Regulations on conditions for operating motor vehicle inspection services; organization and operation of inspection facilities; service life of motor vehicles

The Government issues this Decree to regulate conditions for operating motor vehicle inspection services; organization and operation of inspection facilities; service life of motor vehicles.

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Pursuant to the Investment Law dated June 17, 2020;

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

At the proposal of the Minister of Transport;

1. Conditions for operating motor vehicle safety technical inspection and environmental protection services, including: inspection of automobiles, trailers or semi-trailers pulled by automobiles, four-wheeled passenger vehicles with engines, four-wheeled cargo vehicles with engines; exhaust gas inspection of motorcycles and motorbikes.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree provides for:

2. Organization and operation of inspection facilities.

3. Service life for various types of cargo automobiles, including specialized cargo automobiles; passenger automobiles with a permitted number of passengers from nine or more, excluding the driver; preschool children transportation automobiles, student transportation automobiles, four-wheeled cargo vehicles with engines, and four-wheeled passenger vehicles with engines.

1. This Decree applies to organizations and individuals related to:

Article 2. Applicability

a) Operating motor vehicle inspection services; inspection of specialized motorcycles;

b) Management and use of motor vehicles and modified vehicles subject to service life regulations, except cases where motor vehicles are not subject to service life regulations as stipulated in Clause 3, Article 40 of the Road Traffic Safety Law.

2. This Decree does not apply to organizations and individuals related to the inspection of motor vehicles and specialized motorcycles under the management of the Ministry of National Defense and the Ministry of Public Security.

1. Inspection facilities are public service units, enterprises, or cooperatives established in accordance with the law, including: motor vehicle inspection facilities; motorcycle and motorbike exhaust gas inspection facilities.

Article 3. Explanation of Terms

2. Motor vehicle inspection facilities are organizations granted certificates confirming their eligibility to conduct motor vehicle inspections.

3. Motorcycle and motorbike exhaust gas inspection facilities (hereinafter referred to as exhaust gas inspection facilities) are organizations granted certificates confirming their eligibility to conduct motorcycle and motorbike exhaust gas inspections.

4. Motor vehicle and specialized motorcycle inspection is the initial and periodic examination and evaluation of the safety technical condition and environmental protection of motor vehicles and specialized motorcycles according to the law. Motor vehicles inspected do not include motorcycles and motorbikes.

5. Motorcycle and motorbike exhaust gas inspection is the examination and evaluation of exhaust gas components of motorcycles and motorbikes. The implementation date follows the Prime Minister's Decision on the roadmap for applying national technical standards and regulations on exhaust emissions of road motor vehicles circulating in Vietnam.

6. Inspectors are individuals granted professional certificates according to the law to certify and inspect motor vehicles and specialized motorcycles, and conduct motorcycle and motorbike exhaust gas inspections.

7. Technical staff are individuals performing tasks such as receiving files, delivering results, entering data, searching information, printing inspection results, and storing files.

8. Inspection lines are areas where inspection equipment, inspection support equipment, inspection tools, and inspection support tools are arranged and installed. Inspection lines are divided into two types:

a) Type I inspection line is an inspection line capable of handling motor vehicles with a single axle load up to 2,000 kg;

b) Type II inspection line is an inspection line capable of handling motor vehicles with a single axle load up to 13,000 kg.

9. Inspection workshops are areas where inspection lines are arranged for motor vehicle inspection facilities or where exhaust gas testing equipment for motorcycles and motorbikes is arranged for exhaust gas inspection facilities.

10. Inspection certificate is a document certifying that motor vehicles and specialized motorcycles meet the requirements for safety technical condition and environmental protection according to the law; motorcycles and motorbikes have been exhaust gas tested and meet the legal requirements for exhaust gas components, including: motor vehicle safety technical inspection and environmental protection certificate; specialized motorcycle safety technical inspection and environmental protection certificate; motorcycle and motorbike exhaust gas inspection certificate.

11. Safety technical inspection and environmental protection sticker for motor vehicles and specialized motorcycles (hereinafter referred to as inspection sticker) is a traffic participation emblem for motor vehicles and specialized motorcycles that have been issued an inspection certificate.

12. Inspection certificate blank forms and inspection stickers are seals uniformly issued and granted by the Vietnam Registration Agency for inspection facilities to print various types of inspection certificates and inspection stickers.

12. The blank certificate of inspection, inspection seal is a stamp uniformly issued and granted by the Vietnam Registration Agency for use by inspection facilities to print various types of inspection certificates and inspection seals corresponding to each measuring instrument for exhaust gas measurement.

