Guidelines for Implementing Decision No. 116/2002/QĐ-TTg dated September 17, 2002
of the Prime Minister on the allowance system for management at temporary detention centers and holding houses under the Ministry of National Defense
Implementing Decision No. 116/2002/QĐ-TTg dated September 17, 2002 of the Prime Minister on the allowance system for management at temporary detention centers and holding houses under the Ministry of National Defense, the Ministry of National Defense and the Ministry of Finance jointly provide guidelines as follows:
I. OBJECTS AND ALLOWANCE LEVELS
1. An allowance of 10% of the rank salary for officers, grade-level salary for professional military personnel, defense civil servants, or insignia allowance for non-commissioned officers and soldiers (including position allowances, if applicable) shall be applied to Wardens, deputy wardens, Detention Assistants, Guards, medical staff directly examining and treating prisoners, and security personnel working at temporary detention centers under Military Regions 2, 3, 4, 5, 9, Hanoi Capital Military Region, and Divisions 1, 2, 3, and 4.
2. An allowance of 5% of the rank salary for officers, grade-level salary for professional military personnel, defense civil servants, or insignia allowance for non-commissioned officers and soldiers (including position allowances, if applicable) shall be applied to other cadres, soldiers, and defense civil servants working at temporary detention centers and those performing specialized duties at 25 holding houses under the People's Military Command of the provinces: Cao Bang, Lang Son, Bac Giang, Lai Chau, Son La, Lao Cai, Ha Giang, Quang Ninh, Hoa Binh, Hai Duong, Thanh Hoa, Quang Binh, Thua Thien-Hue, Binh Dinh, Khanh Hoa, Dak Lak, Kon Tum, Binh Phuoc, Tay Ninh, Binh Thuan, Lam Dong, Ca Mau, Kien Giang, Ben Tre, and Dong Thap.
3. In cases where the number of temporary detention centers and holding houses increases or decreases according to requirements, the Ministry of National Defense will decide on the application or cessation of the aforementioned systems after consultation with the Ministry of Finance.
II. CALCULATION METHOD
1. The management allowance for temporary detention centers and holding houses shall be calculated based on the actual number of working days in the month at the temporary detention center or holding house and paid together with the monthly salary according to the following formula:

2. Days off, study leave, illness, etc., during which work is not performed at the temporary detention center or holding house, shall not be eligible for this allowance.
III. IMPLEMENTATION
The allowance system for management at temporary detention centers and holding houses shall be implemented from September 1, 2002.
In 2002, the funding for payment shall be self-balanced by the Ministry of National Defense within the regular budget allocated by the State. From 2003 onwards, it shall be included in the annual regular budget estimate of the Ministry of National Defense.
Any difficulties or issues encountered during implementation should be reported to the relevant ministries for consideration and resolution./.
