On the integration of national defense with economic and social affairs and economic and social affairs with national defense

On the basis of Law on Government Organization dated June 19, 2015;
On the basis of Law on National Defense dated June 8, 2018;
"Based on the proposal of the Minister of National Defense;"
The Government issues this Decree to provide detailed regulations on the integration of national defense with economic and social development and vice versa.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree provides detailed regulations on Clause 3, Article 15 of the Law on National Defense regarding the principles, bases, contents, forms of implementation of the integration of national defense with economic and social development and vice versa; responsibilities of ministries, sectors, and localities related thereto.
Article 2. Applicability
1. Vietnamese citizens, ministries, sectors, localities, political organizations, socio-political organizations.
2. Economic organizations, public institutions, Vietnamese enterprises.
3. Individuals and organizations from foreign countries residing, investing, operating, and conducting activities in Vietnam.
Article 3. Explanation of Terms
1. National defense demand plan is a collection of demands for national defense tasks to meet the requirements of protecting the country.
2. The ability to integrate national defense with economic and social development during peacetime, emergency situations concerning national defense, and war conditions is specific content that organizations and individuals must implement when deploying strategies, plans, projects, and important national programs for economic and social development of ministries, sectors, regions, and localities.
3. Dual-use investment and construction projects are investment and construction projects planned and arranged by competent state agencies in accordance with the requirements for economic and social development during peacetime and ready to be converted to serve national defense needs when there are emergency situations concerning national defense or war.
4. Economic-defense zones are areas with defined boundaries including several communes of one or more districts, belonging to one or more provinces, particularly difficult communes, remote areas, border areas, strategic areas concerning national defense and security, maritime and island areas, exclusive economic zones, and continental shelves of the Socialist Republic of Vietnam, consistent with the national planning system. Within these areas, the Ministry of National Defense leads and coordinates with relevant ministries, sectors, and localities to implement the goal of economic and social development combined with the consolidation of national defense and security.
5. Economic-defense team is a military unit established by the Ministry of National Defense to implement the goals and tasks of building and developing economic-defense zones.
6. Defense service enterprise is an enterprise established or organized in accordance with the law to perform defense tasks and participate in economic and social development.
7. Military units assigned to perform economic tasks combined with national defense are organizations under the Ministry of National Defense engaged in labor, production, and economic construction activities, managed and operated in accordance with the law.
Article 4. Principles of Combining National Defense with Economic-Social Development and Economic-Social Development with National Defense
1. Under the absolute and direct leadership of the Party in all aspects, the centralized and unified management of the State, contributing to strengthening and enhancing the national defense potential, improving combat strength and readiness, mobilizing the strength of the entire Party, people, military, and political system in the cause of building and defending the country.
2. Ensuring the unity and synchronization of national defense activities with strategies, plans, and projects for economic and social development; clearly defining short-term and long-term goals; integrated activities must be implemented throughout the entire process from the formulation, review to the implementation of strategies, plans, and projects for economic and social development over the short, medium, and long term in each project and program according to regions and territories; in all sectors and fields of the national economy of ministries, sectors, localities, and related organizations and individuals.
3. Clearly defining the responsibilities of ministries, sectors, and localities in combined national defense and economic-social development activities.
Article 5. Basis for Combination
1. The new strategy for protecting the Fatherland, the National Defense Strategy of Vietnam, the Military Strategy of Vietnam, the National Security Strategy, the Border Protection Strategy, the Vietnam Sea Strategy, the Strategy for Protecting the Fatherland in Cyberspace, and related contents.
2. The determination to defend the Socialist Fatherland of Vietnam. The overall planning for the deployment of national defense.
3. National defense mobilization plans of ministries, sectors, agencies, organizations, military regions, provincial levels, and district levels approved by competent authorities.
4. Planning for troop deployment and force allocation of People's Army units and Self-Defense Militia units.
5. National-level master plans, regional plans, provincial plans, special administrative-economic unit plans, urban plans, rural plans; strategies and plans for economic and social development at different stages approved by competent authorities.
6. Plans for constructing provincial and centrally-administered city defense areas into solid defense areas.
7. Military and national defense tasks of units in each period approved by the competent authority.

Chapter II
COMBINING NATIONAL DEFENSE WITH ECONOMIC-SOCIAL DEVELOPMENT
Article 6. Content of Combination
Integrating national defense with economic and social development includes combining all activities related to national defense with the implementation of strategies, plans, and projects for economic and social development by ministries, sectors, and localities; ensuring a stable environment for the country's economic and social development.
