Considering the proposal of the Minister of Science and Technology,
DECISION:
Article 1. The Regulation on Approving National Measurement Standards is hereby promulgated along with this Decision.
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette.
Article 3. Ministers of Ministries, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial people's committees under central cities shall be responsible for implementing this Decision./.

PART I
General Provisions
Article 1. Scope of application
This Regulation stipulates the contents, procedures, and formalities for approving national measurement standards.
Article 2. Explanation of terms
In these Regulations, the following terms are understood as follows:
1. Measurement Standard is a technical means that represents a unit of measurement and serves as a basis to determine the value of quantities expressed on measuring instruments.
2. National Measurement Standard is the highest accuracy measurement standard of the country approved by the Prime Minister to serve as the primary reference for determining the values of other standards within a specific field of measurement. National measurement standards must be linked to international standards through periodic direct comparisons with international standards or indirect comparisons via national standards of foreign countries.
Article 3. Authority to Approve National Measurement Standards
The Minister of Science and Technology is responsible for organizing, evaluating, appraising, and submitting to the Prime Minister for approval national measurement standards for each field of measurement.
Article 4. Management Agency for National Measurement Standards
The General Department of Standardization, Metrology and Quality under the Ministry of Science and Technology is the agency responsible for establishing, maintaining, preserving, and utilizing national measurement standards (hereinafter referred to as the management agency for national measurement standards) in accordance with Article 22 of Decree No. 06/2002/NĐ-CP dated January 14, 2002 of the Government detailing the implementation of the Ordinance on Metrology.
Chapter II
Contents, Procedures, Formalities
on approving national measurement standards
Article 5. Contents of Approving National Measurement Standards
The contents of approving national measurement standards include:
1. Technical and metrological level of existing standards proposed for approval as national measurement standards (hereinafter referred to as standards).
2. Necessary conditions for maintaining, preserving, and utilizing standards: transmission equipment, auxiliary equipment, environmental conditions, workspace.
3. Competence of specialized staff.
4. Relevant technical and metrological documents.
Article 6. Application for Approval of National Measurement Standards
The management agency for national measurement standards prepares the application for the Minister of Science and Technology to consider and decide to submit to the Prime Minister for approval of national measurement standards.
The application for the Minister of Science and Technology includes:
1. Application for Approval of National Measurement Standards (Annex).
2. Explanation of the economic and scientific-technical basis of the national measurement standard, including:
2.1. The necessity of the national measurement standard for the needs of building and developing the economy and society and for the requirements of international economic integration.
2.2. The appropriateness of the scientific-technical level of the national measurement standard compared to the development trend of science and technology in the country and worldwide.
2.3. Analysis of the socio-economic effectiveness of the national measurement standard.
3. Explanation of the current status of the standard, including:
3.1. Technical and metrological level of the standard.
a) Quantity, unit (of the corresponding field of measurement).
b) Description of the standard, including:
- Name of the national measurement standard;
- Serial number;
- Code of the standard;
- Place and year of production;
- Measuring range and corresponding accuracy;
- Other necessary technical and metrological characteristics.
3.2. Necessary conditions for maintaining, preserving, and utilizing the standard.
a) List of auxiliary equipment accompanying the standard:
- Transmission equipment (name, code, main technical and metrological characteristics...);
- Auxiliary equipment (name, code, main technical and metrological characteristics...).
b) Workspace and environmental conditions (area, laboratory room, laboratory environment: temperature, humidity...).
3.3. Explanation of staff competence.
Staff directly responsible for maintaining, preserving, and utilizing the standard must meet the following requirements:
a) Professional qualifications: bachelor's degree in a relevant field;
b) Language proficiency: English equivalent to Level B;
c) Experience working in a laboratory: at least three years.
3.4. Relevant technical and metrological documents, including:
a) Regulations on environmental conditions for maintaining and preserving the standard (temperature, humidity, atmospheric pressure, stability of power supply, permissible radiation levels, fire safety requirements, natural disaster prevention, and emergency relocation...);
b) Regulations on using, preserving, and utilizing the standard;
c) Regulations on calibration and comparison methods;
d) Diagram of standard comparison;
e) Calibration certificate of the standard;
f) Records and data from research, evaluation, and comparison results of the standard (if available).

