DECISION OF THE MINISTER OF FINANCE
Regarding the assignment of tasks to manage the Fund for Supporting Enterprise Restructuring and Shareholding Reform
to units under the Ministry and directly under the Ministry.
THE MINISTER OF FINANCE
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decision No. 177/1999/QĐ-TTg dated August 30, 1999 of the Prime Minister on the organization and operation of the Fund for Supporting Enterprise Restructuring and Shareholding Reform;
Pursuant to Decision No. 95/2000/QĐ-BTC dated June 9, 2000 of the Minister of Finance on the issuance of the Management Regulations for the Collection, Allocation, and Utilization of the Fund for Supporting Enterprise Restructuring and Shareholding Reform;
Upon the proposal of the Director of the State Enterprise Financial Department, the Director of the Budget Department, and the General Director of the National Treasury,
DECISION:
Article 1: Assign the State Enterprise Financial Department to perform the following tasks:
1. Assist the Minister of Finance in performing state management functions over the activities of the system of Funds for Supporting and Restructuring Enterprises nationwide in various fields:
a. Guide and supervise the management and utilization of the Fund in accordance with the regulations of the State.
b. Aggregate and report to the Minister of Finance the plan for collecting and using the Fund at all levels, and the plan for managing the Fund's resources throughout the country.
c. Balance the revenues and expenditures of the Fund nationwide, develop plans for supplementary funding from the State Budget for the Fund to be submitted to the Minister of Finance for approval.
d. Implement the adjustment of the Fund according to the approved plan by the Minister of Finance.
đ. Organize inspections of the management and utilization of the Fund in localities and the 91 State-owned Corporations. Regularly (monthly, quarterly, annually) aggregate the management and utilization situation of the Fund at three levels (central, local, 91 State-owned Corporations) and report to the Minister of Finance.
e. Inspect and consolidate annual revenue and expenditure reports of the Fund from localities and the 91 State-owned Corporations. Aggregate and consolidate the annual revenue and expenditure of the entire Fund system to be submitted to the Minister of Finance for approval to report to the Prime Minister.
2. Assist the Minister of Finance in directly managing and operating the Fund for Supporting Enterprise Restructuring and Shareholding Reform (including international organizations' financial support for the Fund).
a. Supervise and coordinate with ministries and sectors to urge enterprises under their central management to transfer Fund revenues according to regulations.
b. Receive and review applications for Fund disbursements from ministries or enterprises (including applications to retain proceeds from selling shares of the 90 State-owned Corporations) and submit them to the Minister of Finance for approval; implement procedures for disbursing the Fund to support enterprises after receiving the Minister of Finance's decision.
c. Inspect and supervise the management and utilization of Fund resources at supported enterprises.
d. Organize accounting and regularly (quarterly, annually) report to the Minister of Finance the situation of Fund revenues and expenditures.
đ. Conduct annual settlement of Fund revenues and expenditures when the accounting period ends.
3. The Minister of Finance authorizes the Director of the State Enterprise Financial Department to sign payment orders for the Fund to the National Treasury to transfer funds to enterprises after the Minister of Finance's decision on Fund disbursement.
Article 2: The National Treasury assists the Minister of Finance in performing the following tasks:
1. Guide the Fund for Supporting Enterprise Restructuring and Shareholding Reform at all levels to open and use Fund accounts.
2. Implement the adjustment of the Fund according to the Minister of Finance's decision and payment orders from the Director of the State Enterprise Financial Department.
3. Transfer funds to beneficiaries according to payment orders from the Director of the State Enterprise Financial Department.
4. Regularly (monthly, quarterly, annually) confirm the balance of Fund deposits at all levels (central, local, 91 State-owned Corporations) and notify the State Enterprise Financial Department according to the attached form.
5. Coordinate with the Fund management agency to conduct the settlement of the Fund.
Article 3: The State Budget Department shall be responsible for allocating resources within the annual budget balance based on the Fund's needs and requirements to provide supplementary funding to the Fund according to the Minister of Finance's decision.
Article 4: This Decision takes effect from the date of signing. The Director of the State Enterprise Financial Department, the General Director of the National Treasury, the Director of the State Budget Department, the Director of the Organization and Training Department, the Head of the Ministry of Finance's Office, and the heads of related units are responsible for implementing this Decision. /
