PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 23/2008/NQ-QH12 dated November 6, 2008 of the 12th National Assembly, fourth session on the socio-economic development plan for 2009;
Pursuant to Resolution No. 23/2008/NQ-CP dated October 3, 2008 of the regular meeting of the Government in September 2008;
Pursuant to Resolution No. 25/2008/NQ-CP dated November 5, 2008 of the regular meeting of the Government in October 2008;
Considering the proposals of the Minister of Home Affairs, the Minister of Finance, and the Minister of Labor, Invalids, and Social Affairs.
DECISION:
Article 1.
1. Implementing hardship allowances at a rate of 360,000 dong per person, paid according to the salary period for four months (January, February, March, and April 2008), starting from January 1, 2009, for officials, civil servants, public employees, and personnel receiving salaries within the armed forces who have low salaries and difficult living conditions.
2. The subjects with low salaries and difficult living conditions entitled to hardship allowances under Clause 1 of this Decision are those whose salary coefficient (salary for position or current grade level) is 3.00 or lower, including:
a) Officials and civil servants (including provisional civil servants) included in the state budget payroll working in state agencies, political organizations, and political-social organizations at the central level; at provincial and centrally-administered city levels; at district, urban district, town, and provincial city levels;
b) Public employees included in the state budget payroll and other sources of institutional income as prescribed by law working in state-owned institutions, political organizations, and political-social organizations;
c) Officials, civil servants, and public employees included in the state payroll and receiving salaries according to the state-prescribed pay scale appointed by competent authorities to work in associations, non-governmental organizations, projects, and international organizations based in Vietnam;
d) Full-time cadres and civil servants at communes, wards, and towns as stipulated in Clause 1 and Clause 2 of Article 2 of Decree No. 121/2003/NĐ-CP dated October 21, 2003 of the Government on the system and policies for cadres and civil servants at communes, wards, and towns;
đ) Kindergarten teachers in the payroll and kindergarten teachers under contract as stipulated in Decision No. 161/2002/QĐ-TTg dated November 15, 2002 of the Prime Minister;
e) Health workers at communes, wards, and towns receiving salaries according to Decision No. 58/TTg dated February 3, 1994 and Decision No. 131/TTg dated March 4, 1995 of the Prime Minister;
g) Subjects entering labor contracts as prescribed in Decree No. 68/2000/NĐ-CP dated November 17, 2000 of the Government on implementing the system of contracts for certain types of work in administrative agencies and public institutions, who have been assigned salaries according to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for officials, civil servants, public employees, and members of the armed forces, currently working in state-owned institutions, public institutions, political organizations, and political-social organizations;
h) Personnel engaged in confidential work in confidential organizations;
i) Professional military personnel, workers, and public employees receiving salaries from the state budget belonging to the Vietnam People's Army;
k) Non-commissioned officers, workers, and staff of the police force receiving salaries from the state budget belonging to the Vietnam People's Public Security Force.
Article 2.
1 Hardship allowances shall be calculated and paid concurrently with monthly salaries and shall not be used to calculate contributions to social insurance and health insurance.
2. The financial resources for implementing hardship allowances for the subjects specified in Article 1 of this Decision shall be guaranteed from the state budget and legitimate income of the agencies and units.
Article 3. The Ministry of Finance shall guide the implementation of financial resources and settlement of the hardship allowance payments under this Decision; supplement financial resources for implementing hardship allowances for ministries, central agencies, provinces, centrally-administered cities, and compile and report to the Prime Minister the results of implementation.
Article 4. This Decision shall take effect fifteen days after its publication in the Official Gazette.
Article 5. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