1. The Minister of Science and Technology establishes an Appraisal Board for National Measurement Standards (hereinafter referred to as the Board) to examine and evaluate national measurement standards.
The organizational structure, tasks, and powers of the Board are stipulated in Chapter III of this Regulation.
2. The Board conducts an examination and evaluation of the standard's ability to meet the requirements of national measurement standards according to the contents specified in Article 5 of this Regulation.
3. After examination and evaluation, the Board prepares a record of the examination and evaluation results to submit to the Minister of Science and Technology.
Article 8. Approval of National Measurement Standards
1. Based on the Board's examination and evaluation records, the Minister of Science and Technology reviews and submits to the Prime Minister for approval of national measurement standards.
Documents submitted to the Prime Minister include:
a) Memorandum from the Minister of Science and Technology;
b) Decision to establish the Board;
c) Record of the Board's examination and evaluation results of national measurement standards.
2. On the basis of the submitted documents, the Prime Minister examines and decides on the approval of national measurement standards.
Article 9. Approval of New National Measurement Standards
In accordance with the development requirements of the national economy and in line with global trends in scientific and technological measurement, the Minister of Science and Technology shall annually consider and submit to the Prime Minister for approval a new national measurement standard with higher technical and measurement levels to replace the current national measurement standard. The approval of the new national measurement standard shall be carried out in accordance with the provisions of Chapter II of this Regulation.
Chapter III
National Measurement Standard Appraisal Council
Article 10. Functions and tasks of the Council
The National Measurement Standard Appraisal Council is an advisory body assisting the Minister of Science and Technology in reviewing and evaluating national measurement standards for specific measurement fields according to the decision of the Minister of Science and Technology.
The Council conducts reviews and evaluations according to the program approved by the Minister of Science and Technology along with the decision establishing the Council.
Article 11. Organization of the Council
1. The Council is established by the Minister of Science and Technology upon the proposal of the national measurement standard management agency.
2. The Council consists of seven to nine members. The Chairman, Vice-Chairman, and Secretary of the Council are appointed by the Minister of Science and Technology from among the Council members. The Chairman and Vice-Chairman of the Council must hold a Doctorate degree or have the title of Professor or Associate Professor in the relevant field; the Secretary of the Council is an employee of the national measurement standard management agency.
Members of the Council are experts in scientific and technological measurement invited from various ministries, sectors, universities, and related scientific and technological organizations.
3. Tasks of the Chairman:
Organizing the implementation of the Council's tasks, assigning specific responsibilities to Council members;
Convening and chairing Council meetings; deciding on the invitation of representatives when necessary; Approving minutes of review and evaluation sessions after each meeting and approving the final summary minutes before submitting them to the Ministry of Science and Technology.

4. Tasks of the Vice-Chairman:
Assisting the Chairman in directing the Council's activities according to the Chairman's assignment;
Being responsible to the Chairman for matters assigned to him/her;
Acting on behalf of the Chairman to manage and resolve Council affairs when authorized by the Chairman.
5. Tasks of Council members:
Attending all Council meetings fully;
Contributing opinions on issues discussed in Council meetings or commenting on documents sent by the Chairman and Vice-Chairman;
Proposing recommendations for the Council to refer to and discuss;
Being responsible to the Council for the content and results of assigned tasks, implementing specific tasks assigned by the Chairman.
6. Duties of the Council Secretary:

Assisting the Chairman in preparing working conditions for review and evaluation meetings;
Recording fully and truthfully all opinions and evaluations, collecting evaluation ballots from Council members;
Drafting minutes of review and evaluation and final summary minutes for the Chairman's approval by the Council.
7. The Council operates on the principle of democracy, open voting or secret ballot, and decisions made by majority vote. In case of equal opinions among Council members, the opinion of the Chairman or the authorized Vice-Chairman has a decisive nature.
Article 12. Funding
8. The Council dissolves itself after the national measurement standard is approved by the Prime Minister.
Chapter IV
Implementation Provisions
Article 13. The operating budget of the Council is allocated within the annual budget of the General Bureau of Standards, Metrology, and Quality Control provided by the State.
Article 14. Amendments and supplements to this Regulation shall be submitted by the Minister of Science and Technology to the Prime Minister for consideration and decision.
The Ministry of Science and Technology is responsible for organizing and guiding the implementation of this Regulation./.
