or the directly managing affiliated religious organization in cases of changing the headquarters of an affiliated religious organization to another province;

c) An approval document of the religious organization or the directly managing affiliated religious organization regarding the change of location;

d) Documents proving the legal location for the new headquarters.

2. The People's Committee of the province where the new headquarters will be located shall be responsible for responding in writing to the request for changing the headquarters of religious organizations or affiliated religious organizations operating across multiple provinces within thirty days from the date of receipt of a complete and valid request file; in case of non-approval, it must respond in writing and clearly state the reasons.

3. Within ten days from the date of moving to the new headquarters, the religious organizations or affiliated religious organizations specified in Clause 1 of this Article shall be responsible for notifying in writing about the change of headquarters to the central state management agency on belief and religion and the People's Committee of the province where the old headquarters was located.

The notification document shall clearly specify the name of the religious organization or the affiliated religious organization; the full name of the representative of the organization; reasons, time of change; headquarters of the organization before and after the change accompanied by a certified copy of the approval document of the People's Committee of the province where the new headquarters is located.

4. Religious organizations or affiliated religious organizations operating within one province when changing headquarters shall be responsible for submitting a request file according to points a, c, and d of Clause 1 of this Article to the People's Committee of the province.

The People's Committee of the province shall be responsible for responding in writing to the request for changing the headquarters of religious organizations or affiliated religious organizations operating within one province within thirty days from the date of receipt of a complete and valid request file; in case of non-approval, it must respond in writing and clearly state the reasons.

Chapter III

REGISTRATION OF NON-COMMERCIAL LEGAL PERSONS; DISSOLUTION OF RELIGIOUS ORGANIZATIONS, AFFILIATED RELIGIOUS ORGANIZATIONS, RELIGIOUS TRAINING INSTITUTIONS; BELIEF STRUCTURES, RELIGIOUS STRUCTURES, AUXILIARY STRUCTURES

Article 9. Procedure and formalities for issuing registration of non-commercial legal entity for subordinate religious organizations

1. The religious organization proposing to issue registration of a non-commercial legal entity for its subordinate religious organization shall be responsible for submitting the application dossier to the competent state agency as prescribed in Clause 2 of this Article.

The application documents include:

a) The application document shall clearly state the name, headquarters, representative of the religious organization; the name, headquarters, operational area, organizational structure, number of followers, clerics, religious workers, monks/nuns at the time of application; the full name of the representative of the subordinate religious organization proposed for registration;

b) A summary of the religious activities of the subordinate religious organization from its establishment until division, separation, merger, or consolidation;

c) List, brief curriculum vitae, criminal record certificate, summary of religious activities of the representative and leaders of the subordinate religious organization;

d) Declaration and documents proving the legitimate assets of the subordinate religious organization;

đ) Charter, regulations, or similar documents of the subordinate religious organization.

2. Authority to issue registration of non-commercial legal entity:

a) The provincial People's Committee shall issue registration of a non-commercial legal entity for a subordinate religious organization operating within one province within 60 days from the date of receipt of a complete and valid application dossier; in case of refusal to issue registration, it must respond in writing and specify the reasons;

b) The central state management agency on belief and religion shall issue registration of a non-commercial legal entity for a subordinate religious organization operating across multiple provinces within 60 days from the date of receipt of a complete and valid application dossier; in case of refusal to issue registration, it must respond in writing and specify the reasons.

Article 10. Procedure and formalities for dissolution of religious organizations and subordinate religious organizations as prescribed in the charter

1. The religious organization dissolving itself or the religious organization and subordinate religious organization dissolving a subordinate religious organization according to the provisions of the charter shall be responsible for submitting the application dossier to the competent state agency as prescribed in Clause 3 of this Article.

The application documents include:

a) The application document shall clearly state the name, headquarters of the organization applying for dissolution; the name, headquarters of the subordinate religious organization being dissolved; the reason and expected dissolution date;

b) Declaration of assets and finances;

c) Method of handling assets and finances and deadline for settling debts (if any);

d) List of subordinate religious organizations.

