REGULATION ON UPDATING INFORMATION, MONITORING, URGING, AND INSPECTING THE IMPLEMENTATION OF TASKS ASSIGNED BY THE GOVERNMENT AND THE PRIME MINISTER TO THE GOVERNMENT INSPECTORATE

PART I
PROVISIONS GENERAL
Article 1. Scope of Regulation and Applicability
Article 1. This Regulation provides for the updating of information, reporting system, monitoring, urging, and inspecting the implementation of tasks assigned by the Government, the Prime Minister, and Deputy Prime Ministers to the Government Inspectorate in guiding and managing documents of the Government, the Prime Minister, and Deputy Prime Ministers (hereinafter referred to as the implementation of tasks assigned by the Government and the Prime Minister).
Article 2. This Regulation applies to departments, units under the Government Inspectorate (hereinafter referred to as departments, units).
Article 2. General Principles
Clause 1. Tasks assigned by the Government and the Prime Minister must be:
Point a) Organized for timely, full, transparent, and public implementation; comply with the Working Regulations of the Government Inspectorate and relevant laws.
Point b) Ensure proactivity, clear division of responsibilities, and close cooperation among departments, units, organizations, and individuals involved.
Point c) The process of organizing implementation must closely integrate with the development, management, inspection, and evaluation of the implementation of the work program of the Government Inspectorate.
Clause 2. Ensure continuous, smooth, and timely guidance and management activities of the Chief Inspector General over tasks assigned by the Government and the Prime Minister; enhance the effectiveness of guidance and management by the Government Inspectorate.
Article 3. Explanation of Terms
In this Regulation, the following terms shall be understood as follows:
Clause 1. "Tasks assigned by the Government and the Prime Minister" include: projects, reports, administrative documents; specific tasks assigned for implementation in guiding and managing documents of the Government and the Prime Minister.
Clause 2. "Guiding and managing documents of the Government and the Prime Minister" include: Resolutions of the Government; administrative decisions, directives, telegrams, letters of the Prime Minister; telegrams, letters, documents announcing conclusions of meetings, guidance opinions of the Prime Minister signed by leaders of the Government Office.
Clause 3. "Monitoring database management system" refers to the software system for managing the database on the implementation of tasks assigned by the Government and the Prime Minister.
Clause 4. "Government Inspectorate's computer network" refers to the dedicated computer network serving the work of the Government Inspectorate, connecting smoothly all departments, units under the Government Inspectorate.
Clause 5. "Digital certificate" is a form of electronic certificate issued by the Party-State Cryptographic Bureau, Government Cryptographic Bureau.
Article 4. Classification of tasks assigned by the Government and the Prime Minister
1. Tasks with a specified implementation period that must be reported or submitted, or not required to be reported or submitted but still need to be completed within the specified period.
2. Tasks without a specified implementation period but must be reported or submitted according to work requirements, or not required to be reported or submitted but still need to be completed.
Chapter II
INFORMATION UPDATE AND INFORMATION REPORTING REGIME
Article 5. Responsibility for updating information
1. Leaders of the Government Inspectorate
Upon receiving tasks assigned by the Government and the Prime Minister, leaders of the Government Inspectorate shall assign relevant bureaus, departments, and units to implement these tasks and approve the results of their implementation.
2. Office
a) When directive or administrative documents from the Government and the Prime Minister are transferred to the Government Inspectorate, the Office shall present them to the leaders of the Government Inspectorate for processing and shall be responsible for updating the assignments to relevant bureaus, departments, and units on the tracking database management system according to the instructions of the leaders of the Government Inspectorate.
b) Submit reports to the Government and the Prime Minister through the tracking database management system after approval by the leaders of the Government Inspectorate.
3. Department of Planning, Finance, and General Affairs
Assist the Chief Inspector of the Government Inspectorate:
a) Monitor and urge relevant bureaus, departments, and units to fulfill tasks assigned by the Government and the Prime Minister which have been delegated by the leaders of the Government Inspectorate (hereinafter referred to as assigned tasks).
b) Review, compile, and evaluate the situation of fulfilling tasks assigned by the Government and the Prime Minister to the Government Inspectorate; prepare reports to the Government and the Prime Minister as stipulated in Article 8 of this Regulation or when requested.