Chapter II
Article 4. Conditions for Operating Motor Vehicle Inspection Services

Article 4. General Conditions

1. Meeting the conditions regarding material infrastructure, organizational structure, human resources, and quality management system as prescribed in this Decree and the National Technical Regulation on Material Infrastructure and Location of Motor Vehicle Inspection Stations, Motorcycle Exhaust Inspection Stations, and Motorbike Inspection Stations (hereinafter referred to as the National Technical Regulation on Inspection Stations).

2. Having inspection officers suitable for the functions of the inspection station. Inspection officers include: Class I inspection officer, Class II inspection officer, and Class III inspection officer.

3. Possessing documents and materials in accordance with the laws on construction, land, traffic connection, and road connection as prescribed; environmental protection, safety, labor hygiene, fire prevention and firefighting, and other relevant laws when constructing and putting the inspection station into operation.

Section 1
CONDITIONS FOR MOTOR VEHICLE INSPECTION STATIONS

Article 5. Area Conditions

1. The floor area of the motor vehicle inspection station, which is the place used to arrange facilities for inspecting motor vehicles on the same plot of land, shall have a minimum area specified as follows:

a) For a motor vehicle inspection station with only one Class I inspection line: 1,250 square meters.²;

b) For a motor vehicle inspection station with only one Class II inspection line: 1,500 square meters.²;

c) For a motor vehicle inspection station with two inspection lines: 2,500 square meters.²;

d) For a motor vehicle inspection station with three or more inspection lines, the area for each additional line from the third line onwards shall be increased by 625 square meters.².

2. In cases where the motor vehicle inspection station is arranged together with a bus terminal or rest stop, the provisions of Clause 1 of this Article shall not apply. The inspection workshop must comply with the provisions of the National Technical Regulation on Inspection Stations.

Article 6. Human Resource Conditions

1. Regarding Quantity

a) At least one leader of the inspection station must be a Class II or higher inspection officer;

b) At least one leader of the inspection department must be a Class I inspection officer;

c) At least two inspection officers must be Class II or higher. Personnel specified in points a and b of this clause may participate in inspections at the inspection lines and are counted as inspection officers under this provision;

d) There must be technical staff to perform tasks as prescribed in Clause 7 of Article 3 of this Decree.

2. The Class II inspection officer specified in point c of Clause 1 of this Article must meet the following conditions:

a) Professional qualifications: hold a bachelor's or engineering degree in a related technical field of motor vehicles or specialized motor vehicles;

b) Hold a valid driver's license for automobiles;

c) Be issued a Class II inspection officer certificate in accordance with the law.

3. The Class I inspection officer specified in point b of Clause 1 of this Article must meet the following conditions:

a) Be a Class II inspection officer with at least five years of experience in inspection activities;

b) Be issued a Class I inspection officer certificate in accordance with the law.

4. The technical staff specified in point d of Clause 1 of this Article must meet the following conditions:

a) Professional qualifications: graduate from a college program or higher;

b) Be guided by the Vietnam Inspection Agency to perform the tasks prescribed in Clause 7 of Article 3 of this Decree.

Section 2
RULES FOR EMISSION TESTING FACILITIES

Article 7. Conditions regarding area

1. For fixed emission testing facilities

The emission testing area for motorcycles and motorbikes must have a minimum area of 15 m corresponding to one exhaust gas measuring device. In cases where the testing area is shared with maintenance and repair activities for motorcycles and motorbikes, it shall not obstruct the movement of vehicles or the operations of the inspector.² If the inspection area is shared with motorcycle maintenance and repair activities, it must not obstruct the movement of vehicles or the operations of the inspector.

2. For mobile emission testing facilities

Mobile emission testing facilities are not required to comply with the provisions of Clause 1 of this Article. Equipment and exhaust gas measuring devices serving emission testing shall be permanently installed on specialized mobile emission testing vehicles.

Article 8. Conditions regarding personnel

1. Number of personnel

a) At least one inspector as stipulated in Clause 2 of this Article;

b) Staff members to perform tasks as specified in Clause 7 of Article 3 of this Decree.

2. Inspectors:

a) Inspectors of Class I and II as stipulated in Article 6 of this Decree;

b) Inspector of Class III who holds a technical college degree related to motor vehicles and specialized motor vehicles and has been issued a Class III inspector certificate in accordance with the law.

3. Technical staff as stipulated in Clause 4 of Article 6 of this Decree.

4. In cases where personnel as stipulated in Clause 1 of this Article concurrently perform duties at different positions, they shall be counted as personnel of the concurrent position if they meet the requirements for professional certificates and conditions as prescribed in this Decree.