Article 7. Combination in Building Comprehensive Planning for National Defense Deployment
The Ministry of National Defense leads and coordinates with ministries, sectors, and localities to build, review, and adjust the overall plan for the integration of national defense deployment with economic and social development across the country for approval by the Prime Minister. Based on the Prime Minister's approval, the Ministry of National Defense leads and coordinates with ministries, sectors, and localities to implement and unify measures for managing and implementing the overall plan for the integration of national defense deployment with economic and social development.
Article 8. Integration in the construction and development of economic-military zones
1. In the work of planning economic-military zones:
a) The Prime Minister directs the organization to establish the overall plan for economic-military zones;
b) The Ministry of National Defense is responsible for building tasks for planning to be approved by the Prime Minister; selecting consulting organizations for planning, building the overall plan, reporting to the Prime Minister to establish a Council to review and approve the overall plan for constructing and developing economic-defense zones;
c) The Ministry of National Defense directs the detailed planning of economic-defense zones; directs units to prepare detailed plans; assigns main units under the Ministry of National Defense to coordinate with relevant agencies and provincial People's Committees to build tasks for planning to be approved by the Minister of National Defense; selects consulting organizations for planning, builds detailed plans, reports to the Minister of National Defense to establish a Review Council to review and approve detailed plans for constructing and developing economic-defense zones;
d) Provincial People's Committees and central city People's Committees; ministries and sectors have the responsibility to cooperate with the Ministry of National Defense in planning the construction and development of economic-defense zones in accordance with the law.
2. In implementing the goals and tasks of constructing and developing economic-military zones
a) The Prime Minister directs the establishment of mechanisms for priority resource allocation in national target programs and key projects to be implemented in economic-military zones;
b) The Ministry of National Defense leads coordination with ministries, sectors, and localities
Ensuring national defense and security in strategic areas, borders, seas, and islands contributes to the development of the economy and society in project areas; building and consolidating the defensive posture in land, sea, and island areas linked with essential infrastructure investment, combined with population resettlement and stabilization according to regional and territorial development plans, various industries and fields, and economic and social development plans of each locality;
Building strong areas in terms of national defense, security, and economic and social development; promoting propaganda and mobilizing the people to understand and implement well the policies and laws of the Party and the State, the political tasks of the locality, and the struggle against hostile forces' propaganda and incitement tactics.
Participate in arranging and resettling residents according to the planning for economic and social development and the long-term goals of national defense and security. Based on the approved planning for economic and defense zones and the local plans for resettling and stabilizing residents, the Ministry of National Defense will coordinate with localities to organize the reception, arrangement, resettlement, and stabilization of the livelihoods of local residents and those who migrate to live in the area; organize the arrangement of residents to engage in business and living activities and settle down in coastal areas, islands, and distant archipelagos with strategic positions; implement the goal of ensuring national defense and security in conjunction with the economic, cultural, and social development of the locality.
Invest in building essential infrastructure in the economic and defense zones on land, coastal areas, and islands according to approved planning; participate in implementing national target programs, agricultural extension programs, and industrial promotion programs to create a foundation for the development of commodity economies, helping people to escape poverty sustainably.
Build and consolidate national defense potential based on supporting production development, guiding, and transferring dual-use service models to the people; develop commodity economies, help people escape poverty sustainably; form suitable economic models in difficult coastal and island regions; act as a bridge between the mainland and islands, organizing marine service activities to help people stay at sea for extended periods, contributing to strengthening civilian activities in strategic maritime and island areas.
Participate in activities aimed at improving and gradually enhancing the cultural, educational, material, spiritual life, and health care for the people in project areas, forming a people's national defense posture in the national protection strategy; contribute to environmental protection, preserving, and developing traditional culture.
c) Ministries, sectors, and localities have the responsibility to allocate and integrate resources, link national target programs and other investment programs on the territory to ensure that the Ministry of National Defense can carry out its tasks of constructing and developing economic and defense zones.
