DECREE

concerning electronic transactions in the social insurance sector and the National Social Insurance Database

On the basis of Law on Government Organization dated February 18, 2025;

On the basis of Law on Social Insurance dated June 29, 2024;

On the basis of Law on Data dated November 30, 2024;

On the basis of Law on Electronic Transactions dated June 22, 2023;

On the basis of Law on Cybersecurity dated November 19, 2015;

On the basis of Law on Access to Information dated April 6, 2016;

On the basis of Law on Cybersecurity dated June 12, 2018;

||| Based on the proposal of the Minister of Home Affairs;

The Government issues this Decree to provide detailed regulations on electronic transactions in the social insurance sector and the National Social Insurance Database.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides detailed provisions for Clause 4 of Article 25, Clause 4 of Article 26, and Clause 3 of Article 30 of the Law on Social Insurance, and measures to organize and guide the implementation of the Law on Social Insurance regarding the National Social Insurance Database.

Article 2. Applicability

This Decree applies to agencies, organizations, and individuals involved in implementing electronic transactions in the social insurance sector, including mandatory social insurance and voluntary social insurance; agencies, organizations, and individuals involved in building, managing, exploiting, and using the National Social Insurance Database.

Article 3. Methods for Implementing Online Public Services in the Social Insurance Sector

1. Agencies, organizations, and individuals implement online public services in the social insurance sector through the National Public Service Portal.

2. The administrative procedure information system of the Ministry of Finance connects, integrates, and shares data with the National Public Service Portal to provide and implement online public services in the social insurance sector.

3. Electronic transactions in the social insurance sector are conducted through electronic identity accounts.

Article 4. Principles of Electronic Transactions in the Social Insurance Sector and Construction, Management, Exploitation, and Use of the National Social Insurance Database

1. Principles of Electronic Transactions in the Social Insurance Sector

a) Implementation of electronic transactions in the social insurance sector is not subject to administrative boundaries;

b) Implementation of electronic transactions in the social insurance sector is based on reusing information, data, and digitized documents integrated on the National Public Service Portal, national databases, specialized databases, and electronic data management repositories of organizations and individuals. Agencies, organizations, and individuals conducting electronic transactions in the social insurance sector do not need to provide documents for information that has already been integrated on the National Public Service Portal, national databases, specialized databases, and electronic data management repositories of organizations and individuals;

c) Implementation of electronic transactions in the social insurance sector complies with laws on electronic transactions, data, cybersecurity, cyber security, social insurance, and other relevant laws; ensuring clarity, non-discrimination based on methods of implementation, honesty, safety, and effectiveness.

2. Principles of Construction, Management, Exploitation, and Use of the National Social Insurance Database

a) The National Social Insurance Database is uniformly constructed, exploited, and used from central to local levels;

b) The National Social Insurance Database is updated according to government regulations, ensuring completeness, accuracy, and timeliness immediately after related administrative procedures and business operations have been completed; maintaining continuous, stable, and smooth operation to meet the exploitation and usage requirements of agencies, organizations, and individuals as stipulated by law;

c) The National Social Insurance Database is stored, secured, and ensures information security and cyber security during management, exploitation, and use;

d) Construction, management, exploitation, and use of the National Social Insurance Database comply with relevant specialized laws, standards, technical norms, and the National Digital Architecture Framework.

Article 5. Conditions and methods for implementing electronic transactions in the field of social insurance

Organizations, individuals conducting electronic transactions in the field of social insurance must ensure the following conditions:

1. Having an electronic identity account in accordance with the provisions of the Law on Identity Verification and Electronic Authentication.

2. Possessing a valid digital signature certificate issued by a service provider of digital signature certification or another electronic signature as prescribed by law.

Article 6. Adjustments, reductions, and simplifications of documents and procedures for implementing social insurance from paper-based transactions to electronic transactions

1. Organizations, individuals who have completed electronic transactions in the field of social insurance in accordance with this Decree shall not be required to implement other transaction methods and shall be recognized as having completed the corresponding social insurance procedures.

