DECREE

REGULATIONS ON ADMINISTRATIVE SANCTIONS FOR VIOLATIONS IN THE FIELD OF NATIONAL SECURITY, PUBLIC ORDER AND SOCIAL SAFETY; PREVENTION AND CONTROL OF SOCIAL EVILS; FIRE PREVENTION AND FIGHTING; PREVENTION AND CONTROL OF DOMESTIC VIOLENCE

On the basis of Law on Government Organization dated December 25, 2001;

On the basis of Law on Handling Administrative Violations dated June 20, 2012;

On the basis of Law on Fire Prevention and Fighting dated June 29, 2001;

On the basis of Law on Residence dated November 29, 2006 and Law Amending and Supplementing Certain Provisions of the Law on Residence dated June 20, 2013;

On the basis of Law on Prevention and Control of Domestic Violence dated November 21, 2007;

On the basis of Law on Prevention and Control of Narcotics dated December 9, 2000 and Law Amending and Supplementing Certain Provisions of the Law on Prevention and Control of Narcotics dated June 3, 2008;

On the basis of Law on Enforcement of Criminal Sentences dated June 17, 2010;

On the basis of Ordinance on Protection of State Secrets dated December 28, 2000;

On the basis of Ordinance on Prevention and Control of Prostitution dated March 17, 2003;

On the basis of Ordinance on Management and Use of Weapons, Explosives, and Auxiliary Tools dated June 30, 2011 and Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Management and Use of Weapons, Explosives, and Auxiliary Tools dated July 12, 2013;

The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.

The Government promulgates this Decree to regulate administrative sanctions for violations in the field of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence,

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Decree stipulates acts of administrative violations, forms, levels of administrative sanctions, measures to remedy consequences for each act of administrative violation, authority to issue administrative violation notices, authority to impose administrative sanctions, specific monetary fines according to each position for acts of administrative violations in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence.

2. Acts of administrative violations in other fields directly related to the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence not regulated in this Decree shall be subject to regulations in other Decrees of the Government on administrative sanctions in the relevant state management fields for imposition of sanctions.

Article 2. Applicability

1. Vietnamese individuals and organizations; foreign individuals and organizations committing administrative violations in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence within the territory, internal waters, territorial seas, contiguous zones, exclusive economic zones, and continental shelf of the Socialist Republic of Vietnam; on aircraft bearing Vietnamese nationality, ships flying the flag of Vietnam shall be subject to administrative sanctions under this Decree and other relevant laws on administrative sanctions.

2. Authorities and persons with the power to impose administrative sanctions in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence and related individuals and organizations.

3. In cases where international treaties to which the Socialist Republic of Vietnam is a party provide different provisions, such provisions shall be implemented.

Article 3. Forms of Administrative Sanctions and Measures to Remedy Consequences

1. For each act of administrative violation in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence, the violator must bear one of the following main forms of administrative sanctions:

a) To issue warnings;

b) Fine.

2. Depending on the nature and degree of the violation, individuals and organizations violating administrative regulations in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence may also be subject to one or more of the following supplementary forms of administrative sanctions:

a) Suspension of the right to use licenses or certificates of practice for a period of time or suspension of operations for a period of time;

b) Confiscation of objects of administrative violations, means used to commit administrative violations (hereinafter referred to collectively as objects and means of administrative violations).

3. In addition to the remedial measures prescribed in Clause 1 of Article 28 of the Law on Handling Administrative Violations, individuals and organizations committing administrative violations in the fields of national security, public order and social safety; prevention and control of social evils; fire prevention and fighting; prevention and control of domestic violence may also be subject to one or more of the following remedial measures:

a) Compelling reduction in quantity of hazardous substances and materials in terms of fire and explosion according to prescribed standards;

b) Compelling relocation of hazardous substances and materials due to administrative violations to warehouses or designated locations according to regulations;

c) Compelling rearrangement of hazardous substances and materials according to regulations;

d) Compelling recovery and cancellation of documents, information related to administrative violations;

đ) Compelling public apology when requested by the victim;

e) Other remedial measures prescribed in Chapter II of this Decree.

4. The application of expulsion as a form of administrative sanction against foreigners may be a main form or a supplementary form of administrative sanction.

Article 4. Provisions on the amount of fines

1. The maximum fine for individuals in the field of preventing domestic violence is thirty million dong, and for organizations it is sixty million dong; the maximum fine for individuals in the field of security, public order, social safety, and preventing social evils is forty million dong, and for organizations it is eighty million dong; the maximum fine for individuals in the field of fire prevention and firefighting is fifty million dong, and for organizations it is one hundred million dong.

2. The fines prescribed in Chapter II of this Decree apply to administrative violations committed by individuals. For organizations committing the same violation, the fine is twice the amount imposed on individuals.

Chapter II
ACTS OF ADMINISTRATIVE VIOLATION, FORMS OF ADMINISTRATIVE PENALTY AND MEASURES TO REMEDY CONSEQUENCES

Section 1

ADMINISTRATIVE VIOLATIONS CONCERNING SECURITY, PUBLIC ORDER, AND SOCIAL SAFETY

Article 5. Violations concerning public order

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Making rude gestures, provocative remarks, teasing, or insulting the dignity and personal integrity of others;

b) Causing disorder at theaters, cinemas, cultural houses, clubs, places of artistic performances, sports events, festivals, exhibitions, fairs, office premises, organizations, residential areas, schools, hospitals, railway stations, bus terminals, airports, ports, streets, border areas, ports, or other public places;

c) Allowing pets to run loose in cities, towns, or public places;

2. A fine from 500,000 VND to 1,000,000 VND shall be imposed for any of the following acts:

a) Fighting or inciting others to fight;

b) Providing false information to state agencies with authority;

c) Being drunk and causing public disorder;

d) Throwing stones, gravel, sand, or any other objects at houses, vehicles, people, or other property;

đ) Gathering a large number of people in public places causing public disorder;

e) Allowing pets to damage the property of others;

g) Flying kites, balloons, remote-controlled planes, or other flying objects in airport zones or prohibited areas; lighting and releasing sky lanterns;

h) Troublesome behavior or harassment of others when carrying, transporting, or keeping luggage at ports, bus terminals, airports, seaports, railway stations, and other public places.

3. Imposing a fine from two million dong to three million dong for any of the following acts:

a) Carrying, hiding in one's person, objects, or means of transportation various types of knives, hammers, tools, or other daily-use items with the intent to disrupt public order or intentionally cause injury to others;

b) Inciting or encouraging others to disrupt public order;

c) Hiring or inciting others to fight;

d) Disrupting public order in courtrooms, execution sites, or engaging in other acts that obstruct judicial proceedings or enforcement;

đ) Disrupting public order at locations where compulsory enforcement decisions are being carried out;

e) Assaulting or hiring others to assault the health of others;

g) Abusing democratic freedoms or religious beliefs to incite others to infringe upon the interests of the State, the rights and legitimate interests of organizations or individuals;

h) Disrupting or hindering the normal operations of agencies or organizations;

i) Assembling illegally in large numbers in public places or restricted areas;

k) Organizing or facilitating others to marry foreigners contrary to local customs or laws, affecting national security, public order, and social safety;

l) Writing, disseminating, or circulating materials containing false, defamatory content that affects the reputation of organizations or individuals;

m) Storing or transporting sky lanterns.

4. A fine of from VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Disrupting public order while carrying crude weapons or support tools;

b) Producing, importing, or selling sky lanterns.

5. Additional forms of punishment:

Seizure of evidence and means of administrative violation for acts stipulated in Point g Clause 2; Point a, l, m Clause 3 and Clause 4 of this Article.

6. Foreigners who commit administrative violations as stipulated in Point k Clause 3 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 6. Violation of provisions on ensuring communal quietness

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Causing loud noise, making a commotion, or creating disturbance in residential areas or public places from 10 p.m. of the previous day to 6 a.m. of the following day;

b) Failing to comply with the quietness regulations of hospitals, sanatoriums, schools, or other places where communal quietness is required;

c) Selling food, drinks, refreshments beyond the hours prescribed by the People's Committee of provinces or centrally governed cities.

2. A fine of VND 300,000 to VND 500,000 shall be imposed for the act of using loudspeakers, gongs, drums, horns, trumpets, or other means to rally in public places without permission from competent authorities.

3. Additional forms of punishment:

Seizure of contraband and administrative violation tools for the act stipulated in Clause 2 of this Article.

Article 7. Violation of provisions on maintaining communal cleanliness

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Failing to clean up garbage and clear drainage channels around houses, offices, enterprises, military camps, thereby causing public hygiene issues;

b) Pouring water or allowing water to flow into collective living areas, streets, sidewalks, railway stations, bus terminals, public transportation vehicles, or other places that cause communal dirtiness;

c) Urinating or defecating on streets, common pathways in public and residential areas;

d) Allowing domestic animals to defecate in public places;

đ) Transporting garbage or waste using primitive transportation means within cities or towns causing spillage or failing to ensure cleanliness;

e) Raising domestic animals or other animals that cause communal dirtiness in residential areas.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Dumping, throwing filth or other substances that stain houses, offices, workplaces, production, or business premises of others;

b) Burning garbage, waste, toxic substances, or other dangerous materials in residential areas or public places without authorization;

c) Dumping garbage, waste, or any other objects into manholes, public drainage systems, sidewalks, or streets;

d) Leaving garbage, waste, animal carcasses, or any other objects that cause pollution in public places or near water taps, drinking wells, ponds, lakes, or reservoirs commonly used by people for daily activities, thereby causing dirtiness.

3. Measures to remedy consequences:

a) Compel the implementation of measures to rectify environmental pollution for acts stipulated in Points b, c, d, đ, e of Clause 1 and Points b, d of Clause 2 of this Article;

b) Compel restoration to the original state for acts stipulated in Points a, c of Clause 2 of this Article.

Article 8. Violation of provisions on registration and management of residence

1. A fine of VND 100,000 to VND 300,000 shall be imposed for any of the following acts:

a) Individuals or household heads not complying with regulations on permanent residence registration, temporary residence registration, or adjustments to changes in household registers or temporary residence certificates;

b) Individuals or household heads not complying with regulations on reporting stay, declaring temporary absence;

c) Refusing to comply with household register checks, temporary residence checks, stay checks, or failing to present household registers, temporary residence certificates, or other related documents upon request by competent authorities.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Altering, erasing, modifying, or engaging in other acts that distort the contents of household registers, temporary residence certificates, or other related documents;

b) Providing false information or documents about residence;

c) Renting or leasing household registers, temporary residence certificates, or other related documents to commit acts contrary to the law;

d) Using household registers, temporary residence certificates, or other related documents to commit acts contrary to the law;

đ) Business establishments providing accommodation not reporting stay to the police as required when guests arrive;

e) Organizations inciting, urging, enticing, brokering, coercing others to violate laws on residence.

