Regarding the issuance of regulations on examination, approval of exit and entryfor

officials, civil servants, and staff of the Ministry of Science and Technology

MINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENT

C||| based on Decree No. 22/CP dated May 22, 1993 of the Government on tasks, rightsand organizational structure of the Ministry of Science and Technology;

Based on Decree No. 05/2000/NĐ-CP dated March 3, 2000 of the Government onexit and entry for Vietnamese citizens;

Based on Circular No. 09/2000/TT-BCA(A18) dated June 7, 2000 of the Ministryof Public Security guiding the issuance of ordinary passports within Vietnamaccording to Decree No. 05/2000/NĐ-CP;

Considering the proposal of the Director of the Department of Organization andScientific Personnel;

 

DECISION:

Article 1.Issuing with this Decision "Regulations on Examination and Approval of Exitand Entry for Officials, Civil Servants, and Staff of the Ministry of Science andTechnology".

Article 2.This Decision takes effect 15 days from the date of signature and replaces theprovisions regarding exit and entry for officials, civil servants, and staff of theMinistry in Document No. 1674/TCCBKH dated October 2, 1995 of the Ministry ofScience and Technology.

Article 3.All members of the Ministry's Leadership Board, Leaders of units, and all officials,civil servants, and staff under the Ministry of Science and Technology areresponsible for implementing this Decision.

REGULATIONS ON EXAMINATION AND APPROVAL OF EXIT AND ENTRY FOR OFFICIALS,CIVIL SERVANTS, AND STAFF OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

(Issued together with Decision No. 1649/2000/QĐ-BKHCNMT

dated September 12, 2000 of the Ministry of Science and Technology)

I-OBJECTS SUBJECT TO CLASSIFICATION MANAGEMENT OF EXIT AND ENTRY

The objects that the Minister examines and delegates classification examinationand approval of exit and entry:

1-Administrative and public service units that regularly have internationalrelations and ensure the following conditions:

The unit has been classified by the Ministry for personnel management,

The unit has a department or dedicated personnel responsible for organizationand personnel work, international relations work.

2-State-owned enterprises directly under the Ministry.

The list of units subject to classification management of exit and entry is definedin the appendix attached to this Regulation.

II-EXAMINATION AND APPROVAL LEVELS:

1-The Minister decides on exit for:

Deputy Ministers

Individuals appointed by the Ministry for units authorized for exit

Officials, civil servants, and staff of units not authorized

Managers at the department level and above and chief accountants of state-ownedenterprises directly under the Ministry.

2-For officials, civil servants, and staff of the Ministry going abroad to implementplans, agreements, or contracts signed with foreign countries approved by theMinistry:

Heads of units authorized to examine and approve exit for officials, civilservants, and staff of their units not listed in Section II.1.

In cases of unexpected situations not yet approved or approved by the Ministry,must be agreed upon by the Ministry's leadership, consulting the Department ofOrganization and Scientific Personnel before the head of the unit examines anddecides on exit.

III-DUTIES:

1-Heads of units are responsible for:

Implementing the provisions of Decree No. 05/2000/NĐ-CP dated March 3, 2000 ofthe Government on exit and entry for Vietnamese citizens, Circular No. 09/2000/TT-BCA(A18) dated June 7, 2000 of the Ministry of Public Security on guidelines forissuing ordinary passports, Official Letter No. 674LS/XNC dated March 24, 2000 ofthe Consular Affairs Department - Ministry of Foreign Affairs on abolishing therequirement to present the dispatch decision when exiting the country, and thefollowing provisions below:

a- Annually prepare and submit plans for exit and entry to the Ministry'sleadership for approval, promptly reporting unexpected cases to the Ministry'sleadership.

b- Examine personnel, expertise, proficiency, language skills, work efficiency,time, etc., for officials, civil servants, and staff of their units going abroad.

c- Units authorized, after issuing the exit decision, must send a copy to theDepartment of Organization and Scientific Personnel for tracking, summarizing,and are responsible for collecting and preserving passports of those decided onexit by their unit and urging those whose passports were decided by the Ministryto hand over their passports to the Department of Organization and ScientificPersonnel immediately upon returning to the country.

d- Report to the Ministry (through the Department of Organization and ScientificPersonnel) cases where officials, civil servants, and staff exceed their stayabroad period or if any special issues are discovered for coordinated handlingand submission to the Ministry's leadership for decision.

e- Report every six months and annually to the Ministry's leadership on theimplementation of exit and entry activities of their unit.

2- The Department of Organization and Scientific Personnel is responsible for:

a- Based on specific proposals from units, examine, summarize, and submitannual plans for exit for training, survey, conferences, seminars, participationin meetings, and review to ensure standards for personnel, expertise, languageskills, etc., for each specific case proposed by units.

b- Inspect the implementation of exit management in authorized units, suggestmeasures to the Ministry's leadership to handle violations, including cancelingthe exit decisions of units when necessary.

c- Suggest measures related to exit work to the Ministry's leadership to bettermanage this activity.

d- Collect and preserve passports of individuals whose exit was decided by theMinistry immediately upon their return to the country.

e- Summarize and report every six months and annually to the Ministry'sleadership on the implementation of exit work of the Ministry.

f- For exit matters, the Department of Organization and Scientific Personnel willsubmit to the Ministry's leadership for a decision document within five workingdays after receiving complete valid files, except in special cases.

3- The Department of International Relations is responsible for:

a- Based on specific proposals from units, examine, summarize, and submitannual plans for exit within the framework of implementing commitments agreedupon in Agreements, Protocols, etc.

b- Lead and coordinate with the Department of Organization and ScientificPersonnel to guide and inspect the implementation of entry management.

c- Suggest measures related to entry work to the Ministry's leadership to bettermanage this activity.

d- On the basis of periodic reports every six months and annually from units,summarize and report to the Ministry's leadership on the implementation ofentry work of the Ministry.

4-For officials, civil servants, and staff of the Ministry:

Each time they exit the country, officers, civil servants, and staff members of the Ministry shall be responsible for returning their passports, reporting to the head of their unit and the Ministry's leadership on the results they have received and making recommendations.

IV-Implementation Organization:

The Department of Organization and Scientific Personnel and the Department of International Relations shall be responsible for monitoring and inspecting the implementation of this Regulation. During the implementation of this Regulation, if there are any difficulties, organizations and individuals are requested to promptly reflect them to the Ministry (through the Department of Organization and Scientific Personnel and the Department of International Relations) for consideration and resolution.
