Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 89/2007/QĐ-TTg dated June 18, 2007 of the Prime Ministerregarding the establishment of construction inspection offices at district and county levels Construction Inspection Office at commune, ward, and town levels in Hanoi and Ho Chi Minh City;

Considering the proposal of the Minister of Home Affairs, the Minister of Construction, and the Chief Inspector of the Government,

Article 1. Scope and Applicability

This Decision stipulates interim standards for construction inspection officers at district and county levels (hereinafter referred to as district level) and at commune, ward, and town levels (hereinafter referred to as commune level), and standards for officials and civil servants working in construction inspection organizations at district and commune levels in Hanoi and Ho Chi Minh City.

Article 2. Standards for Construction Inspection Officers at District and Commune Levels

Officials and civil servants recruited and appointed as construction inspection officers at district and commune levels must meet the following standards:

1. Loyalty to the country and the Constitution of the Socialist Republic of Vietnam; having good moral qualities, sense of responsibility, integrity, honesty, fairness, and objectivity in performing duties and public service;

2. Having a bachelor's degree in construction, architectural planning, law, economics, or land management;

3. Holding a certificate in construction law and inspection practice;

4. Having at least two years of experience in construction inspection work (excluding probationary period) for newly recruited personnel; in cases where officials and civil servants from other agencies and organizations transfer to construction inspection organizations, they must have at least one year of experience in construction inspection work.

Article 3. Standards for Civil Servants Working at District Construction Inspection Offices

Civil servants working in construction inspection organizations at district levels who have not been appointed as construction inspection officers at district levels must meet the following standards:

1. Loyalty to the country and the Constitution of the Socialist Republic of Vietnam; having good moral qualities, sense of responsibility, integrity, honesty, fairness, and objectivity in performing duties and public service;

2. Having a bachelor's degree or higher in construction, architectural planning, law, economics, or land management;

3. Holding a certificate in construction law and inspection practice.

Article 4. Standards for Civil Servants Working at Commune Construction Inspection Offices

Civil servants recruited, transferred, or accepted to work in construction inspection organizations at commune levels who have not been appointed as construction inspection officers at commune levels must meet the following standards:

1. Loyalty to the country and the Constitution of the Socialist Republic of Vietnam; having good moral qualities, sense of responsibility, integrity, honesty, fairness, and objectivity in performing duties and public service;

2. Having a vocational high school degree or higher in construction, architectural planning, law, economics, or land management;

3. Holding a certificate in construction law and inspection practice.

State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.

1. The Chairman of the People's Committee of Hanoi City and the Chairman of the People's Committee of Ho Chi Minh City shall be responsible for reviewing, arranging officials and civil servants engaged in construction inspection work at local levels, and organizing recruitment, appointment, management, and utilization of construction inspection officers and other civil servants working in construction inspection organizations at district and commune levels in accordance with the law.

2. The Minister of Home Affairs and the Minister of Construction shall inspect and urge the implementation of this Decision and report to the Prime Minister.

Article 6. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette.

Heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees directly under the Central Government, Chairmen of the Management Boards, and General Directors of the Social Policy Bank are responsible for enforcing this Decision./.Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of the People's Committees of Hanoi City, Chairmen of the People's Committees of Ho Chi Minh City, Heads of agencies and units, officials, civil servants, and individuals concerned are responsible for implementing this Decision./.