Chapter III
ORGANIZATION AND OPERATIONS OF INSPECTION FACILITIES

Article 9. Organizational Structure

1. The organizational structure of inspection facilities includes:

a) Leadership department comprising: Director, Deputy Director or person in charge of the inspection facility appointed according to the law to manage and direct the unit;

b) Inspection department comprising: leadership of the inspection department and inspectors to conduct inspections of vehicles;

c) Office department comprising: technical staff and other employees to perform office work and support inspection activities.

2. Personnel belonging to the departments mentioned in Clause 1 of this Article may concurrently perform tasks between different departments and shall be counted as personnel of the concurrent department if they meet the requirements for professional certificates and conditions as prescribed in this Decree.

Article 10. Principles of operation of inspection facilities

1. Ensuring independence, objectivity, transparency, compliance with the regulations of this Decree and relevant laws concerning the inspection of motor vehicles, specialized motor vehicles, and emission testing of motorcycles and motorbikes.

2. Motor vehicle inspection facilities that have been granted a certificate of eligibility to conduct motor vehicle inspections shall carry out inspections and issue inspection certificates for motor vehicles, and conduct emission testing and issue emission inspection certificates for motorcycles and motorbikes.

3. Emission testing facilities that have been granted a certificate of eligibility to conduct emission testing for motorcycles and motorbikes shall carry out emission testing and issue emission inspection certificates for motorcycles and motorbikes.

4. Inspection facilities with inspectors holding professional certificates for the inspection of specialized motor vehicles as prescribed by law shall carry out inspections and issue inspection certificates for specialized motor vehicles.

5. Facilitating organizations and individuals when bringing vehicles for inspection.

Article 11. Activities of inspection stations

1. Conduct inspections and issue inspection certificates for motor vehicles, special-purpose motorcycles, exhaust gas inspections for motorcycles and motorbikes in accordance with relevant regulations and technical standards related to inspection work.

2. Assign inspectors to conduct inspections of motor vehicles, special-purpose motorcycles, and exhaust gas inspections for motorcycles and motorbikes in accordance with the content of their inspector certification. Establish an assignment record for inspection tasks according to the model prescribed in Appendix I attached hereto.

3. Ensure that inspections of vehicles are carried out when inspection equipment and tools (hereinafter referred to as measuring instruments) meet the technical requirements stipulated in the National Technical Regulation on Inspection Stations; comply with calibration and verification procedures as prescribed by laws on measurement.

4. Arrange measuring instruments of the inspection station in the inspection workshop or outside the workshop as appropriate for different inspection cases. For equipment and measuring instruments serving exhaust gas inspections, they may be installed permanently on mobile exhaust gas inspection vehicles.

5. Inspections conducted outside the inspection station shall be carried out in accordance with the provisions of the Minister of Transport.

6. In case of equipment failure or replacement of measuring instruments, the inspection station must proactively address the issue to ensure that the measuring instruments meet the requirements set forth in Clause 3 of this Article, while simultaneously notifying the Department of Transport for monitoring and management according to the model prescribed in Appendix II attached hereto. 7. When there are changes in leadership at the inspection station, inspection department leadership, inspectors, and technical staff, the inspection station must notify the Department of Transport according to the model prescribed in Appendix III attached hereto.

8. Revoke incorrectly issued inspection certificates and inspection seals.

9. Do not conduct inspections of vehicles in cases where warnings are issued as provided for in points a, b, c, d, and e of Clause 1 of Article 12 of this Decree.

10. Cease inspection activities upon receipt of a decision to temporarily suspend or revoke the certificate of eligibility for motor vehicle inspection or motorcycle and motorbike exhaust gas inspection issued by the competent authority. Return the certificate of eligibility for motor vehicle inspection or motorcycle and motorbike exhaust gas inspection to the Department of Transport in the event of revocation of the certificate.

11. Be allowed to carry out technical service activities related to motor vehicles, special-purpose motorcycles, and motorcycle and motorbike exhaust gas.

12. Implement training programs, internships, evaluations, and specialized tasks as prescribed by the competent authority.

13. Maintain a department to handle matters related to inspection records during periods when the inspection station is temporarily suspended or has its activities temporarily halted, except in cases of force majeure as prescribed by law.

14. Within twelve months from the date of issuance of a new (first-time) certificate of eligibility for inspection activities, the inspection station must establish, implement, and maintain a quality management system in accordance with ISO 9001 standards.

Within twelve months from the date of issuance of the new certificate (first issuance) certifying eligibility to conduct inspections, the inspection facility must establish, implement, and maintain a quality management system in accordance with ISO 9001 standard.