2. The religious organization dissolving itself or the subordinate religious organization being dissolved shall be responsible for notifying the deadline for settling debts (if any) to related organizations and individuals in accordance with the law through five consecutive issues of newspapers or online media at the central level for religious organizations and subordinate religious organizations operating across multiple provinces, and at the local level for religious organizations and subordinate religious organizations operating within one province.

3. Authority to approve dissolution:

a) The provincial People's Committee shall approve the dissolution of religious organizations and subordinate religious organizations operating within one province within 45 days from the end of the debt settlement period (if any) and liquidation of assets and finances recorded in the organization's announcement without any objections; in case of disapproval, it must respond in writing and specify the reasons;

b) The central state management agency on belief and religion shall approve the dissolution of religious organizations and subordinate religious organizations operating across multiple provinces within 45 days from the end of the debt settlement period (if any) and liquidation of assets and finances recorded in the organization's announcement without any objections; in case of disapproval, it must respond in writing and specify the reasons.

4. For religious organizations dissolving themselves, the date when the competent state agency as prescribed in Clause 3 of this Article approves the dissolution of the organization is the date when the organization must return the original decision recognizing the religious organization; the certificate from the police authority confirming that the organization has submitted and canceled the seal according to the regulations.

5. For religious organizations and subordinate religious organizations dissolving subordinate religious organizations, no later than five working days from the date the competent state agency approves the dissolution, the religious organization or subordinate religious organization shall be responsible for dissolving the subordinate religious organization and returning to the competent state agency as prescribed in Clause 3 of this Article the following documents:

a) Original document approving the establishment, division, separation, merger, or consolidation of the subordinate religious organization issued by the competent state agency;

b) Original document establishing, dividing, separating, merging, or consolidating the subordinate religious organization issued by the religious organization or directly managing subordinate religious organization;

c) List of subordinate religious organizations belonging to the subordinate religious organization being dissolved;

d) Certificate or confirmation document from the police authority regarding the subordinate religious organization being dissolved having submitted and canceled the seal according to the regulations.

6. No later than 20 days from the date the subordinate religious organization is dissolved, the religious organization or directly managing subordinate religious organization shall be responsible for informing the competent state agency as prescribed in Clause 3 of this Article about the dissolution of the subordinate religious organization.

The notification document shall clearly state the name, headquarters, and full name of the representative of the religious organization or subordinate religious organization making the request; the name, headquarters, and full name of the representative of the religious organization, subordinate religious organization being dissolved; the dissolution date.

Article 11. Procedures and formalities for dissolving religious organizations and subordinate religious organizations as provided for in points b and c, Clause 1, Article 31 of the Law.

1. Sixty days prior to the dissolution of a religious organization or a subordinate religious organization as provided for in points b and c, Clause 1, Article 31 of the Law, the state management agency on belief and religion at the central level shall be responsible for notifying in writing about the dissolution of the religious organization or subordinate religious organization with operational areas in multiple provinces; the People's Committee of the province shall be responsible for notifying in writing about the dissolution of the religious organization or subordinate religious organization with operational areas in one province to the directly managing religious organization or subordinate religious organization and the subordinate religious organization proposed to be dissolved.

The notification document shall clearly state the name, headquarters, and full name of the representative of the religious organization or subordinate religious organization to be dissolved; the competent state agency or the directly managing religious organization or subordinate religious organization shall be responsible for dissolving it; the reasons, anticipated dissolution date accompanied by the conclusion of the state agency with the function of inspecting beliefs and religions regarding the organization's inability to rectify the cause leading to the suspension of all religious activities as stipulated in point c, Clause 1, Article 31 of the Law.

2. Within fifty days from the date the competent state agency notifies about the dissolution as provided for in point b, Clause 1, Article 31 of the Law, the religious organization or the directly managing subordinate religious organization shall be responsible for submitting a written explanation to the competent state agency specified in Clause 1 of this Article.