2. For components of social insurance documents stipulated in the Social Insurance Law that have been digitized and stored in national databases or specialized databases, citizens and businesses are not required to provide them when handling administrative procedures related to social insurance.

Chapter II
ELECTRONIC TRANSACTIONS IN THE FIELD OF SOCIAL INSURANCE

Article 7. Electronic social insurance documents and certificates

1. Electronic social insurance documents and certificates include:

a) Electronic social insurance documents;

b) Electronic accounting certificates in the implementation of social insurance;

c) Other documents and notifications of organizations, individuals conducting social insurance transactions through electronic means.

2. Electronic social insurance documents and certificates prescribed in this Decree have the same legal value as paper-based documents, certificates, notifications, and other documents as prescribed by law.

3. The retention period for electronic social insurance documents and certificates shall be implemented in accordance with the provisions of the Law on Record Keeping and the Law on Data.

Article 8. Social Insurance Book

1. A social insurance book is issued to each worker, each person is only issued one unique social insurance number and contains information as prescribed in Clause 1, Article 25 of the Social Insurance Law.

2. An electronic social insurance book is a social insurance book established by the Ministry of Finance using electronic means, containing information similar to a paper-based social insurance book.

3. An electronic social insurance book is integrated with the individual's electronic identity account participating in social insurance and stored, updated regularly in the electronic data management database of organizations, individuals on the Information System for Administrative Procedure Processing of the Ministry of Finance, National Public Service Portal after the individual, organization successfully completes electronic transactions in the field of social insurance.

4. An electronic social insurance book for subjects under the jurisdiction of the Ministry of National Defense, the Ministry of Public Security contains information similar to a paper-based social insurance book; it is created, integrated, and managed on the electronic identity account according to the regulations of the Minister of National Defense, the Minister of Public Security and ensuring the regulations on protecting state secrets in the fields of national defense security and public order.

5. An electronic social insurance book shall be issued no later than January 1, 2026 and has the same legal value as a paper-based social insurance book.

Article 9. Requirements for electronic social insurance files and certificates

1. Electronic social insurance files and certificates must have the digital signatures of responsible persons as prescribed by law. In cases where the law requires that a document be confirmed by an agency or organization, such document must be signed with a dedicated electronic signature ensuring security or the digital signature of the agency or organization. Where electronic social insurance files and certificates only bear the signature of an authorized person, the information system must be capable of identifying and confirming the processing actions of responsible persons as prescribed by law during the circulation of electronic social insurance files and certificates to the final signatory.

2. Where electronic social insurance files and certificates include components in paper form, agencies, organizations, and individuals participating in electronic transactions in the field of social insurance must convert them to electronic form. The conversion from paper-based files and certificates to electronic files and certificates and vice versa shall be carried out in accordance with the provisions of laws on electronic transactions and data.

Article 10. Time for submission of electronic social insurance files and certificates

1. Agencies, organizations, and individuals submitting electronic social insurance files and certificates shall conduct electronic transactions 24 hours a day and seven days a week.

2. Confirmation notifications of receipt of electronic social insurance files and certificates shall be sent to the electronic data management repository of organizations and individuals on the Information System for Administrative Procedure Processing of the Ministry of Finance and the National Public Service Portal no later than fifteen minutes after receiving the electronic social insurance files and certificates submitted by agencies, organizations, and individuals.

Article 11. Rights of agencies, organizations, and individuals when participating in electronic transactions in the field of social insurance

1. To be guided, supported, and promptly resolved when encountering issues during the implementation of electronic transactions.

2. To have their electronic transaction data confidentiality and integrity protected in accordance with the law.

3. To be provided with information about social insurance contributions and benefits through electronic means.

Article 12. Obligations of agencies, organizations, and individuals when participating in electronic transactions in the field of social insurance

1. To establish, send, and receive electronic social insurance files and certificates through the National Public Service Portal.

