Regulations on standards, quantities, and amounts for regular food allowance and health supplement allowance for coaches, athletes, and physical education teachers in the Military

Pursuant to Decree No. 76/2016/NĐ-CP dated July 1, 2016 of the Government stipulating material standards for active-duty military personnel, defense workers, and civil servants;

Based on Decree No. 164/2017/NĐ-CP dated December 30, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;

At the proposal of the Director of the Finance Department of the Ministry of National Defense;

The Minister of National Defense issues this Circular to regulate standards, quantities, and amounts for regular food allowance and health supplement allowance for coaches, athletes, and physical education teachers in the Military.

Article 1. Scope of Regulation

This Circular regulates standards, quantities, and amounts for regular food allowance and health supplement allowance for coaches, athletes, and physical education teachers in the Military.

Article 2. Applicability

1. Coaches, athletes, and physical education teachers under Military management.

2. Coaches and athletes of the Military's military shooting team.

3. Relevant agencies, units, organizations, and individuals.

Article 3. Standards, Quantities, and Amounts for Regular Food Allowance and Health Supplement Allowance

1. The subjects specified in Clause 1 and 2 of Article 2 of this Circular shall enjoy the amounts for regular food allowance and health supplement allowance as stipulated in Appendix I attached hereto.

2. The standards and quantities for regular meals of the subjects specified in Clause 1 and 2 of Article 2 of this Circular shall be implemented according to the provisions set out in Appendix II attached hereto.

Article 4. Provisions on Assurance and Implementation

1. The amounts for food allowance stipulated in this Circular shall be calculated based on the unified price of fragrant rice at 21,000 VND/kg. In cases where units must purchase rice at a higher price than prescribed, the difference for non-commissioned officers and soldiers shall be settled; in cases where the purchase price of rice is lower than prescribed, the difference shall be supplemented to ensure food for the beneficiaries.

2. Subjects specified in Clause 1 and 2 of Article 2 of this Circular who simultaneously enjoy multiple levels of food allowance and health supplement allowance during the same period shall only receive the highest level of food allowance and health supplement allowance. Specifically, coaches and athletes participating in national teams still receive the regular food allowance and health supplement allowance as stipulated in this Circular.

3. For coaches and athletes who suffer injuries, during treatment and upon returning to training after recovery, they shall continue to enjoy the food allowance and health supplement allowance as before the injury; if they return to competition but fail to maintain their rank or class, the Chief of General Staff shall consider and decide on the food allowance and health supplement allowance for coaches and athletes (but not exceeding the amount before the injury).

4. The standard for health supplement allowance only applies to coaches and athletes; it does not apply to physical education teachers directly teaching at military academies, schools, and the Miếu Môn Training Center under the General Department of Training.

5. Subjects under Military management working at sports centers, teams, and squads, during days directly inspecting, coaching, and training alongside coaches and athletes, shall enjoy the food allowance as stipulated in Appendix I attached hereto, without receiving the health supplement allowance standard. These subjects must pay the basic food allowance for non-commissioned officers and soldiers of the infantry according to current regulations plus the price adjustment for rice (if applicable); the difference shall be guaranteed and settled by the sports centers, teams, and squads. Those who work must pay the basic food allowance for non-commissioned officers and soldiers of the infantry according to current regulations plus the price adjustment for rice (if applicable); the difference shall be guaranteed and settled by the units.

6. Individuals receiving salaries only need to pay the basic food allowance for non-commissioned officers and soldiers of the infantry according to current regulations plus the price adjustment for rice (if applicable); the difference shall be guaranteed and settled by the units. Subjects in the talent system who have not been officially assigned shall enjoy the food allowance and health supplement allowance as stipulated in this Circular without having to pay.

7. Personnel serving in the kitchens of sports centers, teams, and squads shall not receive the food allowance and health supplement allowance as stipulated in this Circular but shall receive an additional allowance of 12,000 VND/person/day.

Article 5. Sources of Funding

The funding for implementing the provisions stipulated in this Circular shall be included in the annual defense budget estimate of agencies, units, and recorded according to the State Budget Classification System applied in the Military, as follows:

1. Food allowance for non-commissioned officers and soldiers: Recorded under Item 6400, Sub-item 6401, Section 20, Category 00 "Food Allowance for Military Branches".

2. Differential food allowance for salary recipients (including contractual employees): Recorded under Item 6400, Sub-item 6401, Section 30, Category 00 "Subsidy for Food Allowance for Salary Recipients in Military Branches".

3. Additional food allowance for service personnel and nutritional supplements: Recorded under Item 6400, Sub-item 6401, Section 40, Category 00 "Additional Food Allowance for Duty Performance".

Article 6. Effectiveness

1. This Circular takes effect from December 20, 2019, and replaces Circular No. 34/2017/TT-BQP dated February 11, 2017, issued by the Minister of National Defense on standards, quantities, and regular food allowances for coaches, athletes, and physical education teachers in the Military.

2. The standards and regulations stipulated in this Circular shall be implemented from November 1, 2019.

Article 7. Responsibility for Implementation

The Chief of General Staff, Director of the General Logistics Department, Director of the Finance Department, Heads of agencies, units, organizations, and individuals related to this matter are responsible for enforcing this Circular./.