3. In organizing the construction and development of forces for economic-military zones
a) The Ministry of National Defense shall take the lead in organizing forces to construct economic and defense zones, establish economic and defense teams, and mobilize other forces to participate in constructing economic and defense zones in accordance with the provisions of the law.
b) Ministries, sectors, and localities have the responsibility to coordinate with the Ministry of National Defense in creating sources and allocating human resources when participating in socio-economic development activities in the locality. Create conditions for the construction forces of economic and defense zones to participate in the grassroots political system in the locality.
Article 9. Integration in the management of economic-defence zones
1. The Government shall uniformly manage state administration over the construction and development of economic-defence zones.
2. The Ministry of National Defense shall take the lead and coordinate with relevant ministries and sectors to assist the Government in managing state administration over the construction and development of economic and defense zones; guide, urge, and inspect the implementation of legal provisions on the construction of economic and defense zones.
3. Provincial People's Committees and municipal people's committees directly under the central government within their functions, tasks, and authorities shall be responsible for coordinating with the Ministry of National Defense and relevant ministries and sectors to manage state administration over the construction and development of economic and defense zones in their localities.
Article 10. Integration in the activities of enterprises serving national defence
1. The Ministry of National Defense shall cooperate with ministries, sectors, and localities to organize, manage, direct, and guide policies for enterprises serving national defense; manage industries and businesses according to the national defense strategy, planning, and development plan; build and develop enterprises serving national defense according to the direction and objectives of the economic and social development strategy, planning, and development plan. Inspect and check business operations; handle violations by enterprises in accordance with the law.
2. The Ministry of National Defense shall direct enterprises serving national defense to utilize potential including material bases and labor to participate in researching and producing dual-use products serving the national economy and the requirements of the Ministry of National Defense, with mechanisms to facilitate the participation of national defense technical industry facilities in researching and producing export products, generating revenue for the country.
3. Civilian enterprises have the responsibility to participate in investing in research and development of military technology and products serving national defense combined with economic and social activities when required, providing resources to better meet military and national defense tasks.
4. The Ministry of National Defense has the responsibility to prioritize assigning 100% state capital or enterprises with controlling shares of state capital appointed by the Ministry of National Defense to organize the implementation of investment projects related to national defense secrets, important national defense tasks, and investment projects in areas with significant national defense positions to meet the requirements of the Ministry of National Defense, in compliance with the law.
Article 11. Integration in the activities of military units assigned to perform economic tasks combined with national defence
1. Military units during their operational and combat readiness training must participate in production and economic construction combined with national defense and economic and social activities; utilize resources and infrastructure to participate in production to create products contributing to improving the living standards of officers and soldiers, contributing to the economic and social development of the garrison area. The combination of national defense with economic and social activities of military units must be carried out according to an appropriate sectoral, regional, and territorial structure in line with the national economic and social development strategy and national defense.
2. Central ministries and sectors shall take the lead and coordinate with the Ministry of National Defence to guide mechanisms and policies, allocate resources for military units when participating in production and economic construction.
Chapter III
ECONOMIC-SOCIAL INTEGRATION WITH NATIONAL DEFENCE
Article 12. Content of Integration
Combining economic and social activities with national defense includes combining in the formulation, review, and assessment of economic and social development strategies, plans, and projects of ministries, sectors, and localities; combining in regional and territorial development; combining in major sectors and fields of the economy.
Article 13. Combination in soliciting opinions for the formulation of economic and social development strategies, plans, and projects
1. The agency responsible for formulating national-level planning, regional planning, provincial planning, urban transportation infrastructure planning, rural planning, and special administrative-economic unit planning must submit documents seeking the opinion of the Ministry of National Defense.
2. Ministries, sectors, localities when building strategies, plans, and projects for economic and social development, and national important projects must submit documents to seek opinions from the Ministry of National Defense in accordance with the provisions of the law.
3. Ministries, sectors, localities have the responsibility to study and adopt the opinions of the Ministry of National Defense on combining national defense with economic and social development and economic and social development with national defense; in cases where there are differing opinions, they must submit a document to request the Ministry of National Defense or present it to the competent authority for consideration and decision.
Article 14. Integration in Reviewing Strategies, Plans, and Projects for Economic and Social Development Related to National Defense
1. The Ministry of National Defense has the responsibility to participate in the Review Committees for national-level planning, regional planning, provincial planning, territorial planning, special administrative-economic unit planning, urban planning, and rural planning related to national defense.