Ten days after the expiration of the explanation period, if the religious organization or the subordinate religious organization to be dissolved cannot rectify the cause leading to its dissolution, the competent state agency shall issue a decision to dissolve the religious organization or request the religious organization or subordinate religious organization to dissolve the subordinate religious organization.

3. Within sixty days from the date the competent state agency notifies about the dissolution as provided for in point c, Clause 1, Article 31 of the Law, the religious organization or subordinate religious organization to be dissolved shall be responsible for fully performing their obligations regarding assets as prescribed by civil laws. After the expiration of this period, the competent state agency shall issue a decision to dissolve the religious organization or request the religious organization or subordinate religious organization to dissolve the subordinate religious organization.

The competent state agency specified in Clause 1 of this Article shall issue a decision to dissolve the religious organization or subordinate religious organization; revoke and recover the following documents:

a) Decision recognizing the religious organization for cases of dissolving a religious organization;

b) Documents approving the establishment, division, separation, merger, or consolidation of subordinate religious organizations issued by the competent state agency; documents establishing, dividing, separating, merging, or consolidating subordinate religious organizations issued by the religious organization or the directly managing subordinate religious organization for cases of dissolving a subordinate religious organization;

c) List of subordinate religious organizations.

5. In cases where a religious organization or subordinate religious organization dissolves a subordinate religious organization upon the request of the competent state agency, within five working days from the date of the request, the organization dissolving the subordinate religious organization shall be responsible for returning the relevant documents and notifying about the dissolution of the subordinate religious organization according to Clauses 5 and 6 of Article 10 of this Decree.

Article 12. Procedure and formalities for dissolving religious training institutions pursuant to the decision of religious organizations

1. Religious organizations dissolving religious training institutions pursuant to the decision of the responsible organization shall submit the application dossier to the state management agency on belief and religion at the central level.

The application documents include:

a) The application document shall clearly state the name and headquarters of the religious organization; the name, headquarters, organizational structure of the religious training institution; reasons and anticipated dissolution date;

b) Declaration of assets and finances;

c) Methods for handling assets and finances and the deadline for settling debts (if any); methods for resolving the rights of students and related persons.

2. The religious training institution shall notify the deadline for settling debts (if any) to relevant organizations and individuals according to the provisions of the law on five consecutive written or electronic newspapers at the central level for religious training institutions operating in multiple provinces, and at the local level for religious training institutions operating in one province.

3. The state management agency on belief and religion at the central level shall approve the religious organization's dissolution of the religious training institution within forty-five days from the expiration of the debt settlement deadline (if any) and asset liquidation recorded in the organization's announcement without any objections; in case of disapproval, it must respond in writing and specify the reasons.

4. Within no more than five working days from the date of approval of the dissolution of the religious training institution, the religious organization shall be responsible for dissolving the religious training institution and submitting the original approval document for establishing the religious training institution issued by the competent state authority; the original establishment document of the religious training institution issued by the religious organization; certificate or confirmation document from the public security agency regarding the submission and cancellation of the seal of the dissolved religious training institution in accordance with regulations.

5. Within twenty days from the date of dissolution of the religious training institution, the religious organization shall be responsible for notifying in writing the dissolution of the religious training institution to the state management agency on belief and religion at the central level.

The notification document shall clearly state the name and headquarters of the religious organization; the name, headquarters, and full name of the representative of the dissolved religious training institution; the dissolution date.

Article 13. Procedure and formalities for dissolving religious training institutions as stipulated in point b and point c, Clause 1, Article 42 of the Law

1. Sixty days prior to the planned dissolution of the religious training institution as stipulated in point b and point c, Clause 1, Article 42 of the Law, the state management agency on belief and religion at the central level shall notify in writing the religious organization and the religious training institution about the dissolution of the religious training institution.

