DECISION
Regarding amendments and supplements to certain articles of Decision No. 181/TTg dated March 26, 1997 of the Prime Ministeron the establishment ofthe Mineral Reserves Evaluation Council
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Article 55 of the Minerals Law dated March 20, 1996;
Pursuant to Decree No. 91/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Minister of Natural Resources and Environment and the Minister of Home Affairs.
DECISION:
Article 1. Amending and supplementing certain articles of Decision No. 181/TTg dated March 26, 1997 of the Prime Minister on the establishment of the Mineral Reserves Evaluation Council as follows:
1. Clause 3, Article 2 shall be amended as follows:
"3. Establish standards for classifying mineral reserves for the Minister of Natural Resources and Environment to promulgate within his authority."
2. Article 3 shall be amended and supplemented to change the composition of the Mineral Reserves Evaluation Council as follows:
- Chairman of the Council: The Minister of Natural Resources and Environment.
- Vice Chairman of the Council: A Deputy Minister of Natural Resources and Environment.
- Supplementing a member of the Council: One Deputy Minister of Science and Technology.
4. Clause 2 of Article 5 is amended and supplemented as follows:
"1. The Mineral Reserves Evaluation Council has an office located at the Ministry of Natural Resources and Environment. The staffing of the Council's office is included in the total staffing of the Ministry of Natural Resources and Environment.
2. The Chairman of the Mineral Reserves Evaluation Council shall specify the Rules of Procedure of the Council, and submit to the Prime Minister for decision on the appointment and removal of Council members."
Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Provisions in Decision No. 181/TTg dated March 26, 1997 of the Prime Minister that conflict with this Decision are hereby abolished.
Article 3. The Chairman of the Mineral Reserves Evaluation Council, Ministers, Heads of ministerial-level agencies, Heads of central government agencies, Chairmen of provincial People's Committees, and Chairmen of municipal People's Committees directly under the Central Government are responsible for implementing this Decision.