2. The national planning system; strategies, plans, and national important projects, economic and social development projects of ministries, sectors, and localities must be integrated with the overall construction of military positions at all levels of defense areas approved by the competent authority.
3. Detailed planning for investment and construction of civil works, industrial works, transportation, agriculture, rural development, technical infrastructure, and key projects must be consistent with the military position in the defense area, dual-purpose, ensuring readiness to switch to serve national defense needs.
4. The分级参与审查与国防有关的经济和社会发展战略、规划、计划和项目的实施如下:
a) The Ministry of National Defense participates in reviewing national-level planning; national economic and social development strategies and plans; national important projects; special administrative-economic units related to national defense under the approval or decision-making authority of the National Assembly, the Prime Minister, ministries, and sectors.
b) The Military Region Command participates in reviewing regional, provincial, urban, and rural planning; economic and social development plans and projects; key projects related to national defense within the approval authority of the Provincial People's Committee Chairperson in the military region.
c) The Hanoi Capital Command participates in reviewing economic and social development plans and projects of districts and counties in Hanoi City; economic and social development plans and projects related to national defense within the approval authority of the Hanoi City People's Committee Chairperson.
d) The Provincial Military Command participates in reviewing county-level economic and social development plans and projects related to national defense; economic and social development plans and projects related to national defense within the approval authority of the Provincial People's Committee Chairperson, except for Hanoi City.
đ) In special cases, upon the request of the competent authority, the Military Region Command, the Hanoi Capital Command, and the Provincial Military Command may participate in reviewing planning, projects, and development plans outside the provisions of points b, c, and d of Clause 4 of this Article.
Article 15. Integration in Major Sectors and Fields
1. Integration in Industry, Commerce, and Services
a) Investment and development of industries: Machinery, metallurgy, electricity, new energy, renewable energy, oil and gas, chemicals, industrial explosives, mining and mineral processing industry, consumer goods industry, food industry, and other processing industries; domestic trade and market; import and export, border trade, shipbuilding to meet both economic and social development needs and ensure service for national defense when required.
b) Industrial facilities during peacetime, in addition to investing and producing for domestic consumption and export, are ready to produce national defense goods and transfer technology to serve the national defense industry when required.
c) Development of diverse trading and service systems, focusing on border areas, mountainous regions, coastal and island areas to ensure production and business activities, creating conditions for people to stabilize their lives. The service system of each locality can be converted into a part of the local logistics and technical system when transitioning to defense states.
2. Integration in Agriculture, Forestry, and Fisheries
a) In agriculture: Exploit effectively the potential of land and labor force to ensure food security; develop various industries to contribute to building economic and social strength during peacetime; be ready to ensure national defense when situations arise.
b) In forestry: Develop forest planting, encirclement and protection of forests, permanent cultivation and settlement, combined with the deployment of national defense forces, contributing to building defense areas, border areas, coastal areas, and islands.
c) In fisheries: Develop various forms of services on the sea and islands, creating conditions for fishermen to stay, produce, and live, combined with building armed forces and defensive positions on the sea and islands, contributing to protecting sovereignty, sovereign rights, and national security in Vietnam's maritime and island territories.
3. Integration in Transportation
a) Develop a road, railway, inland waterway, maritime, air transport system, ensuring connectivity between regions, provinces, economic centers, and strategic transport routes within the defense area, ensuring continuity and smoothness. Build a modern, synchronized transport infrastructure with focus and priority, meeting the requirements of economic and social development during peacetime and serving national defense during wartime.
b) In regional development planning, ensure the upgrading of existing port, canal, river, stream, dike, and sluice systems into a regional water and land transport network as a basis for combining modern and primitive transport means, ready to serve national defense when required, preventing disconnection in all situations.
4. Integration in information and communication
a) Build a civilian communication system closely integrated with the communication system of armed forces units, defense enterprises, and security agencies; combine modern and primitive communication means to ensure timely, accurate, secret, safe, and stable information for leadership, direction, and command of forces in all situations; implement cybersecurity measures and secure digital information for the system and take measures against electronic warfare and cyber warfare.
b) Ministries, sectors, and localities strengthen propaganda and dissemination of contents and forms of integration between national defense and economic and social development and economic and social development with national defense through mass media, grassroots information systems, and external information systems. Struggle against hostile forces on the cultural, information, and propaganda fronts.