2. Not to carry out transactions using paper files for procedures registered in electronic form during the period of conducting electronic transactions, except in cases stipulated in Clause 7 of this Article.

3. To manage digital signature certificates and ensure the accuracy of digital signature certificates on electronic social insurance files and certificates; to manage electronic identity accounts to ensure safety and cybersecurity.

4. To store and ensure the integrity of all electronic social insurance files and certificates.

5. To store paper files in accordance with the legal provisions on archiving for declarations made to social insurance agencies but not yet converted to electronic files and certificates; to present them for comparison and inspection by competent authorities when required.

6. To comply with regulations ensuring the security and cybersecurity of the electronic data exchange system.

7. To prepare social insurance files in paper form or convert electronic social insurance files to paper form and submit them to the directly managing social insurance agency no later than three working days from the expiration date of the submission deadline for social insurance collection, in case the electronic data exchange system and technical infrastructure fail to resolve the issue within the submission deadline for electronic social insurance files; no later than seven working days from the expiration date for other transactions. After the issue has been resolved, the agency or organization shall submit electronic social insurance files through the National Public Service Portal.

8. To comply with inspections, audits, and verifications by state agencies with authority regarding the implementation of electronic transactions in the field of social insurance in accordance with the law.

9. To be responsible for declaring electronic social insurance files and certificates in accordance with the legal provisions on electronic transactions, social insurance, and related laws.

10. To fulfill other obligations as prescribed by law.

Article 13. Conducting electronic transactions through the National Public Service Portal

1. Agencies, organizations, and individuals participating in electronic transactions in the social insurance sector shall access the National Public Service Portal to establish online social insurance files and submit electronic social insurance files to the information system for administrative procedure resolution of the Ministry of Finance.

2. Within two hours from receiving the electronic social insurance file from agencies, organizations, or individuals, the Ministry of Finance shall send an acceptance receipt and schedule for resolution via email to the agencies, organizations, or individuals participating in electronic transactions in the social insurance sector.

Article 14. Ensuring connectivity between information systems in electronic transactions in the social insurance sector

1. Information systems serving the implementation of electronic transactions in the social insurance sector must comply with regulations applicable to information systems with scale and scope from central to local levels.

2. Data sharing and exchange in electronic transactions in the social insurance sector must be standardized in the form of structured data message exchange.

Chapter III
NATIONAL DATABASE ON INSURANCE

Article 15. Managing agency and operating unit of the National Database on Insurance

1. The Ministry of Finance is the managing agency of the National Database on Insurance.

2. The National Data Center is the operating unit of the information system of the National Database on Insurance.

Article 16. Data of the National Database on Insurance

1. The National Database on Insurance includes the following information:

a) Basic personal data including: surname, middle name, and given name at birth; date of birth; gender; individual identification number or passport number; ethnicity; nationality; place of birth registration; place of origin, place of residence; surname, middle name, given name, individual identification number or passport number of father, mother, spouse, or legal representative;

b) Contact information of citizens;

c) Household information group: Address; list of household members;

d) Social insurance information group: Social insurance number; management unit code of participants; social insurance administration agency; type of social insurance object; payment method; social insurance contribution and benefit history; tax identification number;

đ) Health insurance information group: Health insurance benefit level code according to the health insurance participant category; initial health insurance treatment registration location; health insurance card validity start and end dates; continuous five-year health insurance participation period; information on health insurance card revocation or temporary suspension (if any); health insurance contribution and benefit history; information and data on health insurance treatment;

e) Unemployment insurance information group: Unemployment insurance contribution and benefit history; unemployment insurance contribution period retained as a basis for calculating unemployment benefits;

g) Employer information group: Name; business registration number/establishment decision number; tax identification number; organization identification number; main office address; business industry (or primary business industry)/field of operation; phone number, email; business type/organization type; payment method.

