Based on the Anti-Corruption Law dated November 29, 2005 and the Law Amending and Supplementing Certain Articles of the Anti-Corruption Law dated August 4, 2007;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Based on Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government stipulating the list of positions and the periodic rotation period for positions for cadres, civil servants, and public officials.

The Government Inspectorate hereby provides detailed regulations on the list of inspection positions for civil servants in state inspection agencies that must be periodically rotated as follows:

Article 1. Scope and Applicability

1. This Circular specifies the detailed list of inspection positions for civil servants not holding leadership or management positions in state inspection agencies that must be periodically rotated to proactively prevent corruption.

2. Principles, contents, forms, and responsibilities for implementing periodic position rotations shall be carried out in accordance with the provisions of Decree No. 158/2007/NĐ-CP dated October 27, 2007 of the Government.

3. The rotation of positions that are not inspection positions for civil servants and public officials in state inspection agencies shall be implemented according to the guidance of ministries and ministerial-level agencies managing specific sectors with authority to issue detailed regulations on the list of positions that must be periodically rotated.

4. The rotation of cadres and civil servants holding leadership or management positions shall be carried out in accordance with the regulations on cadre rotation.

Article 2. List of inspection positions for civil servants in state inspection agencies that must be periodically rotated

1. Administrative inspection;

2. Specialized inspection;

3. Handling complaints and denunciations;

4. Inspection for anti-corruption;

5. Receiving citizens.

6. Handling complaint and denunciation letters;

7. Management by area and sector assigned for inspection, handling complaints and denunciations, and anti-corruption.

Article 3. Periodic Term for Position Rotation

The periodic rotation period for positions is three years (36 months) for civil servants working in the inspection positions specified in Article 2 of this Circular.

Article 4. Cases where rotation has not occurred or will not occur

1. In cases where the rotation period has expired but the rotation has not yet been carried out; the rotation shall be carried out when there are no longer reasons for non-rotation:

a) Civil servants currently under disciplinary review;

b) Civil servants currently under investigation or related to ongoing investigations, inspections, or audits;

c) Civil servants undergoing treatment for serious illnesses as defined by the Ministry of Health, studying abroad long-term, or on special assignment;

d) Female civil servants currently pregnant or nursing children under 36 months old. In cases where male civil servants need to care for children under 36 months old due to their wife's death or other objective reasons, they shall also be treated like female civil servants.

đ) Civil servants currently serving as heads of inspection teams or complaint and denunciation resolution teams.

2. Position rotation shall not be implemented for civil servants who have less than 18 months of service remaining before reaching retirement age.

Article 5. Implementation Provisions

1. This Circular takes effect 45 days from the date of issuance.

2. Ministries, ministerial-level agencies, provincial People's Committees, and municipal People's Committees directly under the central government shall be responsible for organizing and directing state inspection agencies within their jurisdiction to implement periodic position rotation for civil servants; they shall compile and report to the Government Inspectorate the results of implementation before November 1 each year.

3. During the implementation process, if there are any emerging issues or difficulties, ministries, ministerial-level agencies, provincial People's Committees, municipal People's Committees directly under the central government, and state inspection agencies shall promptly reflect these issues to the Government Inspectorate for research and resolution.