3. A fine of VND 2,000,000 to VND 4,000,000 shall be imposed for any of the following acts:

a) Falsifying or fabricating documents to obtain permanent residence registration, temporary residence registration, issuance of household registers, or temporary residence certificates;

b) Counterfeiting household registers, temporary residence certificates, or fabricating conditions to obtain permanent residence registration;

c) Using counterfeit household registers or temporary residence certificates;

d) Allowing others to register residence at their place of residence for profit or in reality, the person registering residence does not reside there;

đ) Individuals or household heads allowing others to join their household at the same place but failing to meet the minimum area requirement per person as prescribed;

e) Signing indefinite-term labor contracts with workers not belonging to their own enterprise to facilitate household registration;

g) Using labor contracts contrary to the law to facilitate household registration;

h) Failing to report temporary residence for foreign nationals renting housing.

4. Additional forms of administrative punishment:

Seizure of contraband and administrative violation tools for acts stipulated in Point a of Clause 2; Points a, b, c of Clause 3 of this Article.

5. Measures to remedy consequences:

a) Compel the recovery of household registers, temporary residence certificates, or other related documents for acts stipulated in Point a of Clause 2; Point a of Clause 3 of this Article;

b) Compel the cancellation of false information or documents for acts stipulated in Point b of Clause 2 of this Article;

c) Compel the return of illegal gains obtained through acts of administrative violations stipulated in Point d of Clause 3 of this Article;

d) Compel the cancellation of labor contracts contrary to the law to facilitate household registration stipulated in Points e, g of Clause 3 of this Article.

Article 9. Violations concerning management and use of identity cards

1. A warning or a fine from 100,000 VND to 200,000 VND shall be imposed for any of the following acts:

a) Failure to present an identity card upon request for inspection by an authorized person;

b) Failure to comply with legal provisions on issuance, reissuance, and replacement of identity cards;

c) Failure to comply with legal provisions on confiscation and temporary detention of identity cards when requested by an authorized person.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Using another person's identity card to commit acts contrary to legal provisions;

b) Altering or tampering with an identity card;

c) Renting, lending, or allowing others to rent or lend an identity card to commit acts contrary to legal provisions.

3. A fine of VND 2,000,000 to VND 4,000,000 shall be imposed for any of the following acts:

a) Providing false information or documents to obtain an identity card through fraudulent means;

b) Producing counterfeit identity cards;

c) Using counterfeit identity cards.

4. A fine of from VND 4,000,000 to VND 6,000,000 shall be imposed for the act of pledging an identity card to commit acts contrary to legal provisions.

5. Additional forms of punishment:

Seizure of contraband and means of committing administrative violations for the acts specified in Point b Clause 2, Clause 3 Article 9 herein.

6. Measures to remedy consequences:

Compulsory recovery of identity cards for the acts specified in Point b Clause 2 Article 9 herein.

Article 10. Violations concerning management and use of firearms, explosives, support tools, fireworks, and dangerous toys prohibited

1. A fine of VND 500,000 to VND 1,000,000 shall be imposed for any of the following acts:

a) Failure to conduct regular inspections of firearms, explosives, and support tools as required;

b) Violating storage regulations for various types of firearms, explosives, and auxiliary tools;

c) Allowing children to use dangerous toys that are prohibited;

d) Circulating permits for managing and using firearms, explosives, support tools, and fireworks that have lost their validity.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Failure to declare and register all types of firearms, explosives, and support tools with the competent authority;

b) Using fireworks without permission.

3. A fine of VND 2,000,000 to VND 4,000,000 shall be imposed for any of the following acts:

a) Destroying, intentionally damaging, giving, sending, lending, renting, mortgaging, or pledging firearms, explosives, and support tools;

b) Trading, producing counterfeit, altering, erasing, lending, renting, mortgaging, pledging, damaging permits, certificates, and confirmation letters related to the management and use of firearms, explosives, support tools, and fireworks;

c) Failing to immediately report to the competent authority about the loss of permits, certificates, and confirmation letters related to the management and use of firearms, explosives, support tools, and fireworks;

d) Using firearms, explosives, and support tools in violation of regulations but without causing consequences;

đ) Using firearms and support tools without a permit;

e) Transferring firearms and support tools to persons who do not meet the conditions and standards for use;

g) Failing to surrender firearms, explosives, and support tools as required.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Buying, selling scrap materials and parts that are firearms, explosives, and support tools;

b) Violating safety regulations for transporting firearms, explosives, and support tools;

c) Cutting or dismantling bombs, mines, bullets, grenades, depth charges, and other weapons to extract explosives illegally;

d) Producing, storing, buying, selling, or transporting fireworks, firework ingredients, and dangerous toys illegally;

đ) Losing firearms and support tools.

5. A fine of from VND 10,000,000 to VND 20,000,000 shall be imposed for any of the following acts:

a) Producing or repairing crude weapons and support tools without a permit;

b) Producing or repairing prohibited toys;

c) Buying, selling, transporting, or storing crude weapons and support tools without a permit;

d) Illegally buying, selling, transporting, or storing sports firearms;

đ) Transporting military firearms, firearm components, explosive accessories, and support tools without a permit or with a permit but failing to comply with the permit's requirements or lacking other required documents as stipulated by law;

e) Selling industrial explosives or high-nitrate ammonium (98.5% or higher) to units that have not been granted certification for security and public order conditions and industrial explosives usage permits or high-nitrate ammonium (98.5% or higher) or approval documents from competent state authorities.

6. A fine of from VND 20,000,000 to VND 40,000,000 shall be imposed for any of the following acts:

a) Illegally producing, manufacturing, or repairing military firearms, sports firearms, or hunting rifles;

b) Illegally bringing military firearms, hunting rifles, support tools, fireworks, or dangerous toys into or out of Vietnam.

7. Administrative violations in the field of industrial explosives management shall be handled according to the Government Decree and other regulatory legal documents related to administrative penalties in the fields of chemicals, fertilizers, and industrial explosives management.

8. Additional forms of punishment:

a) Seizure of contraband and means of committing administrative violations for the acts specified in Point c Clause 1; Point b Clause 2; Points d, đ, g Clause 3; Points a, c, d Clause 4; Clause 5; Clause 6 Article 10 herein;

b) Suspension of the right to use permits for firearms and support tools for a period of three to six months for the acts specified in Point e Clause 3 Article 10 herein;

c) Suspension of the right to use permits, certificates, and confirmation letters related to the management and use of firearms, explosives, support tools, and fireworks for a period of nine to twelve months for the acts specified in Points a, b, d Clause 3; Point b Clause 4 Article 10 herein.

9. Remedial measures:

Compulsory recovery and cancellation of permits, certificates, and confirmation letters related to the management and use of firearms, explosives, support tools, and fireworks for the acts specified in Point b Clause 3 Article 10 herein.

Article 11. Violations of regulations on management of industries and trades subject to conditions regarding security and public order

1. A fine of VND 500,000 to VND 1,000,000 shall be imposed for any of the following acts:

a) Using persons who do not meet the required qualifications and standards for work in businesses subject to conditions regarding security and public order;

b) Failing to present the certificate of compliance with conditions regarding security and public order when requested for inspection by competent authorities;

c) Failing to immediately notify competent authorities of the loss of the certificate of compliance with conditions regarding security and public order;

d) Failing to fully comply with regulations on management of security and public order for industries and trades subject to conditions.

2. A fine of from VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Engaging in business activities outside the scope, trade, and location specified in the certificate of compliance with conditions regarding security and public order;

b) Changing the head of the enterprise, branch, representative office, or legal representative of the business without notifying competent authorities in writing;

c) Lending, leasing, purchasing, or selling certificates of compliance with conditions regarding security and public order for illegal purposes;

d) Accepting collateral of assets that require ownership documents but lacking such documents;

đ) Accepting collateral of assets without a contract as prescribed;

e) Accepting collateral of assets belonging to others without a valid power of attorney from the owner authorizing the person bringing the asset for collateral;

g) Storing collateral assets at locations other than those registered with competent authorities;

h) Operating nightclubs, electronic games for foreigners, or casinos without security personnel employed by a security service company as prescribed;

i) Selling or providing signal-emitting devices for vehicles with priority rights to unauthorized individuals without permission from competent authorities;

3. A fine of VND 5,000,000 to VND 15,000,000 shall be imposed for any of the following acts:

a) Engaging in industries and trades subject to conditions regarding security and public order without a certificate of compliance with conditions regarding security and public order;

b) Altering or erasing a certificate of compliance with conditions regarding security and public order;

c) Failing to maintain the required and full conditions regarding security and public order during business operations;

d) Offering loans secured by collateral with interest rates exceeding 150% of the basic lending rate published by the State Bank of Vietnam at the time of loan issuance.

4. A fine of VND 20,000,000 to VND 30,000,000 shall be imposed for any of the following acts:

a) Using a business establishment engaged in industries and trades subject to conditions regarding security and public order to organize social evils or illegal activities;

b) Accepting collateral of assets stolen, fraudulently obtained, embezzled, or derived from criminal activities by others.

5. Additional forms of punishment:

a) Revoking the right to use licenses, practice certificates, or certificates of compliance with conditions regarding security and public order for a period of three to six months for the acts prescribed in Point a and c Clause 2; Point d Clause 3 of this Article;

b) Revoking the right to use licenses, practice certificates, or certificates of compliance with conditions regarding security and public order for a period of six to nine months for the act prescribed in Clause 4 of this Article.

6. Foreigners committing administrative violations as prescribed in Clause 2, Clause 3, and Clause 4 of this Article may be expelled from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 12. Violations of regulations on management and use of seals

1. A fine of VND 500,000 to VND 1,000,000 shall be imposed for any of the following acts:

a) Failing to immediately report to the competent authority regarding the loss or damage of the certificate for registered seal samples.

b) Failing to re-register seal samples with the competent authority as prescribed.

2. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed for any of the following acts:

a) Carving various types of seals without a permit or other required documents as prescribed.

b) Using seals that have not been registered for imprint sample or do not have a certificate for registered seal samples.

c) Taking seals out of the organization without permission from the competent authority;

d) Failing to immediately report to the competent authority regarding the loss of the currently used seal.

đ) Failing to replace the seal when there is a decision from the competent authority regarding the change of name of the agency or organization using the seal or the change of name of the superior agency or changes related to the seal model due to changes in the office location of the relevant agency or organization.

e) Not re-engraving the seal according to the prescribed model;

g) Failing to return the seal and the certificate for registered seal samples when the decision of the competent authority becomes effective regarding the division, merger, consolidation, dissolution, termination of tasks, conversion of ownership form, cessation of operations, or temporary suspension of seal usage of the agency or organization.

h) Failing to notify the competent authorities about the seal model before using it.

i) Failing to present the seal and the certificate for registered seal samples upon request for inspection by the competent authority.

3. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Failing to return the seal, the certificate for registered seal samples, or failing to return the seal within the specified time period when there is a decision from the competent authority to confiscate it.

b) Stamping documents or papers without the signature of an authorized person or the signature of a person who is not authorized.

c) Borrowing, lending seals, or using seals of another agency or organization for activities.

d) Producing corporate seals incorrectly according to the prescribed procedures.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Bringing seals into the Socialist Republic of Vietnam without a permit or without a certificate for registered seal samples.

b) Illegally using seals brought from abroad into Vietnam;

c) Fabricating documents to produce additional seals for agencies or organizations.

d) Carving counterfeit seals or using counterfeit seals.

