DECISION OF THE PRIME MINISTER

REGARDING THE REPORTING SYSTEM

 

BASED ON Article 32 and Article 33 of the Government's Operational Regulations issued together with Decree No. 13/CP dated December 1, 1992, the Prime Minister stipulates the reporting system as follows:

 

I- REPORTING SYSTEM WITH THE PRIME MINISTER.

Ministries, ministerial-level agencies, and government agencies (hereinafter referred to collectively as "Ministries"), provincial People's Committees, and municipal People's Committees directly under the central government (hereinafter referred to as "province") must report to the Prime Minister on the following reports:

1- Monthly report applicable for each month of the year, except June and December, with the following contents:

Evaluation of the implementation of economic and social tasks, state budget, and specialized tasks within the sector or locality.

Situation and results of implementing important decisions of the Government and the Prime Minister in the sector, field, or locality.

Preparation situation of draft projects to be submitted to the Government and the Prime Minister (for Ministries assigned such tasks). Main activities of the Minister, deputy minister, or head of a ministerial-level agency or government agency, and the Chairman of the provincial People's Committee in organizing, directing, and managing economic and social issues, public order, national defense, security, and foreign affairs; cases that have been adjudicated, and arrests of foreign and domestic vessels.

In the month when there is a session of the Provincial People's Council, the monthly report of the People's Committee must clearly state the contents of the Resolutions of the session, paying attention to the consistency between the People's Council Resolutions and the current policies, decisions of the Government and the Prime Minister.

Reports must be specific, detailing achievements and shortcomings, causes, and recommendations to the Government and the Prime Minister.

The monthly report must be sent to the Government Office before the 25th of each month, in two copies.

2- Mid-year report must reflect:

Evaluation of the implementation of tasks, plans, and state budget of the sector, field, and main economic and social development projects, local programs; implementation of government work programs and key national projects on economy and society, science and technology that the Ministry is responsible for organizing.

Evaluation of the performance of the Ministry's and the provincial People's Committee's state management functions, achievements, shortcomings, and measures needed to improve state management tasks, and recommendations to the Government and the Prime Minister.

Forecast of main tasks of the sector, field, and locality in the last six months of the year and guidance measures from the Ministry and the provincial People's Committee.

The mid-year report must be sent to the Government Office before June 15, in two copies.

3- Annual report has the same content as the mid-year report but must review and evaluate the implementation of tasks throughout the year and propose directions and tasks for the next year.

The annual report must be sent to the Government Office before December 10, in two copies.

4- Emergency report: In case of significant internal or external events within the responsibility of the sector or locality that the Prime Minister needs to know to direct handling. The report must include:

Summary of the event's development and its cause.

Measures taken to handle the situation, results of handling, and recommendations to the Government and the Prime Minister.

The emergency report must be sent to the Government Office using the fastest method.

5- Special topic report applies to important programs, projects, and special tasks according to the requirements of the Prime Minister. The Minister and the Director of the Government Office will notify relevant agencies about the requirements for the special topic report.

6- Weekly report by the Minister and the Director of the Government Office and must be sent to the Prime Minister and Deputy Prime Ministers on Monday morning of the following week, with the following contents:

Internal and external situations emerging in the week that the Prime Minister and Deputy Prime Ministers need to know to direct overall operations.

Summary of the Prime Minister and Deputy Prime Ministers' leadership and management activities in the week.

7- Besides the above reports, the following agencies must submit comprehensive reports to the Prime Minister on the following areas:

General Statistics Office submits a comprehensive report on the implementation of the state plan and major balances of the national economy (quarterly, semi-annually, nine-monthly, and annually), and a monthly report in special cases.

State Planning Commission submits a comprehensive evaluation report on the implementation of the state plan (quarterly, semi-annually, nine-monthly, and annually) and major balances of the national economy, proposing solutions to implement the state plan.

Ministry of Finance submits a comprehensive report on the implementation of the state budget (quarterly, semi-annually, nine-monthly, and annually), proposing measures to implement the plan and state budget.

Ministry of Home Affairs reports on the situation of maintaining public order and protecting state assets (semi-annually, annually).

State Audit Office reports on anti-corruption efforts (quarterly, semi-annually, annually), and the situation of resolving citizens' complaints and petitions (semi-annually, annually).

Ministry of Foreign Affairs reports on foreign activities, international and regional situations related to the country's foreign policy (semi-annually, annually), and may submit emergency reports if necessary.

Ministry of Science, Technology, and Environment reports on the implementation of national-level research projects, innovative inventions applied in various fields of economy, culture, and society (semi-annually, annually).

8- Ministers, heads of ministerial-level agencies, and government agencies, and Chairmen of provincial People's Committees must sign the reports sent to the Prime Minister. The Minister or Chairman of the provincial People's Committee may delegate a deputy to sign and send monthly and emergency reports to the Prime Minister, and they remain responsible for the reports signed by the delegated person.

9- Consolidated legal texts (including joint Circulars) issued by Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally governed cities must be sent to the Office of the Government in their original form for reporting to the Prime Minister.

II- INFORMATION SYSTEM ON THE ACTIVITIES OF THE GOVERNMENT,

THE PRIME MINISTER.

1- Once a month, the Minister, Head of the Office of the Government shall send information to members of the Government, Heads of agencies under the Government, and Chairpersons of People's Committees of provinces regarding:

The summary of the State management activities of the Government and the guidance and direction activities of the Prime Minister and Deputy Prime Ministers.

The implementation status of important decisions of the Government,

At all levels and sectors.

The implementation of the Government's work program for the month and significant activities of the Government and the Prime Minister for the following month.

2- Information on the activities of the Government for the press.

Monthly, the Minister, Head of the Office of the Government shall provide information to the press about the main activities and important decisions of the Government and the Prime Minister; announce in the press the contents of Government meetings, except for issues within the scope of national secrets.

Upon the authorization of the Prime Minister, the Ministers and Heads of ministerial-level agencies, agencies under the Government shall explain to the press important domestic and foreign policies of the Government.

The Office of the Government is responsible for organizing this information activity; regularly working with news agencies to collect and analyze public opinion to serve the guidance and direction of the Prime Minister and Deputy Prime Ministers.

III- IMPLEMENTATION

1- This reporting system replaces previous regulations and will take effect from March 1, 1993.

2- Ministers, Heads of ministerial-level agencies, agencies under the Government, and Chairpersons of People's Committees of provinces and centrally governed cities shall base on this Decision to specify the information reporting system in their respective fields, sectors, and localities, promptly rectify information management activities, and modernize information systems.

3- The Minister, Head of the Office of the Government is responsible for supervising and inspecting the implementation of this Decision. Periodically, the Office of the Government shall provide information guidelines and clearly state reporting requirements for agencies to meet information needs accurately and effectively support the guidance and direction of the Government and the Prime Minister./.