The notification document shall clearly state the name, headquarters, and full name of the representative of the religious organization; the name, headquarters, and full name of the representative of the dissolved religious training institution; the state management agency on belief and religion at the central level or the religious organization responsible for dissolution; reasons, anticipated dissolution date accompanied by the conclusion of the state functional inspection agency on belief and religion regarding the failure of the religious training institution to address the causes leading to suspension of religious training activities as stipulated in point c, Clause 1, Article 42 of the Law.

2. Within fifty days from the date the state management agency on belief and religion at the central level notifies the dissolution for cases stipulated in point b, Clause 1, Article 42 of the Law, the religious training institution shall submit an explanatory document to the state management agency on belief and religion at the central level.

After ten days from the expiration of the explanation period, if the religious training institution fails to address the causes leading to its dissolution, the state management agency on belief and religion at the central level shall issue a dissolution decision or request the religious organization to dissolve the religious training institution.

3. Within sixty days from the date the state management agency on belief and religion at the central level notifies the dissolution for cases stipulated in point c, Clause 1, Article 42 of the Law, the dissolved religious training institution shall fulfill all property obligations under civil law regulations. Upon expiration of this period, the state management agency on belief and religion at the central level shall issue a dissolution decision or request the religious organization to dissolve the religious training institution.

4. The state management agency on belief and religion at the central level shall issue a dissolution decision for the religious training institution; revoke and recover the approval document for establishing the religious training institution issued by the competent state authority; the original establishment document of the religious training institution issued by the religious organization.

5. In cases where the religious organization dissolves the religious training institution upon the request of the state management agency on belief and religion at the central level, within no more than five working days from the date of the request, the religious organization shall be responsible for dissolving the religious training institution and submitting the documents as stipulated in Clause 4 of this Article and notifying the dissolution of the religious training institution in accordance with Clause 5 of Article 12 of this Decree.

Article 14. Obligation to Announce Dissolution of Religious Organizations, Subordinate Religious Organizations, and Religious Training Institutions on Mass Media

1. The dissolution of religious organizations, subordinate religious organizations, and religious training institutions must be publicly announced in three issues of newspapers or online newspapers at the central level or local level where the headquarters of the religious organization, subordinate religious organization, or religious training institution is located within fifteen days after the dissolution.

2. The competent state agency, religious organizations, and subordinate religious organizations with the right to dissolve shall be responsible for the announcement in accordance with Clause 1 of this Article.

Article 15. Termination of Activities and Right to Protest of Religious Organizations, Subordinate Religious Organizations, and Religious Training Institutions Upon Dissolution

1. Religious organizations, subordinate religious organizations, and religious training institutions cease operations from the date the competent state agency decides on their dissolution.

2. If religious organizations, subordinate religious organizations, and religious training institutions subject to dissolution under Articles 11 and 13 of this Decree disagree with the decision of the competent state agency, they have the right to protest in accordance with the law on protests. During the time awaiting resolution of the protest, these organizations may not carry out religious activities or religious training activities.

Article 16. Renovation, Upgrading, and New Construction of Worship Facilities, Religious Facilities, and Ancillary Facilities

1. Renovation, upgrading, and new construction of ancillary facilities shall be carried out in accordance with Clause 2 and Clause 3 of Article 58 of the Law.

2. When renovating or installing equipment inside worship facilities or religious facilities that are not historical-cultural relics or scenic spots classified by the competent state agency without changing the load-bearing structure, function, or affecting the environment and safety of the facility, a construction permit is exempted.

Article 1. Subjectsograms andSection IV

APPROVAL, REGISTRATION OF FOREIGN ELEMENTS IN CONSECRATION, APPOINTMENT, ELECTION, AND REMOVAL

Article 17. Procedures and Formalities for Approval of Consecration, Appointment, Election, and Removal with Foreign Elements in Vietnam

1. Religious organizations with Vietnamese citizens as followers who are proposed for consecration, appointment, election, or removal by foreign religious organizations to serve as clergy or religious officials in Vietnam shall be responsible for submitting the application dossier to the central state management agency for beliefs and religions.