Article 12. Warning of Vehicles

1. Cases for warning vehicles:

a) Administrative violations in the field of traffic order and safety on roads;

b) At the request of judicial agencies;

c) There is evidence that the vehicle owner falsified vehicle documents;

d) There is a discrepancy between the vehicle registration certificate and the actual vehicle when undergoing inspection procedures;

đ) Failure to issue a new vehicle registration certificate at the next inspection following the issuance of a vehicle modification certificate;

e) The inspection certificate and inspection label are lost or have been recalled.

2. Methods of warning and removing warnings

a) Vehicles subject to warning will be listed on the management software of the Vietnam Vehicle Inspection Agency and published on the agency's website;

b) A vehicle under warning will be removed from the warning list immediately upon receiving satisfactory inspection results or evidence of corrective action taken regarding the warning content;

c) For vehicles warned under point c, Clause 1, Article 12 of this Decree, the warning entity must notify the local police authority.

3. Implementation of Warnings and Removal of Warnings

a) The Department of Transport implements warnings and removals for cases specified in points a and b, Clause 1, Article 12 of this Decree, based on requests from competent authorities and judicial agencies at the local level;

b) Inspection facilities implement warnings and removals for cases specified in points c, d, đ, and e, Clause 1, Article 12 of this Decree;

c) The Vietnam Vehicle Inspection Agency implements warnings and removals for vehicles, except for those warned according to points a and b of this clause.

Article 13. Inspection Certificate and Inspection Label

1. The inspection certificate for motor vehicles (paper or electronic version) consists of two parts: the inspection certificate and the inspection label.

2. Vehicles participating in traffic shall be issued both the inspection certificate and the inspection label simultaneously.

3. Non-operational vehicles or those required to obtain permission from authorized agencies due to overloading or over-dimensioning, as stipulated by road load and size regulations, shall only be issued the inspection certificate without the inspection label.

4. The inspection certificate and inspection label are invalid if:

a) The vehicle was not inspected according to the prescribed procedures and formalities in the inspection process;

b) The inspection file was established and confirmed in violation of inspection regulations;

c) Inspected by personnel without the necessary expertise and authority;

d) Inspected using measuring equipment that does not ensure accuracy;

đ) Issued to a vehicle under warning as provided in Clause 1, Article 12 of this Decree.

5. The inspection certificate and inspection label become invalid if:

a) The vehicle is damaged and no longer meets technical safety and environmental protection requirements as stipulated by law;

b) There is a warning about the loss or recall of the inspection certificate and label on the management software of the Vietnam Vehicle Inspection Agency;

c) The inspection certificate and label have been replaced by another set;

d) The vehicle fails the inspection due to major defects (MAJOR DEFECTS - MaD) and requires repairs before re-inspection;

đ) The vehicle fails the inspection due to dangerous defects (DANGEROUS DEFECTS - DD), cannot participate in traffic, and requires repairs before re-inspection.

6. Inspection Certificate and Label Templates

Templates are used to print inspection certificates and labels suitable for specific types of vehicles as follows:

a) Green inspection certificate and label templates are used for clean energy, green, and environmentally friendly motor vehicles according to Model 01 in Appendix IV attached to this Decree;

b) Orange inspection certificate and label templates are used for other motor vehicles according to Model 02 in Appendix IV attached to this Decree;

c) Purple inspection certificate and label templates are used for special-purpose motorcycles according to Model 03 in Appendix IV attached to this Decree.

7. Issuance of Inspection Certificate and Label Templates

a) From the 15th to the 20th of the last month of each quarter, or in case of additional requests, inspection facilities needing to apply for templates shall submit a request letter along with a report on the inventory of inspection certificates and labels according to the model specified in Appendix V attached to this Decree through the Ministry of Transport's public service portal and the single window electronic system;

b) Within three working days from the date of receipt of the request letter, the Vietnam Vehicle Inspection Agency will notify the quantity of inspection certificate and label templates to be issued to the inspection facility according to the model specified in Appendix VI attached to this Decree; the inspection facility will base its payment for related printing and distribution costs on this notification;

c) Within five working days from the date the Vietnam Vehicle Inspection Agency receives payment from the inspection facility, it will issue the corresponding number of inspection certificate and label templates.

8. Management and Use of Inspection Certificate and Label Templates

a) Motor vehicle inspection facilities establish a logbook (paper or electronic) to manage the receipt and distribution of inspection certificate and label templates according to the model specified in Appendix VII attached to this Decree;

b) Damaged inspection certificate and label templates are stored separately by type, in serial order, and by month; the reason for damage is clearly noted on the templates.