5. Integration in Construction
a) Closely integrate with national defense in constructing dual-purpose building materials, housing, offices, architecture, urban construction planning, rural construction planning, urban technical infrastructure to ensure both economic and social development and serve national defense when required;
b) When constructing civil projects, ensure their dual-use nature, particularly for investment projects in key areas for national defense; integration must be implemented from surveying, planning, planning, soliciting opinions, assessing, and approving projects; do not construct projects that infringe upon airspace, military-valuable terrain, or hinder combat plans;
c) In construction, prioritize researching and developing dual-purpose materials meeting national defense requirements to serve defensive works and field fortifications of armed forces; build and renovate natural caves serving civilian needs while also serving national defense in emergency situations;
6. Integration in Investment and Economic Management
The establishment of mechanisms and policies for general economic management and specific fields, domestic investment policies, foreign investment in Vietnam, and Vietnamese investment abroad; the establishment of economic zones, industrial parks, border economic zones, high-tech zones, and other types of economic zones; the management of official development assistance (ODA), non-governmental foreign aid; bidding; the establishment and development of enterprises and collective economic sectors, cooperatives must meet national defense requirements;
7. Integration in Education and Social Welfare for War Veterans
a) Training and capacity building for human resources to meet the requirements of local economic, cultural, and social development and be ready to serve national defense, focusing on highly skilled technical staff in industries ready to serve national defense;
b) Management and development of the workforce, employment, labor safety and hygiene, vocational training must be linked with policies for war invalids, martyrs, those who have made contributions, and social assistance.
8. Integration in Science and Technology
a) Scientific and technological activities; development of scientific and technological potential; intellectual property; standards, measurements, and quality; nuclear energy, radiation safety, artificial intelligence, serving civilian needs must be linked to the scientific and technological sectors of national defense;
b) Apply military scientific and technological achievements and national defense industry products to serve the national economy and vice versa, strengthen the economy's strength, encourage joint ventures and collaborations with domestic and foreign organizations, create conditions to promote economic development, and learn international experiences in this field;
9. Integration in healthcare: Close cooperation between civilian and military healthcare in research, application, training of human resources, and medical treatment; establish combined military-civilian healthcare models in various regions, especially in remote, border, and island areas. Provinces and districts, in addition to hospitals arranged according to residential clusters, must organize mobile medical teams according to combat plans, meeting the health care needs of civilians during peacetime and being ready to serve national defense tasks when necessary;
10. Integration in resource management and environmental protection: Management and use of land; exploitation of minerals, water resources, forest resources; management of resources and environment, protection of maritime and island sovereignty and continental shelf; meteorological and hydrological activities, response to climate change, rising sea levels, desertification; mapping, remote sensing, boundary demarcation; remediation and handling of Agent Orange/dioxin, bombs, mines, and unexploded ordnance left over from war must meet national defense requirements;
11. Other sectors and fields: When formulating and implementing planning, strategies, and projects for economic and social development, ensure readiness to serve national defense when required; simultaneously have evacuation and dispersion plans to safe locations to ensure production when there are national defense and security situations; products of these sectors and fields must meet civilian needs during peacetime and be ready to meet national defense requirements when necessary;
Chapter IV
PLAN ON DEFENSE NEEDS AND THE CAPABILITY OF INTEGRATING DEFENSE WITH ECONOMY-SOCIETY AND ECONOMY-SOCIETY WITH DEFENSE DURING PEACETIME, EMERGENCY DEFENSE SITUATIONS, AND WAR SITUATIONS
Article 16. System of Plans, Planning Periods, and Plan Adjustments
1. System of Plans
a) Overall plan on national defense needs and the ability to combine national defense with economic and social development, including: Peace-time assurance plan established according to the State Budget Law, Public Investment Law, and national defense mission requirements; Plan for emergency national defense situations and war situations;
b) Detailed plan on national defense needs and the ability to combine national defense with economic and social development during peace time, emergency national defense situations, and war situations for Military Region Command, Provincial Military Command, and Hanoi Capital Military Command;
2. Planning Period
Plan established for a five-year period, with a vision of ten to fifteen years. The plan is always reviewed, adjusted, and supplemented in line with the national strategy and system of national master plans; important national plans and projects, economic and social development plans of ministries, sectors, and localities;
3. Plan Adjustment
Review and adjust the plan annually. Reviews, adjustments, and supplements must ensure continuity, only adjusting contents that are no longer suitable for actual capabilities and needs;
Article 17. Responsibilities for drafting, adjusting, and submitting plans
1. The Ministry of National Defense establishes, adjusts, and submits the overall plan for approval by the Prime Minister in accordance with national-level master plans, strategies, and economic and social development plans, and national defense protection strategies for each period;
2. The Military Region Command establishes, adjusts, and submits the detailed plan for approval by the Minister of National Defense in accordance with regional, provincial, special administrative-economic zone, urban, and rural master plans; in line with provincial and district-level economic and social development plans in key national defense areas; sector and field development plans and projects of provinces in key national defense areas;
3. The Hanoi Capital Command establishes, adjusts, and submits the detailed plan for approval by the Minister of National Defense in accordance with district and county-level economic and social development plans; city-level sector and field development plans and projects of Hanoi City;
4. The Provincial Military Command establishes, adjusts, and submits the detailed plan for approval by the Military Region Commander in accordance with county-level economic and social development plans within the province; sector and field development plans and projects at the provincial level under the approval authority of the Provincial People's Committee Chairman, except for key national defense counties.