The application documents include:

a) The application document clearly states the name and headquarters of the proposing religious organization; the name and headquarters of the foreign religious organization; the reasons for the proposal; the full name of the person proposed; the rank, position, and area of responsibility before and after consecration, appointment, election, or removal;

b) A summary of the religious activities of the person proposed for consecration, appointment, election, or removal;

c) Curriculum vitae and judicial record of the person proposed for consecration, appointment, election, or removal.

2. Religious organizations in Vietnam that confer consecration or remove ranks for foreigners legally residing in Vietnam shall be responsible for submitting the application dossier to the central state management agency for beliefs and religions.

The application documents include:

a) The application document clearly states the name and headquarters of the religious organization; the reasons for the proposal; the full name, rank (if applicable), nationality of the person proposed; the rank proposed;

b) A summary of the religious activities of the person proposed;

c) Graduation certificate issued by a religious training institution in Vietnam;

d) Copy of passport, original or certified copy of judicial record or document confirming that the proposed person is not a criminal or being pursued for criminal responsibility issued by the competent authority of the foreign country, legalized by consular legalization, except in cases where consular legalization is waived according to reciprocity principles under international treaties to which Vietnam is a party. In case the proposed person has continuously resided in Vietnam for more than six months, there must also be an original judicial record issued by the competent authority of Vietnam.

3. The central state management agency for beliefs and religions shall respond in writing regarding the consecration, appointment, election, or removal specified in Clause 1 and Clause 2 of this Article within sixty days from the date of receipt of a complete and valid application dossier; if disapproved, it must provide a written response stating the reasons.

4. Persons with foreign elements who have not been approved by the central state management agency for beliefs and religions shall not use such titles to conduct religious activities in Vietnam.

Article 18. Procedures and formalities for registering Vietnamese citizens to serve as religious officials and functionaries abroad

1. When Vietnamese citizens who have been ordained, appointed, elected, or nominated by foreign religious organizations return to Vietnam to serve as religious officials and functionaries, the religious organization or the directly managing subordinate religious organization shall be responsible for submitting registration files to the state management agency on belief and religion at the central level.

The registration documents include:

a) The registration document clearly states the name and headquarters of the religious organization or the directly managing subordinate religious organization; the full name, area of responsibility, rank, and position of the person being registered both abroad and in Vietnam;

b) Curriculum vitae and judicial record of the person being registered;

c) A summary of the religious activities of the person being registered abroad;

d) Documents proving the rank, position, and area of operation of the person who has been ordained, appointed, elected, or nominated abroad.

2. The state management agency on belief and religion at the central level shall be responsible for replying in writing within sixty days from the date of receiving complete valid registration files; in case of rejecting the registration, it must reply in writing and specify the reasons.

3. Vietnamese citizens who have registered to serve as religious officials and functionaries may engage in religious activities according to their ranks and positions after the state management agency on belief and religion at the central level approves the registration.

Chapter V

ACTIVITY OF SOLICITING DONATIONS; RECEIVING AND MANAGING FOREIGN ORGANIZATIONS' AND INDIVIDUALS' FINANCIAL ASSISTANCE

Article 19. Solicitation activities of belief premises, religious organizations, and subordinate religious organizations

1. Belief premises, religious organizations, and subordinate religious organizations organize solicitation activities to carry out belief activities, religious activities, and social welfare activities based on the voluntary contributions of domestic organizations and individuals in accordance with relevant laws.

2. The representative or management board of the belief premise; religious organization, or subordinate religious organization shall be responsible for notifying in writing to the competent state authority as stipulated in Clause 3 of this Article about the organization of solicitation activities, specifying the purpose, area, method, time of solicitation; and the management and utilization methods of the solicited assets.