9. Management, Use, and Disposal of Damaged Inspection Certificate and Label Templates

a) Before January 30 each year, inspection facilities submit (paper or electronic) a request to the local Department of Transport to inspect the management and use of inspection certificate and label templates, and dispose of damaged templates from the previous year according to the model specified in Appendix VIII attached to this Decree.

b) Within five days from the date of receiving the request from the vehicle inspection facility, the Department of Transport shall conduct an inspection of the management and use of blank certificates of inspection, inspection stickers, and proceed to prepare a record for the cancellation of damaged certificates of inspection and inspection stickers according to the model prescribed in Appendix IX attached to this Decree.

Article 14. Authority to Sign Inspection Certificates

1. Vehicle Inspection Facilities

a) The leader of the vehicle inspection facility as stipulated in point a, Clause 1, Article 6 of this Decree;

b) The leader of the inspection department assigned by the vehicle inspection facility.

2. Emission Inspection Facilities for Motorcycles and Motorized Bicycles

a) The leader of the emission inspection facility appointed in accordance with the law;

b) The inspector signs the inspection certificate according to the assignment of the emission inspection facility.

Article 15. Suspension of Inspection Activities of Vehicle Inspection Facilities

1. A vehicle inspection facility shall be suspended from operating when it violates any of the following cases:

a) Failing to provide stored vehicle records at the vehicle inspection facility to other vehicle inspection facilities during the inspection process upon request;

b) Providing login accounts to upload warning information for motor vehicles and special-purpose motorcycles on the software used in the inspection process to persons not assigned by the vehicle inspection facility to manage and use;

c) Failing to notify the recall of incorrectly issued inspection certificates and inspection stickers;

d) Arbitrarily repairing, erasing, or removing vehicle registration forms and vehicle inspection result forms.

2. Duration of Suspension

A vehicle inspection facility shall be suspended from conducting inspections for one month if it violates any of the cases specified in Clause 1 of this Article.

Article 16. Revocation of Certificate of Eligibility for Inspection Activities of Vehicle Inspection Facilities

1. A vehicle inspection facility shall have its certificate of eligibility for inspection activities revoked if it violates any of the following cases:

a) The certificate of eligibility for vehicle inspection activities or the certificate of eligibility for motorcycle and motorized bicycle emission inspection activities issued due to falsifying documents to obtain the certificate;

b) The certificate of eligibility for vehicle inspection activities or the certificate of eligibility for motorcycle and motorized bicycle emission inspection activities intentionally altered or tampered with, causing distortion of the content;

c) Being suspended from inspection activities three times or more within a continuous period of twelve months as provided for in Article 15 of this Decree;

d) Being administratively penalized three times or more within a continuous period of twelve months as provided for in the Decree on Administrative Penalties for Violations of Traffic Order and Safety in Road Transport, except for demerit points and restoration of driving license points;

đ) Having five or more inspectors suspended from participating in inspection activities or three or more inspectors having their inspector certificates revoked within a continuous period of twelve months;

e) Modifying vehicle data or inspection data to legitimize vehicle information and inspection results;

g) Failing to maintain a department to handle matters related to inspection records during the period when the unit suspends or is suspended from inspection activities, except in cases of force majeure as prescribed by law;

h) Ceasing inspection activities for over twelve consecutive months;

i) Arranging non-inspectors to perform inspections; assigning inspectors to simultaneously conduct inspections at two or more inspection facilities at the same time;

k) The vehicle inspection facility being dissolved.

2. A vehicle inspection facility that has had its certificate of eligibility for inspection activities revoked may only be considered for reissuance of the certificate twelve months from the date of the revocation decision, except for the case provided for in point h, Clause 1 of this Article.

Article 17. Responsibilities of inspection stations in cases of suspension of vehicle inspection activities, motorbike exhaust inspection, and motorcycle inspection

1. In case an inspection station suspends operations for three consecutive days or more but less than thirty days, the inspection station shall have the following responsibilities:

a) Notify in writing to the local Department of Transport and the Vietnam Registration Agency, specifying the reasons for the suspension and the remediation plan;

b) Notify in writing at the waiting room of the inspection station;

c) Maintain a department to handle matters related to inspection documentation.

2. In case an inspection station suspends operations for thirty days up to twelve months consecutively, the inspection station shall have the following responsibilities:

a) Notify in writing to the local Department of Transport and the Vietnam Registration Agency, specifying the reasons and duration of the suspension thirty days before the suspension date;

b) Fulfill the responsibilities stipulated in points b and c of Clause 1 of this Article.