4. Bureaus, Departments, and Units
When assigned by the leaders of the Government Inspectorate to perform tasks assigned by the Government and the Prime Minister, bureaus, departments, and units shall be responsible for:
a) Verify and compare information on the tracking database management system with directives and task assignment documents from the leaders of the Government Inspectorate. In cases where the content of the assigned task has not been accurately updated or does not fall within the functions, duties, and authorities of the bureau, department, or unit, they must report to the leaders of the Government Inspectorate, clearly stating the reasons, suggestions, and return the documents to the Office for adjustment according to the delegation of the leaders of the Government Inspectorate.
b) Fully update the situation and results of task implementation according to the prescribed contents on the tracking database management system.
Article 6. Deadline for Updating Information on the Tracking Database Management System
1. For tasks as stipulated in Clause 1 of Article 4 of this Regulation, at least one working day before the deadline for completing the assigned task or reporting or submitting to the competent authority, relevant bureaus, departments, and units must update related information about the situation and results of implementing the assigned task by the Government and the Prime Minister on the tracking database management system.
Within three working days after the deadline for completing the assigned task or reporting or submitting to the competent authority, the leaders of the Government Inspectorate must approve and the Office must submit the report to the Government and the Prime Minister through the tracking database management system.
2. For tasks as stipulated in Clause 2 of Article 4 of this Regulation, bureaus, departments, and units assigned the task must regularly update the situation of implementation when there are results or monthly, quarterly, semi-annually, or annually.
Article 7. Monitoring, exchanging, and processing updated information
1. The units assigned by the Government Inspectorate's leadership to perform tasks delegated by the Government and the Prime Minister shall be responsible for:
a) Monitoring and inspecting updated information on the situation and results of the assigned tasks on the Management System of the Database and data in the reports of the Government Inspectorate (when required) and their own units.
b) In case the updated information and reporting data of their own units do not match reality or deviate from the information on the Management System of the Database, they must review, adjust, or promptly exchange and notify the Office to make adjustments.
c) The Heads of Departments, Units under the Government Inspectorate shall be responsible before the Chief Inspector General for the timeliness of updating and the accuracy and completeness of the information on the situation and results of the assigned tasks of their own units according to this Regulation.
2. The Office shall be responsible for promptly exchanging and notifying the Government Office (in writing, fax, or via telephone, email); in necessary cases, closely coordinating with the Government Office to handle the situation.
3. The Department of Planning, Finance, and Consolidation shall be responsible for monitoring updated information on the situation and results of the tasks assigned by the Government and the Prime Minister to the Government Inspectorate on the Management System of the Database and data in the reports of the departments, units. In case of discovering inaccurate or deviating updated information or data, promptly exchange with the departments, units to adjust.
Article 8. Deadline for Information and Periodic Reports
1. Monthly, quarterly, semi-annually, every nine months, and annually, the departments, units shall compile and report to the Chief Inspector General on the situation and results of the tasks assigned by the Government and the Prime Minister to supplement the content in the monthly, quarterly, semi-annual, nine-monthly, and annual reports of their units.
2. Based on the data of the departments, units, before the monthly meeting, on the 19th day of the last month of each quarter, June 19th, and November 28th each year, the Department of Planning, Finance, and Consolidation shall compile and draft a report on the situation and results of the tasks assigned by the Government and the Prime Minister to submit to the Chief Inspector General.
