DECISION NO. 169/2002/QĐ-TTg OF NOVEMBER 27, 2002 ON THE REGULATION OF STANDARDS AND RATES FOR THE USE OF PASSENGER CARS IN THE ARMED FORCES
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 120/1997/NĐ-CP dated December 27, 1997 on the management and use of state budget and assets for certain activities in the fields of national defense and security;
Pursuant to Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman on the regulation of standards and rates for the use of passenger cars in administrative and public service agencies and state-owned enterprises;
At the proposal of the Minister of National Defense,
DECISION:
Article 1. Units of the Vietnam People's Army that are equipped with passenger cars are units specified in the Government's Decree on the functions, tasks, authorities, and organizational structure of the Ministry of National Defense and other regulations of the State related to the organization of the military.
Article 2. The passenger cars referred to in this Decision are passenger cars with up to 15 seats used to serve: leaders, ensuring command tasks, and serving officers, professional soldiers, workers, and civil servants going on official business.
These cars may be purchased from state budget funds or have their origin from state budgets (including aid, war spoils, gifts from organizations and individuals both within and outside the country or established ownership rights of the State according to the provisions of the law, projects, programs when they end and transfer); purchased from state-owned enterprise funds in the military and other sources included in military equipment.
Article 3.
1. Passenger cars in the military shall be managed and used in accordance with the state asset management regime and the standards and rates prescribed in this Decision.
The Minister of National Defense shall stipulate the management, use, and registration of license plates (including cars of state-owned enterprises in the military).
2. Units equipped with passenger cars shall not sell, give away, or transfer ownership and use rights to other organizations or individuals without permission from the Minister of National Defense.
3. Strictly prohibit the use of state-owned passenger cars for personal purposes, leasing, and other purposes that are not for combat, training, and military work.
Article 4.
1. The following officials shall be entitled to use one passenger car during their term of office.
a) Minister.
b) Deputy Minister.
c) Leadership and command positions with leadership position allowances equivalent to those of a Deputy Minister.
d) Officials holding general rank who do not belong to the positions specified in points a, b, and c of Clause 1 of Article 1 of this Decision and officials currently holding positions with a ceiling rank of general.
2. Scientists meeting the criteria set forth in Decision No. 33/2001/QĐ-TTg dated March 13, 2001 of the Government Chairman shall be entitled to use passenger cars.
Passenger cars specified in Clause 1 and Clause 2 of this Article shall be considered for replacement when they have been used with a wear rate of 70% or more or are no longer safe for operation.
Article 5. Shared passenger cars:
1. Commanders with leadership position allowances ranging from 0.5 to less than 1.1 and senior officials (excluding the categories specified in Article 4 of this Decision) shall be provided with passenger cars for official travel, but not for daily transportation between residence and workplace.
In urgent cases to serve tasks, unit commanders have the authority to provide passenger cars for other positions to go on official business.
2. The number of shared passenger cars for administrative military agencies shall be determined according to the annex attached to this Decision.
Combat units at division level and below (or equivalent) and other special cases shall be provided with the number of passenger cars necessary to fulfill their tasks as stipulated by the Minister of National Defense.
Article 6. State-owned enterprises in the Vietnam People's Army shall be equipped with passenger cars in accordance with the standards and rates prescribed in Article 15 of Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman.
Article 7. The price of purchasing passenger cars shall be implemented in accordance with Decision No. 122/1999/QĐ-TTg dated May 10, 1999 of the Government Chairman and the regulations of the Ministry of Finance.
When there is a need to purchase imported passenger cars, the Minister of National Defense shall submit to the Government Chairman for decision.
Article 8. Annually, based on the current number of passenger cars and the standards and rates for using passenger cars as stipulated in this Decision, the Minister of National Defense shall determine the needs and prepare a budget to purchase additional replacement cars as required under the regulations.
Article 9. Based on the provisions of this Decision, the Minister of National Defense shall be responsible for:
1. Deciding the allocation of passenger cars for each type of organization.
2. Specifying types of passenger cars suitable for the requirements of military tasks: combat, training, and work.
3. Adjusting the current number of passenger cars of units to comply with current laws.
4. Organizing guidance for units on the management and use of passenger cars in accordance with the legal standards and rates.
Article 10.
1. Heads of units in the military who make decisions to purchase passenger cars beyond their authority and standards, types, and price limits shall be subject to disciplinary action, and if damage occurs, they must compensate according to the law.
2. Organizations and individuals who implement the purchase, management, and use of passenger cars beyond the standards and rates and exceed the prices specified in Article 7 of this Decision shall be subject to disciplinary action or criminal liability depending on the nature and degree of violation, and if damage occurs, they must compensate according to the law.
Article 11. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER THE DATE OF SIGNATURE.
All previous regulations that conflict with this Decision are hereby abolished.
Article 12. Ministers of the Ministries of National Defense, Finance, Planning and Investment, and heads of relevant agencies shall be responsible for implementing this Decision./.