Chapter IV
SERVICE LIFE OF MOTOR VEHICLES

Article 18. Determination of service life

1. Twenty-five (25) years from the year of manufacture for trucks (cargo vehicles) and specialized cargo vehicles.

2. Twenty (20) years from the year of manufacture for passenger vehicles with a seating capacity of nine (9) or more passengers (excluding the driver), preschool children transport vehicles, school bus vehicles, and four-wheeled cargo vehicles with engines.

3. Fifteen (15) years from the year of manufacture for four-wheeled passenger vehicles with engines.

4. The service life for similar motor vehicles shall be applied according to the types of motor vehicles specified in Clauses 1, 2, and 3 of this Article, ensuring suitability for each function and purpose of the respective similar vehicle type.

Article 19. Determination of Year of Manufacture

1. The year of manufacture of a vehicle is determined based on information about the year of manufacture in one of the following documents in order of priority:

a) Certificate of quality and technical safety and environmental protection for imported motor vehicles; quality check report upon factory release for domestically produced and assembled vehicles;

b) Information about the year of manufacture affixed by the manufacturer on the vehicle;

c) Results of inquiries from the manufacturer or documents provided by the manufacturer.

2. Vehicles without the documents, files, or bases mentioned in Clause 1 of this Article shall be considered to have exceeded their service life.

Chapter V
IMPLEMENTATION

Article 20. Responsibilities of the Ministry of Transport

1. To be responsible for state management in the activities of vehicle inspection, specialized motor vehicle inspection, motorbike exhaust inspection, and implementation of this Decree.

2. To issue training content, programs, evaluation, and implementation of professional tasks for registration officers of Class I, II, and III.

Article 21. Responsibilities of the Ministry of Science and Technology

To organize and implement calibration and verification of measuring instruments, to lead and coordinate with relevant ministries and sectors in organizing supervision and inspection of the use of measuring instruments in vehicle inspection activities, motorbike exhaust inspection, and motorcycle inspection as prescribed by laws on measurement.

Article 22. Responsibilities of the Vietnam Registration Agency

1. To organize specialized inspections and checks: business activities of vehicle inspection services, specialized motor vehicle inspection, motorbike exhaust inspection, and motorcycle inspection nationwide; to handle or recommend handling within its authority violations.

2. To develop, unify management, grant exploitation rights, and guide the use of software used in vehicle inspection activities, specialized motor vehicle inspection, and motorbike exhaust inspection for inspection stations; share vehicle inspection data with competent agencies to cooperate in management; to organize the implementation of warning and removal of warnings as prescribed in point c of Clause 3 of Article 12 of this Decree.

3. To grant trial exploitation rights for management inspection software at inspection stations for organizations establishing new inspection stations requesting issuance of certificates of eligibility for inspection activities.

4. To compile documents, organize guidance, training, practice, assessment of inspection officer and technical staff business; to disseminate regulatory legal documents, update and supplement inspection business; to train Departments of Transport and inspection stations on inspection management business.

5. To unify management and issue blank inspection certificates and inspection seals; to organize printing, distribution of blank inspection certificates and inspection seals.

6. To publish on the Vietnam Registration Agency's website lists of newly issued, reissued, temporarily suspended, revoked certificates of eligibility for inspection activities; lists of inspection officers and technical staff.

7. Annually in January, to compile lists of vehicles that have exceeded their service life and notify the Traffic Police Corps; to compile results of vehicle exhaust inspection and notify the Environmental Pollution Control Department (Ministry of Natural Resources and Environment) for cooperation in monitoring and managing.

8. To participate in inspecting and evaluating vehicle inspection stations according to technical requirements stipulated in National Technical Regulations on Inspection Stations when requested by Departments of Transport.

9. To hand over to local Departments of Transport for storage and management of files for issuing certificates of eligibility for inspection activities of vehicle inspection stations evaluated by the Vietnam Registration Agency.

10. To designate Conformity Assessment Bodies to assess conformity of vehicle inspection stations with National Technical Regulations on Inspection Stations as prescribed by laws on product and commodity quality and to publish on the Vietnam Registration Agency's website.

Article 23. Responsibilities of the People's Committee of provinces and centrally governed cities

1. Coordinate with the Ministry of Transport to organize the implementation of this Decree.

2. Direct the Department of Transport and other local functional agencies to implement state management over the activities of vehicle inspection for motor vehicles, special-purpose vehicles, and exhaust gas inspection for motorcycles and motorized bicycles at the local level in accordance with the provisions of this Decree.

