JOINT CIRCULAR OF THE MINISTRY OF NATIONAL DEFENSE AND THE MINISTRY OF FINANCE NO. 163/2002/TTLT-BQP-BTC DATED NOVEMBER 8, 2002 GUIDING THE IMPLEMENTATION OF DECISION NO. 116/2002/QD-TTg DATED SEPTEMBER 17, 2002 OF THE PRIME MINISTER ON THE REGIME OF ALLOWANCES FOR MANAGEMENT OF TEMPORARY DETENTION CAMPS AND TEMPORARY HOLDING HOUSES UNDER THE MINISTRY OF NATIONAL DEFENSE
Implementing Decision No. 116/2002/QD-TTg dated September 17, 2002 of the Prime Minister on the regime of allowances for management of temporary detention camps and temporary holding houses under the Ministry of National Defense. The Ministry of National Defense and the Ministry of Finance hereby jointly guide the implementation as follows:
I. OBJECTS AND AMOUNTS OF ALLOWANCES
1. An allowance of 10% calculated based on the rank salary for officers, grade salary for professional soldiers, civil servants of the National Defense, or military rank allowance for non-commissioned officers and soldiers (including position allowance if applicable) shall be applied to wardens, deputy wardens, assistant custodians, educators, medical staff directly examining and treating prisoners, and guards working at temporary detention camps under Military Zones 2, 3, 4, 5, 9, Hanoi Capital Military Zone, Military Corps 1, 2, 3, and 4.
2. An allowance of 5% calculated based on the rank salary for officers, grade salary for professional soldiers, civil servants of the National Defense, or military rank allowance for non-commissioned officers and soldiers (including position allowance if applicable) shall be applied to other cadres, soldiers, civil servants of the National Defense working at temporary detention camps and those performing specialized tasks at 25 temporary holding houses under the People's Military Command of the provinces: Cao Bang, Lang Son, Bac Giang, Lai Chau, Son La, Lao Cai, Ha Giang, Quang Ninh, Hoa Binh, Hai Duong, Thanh Hoa, Quang Binh, Thua Thien Hue, Binh Dinh, Khanh Hoa, Dak Lak, Kon Tum, Binh Phuoc, Tay Ninh, Binh Thuan, Lam Dong, Ca Mau, Kien Giang, Ben Tre, and Dong Thap.
3. In cases where the number of temporary detention camps and temporary holding houses increases or decreases according to the requirements of the Ministry of National Defense, the application or cessation of the above regimes shall be decided after consultation with the Ministry of Finance.
II. METHOD OF PAYMENT
1. The allowance for managing temporary detention camps and temporary holding houses shall be paid based on the actual number of working days in the month at the temporary detention camp or temporary holding house, and shall be paid together with the monthly salary according to the following formula:

2. Days off, study leave, sick leave... when not performing regular work at the temporary detention camp or temporary holding house shall not be eligible for this allowance.
III. IMPLEMENTATION ORGANIZATION
The allowance regime for managing temporary detention camps and temporary holding houses shall be implemented from September 1, 2002.
In 2002, the funding for payment shall be self-balanced by the Ministry of National Defense within the regular budget allocated by the State. From 2003 onwards, it will be included in the annual regular budget estimate of the Ministry of National Defense.
Any difficulties or issues encountered during implementation should be reported to the joint ministries for consideration and resolution.