Chapter III
MONITORING, URGING IMPLEMENTATION OF TASKS DELEGATED BY THE GOVERNMENT AND THE PRIME MINISTER
Section 1: MONITORING AND URGING IMPLEMENTATION OF TASKS DELEGATED BY THE GOVERNMENT AND THE PRIME MINISTER
Article 9. Responsibilities for Monitoring and Urging Implementation
1. Responsibilities of the Department of Planning, Finance, and Consolidation
a) As the main unit assisting the leadership of the Government Inspectorate in monitoring and urging the implementation of tasks assigned by the Government and the Prime Minister; actively and regularly assessing the situation of the implementation of assigned tasks and work of the departments, units and reporting to the leadership of the Government Inspectorate.
b) Cooperating with related departments, units to advise and propose solutions to the leadership of the Government Inspectorate to resolve difficulties and obstacles arising during the implementation of tasks assigned by the Government and the Prime Minister, ensuring timely, effective, and quality implementation.
2. Responsibilities of the departments, units
a) The departments, units primarily responsible for implementing tasks must actively and regularly monitor and urge the implementation of assigned tasks of their own units and cooperating departments, units; promptly rectify and correct errors within their authority.
b) The departments, units cooperating in implementing tasks shall be responsible for promptly providing information on the situation and results of cooperative tasks to the primary implementing departments, units.
Article 10. Content of monitoring and urging
1. The situation of performing tasks assigned by the Government and the Prime Minister, and the implementation of information and reporting systems.
2. Summarizing, evaluating, and reporting on the situation of performing tasks assigned by the Government and the Prime Minister.
3. Advising and proposing to the leaders of the Government Inspectorate to handle difficulties and obstacles arising or adjusting the performance of tasks; handling cases where tasks assigned by the Government and the Prime Minister have not been performed or have been performed incorrectly.
Article 11. Methods of monitoring and urging
1. Through the Database Management System for tracking and on the Computer Network of the Government Inspectorate.
2. Through regular or ad hoc reports.
3. Through direct meetings and exchanges.
4. Through telephone or email...
5. Through inspection work.
Section 2: INSPECTION OF THE IMPLEMENTATION OF TASKS ASSIGNED BY THE GOVERNMENT AND THE PRIME MINISTER
Article 12. Inspection Responsibilities
1. The Planning, Finance, and Consolidation Department advises on inspecting the implementation of tasks assigned by the Government and the Prime Minister by departments, bureaus, and units according to the division of labor by the leadership of the Government Inspectorate.
Advising and recommending the Chief Inspector of the Government to establish an Inspection Team to conduct regular or ad hoc inspections of departments, bureaus, and units in organizing the implementation of assigned tasks.
2. Within their functions, tasks, and authority delegated by the leadership of the Government Inspectorate, departments, bureaus, and units are responsible for inspecting the updating, monitoring, and urging of compliance with information and reporting systems regarding the implementation of assigned tasks within their own units.
Article 13. Content of Inspection
1. Inspecting the deployment and situation and results of implementing assigned tasks by departments, bureaus, and units under the Government Inspectorate.
2. Inspecting the updating of the situation and results of implementing assigned tasks on the Database Management Tracking System.
3. Inspecting the implementation of information and reporting systems about the implementation of assigned tasks by departments, bureaus, and units.
Article 14. Basis for Inspection and Forms of Inspection
1. Inspection is conducted regularly, periodically, or ad hoc.
2. Regular and periodic inspections are carried out based on plans approved by the leadership of the Government Inspectorate.
3. Ad hoc inspections are conducted based on directives from the leadership of the Government Inspectorate, competent authorities, or when discovering signs that departments, bureaus, units, or individuals are not implementing or are implementing incorrectly the assigned tasks.
Article 15. Decision on Inspection and Establishment of Inspection Teams
1. The Chief Inspector of the Government issues decisions on inspection and establishment of Inspection Teams.
2. The inspection decision includes the following contents:
a) Legal basis for inspection;
b) Composition of the Inspection Team;
c) Scope, objects, and tasks of inspection;
d) Inspection contents;
d) Time limit for inspection.
Article 16. Organization of the examination
1. Based on the inspection decision, the Head of the Inspection Team organizes the implementation of the inspection.
2. During the inspection process, if necessary, the Head of the Inspection Team invites relevant agencies, organizations, or individuals related to the inspection content to join the Inspection Team. Agencies, organizations, or individuals invited to join the Inspection Team have the responsibility to participate and appoint suitable personnel to join the Inspection Team.