2. The data specified in points d, đ, and e of Clause 1 of this Article are original data of the National Database on Insurance.

Article 17. Collection, updating, and synchronization of data into the National Database on Insurance

1. Data collected, updated, and synchronized into the National Database on Insurance includes:

a) Open data;

b) Shared data of state agencies;

c) Exclusive data of state agencies pursuant to the Prime Minister's decision for national defense, security, diplomacy, confidential matters, economic and social development, digital transformation, national interests, public interest;

d) Data of Party agencies, Vietnam Fatherland Front Committee, and political-social organizations when consented by the data owner;

đ) Other data provided by organizations and individuals.

2. Sources of collecting, updating, and synchronizing data in the National Database on Insurance include:

a) From the process of implementing administrative procedures and public services related to social insurance, health insurance, unemployment insurance;

b) Updated, shared, and synchronized from other databases;

c) Digitized, provided, and integrated by individuals and organizations;

d) Other sources as prescribed by law.

3. The Ministry of Finance shall coordinate with relevant agencies, organizations, and individuals to check data during collection, updating, and synchronization to ensure accuracy and consistency.

4. The National Database on Insurance stores data on the infrastructure of the National Data Center.

Article 18. Subjects Exploiting and Using Data in the National Database on Insurance

1. The Ministry of Finance exploits and uses data from the National Database on Insurance to serve specialized business activities in the insurance field and manage state financial affairs related to social insurance.

2. Ministries, sectors, agencies, units, and individuals exploit and use data from the National Database on Insurance according to regulations on exploiting and using the National Database and the National Comprehensive Database.

3. Agencies, organizations, and individuals are permitted to exploit and use their own information; personal information of others if such person consents in accordance with the law.

Article 19. Methods of Exploiting and Using Data in the National Database on Insurance

The exploitation and use of data in the National Database on Insurance are carried out through the following methods:

1. Connecting and sharing data between the National Database, specialized databases, other databases, and information systems with the National Database on Insurance.

2. The National Data Portal, the National Public Service Portal, electronic information portals, and administrative procedure information systems.

3. Electronic identity and authentication platforms.

4. National identification applications.

5. Equipment, means, and software provided by the National Data Center.

6. Other methods prescribed by the Ministry of Finance.

Article 20. Connection and Sharing of Data

The connection and sharing of information between the National Database on Insurance and other national databases, specialized databases, and information systems must comply with legal provisions on connecting and sharing data of state agencies consistent with the overall national digital architecture framework.

Article 21. State Management of the National Database on Insurance

1. The Government uniformly manages the National Database on Insurance. The Government is the data owner and uniformly manages data in the National Database on Insurance.

2. The Ministry of Finance is the managing agency of the National Database on Insurance, responsible for building and developing the National Database on Insurance.

3. Data in the National Database on Insurance is checked, evaluated, and maintained in accordance with legal provisions on data.

Chapter IV
IMPLEMENTATION

Article 22. Responsibilities of the Ministry of Finance

1. Issuing procedures and business operations for electronic transactions in the field of social insurance in accordance with laws on electronic transactions, social insurance, and related laws to implement this Decree.

2. Studying the regulations on intermediary services in electronic transactions in the field of social insurance.

3. Ensuring conditions for implementing electronic transactions in the field of social insurance no later than January 1, 2027.

4. Implementing mandatory social insurance and voluntary social insurance regimes through electronic transactions in the field of social insurance.

5. Providing information on contributions and benefits from social insurance via electronic means.

6. Inspecting the implementation of electronic transactions in the field of social insurance.

7. Annually reporting to the Prime Minister on the implementation of electronic transactions in the field of social insurance.

8. Performing other tasks assigned under this Decree.

Article 23. Responsibilities of the Ministry of Public Security

1. Guiding the implementation of electronic transactions in the field of social insurance for subjects under the management authority of the Ministry of Public Security.