5. Additional forms of punishment:

a) Confiscation of contraband and means of administrative violation for the acts stipulated in Point a Clause 2; Point d Clause 3; Points c, d Clause 4 of this Article.

b) Suspension of the right to use licenses or certificates of practice for a period of three to six months for the acts stipulated in Point a Clause 2; Point d Clause 3 of this Article.

6. Measures to remedy consequences:

a) Compulsory recovery of seals for the acts stipulated in Points b, đ, e Clause 2; Point c Clause 3; Points c, d Clause 4 of this Article.

b) Compulsory recovery of seals and certificates for registered seal samples for the acts stipulated in Point g Clause 2; Point a Clause 3 of this Article.

c) Compulsory cancellation of documents or papers stamped in violation of regulations for the acts stipulated in Point b Clause 3 of this Article.

7. Foreign individuals committing administrative violations stipulated in Clause 3 and Clause 4 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 13. Violations of regulations on management of security service business activities

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Security personnel not wearing uniforms, not wearing identification badges, or using identification badges contrary to regulations while performing security duties.

b) Not having a security personnel certification issued by the company director.

2. A fine of VND 200,000 to VND 500,000 for any of the following acts:

a) Failing to report to the competent authority regarding the location of the headquarters or target of protection, the start date of business operations of the enterprise, branch, representative office; failing to submit periodic reports or failing to immediately report to the competent authority regarding the loss of the certificate confirming compliance with security and public order conditions.

b) Failing to present the certificate confirming compliance with security and public order conditions for security service business operations when requested for inspection by the competent authority.

c) Using security service personnel who have not undergone training or have not been granted a security service vocational certificate.

d) Failing to implement or fully implement the training and examination of security service personnel.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Conducting business activities in other industries, professions, and services outside security services, except as provided in Point c Clause 4 of this Article.

b) Failing to report to the competent authority regarding changes in the head of the enterprise, branch, representative office.

c) Failing to issue security personnel certification or identification badges to security personnel.

d) Recruiting security service personnel who do not meet the prescribed conditions and standards.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Engaging in security service business operations without a certificate confirming compliance with security and public order conditions for security service business operations.

b) Providing uniforms, identification badges, insignias, hats to security service personnel contrary to regulations.

c) Conducting private investigation or detective activities under any form.

d) Allowing others to use the name of the organization or individual to establish a security service business enterprise.

đ) Establishing a security service business enterprise for others to operate.

e) Training and issuing security service vocational certificates to security service personnel without permission or beyond jurisdiction.

g) Engaging in security service business operations without signing a contract with individuals or organizations hiring security services.

h) Hiring security services but requiring security service personnel to use force or commit acts violating the law, infringing upon the legitimate rights and interests of individuals or organizations.

i) Hiring security services with the purpose of threatening, obstructing, or causing difficulties for the normal, lawful activities of individuals or organizations.

5. Additional forms of punishment:

a) Suspension of the right to use certificates confirming compliance with security and public order conditions for security service business operations for a period of one to three months for the acts stipulated in Point c Clause 2 of this Article.

b) Suspension of the right to use certificates confirming compliance with security and public order conditions for security service business operations for a period of three to six months for the acts stipulated in Point a Clause 3; Points c, g Clause 4 of this Article.

c) Confiscation of contraband and means of administrative violation for the acts stipulated in Point b Clause 4 of this Article.

6. Foreign individuals committing administrative violations stipulated in Clause 3 and Clause 4 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 14. Violations of criminal procedure regulations, enforcement of criminal penalties, and enforcement of administrative handling measures

1. Warning or a fine from VND 100,000 to VND 300,000 for failing to fulfill the obligations of persons subject to community-based educational measures as prescribed.

2. A fine from VND 500,000 to VND 1,000,000 for violations related to compliance with community-based educational measures; placement in a rehabilitation school; compulsory education facility; compulsory drug rehabilitation facility.

3. A fine of VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Violations of regulations on enforcement of preventive measures: arrest, temporary detention, pre-trial detention, bail, prohibition from leaving residence, depositing money or valuable assets as security, or other violations of preventive measures as prescribed by law;

b) Violations of the obligations of participants in criminal proceedings: failure to provide documents and evidence upon lawful request of the competent authority and the person conducting the proceedings, failure to fulfill the obligations of witnesses, interpreters, defense counsel, and parties with rights and interests in the case; violations of regulations on the preservation of evidence, sealing, and seizure of property, or other violations as prescribed by law;

c) Violations of regulations on enforcement of temporary detention and pre-trial detention; violations of regulations on enforcement of fines and confiscation of property as punishment.

4. A fine from VND 2,000,000 to VND 3,000,000 for any of the following acts:

a) Persons granted suspension or temporary cessation of execution of custodial sentences leave their place of residence without the consent of the People's Committee of the commune or are not present at the enforcement agency or the local criminal enforcement agency after the suspension or temporary cessation period has expired;

b) Persons sentenced to imprisonment who are under conditional release but fail to appear at the enforcement agency within the prescribed time;

c) Persons sentenced to suspended imprisonment or non-custodial corrective education who fail to fulfill their obligations as prescribed; are not present as required by the criminal enforcement agency or the People's Committee of the commune assigned to supervise and educate them without a valid reason or leave their place of residence without the consent of the People's Committee of the commune;

d) Persons sentenced to house arrest who fail to fulfill their obligations as prescribed; are not present as required by the criminal enforcement agency or the People's Committee of the commune where they are under house arrest without a valid reason; leave the place of house arrest without the permission of the authorized person or exceed the permitted time to leave the place of house arrest without a valid reason;

đ) Persons sentenced to residence prohibition who reside in prohibited areas or are not present as required by the People's Committee of the commune where they reside;

e) Persons deprived of certain civil rights who fail to fulfill their obligations as prescribed;

g) Persons prohibited from holding positions, practicing professions, or performing specific jobs who fail to fulfill their obligations as prescribed.

Article 15. Violations of causing damage to another person's property

1. A fine from VND 1,000,000 to VND 2,000,000 for any of the following acts:

a) Theft of property;

b) Openly appropriating others' property;

c) Using deceitful means or fleeing to appropriate others' property;

d) Unauthorized use of another person's property.

2. A fine of from VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Destroying or intentionally damaging others' property;

b) Causing loss, damage, or destruction of state property directly managed;

c) Using deceitful means or creating circumstances to compel another person to hand over money or property;

d) Fraud or deception in brokerage, guidance, or introduction services for buying, selling real estate, or other properties;

đ) Buying, selling, storing, or using another person's property knowing that it was obtained through illegal means;

e) Illegally detaining another person's property.

3. Additional forms of punishment:

Confiscation of contraband and means of violating administrative regulations for the acts specified in Points a, b, c Clause 1; Points c, đ, e Clause 2 of this Article.

4. Foreigners committing administrative violations as prescribed in Clause 1 and Clause 2 of this Article may be subject to deportation from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 16. Violations concerning the protection of public works and security facilities

1. A fine of VND 500,000 to VND 1,000,000 shall be imposed on the act of arbitrarily moving traffic signs, directional signs, or organizational signs.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Arbitrarily moving or dismantling telephone poles, telegraph poles, streetlights, or fences of state agencies or other public works.

b) Dismantling, destroying, or performing any other acts that cause damage to traffic signs, directional signs, or organizational signs.

3. Additional forms of punishment:

Seizure of contraband and means of administrative violation for the acts stipulated in Clause 1 and Clause 2 of this Article.

4. Measures to remedy consequences:

Restoration to the original condition shall be ordered for the acts stipulated in Clause 1 and Clause 2 of this Article.

5. Foreign nationals committing administrative violations as stipulated in Clause 2 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 17. Violations concerning exit, entry, transit, residence, and movement

1. A warning or a fine of VND 100,000 to VND 300,000 shall be imposed on foreign nationals traveling within Vietnam without carrying their passport or other travel documents.

2. A fine of VND 500,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Failing to immediately report to the competent authority regarding the loss or damage of passports or other travel documents, Vietnamese visas, temporary residence cards, permanent residence cards.

b) Erasing, altering, or distorting the form or content recorded in passports or other travel documents, visas, temporary residence cards, and permanent residence cards.

c) Providing false information to obtain passports, other travel documents, Vietnamese visas, temporary residence cards, permanent residence cards, or documents for entry and exit to and from Vietnam.

d) Foreign nationals entering restricted areas or areas requiring permits without such permits, or exceeding the permitted scope and duration.

đ) Failing to present passports or other travel documents when requested by Vietnamese authorities, or failing to comply with other inspection requirements set forth by Vietnamese authorities.

e) Foreign nationals failing to declare temporary residence as required, or using temporary residence certificates, temporary residence cards, or permanent residence cards beyond the permitted period of up to 15 days without authorization from the competent authority.

g) Accommodating foreign nationals overnight without declaring temporary residence, failing to guide them to declare temporary residence as required, or failing to comply with other regulations set forth by the competent authority.

3. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Crossing national borders without following prescribed exit and entry procedures.

b) Evading or organizing, assisting others to evade entry or exit means to enter Vietnam or leave the country;

c) Allowing others to use passports or other travel documents to commit acts contrary to the law.

d) Using another person's passport or other travel documents to enter, exit, or transit.

đ) Foreign nationals failing to declare temporary residence as required, or using temporary residence certificates, temporary residence cards, or permanent residence cards beyond the permitted period of more than 16 days without authorization from the competent authority.

e) Foreign nationals who have been issued permanent residence cards but change their address without declaring it to obtain a new card.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) The owner or driver of vehicles transporting passengers entering or exiting Vietnam illegally;

b) Using counterfeit passports, other counterfeit travel documents, counterfeit visas, counterfeit temporary residence cards, counterfeit permanent residence cards, or counterfeit inspection stamps to exit, enter, transit, or reside.

5. A fine of VND 15,000,000 to VND 25,000,000 shall be imposed for any of the following acts:

a) Assisting, harboring, concealing, or facilitating others to leave the country illegally, stay abroad illegally, enter Vietnam illegally, stay in Vietnam illegally, or cross national borders illegally.

b) Foreign nationals entering Vietnam to work or engage in other activities without permission from Vietnamese authorities.

c) Individuals or organizations in Vietnam sponsoring or processing applications for foreign nationals to enter Vietnam, apply for visas, obtain temporary residence cards, extend temporary residence, or obtain documents for entry and residence in Vietnam, but failing to fulfill their responsibilities as prescribed by law, or providing false information when sponsoring, inviting, or processing applications for foreign nationals to enter Vietnam, apply for visas, obtain temporary residence cards, extend temporary residence, or obtain documents for entry and residence in Vietnam.

d) Foreign nationals entering Vietnam to engage in activities not in accordance with the purpose or program proposed for obtaining temporary residence cards or permanent residence cards.

6. A fine of VND 30,000,000 to VND 40,000,000 shall be imposed for any of the following acts:

a) Falsifying documents to obtain a passport or other documents substituting for a passport, visa, temporary residence card, or permanent residence card;

b) Counterfeiting passports or other documents substituting for passports, visas, temporary residence cards, or permanent residence cards, or inspection stamps;

c) Entering the premises of embassies, consulates, or international organizations' offices in Vietnam without authorization.

d) Foreign nationals residing in Vietnam without permission from the competent authority.