Article 18. Basis for Drafting, Adjusting Plans and Content of Plans
1. Basis for Drafting, Adjusting Plans
a) National strategies, national planning systems, important national plans and projects, socio-economic development projects of ministries, sectors, and localities;
b) Military and national defense tasks nationwide, in regions, territories, sectors, and fields of ministries, sectors, and localities;
c) Results of investigations and surveys regarding the integration of national defense with socio-economic activities during peacetime, in emergency situations related to national defense, and in wartime.
2. Main Content of Plans
a) Analysis and assessment of current conditions, forecasting national defense needs during peacetime, in emergency situations related to national defense, and in wartime;
b) Analyze and forecast trends in economic and social development, scientific progress, and technological advancements that directly impact the ability to integrate national defense with economic and social activities during peacetime, defense emergencies, and wartime conditions;
c) Guiding viewpoints, objectives, and requirements for integrating national defense with socio-economic activities during peacetime, in emergency situations related to national defense, and in wartime;
d) Proposing overall solutions to ensure the integration of national defense with socio-economic activities during peacetime, in emergency situations related to national defense, and in wartime;
d) Determine specific tasks, priority tasks, and the sequence of steps necessary to ensure the integration of national defense with economic and social activities during peacetime, defense emergencies, and wartime conditions;
e) Determining policies and resources to achieve the plan's objectives; programs and projects requiring priority development to effectively implement the plan.
3. Detailed content of the plan aimed at concretizing policies, orientations, contents, tasks, solutions, and resources already determined in the overall plan; consistent with regional, provincial, urban, and rural planning; compatible with provincial, district, special administrative-economic units, border areas, islands, and strategic regions' economic and social development plans and projects;
Article 19. Procedures and formalities for planning
1. The planning agency shall take the lead and coordinate with relevant ministries, sectors, and localities to develop planning tasks, report to the competent authority for approval; the leading agency shall propose guiding viewpoints, goals, orientations, priority sequences, solutions, and resources for building the plan, and send them to relevant ministries, sectors, and localities;
2. Ministries, sectors, and localities shall cooperate to propose related content to be included in the plan and submit it to the leading planning agency; the leading agency shall compile, complete the plan, seek opinions from relevant ministries, sectors, and localities; incorporate feedback, explain, and finalize the plan for review and decision by the competent authority;
3. The dossier for the plan to be submitted to the competent authority for approval includes: A proposal requesting approval of the plan; draft of the plan; draft decision or approval document for the plan; summary report on the opinions received from relevant ministries, sectors, and localities and related documents;
Article 20. Approval Authority for Plans
1. The Prime Minister shall approve the overall plan regarding national defense needs and the ability to combine national defense with economic and social development during peacetime, emergency situations concerning national defense, and wartime.