Article 24. Responsibilities of the Department of Transport

1. Organize management, inspection, supervision, handling, and recommending handling of violations within its authority in the implementation of regulations on the activities of vehicle inspection for motor vehicles, special-purpose vehicles, and exhaust gas inspection for motorcycles and motorized bicycles at the local level.

2. Implement issuance, reissuance, temporary suspension, and revocation of certificates of qualification for vehicle inspection for motor vehicles, certificates of qualification for exhaust gas inspection for motorcycles and motorized bicycles.

3. Conduct inspections and evaluations of operating conditions for inspection stations

a) For inspection stations for motor vehicles: inspect and evaluate conditions as prescribed in this Decree; National technical standards on inspection stations, when there is a Conformity Assessment Body as stipulated in Clause 10, Article 22 of this Decree, then utilize the certification results of that Body;

b) For exhaust gas inspection stations for motorcycles and motorized bicycles: inspect and evaluate conditions as prescribed in this Decree and National technical standards on inspection stations; utilize the results of exhaust gas measurement equipment calibration and verification according to laws on metrology.

4. Inspect the management and use of blank inspection certificates, inspection seals; damaged inspection certificates and seals of inspection stations for motor vehicles as prescribed in Clause 8, Clause 9, Article 13 of this Decree.

5. Propose the Vietnam Registration Agency to participate in inspecting and evaluating inspection stations for motor vehicles according to technical requirements stipulated in National technical standards on inspection stations upon receipt of applications for new issuance or reissuance of certificates of qualification for vehicle inspection for motor vehicles.

6. Promote and disseminate the provisions of this Decree and related laws on the activities of vehicle inspection for motor vehicles, special-purpose vehicles, and exhaust gas inspection for motorcycles and motorized bicycles to relevant organizations and individuals in the locality to be aware and comply.

7. Implement the posting and removal of warnings as prescribed in Point a, Clause 3, Article 12 of this Decree.

8. Publish on the Department of Transport’s electronic information website lists of inspection stations for motor vehicles, exhaust gas inspection stations newly issued, reissued, temporarily suspended, or revoked certificates of qualification for vehicle inspection for motor vehicles, certificates of qualification for exhaust gas inspection for motorcycles and motorized bicycles; lists of inspectors, technical staff, and suspended inspectors under the management of the Department of Transport.

9. Dispatch personnel to attend training on managing inspection activities.

10. Regularly before the end of each quarter, submit (in paper form or electronic data) to the Vietnam Registration Agency the results of implementing the provisions of Clause 1, Clause 2 of this Article or when requested according to the model attached as Appendix X to this Decree.

Article 25. Responsibilities of the organization establishing inspection stations

1. Implement relevant provisions of this Decree and the National Technical Regulations on inspection stations.

2. Bear responsibility for the legality of the application dossier for issuing certificates of eligibility to conduct vehicle inspection and exhaust emission inspection for motorcycles and motor vehicles.

3. Before requesting issuance of certificates of eligibility to conduct vehicle inspection, the organization establishing the inspection station shall carry out software management system operation, installation, and trial run at the inspection station.

4. Shall not interfere with the inspection of motor vehicles, special-purpose motor vehicles, or exhaust emission inspection of motorcycles and motor vehicles under its subordinate inspection stations to violate legal regulations.

5. Request the conformity assessment organization to inspect and evaluate according to Clause 10, Article 22 of this Decree and use the inspection and evaluation results to complete the procedures for issuing new certificates of eligibility to conduct vehicle inspection.

Article 26. Responsibilities of the inspection station

1. Develop and issue internal procedures and guidelines of the inspection station to fully implement all inspection contents as prescribed for vehicle inspection, special-purpose vehicle inspection, and exhaust emission inspection for motorcycles and motor vehicles.

2. Internally manage and supervise inspection activities and bear full responsibility when violations or malpractices occur at the inspection station.

3. Manage and use blank inspection certificates and inspection seals; cancel inspection certificates and inspection seals according to Clause 8 and Clause 9, Article 13 of this Decree; cut corners of inspection certificates for cases where the inspection results are unsatisfactory due to major defects or serious damage (MaD); critical defects or dangerous damage (DD).

4. Cooperate with competent state management agencies in implementing and piloting the application of new inspection technologies and equipment in vehicle inspection, special-purpose vehicle inspection, and exhaust emission inspection for motorcycles and motor vehicles.

5. Before January 15 each year, review and submit reports (in paper form or electronic data) listing vehicles that have reached their service life limit of the previous year according to the model specified in Appendix XI attached to this Decree to the Vietnam Vehicle Inspection Agency, Department of Transport, and local Traffic Police Office; implement data transmission and reporting according to the regulations of the Ministry of Transport.