đ) Organizing, leading, or brokering for others to exit or enter Vietnam illegally;

7. Additional forms of administrative sanction:

Seizure of contraband and means of administrative violation for the acts stipulated in Point b Clause 2; Point c, d Clause 3; Point a Clause 4; Point a, b Clause 6 of this Article.

8. Measures to remedy consequences:

a) Ordering the confiscation of passports, other travel documents, visas, temporary residence cards, permanent residence cards, or inspection stamps for the acts stipulated in Point b Clause 2; Point d, đ Clause 3; Point b Clause 4; Point a, b Clause 6 of this Article.

b) Ordering the cancellation of false information for the acts stipulated in Point c Clause 2; Point c Clause 5 of this Article.

9. Foreign nationals committing administrative violations as stipulated in Clause 1, 2, 3, 4, 5, and Clause 6 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 18. Violation of provisions on protecting state secrets

1. A fine of from VND 1,000,000 to VND 3,000,000 shall be imposed for any of the following acts:

a) Printing, photocopying classified, top secret, and absolutely secret documents not in accordance with regulations;

b) Disseminating, researching information within the scope of state secrets not in accordance with regulations;

c) Not complying with regulations on transporting, delivering classified documents and objects;

d) Destroying classified documents and objects not in accordance with regulations;

đ) Entering restricted areas, locations, places for storing and keeping, or places where activities involving state secrets are conducted without permission;

e) Filming, photographing, drawing diagrams in restricted areas.

2. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Providing information within the scope of state secrets to agencies, organizations, and citizens inside and outside the country not in accordance with regulations;

b) Taking classified documents and objects out of the country without permission from the competent agency and authorized person;

c) Filming, photographing, drawing diagrams in restricted areas related to national defense and security.

3. Additional forms of punishment:

Seizure of contraband and means of administrative violation for the act prescribed in Point c Clause 2 Article 18 herein.

4. Measures to remedy consequences:

a) Order the recovery of state secret documents and information for the acts prescribed in Points a, b, e Clause 1; Clause 2 Article 18 herein;

b) Order restoration to the original condition for the act prescribed in Point d Clause 1 Article 18 herein.

Article 19. Violation of laws on management and use of uniforms, insignia, badges, and numbers reserved for the People's Public Security force

1. A fine of from VND 500,000 to VND 1,500,000 shall be imposed for the act of illegally storing or using uniforms, insignia, badges, and numbers.

2. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed for the act of illegally buying, selling, or exchanging uniforms, insignia, badges, and numbers.

3. A fine of from VND 10,000,000 to VND 30,000,000 shall be imposed for the act of illegally producing or forging uniforms, insignia, badges, and numbers.

4. Additional forms of administrative punishment:

Seizure of contraband and means of administrative violation for the acts prescribed in Clause 1, 2, and Clause 3 Article 19 herein.

5. Foreign individuals committing administrative violations prescribed in Clause 1, 2, and Clause 3 Article 19 herein may be subject to expulsion from the Socialist Republic of Vietnam depending on the degree of violation.

Article 20. Acts obstructing, resisting inspection, examination, supervision by public officials or offering bribes to public officials

1. A fine of from VND 500,000 to VND 1,000,000 shall be imposed for the act of brokering, assisting, or guiding individuals or organizations to evade inspection, examination, and supervision by public officials.

2. A fine of from VND 2,000,000 to VND 3,000,000 shall be imposed for any of the following acts:

a) Obstructing or failing to comply with requests for inspection, examination, and supervision by public officials;

b) Using words or actions to threaten, insult, or defame the honor and dignity of public officials;

c) Inciting, enticing, or instigating others not to comply with requests for inspection, examination, and supervision by public officials.

3. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Using violence or threatening to use violence against public officials;

b) Causing damage to property or means of state agencies or public officials;

c) Offering money, property, or other material benefits to public officials to avoid administrative violation handling.

4. Additional forms of administrative punishment:

Seizure of the amount of money, property, or other material benefits for the act prescribed in Point c Clause 3 Article 20 herein.

PART 2

ADMINISTRATIVE VIOLATIONS REGARDING SOCIAL EVILS PREVENTION AND CONTROL

Article 21. Violations of regulations on prevention, control, and supervision of narcotics

1\. A warning or a fine from 500,000 VND to 1,000,000 VND shall be imposed for the act of illegally using narcotic substances.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a\. Illegally storing, transporting, or appropriating narcotic substances;

b\. Illegally storing, transporting, buying, selling, or appropriating precursor chemicals used for the illegal production of narcotic substances;

c\. Producing, purchasing, or selling equipment for the use of narcotic substances contrary to the provisions of the law.

3\. A fine from 2,000,000 VND to 5,000,000 VND shall be imposed for the act of growing opium plants, cannabis plants, and other plants containing narcotic substances.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a\. The owner or person responsible for managing restaurants, rental establishments, clubs, transportation means, and other places allowing others to illegally use narcotic substances within their managed areas;

b\. Mediating, assisting, facilitating, or otherwise helping others to illegally use narcotic substances;

c\. Transferring narcotic substances, psychotropic substances, or other narcotic substances to persons not authorized to possess or use them.

5\. A fine from 20,000,000 VND to 40,000,000 VND shall be imposed for any of the following acts:

a\. Providing illegally premises or means for others to use narcotic substances illegally;

b\. Violating regulations on the export, import, temporary import, re-export, transit of substances containing narcotic substances, addictive drugs, psychotropic drugs, and precursor chemicals for narcotic substances;

c\. Violating regulations on research, appraisal, production, and storage of narcotic substances and precursor chemicals for narcotic substances;

d\. Violating regulations on delivery, storage, and transportation of narcotic substances and precursor chemicals;

đ\. Violating regulations on distribution, purchase, sale, exchange of narcotic substances and precursor chemicals;

e\. Violating regulations on management, control, and retention of narcotic substances and precursor chemicals at border areas, ports, and on the sea.

6. Additional forms of punishment:

Seizure of contraband items and means of administrative violation for the acts stipulated in Clause 1, 2, 3, 4, and Clause 5 of this Article.

7\. Foreign individuals committing administrative violations stipulated in Clause 1, 2, 3, 4, and Clause 5 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 22. Acts of purchasing prostitution services

1\. A fine from 500,000 VND to 1,000,000 VND shall be imposed for the act of purchasing prostitution services.

2. A fine from VND 2,000,000 to VND 5,000,000 shall be imposed in cases where multiple individuals purchase sexual services simultaneously.

3\. A fine from 5,000,000 VND to 10,000,000 VND shall be imposed for the act of enticing or compelling others to purchase prostitution services together.

Article 23. Acts of selling prostitution services

1\. A warning or a fine from 100,000 VND to 300,000 VND shall be imposed for the act of selling prostitution services.

2. A fine from VND 300,000 to VND 500,000 shall be imposed in cases where selling sexual services is provided to multiple individuals simultaneously.

3\. Foreign individuals committing administrative violations stipulated in Clause 1 and Clause 2 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 24. Other acts related to purchasing and selling prostitution services

1\. A fine from 1,000,000 VND to 2,000,000 VND shall be imposed for the act of providing premises for purchasing and selling prostitution services.

2. A fine of from VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a\. Leading or enticing activities of purchasing and selling prostitution services;

b) Concealing or protecting acts of purchasing or selling sex.

3\. A fine from 5,000,000 VND to 10,000,000 VND shall be imposed for any of the following acts:

a\. Enticing, compelling, or forcing others to sell prostitution services;

b) Using coercive means to extort money or property from purchasers or sellers of sex.

4\. A fine from 15,000,000 VND to 20,000,000 VND shall be imposed for any of the following acts:

a\. Taking advantage of prestige to protect and maintain activities of purchasing and selling prostitution services;

b\. Threatening to use violence to protect and maintain activities of purchasing and selling prostitution services;

c\. Mediating purchasing and selling prostitution services but not regularly;

d\. Contributing capital for the purpose of operating purchasing and selling prostitution services.

5\. A fine from 20,000,000 VND to 30,000,000 VND shall be imposed for any of the following acts:

a\. Taking advantage of position or authority to protect and maintain activities of purchasing and selling prostitution services;

b\. Using violence to protect and maintain activities of purchasing and selling prostitution services.

6. Additional forms of punishment:

a\. Confiscation of the proceeds from administrative violations for the acts stipulated in Clause 1, 2, and Clause 3 of this Article;

b\. Confiscation of the contributed capital for the purpose of operating purchasing and selling prostitution services for the act stipulated in Point d Clause 4 of this Article.

Article 25. Acts of Exploiting Business and Services for Prostitution Activities

1. A fine of from VND 15,000,000 to VND 20,000,000 shall be imposed on the head of a business service establishment due to lack of responsibility leading to prostitution activities occurring at the establishment under their management.

2. A fine of from VND 20,000,000 to VND 30,000,000 shall be imposed on acts using prostitution and other sexual activities as a means of doing business.

3. Additional forms of punishment:

The right to use the business license shall be revoked for a period of from six months to twelve months for the acts stipulated in Clause 1 and Clause 2 of this Article.

Article 26. Acts of Illegally Gambling

1. A warning or a fine of from VND 200,000 to VND 500,000 shall be imposed on acts purchasing lottery numbers or bets.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed on one of the following gambling acts:

a) Illegally gambling through one of the forms such as dice rolling, tile matching, dominoes, poker, three-card, four-color, red-black, chess, or other forms where winnings and losses are determined by money or goods;

b) Gambling using illegal machines or electronic games;

c) Betting with money or in other forms during sports competitions, entertainment activities, or other activities;

d) Selling lottery boards or other publications for betting.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Depositing money, pawnbroking, or lending at casinos or other gambling venues;

b) Concealing illegal gambling activities.

4. A fine of from VND 5,000,000 to VND 10,000,000 shall be imposed on one of the following acts of organizing gambling:

a) Luring, enticing, or gathering others to illegally gamble;

b) Using one's own house or residence or other means and locations to store gambling equipment;

c) Installing illegal gambling machines or electronic games;

d) Organizing illegal money-based betting activities.

5. A fine of from VND 10,000,000 to VND 20,000,000 shall be imposed on one of the following acts of organizing lottery betting:

a) Managing lottery operations;

b) Organizing the production and distribution of lottery boards or other publications for lottery operations;

c) Organizing networks for selling lottery numbers;

d) Organizing betting during sports events, entertainment activities, or other activities for gambling purposes.

6. Additional forms of punishment:

Seize the contraband items, means of administrative violation, and seize the proceeds from the administrative violation for the acts stipulated in Clause 1; Clause 2; Point a Clause 3; Points b, c, d Clause 4 and Clause 5 of this Article.