2. Cooperating with the Ministry of Finance to establish regulations on connecting and sharing information related to social insurance, health insurance, unemployment insurance that are not within the scope of state secrets managed by the Ministry of Public Security, in compliance with confidentiality and information security regulations, ensuring national security, public order, and social safety, and the actual implementation of social insurance, health insurance, and unemployment insurance work in the People's Public Security.

Article 24. Responsibilities of the Ministry of National Defense

1. Establishing the implementation of electronic transactions in the field of social insurance for subjects under the management authority of the Ministry of National Defense.

2. Cooperating with the Ministry of Finance to establish regulations on connecting and sharing information related to social insurance, health insurance, unemployment insurance that are not within the scope of state secrets managed by the Ministry of National Defense, in compliance with confidentiality and information security regulations, ensuring national security, public order, and social safety, and the actual implementation of social insurance, health insurance, and unemployment insurance work in the field managed by the Ministry of National Defense.

Article 25. Responsibilities of Ministries, Agencies Equivalent to Ministries, Government Agencies, and Provincial People's Committees under Central Government

1. The Ministry of Home Affairs guides and directs specialized agencies to share and connect necessary information and data in their respective fields with the Ministry of Finance to implement electronic transactions in the field of social insurance.

2. The Ministry of Health guides and directs medical examination and treatment facilities, Medical Examination Boards to share and connect necessary information and data in their respective fields with the Ministry of Finance to implement electronic transactions in the field of social insurance.

3. The Ministry of Science and Technology takes the lead and coordinates to connect the national database and specialized databases through an integrated data sharing system, in line with the overall national digital architecture framework.

4. The Office of the Government leads the connection between the Government and Prime Minister's Information Management System located at the National Data Center with the National Insurance Database to serve government and Prime Minister's management.

5. Ministries, agencies equivalent to ministries, government agencies, and provincial people's committees review regulations and procedures within their management scope to simplify personal documents based on using data from the National Insurance Database.

6. Ministries, agencies equivalent to ministries, and government agencies within their respective duties and authorities fully share and connect necessary information and data to implement electronic transactions in the field of social insurance.

7. People's Committees at all levels are responsible for directing functional agencies at the local level to fully share and connect necessary information and data with financial agencies to implement electronic transactions in the field of social insurance.

Chapter V
IMPLEMENTING PROVISIONS

Article 26. Transitional Provisions

1. The Electronic Information Portal of the Vietnam Social Security, as prescribed in Decree No. 166/2016/ND-CP dated December 24, 2016 of the Government, shall be integrated into the Information System for Administrative Procedures of the Ministry of Finance and continue to conduct electronic transactions in the field of social insurance until February 29, 2026.

2. Value-added services regarding electronic transactions in the field of social insurance, as prescribed in Decree No. 166/2016/ND-CP dated December 24, 2016, shall continue to be implemented until further guidance from the Ministry of Finance is issued.

Article 27. Effective Date

1. This Decree takes effect from July 1, 2025.

2. From the date this Decree takes effect, Decree No. 43/2021/ND-CP dated March 31, 2021 of the Government prescribing the National Database on Insurance shall cease to be effective.

3. From the date this Decree takes effect, the provisions of Decree No. 166/2016/ND-CP dated December 24, 2016 of the Government concerning electronic transactions in the fields of social insurance, health insurance, and unemployment insurance, which have been amended and supplemented by Decree No. 140/2018/ND-CP dated October 8, 2018 of the Government amending and supplementing related Decrees concerning investment conditions and administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs for the implementation of mandatory social insurance and voluntary social insurance electronic transactions, shall not be applied.

Article 28. Responsibility for Implementation

1. The Ministry of Finance shall guide, monitor, urge, and inspect the implementation of this Decree; report periodically annually or at any time to the Government and the Prime Minister.

2. Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under the central government, and relevant agencies, organizations, and individuals shall be responsible for implementing this Decree.