6. Hand over all related archival files concerning vehicle inspection, special-purpose vehicle inspection, exhaust emission inspection for motorcycles and motor vehicles, and unused blank inspection certificates and inspection seals as directed by the local Department of Transport when the inspection station's certificate of eligibility for inspection is revoked.

7. Manage and use software provided by the Vietnam Vehicle Inspection Agency in vehicle inspection, special-purpose vehicle inspection, and exhaust emission inspection for motorcycles and motor vehicles in accordance with legal regulations to ensure network security.

8. Announce the revocation (in paper form or electronically) according to the model specified in Appendix XII attached to this Decree for inspection certificates and inspection seals that are no longer valid according to Clause 4, Article 13 of this Decree, send it to the vehicle owner, and enter a warning into the inspection management software.

9. Charge service fees, taxes, and fulfill financial obligations to the state budget related to inspection activities as prescribed by law.

10. Request the conformity assessment organization to inspect and evaluate according to Clause 10, Article 22 of this Decree and use the inspection and evaluation results to complete the procedures for reissuing certificates of eligibility to conduct vehicle inspection.

11. Implement the posting and removal of warnings as prescribed in Point b, Clause 3, Article 12 of this Decree and for cases where the inspection results are unsatisfactory.

Chapter VI
IMPLEMENTING PROVISIONS

Article 27. Transitional Provisions

1. Inspection stations for motor vehicles that were issued certificates of eligibility to conduct vehicle inspection before this Decree takes effect but do not meet the conditions stipulated in Clause 1, Article 5 of this Decree may continue operations until December 31, 2028.

2. Inspection stations for motor vehicles that have been issued certificates of eligibility to conduct vehicle inspection but have not yet undergone conformity assessment by the conformity assessment organization as prescribed in Clause 10, Article 22 of this Decree must be assessed for conformity with the National Technical Regulations on inspection stations before January 1, 2029.

3. Motor vehicle inspectors who obtained inspector certificates before this Decree takes effect shall be considered equivalent to Class II inspectors; high-level motor vehicle inspectors who obtained inspector certificates before this Decree takes effect shall be considered equivalent to Class I inspectors.

4. Vehicles that have been determined to have a service life or no service life limit prior to the effective date of this Decree shall continue to be applied according to the service life already determined.

5. Application dossiers for certificates of eligibility to conduct vehicle inspection submitted to the Department of Transport or the Vietnam Vehicle Inspection Agency before this Decree takes effect shall be processed according to Decree No. 139/2018/ND-CP dated October 8, 2018, amended and supplemented by Decree No. 30/2023/ND-CP dated June 8, 2023, and Decree No. 121/2024/ND-CP dated October 3, 2024 of the Government.

6. The templates for certificates of technical inspection and inspection seals according to the models set forth in Circular No. 16/2021/TT-BGTVT dated August 12, 2021 of the Minister of Transport on technical safety inspection and environmental protection for road motor vehicles, Circular No. 16/2014/TT-BGTVT dated May 13, 2014 of the Minister of Transport on conditions for four-wheeled cargo vehicles with engines and drivers participating in road traffic, Circular No. 86/2014/TT-BGTVT dated December 31, 2014 of the Minister of Transport on conditions for four-wheeled passenger vehicles with engines and drivers participating in restricted road traffic, and Circular No. 89/2015/TT-BGTVT dated December 31, 2015 of the Minister of Transport on quality and technical safety inspections and environmental protection for specialized motorcycles that have been produced and continue to be used until June 30, 2025.

Article 28. Effectiveness

1. This Decree shall take effect from January 1, 2025, except for Point d Clause 1 Article 16 of this Decree which shall take effect from January 1, 2026.

2. The following Decrees shall cease to be effective from the date this Decree takes effect:

a) Decree No. 95/2009/NĐ-CP dated October 30, 2009 of the Government on service life limits for cargo trucks and passenger cars;

b) Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of vehicle technical inspection services;

c) Decree No. 30/2023/NĐ-CP dated June 8, 2023 of the Government amending and supplementing certain articles of Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of vehicle technical inspection services;

d) Decree No. 121/2024/NĐ-CP dated October 3, 2024 of the Government amending and supplementing certain articles of Decree No. 139/2018/NĐ-CP dated October 8, 2018 of the Government on business operations of vehicle technical inspection services, amended and supplemented by certain articles in Decree No. 30/2023/NĐ-CP dated June 8, 2023.

3. Ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, and related organizations and individuals are responsible for implementing this Decree.