7\. Foreign individuals committing administrative violations stipulated in Clause 1, 2, 3, 4, and Clause 5 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

SECTION 3

ADMINISTRATIVE VIOLATIONS RELATED TO FIRE PREVENTION AND FIGHTING

Article 27. Violations of Regulations on Issuing, Publicizing, and Implementing Fire Prevention and Fighting Rules and Regulations

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Not fully complying with fire prevention and fighting rules and regulations issued by competent state agencies;

b) Causing fire prevention and fighting rules and regulations, signals, signs, prohibitions, and guidance signs to lose effectiveness or become faded, unclear, or illegible;

c) Equipping fire prevention and fighting rules and regulations, signals, signs, prohibitions, and guidance signs not in accordance with standards.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Not arranging or posting fire prevention and fighting signals, signs, prohibitions, and guidance signs;

b) Not complying with fire prevention and fighting rules and regulations issued by competent state agencies;

c) Not publicizing fire prevention and fighting rules and regulations to people within the scope of their management;

d) Issuing fire prevention and fighting rules and regulations that are incomplete or not suitable for the fire and explosion hazards of the premises.

3. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed on the act of not arranging or posting fire prevention and fighting rules and regulations.

4. A fine of from VND 2,000,000 to VND 5,000,000 shall be imposed on the act of having no or having fire prevention and fighting rules and regulations that contradict national regulatory documents.

5. Measures to remedy consequences:

Order restoration to the original condition for the act stipulated in Point b Clause 1 of this Article.

Article 28. Violation of fire safety inspection regulations

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for the act of not presenting documents and materials for fire safety inspection.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Implementing fire safety requirements incompletely or not within the prescribed time limit as required in writing by the competent authority;

b) Not assigning responsible persons to participate in fire safety inspection teams;

c) Not organizing fire safety inspections as prescribed.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Not implementing guidance and directives on fire safety issued in writing by the competent authority;

b) Not complying with fire safety requirements as required in writing by the competent authority.

4. A fine from VND 10,000,000 to VND 15,000,000 shall be imposed for the act of the head of the facility not having a written notification and commitment that the facility meets all requirements and maintains conditions for fire safety during the use of buildings and construction works and production and business activities, after the facility has been reviewed and accepted for fire safety but before it is put into operation.

5. Foreign individuals committing administrative violations as stipulated in Clause 2, Clause 3, and Clause 4 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 29. Violations concerning fire safety management records

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Not reporting on fire safety work;

b) Insufficient documentation in fire safety management records;

c) Not updating information related to changes in fire safety work in fire safety management records.

2. A fine from VND 2,000,000 to VND 5,000,000 shall be imposed for the act of not establishing fire safety management and monitoring records.

3\. Foreign individuals committing administrative violations stipulated in Clause 1 and Clause 2 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 30. Violations concerning fire safety in the management, storage, and use of dangerous goods and items prone to fire and explosion

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for the act of not maintaining books and records tracking and managing dangerous goods and items prone to fire and explosion.

2. A fine from VND 1,000,000 to VND 3,000,000 shall be imposed for the act of storing, arranging, and positioning dangerous goods and items prone to fire and explosion beyond the permitted quantities or improperly without following the prescribed grouping.

3. A fine from VND 3,000,000 to VND 5,000,000 shall be imposed for the act of using containers and equipment for dangerous goods and items prone to fire and explosion without certification or failing to meet fire safety conditions.

4. A fine from VND 15,000,000 to VND 25,000,000 shall be imposed for the act of illegally storing dangerous goods and items prone to fire and explosion.

5. A fine from VND 40,000,000 to VND 50,000,000 shall be imposed for the act of illegally using dangerous goods and items prone to fire and explosion.

6. Additional forms of punishment:

Seizure of dangerous goods and items prone to fire and explosion for acts stipulated in Clause 4 and Clause 5 of this Article.

7. Measures to remedy consequences:

a) Order to store, arrange, reduce quantities, and volumes of dangerous goods and items prone to fire and explosion according to regulations for the act stipulated in Clause 2 of this Article;

b) Order to move dangerous goods and items prone to fire and explosion to warehouses or designated locations according to regulations for the act stipulated in Clause 3 of this Article.

8. Foreign individuals committing administrative violations as stipulated in Clause 2, Clause 3, Clause 4, and Clause 5 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 31. Violations concerning fire prevention and firefighting regulations in the production and business of flammable and explosive substances and items

1. A fine from 200,000 VND to 500,000 VND shall be imposed for any of the following acts:

a) Not having measures and equipment to prevent static electricity accumulation as prescribed;

b) Not having natural ventilation measures or not having forced ventilation equipment as prescribed.

2. A fine of from VND 8,000,000 to VND 15,000,000 shall be imposed for one of the following acts:

a) Not installing devices to detect and handle leaks of flammable and explosive substances and items into the surrounding environment;

b) Not having emergency response plans or equipment to handle ruptures, cracks, or breaks of storage tanks, containers, pipelines carrying crude oil, petroleum products, and other flammable liquids.

3. A fine of from VND 15,000,000 to VND 25,000,000 shall be imposed for one of the following acts:

a) Producing, trading, transferring, filling, or refilling flammable and explosive substances and items without a permit;

b) Transferring, filling, or refilling flammable and explosive substances and items at unauthorized locations or transferring them to containers of incorrect types that are unsuitable for such substances and items.

4. A fine of from VND 30,000,000 to VND 40,000,000 shall be imposed for producing or trading flammable and explosive substances and items prohibited from trade.

5. Additional forms of punishment:

Seizure of flammable and explosive substances and items for the acts stipulated in Clause 3 and Clause 4 of this Article.

6. Measures to remedy consequences:

Compel the implementation of remedial measures to address environmental pollution according to the provisions for the acts stipulated in Points a and b of Clause 2 of this Article.

7. Foreign individuals committing administrative violations stipulated in Clause 1, Clause 2, Clause 3, and Clause 4 of this Article may be subject to deportation from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 32. Violations concerning the transportation of flammable and explosive substances and items

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Damaging the transportation permit for flammable and explosive substances and items;

b) Not carrying the transportation permit when transporting flammable and explosive substances and items;

c) Not removing or detaching the hazardous substance and item labels from the transport vehicle when the flammable and explosive substances and items have been moved off the transport vehicle;

d) Losing the transportation permit for flammable and explosive substances and items but promptly reporting it to the competent authority.

2. A fine of from VND 1,000,000 to VND 2,000,000 shall be imposed for improperly arranging flammable and explosive substances and items on the transport vehicle as prescribed.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Not maintaining adequate fire prevention and firefighting safety conditions when using motorized vehicles to transport flammable and explosive substances and items during transportation;

b) Transporting other goods together with flammable and explosive substances and items on the same transport vehicle without permission from the competent authority;

c) Carrying non-essential personnel on the transport vehicle for flammable and explosive substances and items.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Transporting flammable and explosive substances and items exceeding the quantity, volume, or type specified in the permit;

b) Not affixing the transportation label for flammable and explosive substances and items on the transport vehicle;

c) Not complying with fire prevention and firefighting safety conditions or not following the instructions of authorized personnel when loading, unloading, pumping, or transferring flammable and explosive substances and items from the transport vehicle as prescribed;

d) Loading, unloading, pumping, or transferring flammable and explosive substances and items at locations that do not meet fire prevention and firefighting safety conditions;

đ) Loading, unloading, pumping, or transferring flammable and explosive substances and items currently in transit to another vehicle without authorization from the competent authority;

e) Losing the transportation permit for flammable and explosive substances and items but not reporting it to the competent authority.

5. A fine of from VND 10,000,000 to VND 15,000,000 shall be imposed for one of the following acts:

a) Transporting flammable and explosive substances and items without a transportation permit;

b) Fabricating or using a fake transportation permit for flammable and explosive substances and items;

c) Repairing or erasing a transportation permit for flammable and explosive substances and items.

6. Additional forms of punishment:

Seizure of flammable and explosive substances and items for the acts stipulated in Point b of Clause 1; Point a and b of Clause 5 of this Article.

7. Measures to remedy consequences:

a) Compel the rearrangement of flammable and explosive substances and items according to the provisions for the act stipulated in Point a of Clause 2 of this Article;

b) Compel the reduction of the quantity, volume, or type of flammable and explosive substances and items according to the provisions for the act stipulated in Point a of Clause 4 of this Article;

c) Compel the relocation of flammable and explosive substances and items to warehouses or designated locations according to the provisions for the act stipulated in Point a and b of Clause 5 of this Article;

d) Compel the recovery of the transportation permit for flammable and explosive substances and items for the act stipulated in Point c of Clause 5 of this Article.

8. Foreign individuals committing administrative violations as stipulated in Clause 2, Clause 3, Clause 4, and Clause 5 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 33. Violations concerning fire prevention and fighting regulations in the use of fire sources, heat sources, equipment, and devices that generate fire or heat

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for using matches, lighters, or mobile phones in places where such use is prohibited.

2. A warning or a fine from VND 300,000 to VND 500,000 shall be imposed for using fire sources, heat sources, equipment, or devices that generate fire or heat without ensuring the required safety distance for fire prevention and fighting as prescribed.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Using fire sources, electronic devices, or other equipment and devices that generate fire or heat in places where such use is prohibited;

b) Welding or cutting metal without measures to ensure safety for fire prevention and fighting as prescribed.

4. Foreign individuals committing administrative violations as stipulated in Clause 1, Clause 2, and Clause 3 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 34. Violations concerning fire prevention and fighting regulations in design, installation, management, and use of electricity

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for failing to have regulations on fire prevention and fighting in the use of electricity at facilities.

2. A fine from VND 300,000 to VND 500,000 shall be imposed for using electrical equipment not in accordance with the manufacturer's instructions.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Failing to maintain the continuous operation of emergency lighting systems;

b) Modifying the design or changing the main structure and parameters of the electrical system or electrical equipment without approval from the competent authority;

c) Installing or using electrical wiring, cables, circuit breakers, protective devices, or electrical consumption devices that do not meet fire prevention and fighting safety requirements;

d) Using overloaded electrical equipment compared to its design specifications;

đ) Using electrical equipment in places where such use is prohibited.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Using electrical equipment that does not meet fire prevention and explosion protection requirements in hazardous environments;

b) Failing to have a backup power supply as prescribed.

5. A fine from VND 15,000,000 to VND 25,000,000 shall be imposed for failing to design and install electrical systems serving fire prevention, firefighting, and rescue operations as prescribed.

Article 35. Violations concerning fire prevention and fighting safety regulations in the design, construction, inspection, and maintenance of lightning protection systems

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for failing to maintain records of the lightning protection system as prescribed.

2. A fine from VND 300,000 to VND 500,000 shall be imposed for failing to inspect the lightning protection system regularly as prescribed.

3. A fine from VND 5,000,000 to VND 10,000,000 shall be imposed for failing to repair defects or damage that render the lightning protection system ineffective.

4. A fine from VND 10,000,000 to VND 25,000,000 shall be imposed for failing to install a lightning protection system for buildings or structures that must have such a system according to the regulations.

Article 36. Violations concerning fire prevention and fighting regulations in investment and construction

1. A fine from VND 300,000 to VND 500,000 shall be imposed for failing to implement measures and means to ensure fire prevention and fighting safety during construction and building works.

