Of the Minister of Transport No. 1666/QĐ-GTVT dated July 9, 1999 on approving the adjustment of the land clearance schedule for the project to renovate and upgrade National Highway 10, National Highway 18, and Bai Chay Bridge
THE MINISTER OF TRANSPORT
Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government on tasks, powers, responsibilities for state management, and organizational structure of the Ministry of Transport;
Pursuant to the Prime Minister's Decision No. 299/QĐ-TTg dated April 13, 1998 on investment in the project to renovate and upgrade National Highway 10; No. 18/QĐ-TTg dated January 7, 1998 on investment in the renovation and upgrading of National Highway 18; No. 634/TTg dated July 20, 1998 approving the project to construct Bai Chay Bridge on National Highway 18 and assigning tasks to the Ministry of Transport as the main authority to coordinate with provinces, cities, and relevant ministries and agencies in compensation and land clearance to meet the project schedule;
Pursuant to Decree No. 22/1998/NĐ-CP dated April 24, 1998 of the Government on compensation for losses when the State requisitions land for national defense, security, national interests, or public interest;
Pursuant to Decision No. 592/1999/QĐ-GTVT dated March 11, 1999 of the Minister of Transport promulgating technical regulations and procedures for land clearance activities serving transportation construction projects;
Pursuant to Decision No. 2348/QĐ/GTVT/CGĐ dated September 19, 1998 of the Ministry of Transport approving the plan, scheme, and preliminary budget estimate for land clearance costs in the project to renovate and upgrade National Highway 10 and National Highway 18;
Pursuant to compensation policies and unit prices for land clearance approved by People's Committees of provinces where the projects pass through;
Pursuant to Request No. 1703/GPMB dated June 2, 1999 from the Management Board of Project 18 regarding adjustment of the land clearance schedule for the project to renovate and upgrade National Highway 10, National Highway 18, and Bai Chay Bridge, as well as the actual situation of land clearance work;
At the proposal of the Director of the Department of Inspection & Quality Control of Transport Construction;
DECISION
Article 1: Adjust the schedule for land clearance for the National Highway 10, National Highway 18, and Bai Chay Bridge project to be substantially completed by the second quarter of 2000.
Article 2: Regular expenses for land clearance activities shall only be calculated from six months after the start of construction. In special cases where the schedule is extended, the Project Owner and Provincial Land Clearance Board must provide explanations and obtain specific approval from the Ministry of Transport. The Project Owner is responsible for coordinating with provincial land clearance boards to implement according to the prescribed schedule.
Article 3: The progress of the Land Clearance Project set forth in this Decision replaces the progress previously prescribed in Decision No. 2348/QĐ-GTVT.CGĐ dated September 19, 1998 issued by the Ministry of Transport.
Article 4: The Directors of the Bureau of Inspection and Quality Control for Road Transport, the General Director of Construction Management Board 18, and the Heads of relevant agencies are responsible for implementing this Decision.