3. Departments, bureaus, units, or individuals subject to inspection or related parties have the responsibility to report on the implementation of assigned tasks; arrange staff to work with the Inspection Team; provide files, documents, and information requested by the Inspection Team in accordance with the law.
Article 17. Report on Inspection Results
1. Time for Reporting Inspection Results
Within the latest five working days after the completion of the inspection, the Inspection Team must report to the Inspectorate General the results of the inspection, and simultaneously send the report on the inspection results to the Planning, Finance and Consolidation Department for monitoring and consolidation.
Based on the conclusion of the Inspectorate General's leadership, the Head of the Inspection Team shall advise on announcing the inspection results to be sent to the bureaus, departments, and units subject to inspection.
2. The contents of the report on inspection results must clearly state the following:
a) Evaluation of the implementation and situation of the assigned tasks of the bureaus, departments, and inspected units and related organizations and individuals; evaluation of the updating of information about assigned tasks, situations, and results of task implementation on the Tracking Database Management System and the implementation of reporting systems regarding the situation of task implementation by bureaus, departments, and units.
b) Specific evaluation of the results of task implementation by the inspected departments, bureaus, and units. In cases where tasks have not been implemented or have been implemented incorrectly, the nature, extent, causes, and responsibilities of the bureaus, departments, and units for failing to implement or implementing tasks incorrectly or incompletely must be clearly identified.
c) Recommendations to the Inspectorate General's leadership on measures to urge and direct the bureaus, departments, and units assigned tasks by the Government and Prime Minister to implement their assigned tasks or adjust the assigned tasks (if necessary); measures to handle violations (if any).
Article 18. Inspection File
1. The Inspection Team must establish an inspection file. The inspection file includes the following documents:
a) Decision to establish the Inspection Team;
b) Documents assigning tasks from the Inspectorate General's leadership and related documents (if any);
c) Follow-up and urging documents (if any);
d) Reports and documents reflecting the situation of implementing tasks assigned by the Government and Prime Minister;
đ) Inspection plan (or documents with directives from the Chief Inspectorate General related to the inspection);
e) Minutes and documents related to the inspection content;
g) Report on inspection results;
h) Other relevant documents.
2. After completing the inspection, the Inspection Team is responsible for transferring the inspection file to the Office for storage according to regulations.
Chapter IV
IMPLEMENTATION
Article 19. Effective Date
This Regulation takes effect from the date of issuance.
Article 20. Responsibility for Implementation
1. Heads of Bureaus, Department Heads, and Heads of Units under the Inspectorate General are responsible for implementing this Regulation.
2. The Head of the Planning, Finance and Consolidation Department is responsible for monitoring, urging, inspecting, and reporting to the Chief Inspectorate General on the implementation status and results of this Regulation; collecting, studying, and proposing supplements and amendments to the Regulation to ensure its content aligns with the work requirements of the Inspectorate General.
3. Information Center
a) The Information Center is responsible for managing the Inspectorate General's system on the Tracking Database Management Software; coordinating with the Government Office and other relevant units to install, train, guide, and support the use of the Tracking Database Management Software on the Inspectorate General's computer network, ensuring the software operates smoothly and stably.
b) Registering, receiving, issuing, and managing digital certificates provided to individuals for updating information on the Tracking Database Management System.
4. Individuals provided with digital certificates to update information on the Tracking Database Management System are responsible for properly storing and using the digital certificates in accordance with current legal regulations.
Article 21. Awards and Disciplinary Measures
1. The results of implementing this Regulation shall be one of the criteria for evaluating the completion of tasks and annual commendation and awarding of titles for excellence for bureaus, departments, units, heads of bureaus, departments, units, and civil servants, officials.
2. Bureaus, departments, and units that achieve outstanding results in implementing this Regulation shall be commended and awarded according to the regulations on commendation and awards of the Government Inspectorate.
3. Bureaus, departments, units, and individuals who fail to fully implement or violate the provisions of this Regulation shall be subject to handling according to current laws, depending on the severity of the violation./.