2. A fine from VND 500,000 to VND 1,000,000 shall be imposed for failing to design a fire prevention and fighting system for projects that must have such a design.

3. A fine from VND 3,000,000 to VND 5,000,000 shall be imposed for putting buildings or projects into use without meeting one of the conditions for fire prevention and fighting safety for projects that do not require fire prevention and fighting review.

4. A fine from VND 8,000,000 to VND 15,000,000 shall be imposed for any of the following acts:

a) Constructing or installing not in accordance with the approved fire prevention and fighting design;

b) Failing to submit documents for re-review when renovating, expanding, or changing the use of buildings or projects during construction or use as prescribed.

5. A fine of VND 15,000,000 to VND 25,000,000 shall be imposed for any of the following acts:

a) Organizing construction or building of projects that require fire prevention and fighting review without a certificate of fire prevention and fighting review;

b) Manufacturing or modifying motor vehicles with special requirements for fire prevention and fighting safety without approval from the competent authority.

6. A fine from VND 30,000,000 to VND 50,000,000 shall be imposed for putting buildings or projects into operation or use without organizing a fire prevention and fighting acceptance inspection.

7. Measures to remedy consequences:

a) Order to rectify conditions to ensure fire prevention and fighting safety for violations stipulated in Clause 1 and Clause 3 of this Article;

b) Order to organize for state management agencies to conduct a fire prevention and fighting acceptance inspection for violations stipulated in Clause 6 of this Article.

Article 37. Violation of fire safety distance regulations for fire prevention and extinguishing

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Arranging and organizing materials and goods without ensuring the required fire safety distances as prescribed;

b) Not organizing industrial cleaning leading to the possibility of creating an environment with fire and explosion hazards.

2. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed on the act of constructing fire-resistant walls, fire-resistant partitions, or fire-resistant doors and other fire prevention measures that do not meet the requirements as prescribed.

3\. A fine from 5,000,000 VND to 10,000,000 VND shall be imposed for any of the following acts:

a) Making ceilings, floors, partitions, roofs, or stacking flammable materials in places where it is not allowed;

b) Building houses or other structures within forests or near forests without ensuring fire spread prevention as prescribed.

4. A fine of VND 15,000,000 to VND 25,000,000 shall be imposed on one of the following acts:

a) Not clearing flammable substances from the safe passage of oil pipelines, gas pipelines, and petroleum product pipelines;

b) Constructing buildings that violate fire separation distances.

5. A fine of VND 30,000,000 to VND 50,000,000 shall be imposed on one of the following acts:

a) Not constructing fire-resistant walls, fire-resistant partitions, fire-resistant doors, and other fire prevention measures as prescribed;

b) Causing fire-resistant walls, fire-resistant partitions, fire-resistant doors, and other fire prevention measures to lose their fire-prevention function.

6. Measures to remedy consequences:

a) Order to restore the original condition for the act prescribed in Point a Clause 1 and Point b Clause 5 of this Article;

b) Order to dismantle illegally constructed buildings for the act prescribed in Point b Clause 3 and Point b Clause 4 of this Article.

Article 38. Violation of fire evacuation regulations

1. A warning or a fine of VND 100,000 to VND 300,000 shall be imposed on the act of designing evacuation doors that do not open in the direction of evacuation or not installing mirrors in evacuation staircases.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Arranging and organizing materials, goods, transportation means, and other objects obstructing evacuation routes;

b) Removing, dismantling, or damaging emergency lighting devices, signs, and directional indicators on evacuation routes;

c) Not installing evacuation signs and directional indicators on evacuation routes.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Not having sufficient rescue equipment and tools as required.

b) Not having ventilation and smoke exhaust equipment as required for escape routes.

c) Not having emergency lighting devices on evacuation routes or having insufficient brightness as prescribed or not functioning properly;

d) Designing and constructing evacuation doors, evacuation routes, and evacuation staircases that do not meet the required quantity, area, width, or do not comply with the prescribed standards.

4. A fine of VND 5,000,000 to VND 15,000,000 shall be imposed on the act of locking, blocking, or obstructing evacuation doors.

5. A fine of VND 15,000,000 to VND 25,000,000 shall be imposed on the act of causing evacuation routes to lose their function.

Article 39. Violation of fire extinguishing plans at facilities

1. A warning or a fine of VND 100,000 to VND 300,000 shall be imposed on the act of not managing fire extinguishing plans as prescribed.

2. A fine from 500,000 VND to 1,000,000 VND shall be imposed for any of the following acts:

a) Developing fire extinguishing plans that do not meet the requirements;

b) Not disseminating fire extinguishing plans.

3. A fine of VND 1,500,000 to VND 3,000,000 shall be imposed on one of the following acts:

a) Not submitting fire extinguishing plans for approval;

b) Not participating in fire extinguishing plan drills;

c) Not supplementing or revising fire extinguishing plans;

d) Not fully practicing all fire extinguishing scenarios in approved fire extinguishing plans.

4. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Not developing fire extinguishing plans;

b) Not organizing fire extinguishing plan drills.

Article 40. Violation of regulations on fire alarm information

1. A warning or a fine of VND 100,000 to 300,000 shall be imposed for the act of not replacing fire alarm communication equipment or devices that are damaged or ineffective.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Not having the prescribed fire alarm signals or equipment.

b) Reporting the fire late or not promptly; reporting the fire incompletely.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) False fire alarms.

b) Not reporting the fire or obstructing, hindering the transmission of fire alarm information.

c) The service provider does not promptly repair faults in the fire alarm information receiving equipment of the Fire Prevention and Fighting Police Department upon written request.

4. Measures to remedy consequences:

Restore the original condition for the acts stipulated in Clause 1 of this Article.

5. Foreign individuals committing administrative violations prescribed in Clause 1, 2, and Clause 3 Article 19 herein may be subject to expulsion from the Socialist Republic of Vietnam depending on the degree of violation.

Article 41. Violation of regulations on equipping, storing, and using firefighting equipment

1. A warning or a fine of VND 100,000 to 300,000 shall be imposed for the act of obstructing firefighting equipment.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Not regularly inspecting and maintaining the fire protection system and firefighting equipment.

b) Equipping firefighting equipment inadequately or not in accordance with regulations.

c) Not equipping common firefighting equipment for motorized vehicles as prescribed.

3. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Equipping, installing, and using firefighting equipment that has not been quality tested according to regulations.

b) Equipping firefighting equipment unsuitable for the fire and explosion hazards of the premises as prescribed.

c) Using firefighting equipment at the permanent firefighting position for other purposes.

d) Not storing sufficient firefighting water as prescribed.

đ) Moving or changing the installation location of firefighting equipment from the design approved by the competent authority.

e) Not equipping common firefighting equipment for specialized motorized vehicles transporting dangerous goods regarding fire and explosion as prescribed.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Not equipping common firefighting equipment for buildings and structures as prescribed.

b) Causing loss, damage, or rendering firefighting equipment ineffective.

5. A fine of VND 15,000,000 to 25,000,000 shall be imposed for the act of not equipping or installing the fire alarm and firefighting system as prescribed.

6. Measures to remedy consequences:

Restore the original condition for the act stipulated in Point b Clause 4 of this Article.

Article 42. Violation of firefighting work regulations

1. A warning or a fine of VND 100,000 to 300,000 shall be imposed for entering the firefighting area without permission from the authorized person.

2. A fine of VND 300,000 to 500,000 shall be imposed for failing to promptly carry out rescue operations or firefighting.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Not being fully prepared in terms of personnel, equipment, water sources, and other conditions required for firefighting as prescribed.

b) Not complying with orders from firefighting commanders;

c) Not complying with orders to participate in firefighting issued by the authorized person.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for any of the following acts:

a) Obstructing the activities of firefighting forces and equipment.

b) Not participating in mitigating the consequences of the fire when requested by the authorized person.

c) Not protecting the fire scene as prescribed.

d) Not arranging traffic routes, building access points, and other open spaces for firefighting vehicles and other mechanical firefighting equipment as prescribed.

5. A fine of from VND 10,000,000 to VND 15,000,000 shall be imposed for one of the following acts:

a) Not organizing evacuation, rescue operations, or firefighting.

b) Exploiting firefighting activities to harm the health and lawful property of citizens and state property.

6. Foreign individuals committing administrative violations stipulated in Clause 1, 2, 3, 4, and Clause 5 of this Article may, depending on the severity of the violation, be subject to expulsion from the Socialist Republic of Vietnam.

Article 43. Violation of regulations on propaganda, dissemination of laws, knowledge, study, training, and firefighting education

1. A warning or a fine from VND 100,000 to VND 300,000 shall be imposed for damaging banners, slogans, posters, placards, or propaganda and promotional pictures related to firefighting and rescue.

2. A fine of from VND 300,000 to VND 500,000 shall be imposed on one of the following acts:

a) Not organizing the dissemination of laws and knowledge on firefighting and rescue as prescribed;

b) Using individuals as grassroots firefighting forces, drivers of motor vehicles with four seats or more, or drivers of motor vehicles transporting hazardous materials without undergoing firefighting training or obtaining certificates of completion of such training.

3. A fine from VND 1,500,000 to VND 3,000,000 shall be imposed for not organizing firefighting business training and education as prescribed.

4. Measures to remedy consequences:

Restore the original condition for the acts stipulated in Clause 1 of this Article.

5. Foreign individuals committing administrative violations stipulated in Clause 2 and Clause 3 of this Article may be subject to expulsion from the Socialist Republic of Vietnam depending on the severity of the violation.

Article 44. Violation of regulations on establishment, organization, and management of grassroots firefighting forces and specialized firefighting forces

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Failing to ensure the number of personnel and shifts required for fire safety and firefighting;

b) Grassroots firefighting forces not proficiently using firefighting equipment provided at the premises.

2. A fine from VND 300,000 to VND 500,000 shall be imposed for not organizing duty shifts at the premises as prescribed.

3. A fine from VND 1,500,000 to VND 5,000,000 shall be imposed for any of the following acts:

a) Establishing grassroots or specialized firefighting teams that do not meet requirements as prescribed;

b) Failing to manage or maintain the operation of grassroots or specialized firefighting teams as prescribed.

4. A fine from VND 2,000,000 to VND 5,000,000 shall be imposed for failing to participate in firefighting activities when requested by authorized persons.

5. A fine from VND 5,000,000 to VND 10,000,000 shall be imposed for failing to establish grassroots or specialized firefighting teams as prescribed.

Article 45. Violation of regulations in production, business operations of firefighting equipment and design for firefighting

1. A fine from VND 1,000,000 to VND 3,000,000 shall be imposed for design units for firefighting and rescue that lack legal entity status and technical expertise as prescribed.

2. A fine from VND 5,000,000 to VND 8,000,000 shall be imposed for conducting business in firefighting equipment without meeting material infrastructure conditions, technical expertise, or having undergone prescribed firefighting business training or instruction.

3. A fine from VND 5,000,000 to VND 10,000,000 shall be imposed for modifying fire trucks, firefighting boats, or firefighting vessels without authorization from competent authorities.

4. A fine from VND 10,000,000 to VND 15,000,000 shall be imposed for construction or installation units of firefighting and rescue components lacking legal entity status and technical expertise as prescribed.