3. Competent authority to receive notifications:

a) Five working days before organizing the solicitation activity, the belief premise, religious organization, or subordinate religious organization shall be responsible for notifying in writing to the People's Committee of the commune where the solicitation activity takes place in cases of solicitation within the territory of one commune;

b) Ten days before organizing the solicitation activity, the belief premise, religious organization, or subordinate religious organization shall be responsible for notifying in writing to the People's Committee of the district where the solicitation activity takes place in cases of solicitation outside the territory of one commune but within the territory of one district, town, city under province, or city under central municipality;

c) Fifteen days before organizing the solicitation activity, the belief premise, religious organization, or subordinate religious organization shall be responsible for notifying in writing to the People's Committee of the province where the solicitation activity takes place in cases not covered by points a and b of Clause 3 of this Article.

4. Solicitation activities of belief premises, religious organizations, and subordinate religious organizations must maintain accounting records ensuring transparency and clarity. Solicited assets must be managed and utilized according to the announced purposes, serving belief activities, religious activities, and social welfare activities.

5. It is prohibited to exploit the name of belief premises, religious organizations, or subordinate religious organizations to solicit donations for personal gain or contrary to the purpose of solicitation.

6. The competent state authority receiving notifications shall be responsible for inspecting the implementation of the contents stipulated in Clauses 4 and 5 of this Article.

Article 20. Religious organizations, subordinate religious organizations receiving foreign funding from organizations and individuals

Religious organizations, subordinate religious organizations receiving foreign funding from organizations and individuals to support religious training and education for full-time religious workers; repair, renovate, upgrade, and construct new religious facilities; organize religious ceremonies; publish, import religious books and religious items shall comply with the Government's regulations on managing and using non-refundable aid.

Chapter VI

IMPLEMENTATION

Article 21. Forms for administrative procedures in the field of belief and religion

1. The forms for administrative procedures in the field of belief and religion are attached to this Decree.

2. Relevant agencies, organizations, and individuals shall use the forms for administrative procedures in the field of belief and religion issued together with this Decree.

Article 22. Responsibilities of the Ministry of Home Affairs and related agencies

1. The Ministry of Home Affairs is the state management agency for beliefs and religions at the central level, responsible before the Government for state management of religions; belief activities and belief facilities not covered under Clause 2 of this Article.

2. The Ministry of Culture, Sports and Tourism is responsible before the Government for state management of belief festivals and belief facilities that are historical-cultural relics or scenic spots ranked or included in the inventory of relics by provincial People's Committees.

3. Ministries and agencies equivalent to ministries within their respective duties and powers have the responsibility to assist the Government in state management of beliefs and religions.

4. In implementing the provisions of the Law on Belief and Religion and this Decree, cases within the jurisdiction of the Ministry of Home Affairs, the Government Office of Religion (Ministry of Home Affairs) shall be responsible for receiving applications, taking the lead, coordinating with relevant ministries, sectors, and localities to advise the Minister of Home Affairs to make decisions. Cases within the jurisdiction of People's Committees at all levels, specialized agencies on beliefs and religions at the same level shall be responsible for receiving applications, taking the lead, coordinating with relevant agencies to advise the People's Committee to make decisions, except for organizing belief festivals; managing and using revenue from organizing belief festivals as stipulated in Articles 13, 14, and 15 of the Law.

Article 23. Receiving Applications

1. Organizations and individuals when implementing administrative procedures according to the Law on Belief and Religion and this Decree shall be responsible for directly sending, mailing, or submitting through online public services one set of application documents to the competent state agency.

2. Upon receiving complete and valid application documents, the competent state agency must issue a receipt for the result. If the application documents are incomplete or invalid, the competent state agency shall be responsible for guiding organizations and individuals to supplement the documents in accordance with the regulations. The time taken to complete the documents will not be counted towards the response deadline.

Article 24. Effective Date

1. This Decree takes effect from January 1, 2018.

2. Decision No. 92/2012/NĐ-CP dated November 8, 2012 of the Government detailing and providing implementation measures for the Ordinance on Beliefs and Religions ceases to be effective from the date this Decree takes effect.

Article 25. Responsibilities for Implementation

The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial and municipal people's committees directly under the central government shall be responsible for enforcing this Decree./.