2. The Minister of National Defense shall approve detailed plans on national defense requirements and the ability to integrate national defense with economic and social activities during peacetime, defense emergencies, and wartime developed by Military Regions and the Command of Hanoi City in accordance with the overall plan approved by the Prime Minister;
3. The Commander of Military Region shall approve detailed plans on national defense requirements and the ability to integrate national defense with economic and social activities during peacetime, defense emergencies, and wartime developed by Provincial Military Commands in accordance with the detailed plans approved by the Minister of National Defense;
Chapter V
RESPONSIBILITIES AND LIMITATIONS OF ORGANIZATIONS IN THE COMBINATION OF NATIONAL DEFENSE WITH ECONOMIC AND SOCIAL DEVELOPMENT AND ECONOMIC AND SOCIAL DEVELOPMENT COMBINED WITH NATIONAL DEFENSE
Article 21. Responsibilities of the Ministry of National Defense
1. Take the lead and coordinate with relevant ministries and sectors to organize research and build legal normative documents on implementing the integration of national defense with economic and social development nationwide, submit to the competent authority for issuance or issue within their authority;
2. Take the lead and coordinate with ministries, sectors, and People's Committees of border provinces, and provinces to implement the construction of economic-defense zones along the border line. Prioritize the development of economic-defense zones in strategic areas and sparsely populated or uninhabited regions. Propose support measures and investment capital to the Government. Coordinate with the Ministry of Finance to establish financial mechanisms and policies for economic-defense zones to be submitted to the Government for approval;
3. Participate in providing opinions to ministries, sectors, and localities when developing strategies, plans, programs, and projects for economic and social development in defense areas related to national defense as stipulated in this Decree;
4. Coordinate with ministries, sectors, and localities in establishing, reviewing, and implementing national planning systems related to national defense; programs, projects, civil, industrial, transportation, agricultural, and rural development infrastructure, and other construction works to ensure dual-use capabilities and readiness to switch to serving national defense needs in key defense areas as stipulated in this Decree;
Article 22. Responsibilities of Ministries and Ministerial-Level Agencies
1. Take the lead and coordinate with the Ministry of National Defense in formulating planning, programs, and projects for economic and social development to ensure the integration of national defense with economic and social activities and vice versa;
2. Coordinate with the Ministry of National Defense in proposing content for planning national defense requirements and the ability to integrate national defense with economic and social activities during peacetime, defense emergencies, and wartime;
3. Coordinate with the Ministry of National Defense in organizing and building economic-defense zones; organizing and managing the operations of enterprises serving national defense and military units assigned to participate in economic and social development combined with national defense.
Article 23. Responsibilities of the People's Committees at the provincial and district levels, special administrative-economic units
1. Shall be responsible to the Government and the higher-level People's Committee for the results of implementing the Party's guidelines and policies and the State's laws on combining national defense with socio-economic development and socio-economic development with national defense within their jurisdiction.
2. When drafting plans, programs, and projects for socio-economic development at the local level related to national defense, they must have the participation of the Ministry of National Defense in the review process according to the classification specified in Clause 4 of Article 14 before submitting to the competent authority for approval.
3. Coordinate with the Ministry of National Defense and the Military Region Command to review and adjust plans, programs, and projects for socio-economic development at the local level in conjunction with the national defense needs plan and the ability to combine national defense with socio-economic development and socio-economic development with national defense during peacetime, emergency situations regarding national defense, and wartime.
4. Coordinate with central ministries, agencies, organizations relevantly to propose mechanisms, policies, and measures to effectively implement the combination of national defense with socio-economic development and socio-economic development with national defense within their jurisdiction.
5. Implement supervision, inspection, and audit of investment activities for socio-economic development within their jurisdiction; promptly identify, correct, and handle violations affecting the combination of national defense with socio-economic development and socio-economic development with national defense.
6. Coordinate with the Vietnam Fatherland Front and its member organizations to promote propaganda and mobilize the people to comply with the Party's and State's guidelines and policies on combining national defense with socio-economic development and socio-economic development with national defense.
Article 24. Effective Date
1. This Decree takes effect from February 10, 2019.
2. This Decree replaces Decision No. 13/2012/QĐ-TTg dated February 23, 2012, of the Prime Minister promulgating the Regulations on Integrating Economic and Social Activities with National Defense in the Defense Area.
Article 25. Implementation organization
1. The Ministry of National Defense shall take the lead and coordinate with relevant ministries and sectors to be responsible for guiding, monitoring, and inspecting the implementation of this Decree.
2. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of People's Committees of centrally governed cities and provinces, and related agencies, organizations, and individuals shall be responsible for implementing this Decree.