Article 46. Violation of Compulsory Fire and Explosion Insurance Regulations

1. A fine of VND 8,000,000 to VND 15,000,000 shall be imposed on the act of conducting compulsory fire and explosion insurance without measures to prevent and limit losses for the insured objects as prescribed.

2. A fine of VND 30,000,000 to VND 50,000,000 shall be imposed on one of the following acts:

a) An establishment that is required to purchase compulsory fire and explosion insurance but does not purchase it as prescribed;

b) Purchasing compulsory fire and explosion insurance not in accordance with the rules and premium rates for compulsory fire and explosion insurance issued by the Ministry of Finance;

c) An establishment that is required to purchase compulsory fire and explosion insurance does not separately contract the compulsory fire and explosion insurance portion in a comprehensive insurance contract as prescribed;

d) Not setting aside the compulsory fire and explosion insurance premium to contribute to the funding for fire prevention and firefighting activities as prescribed.

Article 47. Violation of Fire and Explosion Prevention and Control Regulations at Households

1. A fine of VND 300,000 to VND 500,000 shall be imposed on the unintentional violation of fire and explosion safety regulations resulting in a fire or explosion without causing damage or causing damage under VND 25,000,000.

2. A fine of VND 500,000 to VND 1,000,000 shall be imposed on the unintentional violation of fire and explosion safety regulations resulting in a fire or explosion causing damage from VND 25,000,000 to VND 50,000,000.

3. A fine of VND 2,000,000 to VND 5,000,000 shall be imposed on the unintentional violation of fire and explosion safety regulations resulting in a fire or explosion causing damage over VND 50,000,000.

Article 48. Violation Resulting in a Fire or Explosion Occurrence

1. A fine of VND 300,000 to VND 500,000 shall be imposed on the violation of fire and explosion safety regulations resulting in a fire or explosion causing damage under VND 2,000,000.

2. A fine of VND 500,000 to VND 3,000,000 shall be imposed on the unintentional violation of fire and explosion safety regulations resulting in a fire or explosion causing damage from VND 2,000,000 to less than VND 10,000,000.

3. A fine of VND 5,000,000 to VND 8,000,000 shall be imposed on the unintentional violation of fire and explosion safety regulations resulting in a fire or explosion causing damage from VND 10,000,000 to less than VND 25,000,000.

4. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed on the unintentional act resulting in a fire or explosion causing damage from VND 25,000,000 to VND 50,000,000.

5. A fine of VND 15,000,000 to VND 25,000,000 shall be imposed on the act of negligently causing a fire or explosion.

6. A fine of VND 30,000,000 to VND 50,000,000 shall be imposed on the unintentional act resulting in a fire or explosion causing damage over VND 50,000,000.

SECTION 4

ADMINISTRATIVE VIOLATIONS CONCERNING DOMESTIC VIOLENCE PREVENTION AND CONTROL

Article 49. Acts Injuring the Health of Family Members

1. A fine of VND 1,000,000 to VND 1,500,000 shall be imposed on the act of beating and causing injury to family members.

2. A fine of VND 1,500,000 to VND 2,000,000 shall be imposed on one of the following acts:

a) Using tools, means, or other objects to cause injury to family members;

b) Failing to promptly take the victim to the hospital for emergency treatment when the victim requires prompt medical care or failing to care for the victim during the period of treatment for injuries caused by domestic violence, except where the victim refuses.

3. Measures to remedy consequences:

Publicly apologize when requested by the victim for the acts stipulated in Clause 1 and Clause 2 of this Article.

Article 50. Acts of Torturing and Abusing Family Members

1. A fine of VND 1,500,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Treating family members poorly such as forcing them to go without food or drink, making them endure cold, wearing torn clothes, not allowing or restricting personal hygiene.

b) Neglecting to care for elderly, weak, disabled, pregnant women, or women with young children.

2. Measures to remedy consequences:

Publicly apologize when the victim requests it for the acts stipulated in Clause 1 of this Article.

Article 51. Acts of Insulting the Dignity and Personality of Family Members

1. A fine of VND 500,000 to VND 1,000,000 shall be imposed for the act of insulting, berating, or damaging the dignity and personality of family members.

2. A fine of VND 1,000,000 to VND 1,500,000 shall be imposed for any of the following acts:

a) Disclosing or disseminating private information about family members with the intent to insult their dignity and personality.

b) Using communication means to insult the dignity and personality of family members.

c) Distributing leaflets, articles, images, sounds aimed at insulting the dignity and personality of the victim.

3. Measures to remedy consequences:

a) Publicly apologize when the victim requests it for the acts stipulated in Clause 1 and Clause 2 of this Article;

b) Retrieve the disclosed or disseminated information, leaflets, articles, images, sounds for the acts stipulated in Point a and Point c of Clause 2 of this Article.

Article 52. Acts of Isolating, Expelling, or Causing Continuous Psychological Pressure

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Prohibiting family members from leaving the house, preventing family members from meeting relatives, friends, or engaging in lawful and healthy social relationships with the purpose of isolating or causing continuous psychological pressure on that member.

b) Not allowing family members to exercise their right to work.

c) Not allowing family members to participate in lawful and healthy social activities.

2. A fine of VND 300,000 to VND 500,000 shall be imposed for compelling family members to witness scenes of violence against people or animals.

3. A fine of VND 500,000 to VND 1,000,000 shall be imposed for any of the following acts:

a) Forcing family members to perform pornographic actions or using stimulants.

b) Engaging in sexual provocation or physical abuse towards family members who are not spouses.

4. Measures to remedy consequences:

Publicly apologize when the victim requests it for the acts stipulated in Clause 1, Clause 2, and Clause 3 of this Article.

Article 53. Acts of Obstructing the Exercise of Rights and Obligations in Family Relationships between Grandparents and Grandchildren; Parents and Children; Spouses; Siblings

Warning or a fine of VND 100,000 to VND 300,000 shall be imposed for obstructing the right to visit and care between grandparents and grandchildren; parents and children, except where parents' visitation rights are restricted by court decision; spouses; siblings.

Article 54. Violations of Care, Maintenance, and Alimony Provisions

Warning or a fine of VND 100,000 to VND 300,000 shall be imposed for any of the following acts:

1. Refusing or evading alimony obligations between spouses after divorce; refusing or evading maintenance obligations between siblings, between maternal or paternal grandparents and grandchildren as prescribed by law.

2. Refusing or evading alimony and maintenance obligations for parents; alimony and care obligations for children after divorce as prescribed by law.

Article 55. Acts of forcing marriage, divorce, child marriage, or obstructing voluntary progressive marriage

Warning or a fine of VND 100,000 to VND 300,000 shall be imposed for any of the following acts:

1. Forcing another person to marry, divorce, or enter into a child marriage through physical abuse, maltreatment, mental coercion, or other means.

2. Obstructing another person from marrying, divorcing, or entering into a voluntary progressive marriage through physical abuse, maltreatment, mental coercion, demanding property, or other means.

Article 56. Acts of economic violence

1. A fine of VND 300,000 to VND 500,000 for acts of not allowing family members to use common assets for legitimate purposes.

2. A fine from 500,000 VND to 1,000,000 VND shall be imposed for any of the following acts:

a) Seizing private property of family members;

b) Compelling family members to work excessively or perform heavy, dangerous, toxic substance-exposed, or other work prohibited by labor laws;

c) Compelling family members to beg or wander for survival.

Article 57. Acts contrary to the law that force family members out of their lawful place of residence

1. A warning or a fine of VND 100,000 to VND 300,000 for acts of forcing family members out of their lawful place of residence.

2. A fine of VND 300,000 to VND 500,000 for acts of frequently threatening with violence to force family members out of their lawful place of residence.

Article 58. Acts of violence against persons who prevent, discover, report domestic violence, or assist victims of domestic violence

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Threatening persons who prevent, discover, report domestic violence, or assist victims of domestic violence;

b) Defaming the dignity and reputation of persons who prevent, discover, report domestic violence, or assist victims of domestic violence.

2. A fine from 500,000 VND to 1,000,000 VND shall be imposed for any of the following acts:

a) Assaulting persons who prevent, discover, report domestic violence, or assist victims of domestic violence;

b) Damaging or destroying property of persons who prevent, discover, report domestic violence, or assist victims of domestic violence.

3. Measures to remedy consequences:

a) Ordering restoration to the original state for acts specified in Point b Clause 2 of this Article;

b) Ordering public apology when the victim requests it for acts specified in Clause 1 and Clause 2 of this Article.

Article 59. Acts of compelling, inciting, instigating, or assisting others to commit acts of domestic violence

1. A warning or a fine of VND 100,000 to VND 300,000 for acts of inciting, instigating, or assisting others to commit acts of domestic violence.

2. A fine of VND 300,000 to VND 500,000 for acts of compelling others to commit acts of domestic violence.

Article 60. Acts of intentionally failing to prevent, report acts of domestic violence, and obstructing prevention, reporting, and handling of acts of domestic violence

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Knowing acts of domestic violence, having conditions to prevent but failing to do so resulting in serious consequences;

b) Knowing acts of domestic violence but failing to report them to authorities, organizations, or competent persons;

c) Obstructing others from discovering or reporting acts of domestic violence.

2. A fine of VND 300,000 to VND 500,000 for acts of obstructing the handling of acts of domestic violence.

Article 61. Acts of using, disseminating information, images, sounds to incite acts of domestic violence

A warning or a fine of VND 500,000 to VND 1,000,000 for acts of using, disseminating information, images, sounds to incite acts of domestic violence.

Article 62. Violation of provisions on disclosure of information about victims of domestic violence

A fine of VND 1,000,000 to VND 3,000,000 shall be imposed on medical staff and counselors in the field of prevention and control of domestic violence who commit any of the following acts:

1. Disclosing personal information of victims of domestic violence without the consent of the victim or the guardian of the victim, thereby affecting the reputation, dignity, and credibility of the victim.

2. Intentionally disclosing or facilitating persons with violent behavior to know the temporary shelter location of victims of domestic violence.

Article 63. Acts of exploiting activities for prevention and control of domestic violence for personal gain

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Demanding money from victims or relatives of victims after providing assistance to victims of domestic violence;

b) Requesting payment for living expenses of victims at trusted addresses in the community;

c) Exploiting the difficult circumstances of victims of domestic violence to require them to perform illegal acts.

2. A fine of VND 10,000,000 to VND 30,000,000 shall be imposed on any of the following acts:

a) Establishing counseling centers for prevention and control of domestic violence or support centers for victims of domestic violence for profit-making activities;

b) Exploiting activities for prevention and control of domestic violence to commit acts violating the law.

3. Additional forms of punishment:

Revoking the license to operate and professional certificates for a period of six months to one year for the acts specified in Point a and b Clause 2 of this Article.

Article 64. Violation of registration requirements for support centers for victims of domestic violence and counseling centers for prevention and control of domestic violence

1. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed on support centers for victims of domestic violence and counseling centers for prevention and control of domestic violence operating outside the scope of their registration certificate.

2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed on support centers for victims of domestic violence and counseling centers for prevention and control of domestic violence operating without a registration certificate or failing to register.

Article 65. Violation of provisions on decisions prohibiting contact issued by the Chairman of the People's Committee of communes

1. Warning or imposing a fine from one hundred thousand dong to three hundred thousand dong for any of the following acts:

a) Intentionally contacting victims of domestic violence during the enforcement of the decision prohibiting contact;

b) Using telephones or other communication means to threaten, curse, or insult victims of domestic violence.

2. Additional forms of punishment:

Seizing evidence and means of administrative violation for the act specified in Point b Clause 1 of this Article.

Chapter III
AUTHORITY TO ISSUE ADMINISTRATIVE VIOLATION DECISIONS AND VIOLATION RECORDS

Article 66. Competence of the People's Public Security to impose administrative penalties

1. Public security officers performing their duties have the authority to:

a) To issue warnings;

b) Imposing a fine up to VND 300,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 400,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 500,000 for administrative violations in the field of fire prevention and fighting.

2. The Head of the Police Station, the Head of the Police Team, and the Head of the Water Police Team of those specified in Article 1 of this provision have the authority:

a) To issue warnings;

b) Imposing a fine up to VND 900,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 1,200,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 1,500,000 for administrative violations in the field of fire prevention and fighting.

3. Chiefs of public security stations at commune level, chiefs of public security posts, and chiefs of public security checkpoints at border gates and export processing zones have the authority to:

a) To issue warnings;

b) Imposing a fine up to VND 1,500,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 2,000,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 2,500,000 for administrative violations in the field of fire prevention and fighting;

c) Confiscate the objects and means of administrative violations with a value not exceeding the fine amount prescribed in Point b of this Clause;

d) Applying measures to remedy consequences as stipulated in Points a, c, and đ Clause 1 Article 28 of the Law on Handling Administrative Violations.

4. The Heads of the Provincial Public Security Departments; the Heads of the Departments under the Traffic Police Corps; the Heads of the Departments under the Waterway Police Corps; the Heads of the Water Police Teams; the Heads of the Provincial Public Security Departments including: the Heads of the Social Order Management Police Department, the Public Order Police Department, the Rapid Response Police Department, the Social Order Crime Investigation Police Department, the Economic and Official Crime Investigation Police Department, the Drug Crime Investigation Police Department, the Road and Rail Traffic Police Department, the Traffic Police Department, the Waterway Police Department, the Protection and Mobile Police Department, the Criminal Enforcement and Judicial Assistance Police Department, the Environmental Crime Prevention Police Department, the Firefighting and Rescue Police Department, the River Firefighting and Rescue Police Department, the Exit and Entry Management Department, the Internal Political Security Department, the Economic Security Department, the Financial, Monetary, Investment Security Department; the Heads of the Firefighting and Rescue Police Departments of districts and counties under the Firefighting and Rescue Service Department; the Heads of mobile police units at battalion level and above have the authority:

a) To issue warnings;

b) Imposing a fine up to VND 6,000,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 8,000,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 10,000,000 for administrative violations in the field of fire prevention and fighting;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscating objects and means of administrative violations with a value not exceeding the amount of fine prescribed in Point b Clause of this Article;

đ) Applying measures to remedy consequences as stipulated in Points a, c, đ, k Clause 1 Article 28 of the Law on Handling Administrative Violations and Points a, b, c, d, e Clause 3 Article 3 of this Decree.

5. The Directors of the Provincial Public Security Departments, the Directors of the Firefighting and Rescue Services Departments have the authority:

a) To issue warnings;

b) Imposing a fine up to VND 15,000,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 20,000,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 25,000,000 for administrative violations in the field of fire prevention and fighting;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscating objects and means of administrative violations with a value not exceeding the amount of fine prescribed in Point b Clause of this Article;

d) The Director of the Provincial Public Security Department decides to apply the expulsion penalty form;

e) Apply the measures to remedy consequences specified in Points a, c, d, i, k Clause 1 Article 28 Law on Handling Administrative Violations and Points a, b, c, d, e Clause 3 Article 3 of this Decree.

6. The Director of the Political Security Internal Affairs Bureau, the Director of the Economic Security General Bureau, the Director of the Information and Communication Security Bureau, the Director of the Financial, Monetary, Investment Security Bureau, the Director of the Agriculture and Rural Areas Security Bureau, the Director of the Administrative Management Police Bureau for Social Order, the Director of the Registration, Residency Management and National Population Data Bureau, the Director of the Social Order Crime Investigation Bureau, the Director of the Economic and Official Crime Investigation Bureau, the Director of the Drug Crime Investigation Bureau, the Director of the Road Traffic Police Corps - Railways, the Director of the Waterway Police Corps, the Director of the Fire Prevention, Firefighting and Rescue Police Corps, the Director of the Protection Police Corps, the Director of the Criminal Enforcement and Judicial Assistance Supervision Bureau, the Director of the Environmental Crime Prevention and Suppression Police Bureau, the Director of the High-Tech Crime Suppression Police Bureau have the authority:

a) To issue warnings;

b) To impose a fine up to 30,000,000 VND for administrative violations in the field of preventing and combating domestic violence; up to 40,000,000 VND for administrative violations in the fields of security, social order, public safety, and preventing and combating social evils; up to 50,000,000 VND for administrative violations in the field of fire prevention and firefighting;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) To apply the measures to remedy consequences specified in Points a, c, d, i, k Clause 1 Article 28 Law on Handling Administrative Violations and Points a, b, c, d, e Clause 3 Article 3 of this Decree.

7. The Director of the Immigration Management Department has the authority to impose penalties according to Clause 6 of this Article and has the right to decide to apply the expulsion penalty form.

Article 67. Authority to impose administrative penalties of Chairpersons of People's Committees at all levels

1. The Chairperson of the People's Committee at the commune level has the right to:

a) To issue warnings;

b) To impose a fine up to 3,000,000 VND for administrative violations in the field of preventing and combating domestic violence; up to 4,000,000 VND for administrative violations in the fields of security, social order, public safety, and preventing and combating social evils; up to 5,000,000 VND for administrative violations in the field of fire prevention and firefighting;

c) To confiscate contraband items and means of administrative violation with a value not exceeding the amount of fine prescribed in Point b Clause of this Article;

d) To apply the measures to remedy consequences specified in Points a, b, c and d Clause 1 Article 28 Law on Handling Administrative Violations.

2. The Chairperson of the People's Committee at the district level has the right to:

a) To issue warnings;

b) Imposing a fine up to VND 15,000,000 for administrative violations in the field of prevention and control of domestic violence; up to VND 20,000,000 for administrative violations in the fields of security, public order, social safety, and prevention and control of social evils; up to VND 25,000,000 for administrative violations in the field of fire prevention and fighting;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscating objects and means of administrative violations with a value not exceeding the amount of fine prescribed in Point b Clause of this Article;

d) To apply the measures to remedy consequences specified in Points a, b, c, d, e, h, i, k Clause 1 Article 28 Law on Handling Administrative Violations and Points a, b, c, d, e Clause 3 Article 3 of this Decree.

3. The Chairman of the Provincial People's Committee has the authority to:

a) To issue warnings;

b) To impose a fine up to 30,000,000 VND for administrative violations in the field of preventing and combating domestic violence; up to 40,000,000 VND for administrative violations in the fields of security, social order, public safety, and preventing and combating social evils; up to 50,000,000 VND for administrative violations in the field of fire prevention and firefighting;

c) To suspend the use of licenses or certificates for a period of time or to suspend operations for a period of time;

d) Confiscate contraband and means of administrative violation;

d) To apply the measures to remedy consequences specified in Clause 1 Article 28 Law on Handling Administrative Violations and Clause 3 Article 3 of this Decree.

Article 68. Authority to impose administrative penalties of other agencies

Forces such as Border Guard, Coast Guard, Customs, Forest Rangers, diplomatic missions, consular offices, and other agencies authorized to perform consular functions of the Socialist Republic of Vietnam abroad have the authority to impose penalties according to the Law on Handling Administrative Violations for the acts stipulated in Chapter II of this Decree within their respective functions, tasks, scope, and areas of management.

Article 69. Administrative Sanctioning Authority of Inspectors and Market Management

Labor, War Invalids and Social Affairs Inspectors have the authority to impose administrative sanctions according to the Law on Handling Administrative Violations for acts stipulated in Section 2 Chapter II; Culture, Sports and Tourism Inspectors have the authority to impose administrative sanctions according to the Law on Handling Administrative Violations for acts stipulated in Section 4 Chapter II; specialized Inspector forces and Market Management have the authority to impose administrative sanctions according to the Law on Handling Administrative Violations for acts stipulated in Article 20 of this Decree within their functions, tasks, and areas under management.

Article 70. Principles for Determination and Division of Administrative Sanctioning Authority

1. The administrative sanctioning authority of those with authority as prescribed in Articles 66, 67, 68, and 69 of this Decree is the authority to apply to an individual's administrative violation. In cases of fines, the sanctioning authority for organizations is twice the sanctioning authority for individuals.

2. The administrative sanctioning authority of forces under the People's Public Security implements according to Article 39 of the Law on Handling Administrative Violations and Article 66 of this Decree within their functions, tasks, and areas under management.

Article 71. Authority to Draft Administrative Violation Records

1. Those with administrative sanctioning authority as prescribed in Articles 66, 67, 68, and 69 of this Decree.

2. Those with authority currently performing public duties or assigned tasks in the fields of security, social order, social safety; prevention and control of social evils; fire prevention and firefighting; prevention and control of domestic violence.

Chapter IV
IMPLEMENTING PROVISIONS

Article 72. Effective Date

1. This Decree takes effect from December 28, 2013.

2. Articles 14, 15, 16, 17, 18, 19, and 20 of Chapter 3 of Decree No. 178/2004/NĐ-CP dated October 15, 2004 detailing implementation of certain provisions of the Ordinance on Prevention and Control of Prostitution, Decree No. 110/2009/NĐ-CP dated December 10, 2009 on administrative sanctions in the field of prevention and control of domestic violence, Decree No. 73/2010/NĐ-CP dated July 12, 2010 on administrative sanctions in the field of security and social order, social safety, Decree No. 52/2012/NĐ-CP dated June 14, 2012 on administrative sanctions in the field of fire prevention and firefighting shall cease to be effective from the date this Decree takes effect.

Article 73. Transitional Provisions

1. For administrative violations in the fields of security, social order, social safety; prevention and control of social evils; fire prevention and firefighting; prevention and control of domestic violence occurring before the effective date of this Decree but discovered later or still under examination and resolution, the more favorable provisions shall be applied.

2. For administrative violations in the fields of security, social order, social safety; prevention and control of social evils; fire prevention and firefighting; prevention and control of domestic violence occurring before the effective date of this Decree but still subject to appeal, the provisions of previous Decrees shall be applied for handling.

Article 74. Responsibility for Implementation

1. The Minister of Public Security is responsible for organizing, urging, guiding, and inspecting the implementation of this Decree.

2. Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of Provincial People's Committees directly under the Central Government, and related organizations and individuals are responsible for implementing this Decree.
