Detailed regulations on the organization and operation
of the People's Committee of a ward in Hanoi City

Pursuant to the Law on Organization of Local Administration dated June 19, 2015;

Pursuant to the Law Amending and Supplementing Several Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Based on the Law on the Capital City dated June 28, 2024;

||| Based on the proposal of the Minister of Home Affairs;

The Government issues this Decree detailing the organization and operation of the People's Committee of a ward in Hanoi City.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree details the organization and operation of the People's Committee of a ward in Hanoi City (hereinafter referred to as the city).

Article 2. Applicability

This Decree applies to:

1. The People's Committee of a ward and civil servants working at the People's Committee of a ward in Hanoi City (hereinafter referred to as the People's Committee of a ward).

2. Other relevant agencies, organizations, and individuals.

Chapter II

ORGANIZATION AND OPERATIONS OF THE PEOPLE'S COMMITTEE OF A WARD

Article 3. Organizational structure of the People's Committee of a ward

1. The organizational structure of the People's Committee of a ward shall be implemented according to point a, Clause 3, Article 13 of the Law on the Capital City.

2. Other civil servants of the People's Committee of a ward include:

a) Head of the Military Command Post;

b) Office - Statistics;

c) Land Administration - Construction - Urban and Environment;

d) Finance - Accounting;

đ) Justice - Civil Registration;

e) Culture - Social Affairs.

Article 4. Principles of operation of the People's Committee of a ward

1. The People's Committee of a ward operates under the head system, ensuring the principle of democratic centralism. The Chairman of the People's Committee of a ward decides matters within the scope of duties and powers of the People's Committee of a ward, and bears responsibility for his decisions.

2. In case of absence of the Chairman of the People's Committee of a ward, the Chairman of the People's Committee of a district, town, or city within the city shall decide to delegate the authority of the Chairman of the People's Committee of a ward until a decision on appointing the Chairman of the People's Committee of a ward is made.

3. Specific tasks and powers of the People's Committee of a ward and the tasks and powers of the People's Committee of a ward delegated and authorized under Clause 1, Article 13 and Article 14 of the Law on the Capital City must be discussed collectively before the Chairman of the People's Committee of a ward makes a decision and bears responsibility for his decision.

The collective referred to in this clause includes: the Chairman of the People's Committee of a ward, Deputy Chairmen of the People's Committee of a ward, and other relevant civil servants.

4. Operations of the People's Committee of a ward must meet the satisfaction of citizens, comply with procedures and formalities, act within the assigned authority, and follow the provisions of the law and the Rules of Procedure of the People's Committee of a ward. Administrative reform should be promoted, online public services should be applied to handle administrative procedures for individuals and organizations in the ward as prescribed by law, ensuring that all activities of the People's Committee of a ward are democratic, transparent, consistent, smooth, effective, and efficient.

5. The Chief of Police Station advises and is subject to the direction and management of the Chairman of the People's Committee of a ward in implementing tasks related to security, public order, social safety, crime prevention, and combating criminal acts and other violations of the law in the area as prescribed by law.

Article 5. Responsibilities of the Chairman of the People's Committee of a ward

1. The Chairman of the People's Committee of a ward is the head of the People's Committee of a ward, responsible for leading, managing, and directing all activities of the People's Committee of a ward comprehensively according to the Rules of Procedure of the People's Committee of a ward, ensuring the principle of democratic centralism and complying with the provisions of the law.

2. Issuing the Rules of Procedure of the People's Committee of a ward.

3. Being accountable to the People's Council, the People's Committee, the Chairman of the People's Committee of a district, town, or city within the city, and the law regarding the performance of the tasks and powers of the People's Committee of a ward.

4. Directly using and managing civil servants working at the People's Committee of a ward according to the Law on the Capital City and the delegation and authorization of the People's Committee of the city, the Chairman of the People's Committee of the city, the People's Committee and the Chairman of the People's Committee of a district, town, or city within the city.

5. Signing documents of the People's Committee of a ward with the title of Chairman of the People's Committee of a ward, the head of the administrative agency of the state at the ward level, and bearing responsibility for the documents of the People's Committee of a ward.

6. If the Chairman of the People's Committee of a ward violates the responsibilities stipulated in this Article, he will be examined and dealt with according to the Law on Cadres and Civil Servants and relevant laws.

Article 6. Responsibilities of Deputy Chairpersons of the People's Committee of the Ward

1. Perform the tasks and powers of the People's Committee of the Ward within the scope of fields assigned by the Chairperson of the People's Committee of the Ward.

2. Be responsible to the Chairperson of the People's Committee of the Ward and to the law when performing tasks and exercising powers within the scope of fields assigned.

3. Be authorized in writing by the Chairperson of the People's Committee of the Ward to manage, resolve work matters, and sign documents of the People's Committee of the Ward in the absence of the Chairperson of the People's Committee of the Ward.

4. Sign on behalf of the Chairperson of the People's Committee of the Ward for documents of the People's Committee of the Ward when assigned by the Chairperson of the People's Committee of the Ward.

5. If Deputy Chairpersons of the People's Committee of the Ward violate responsibilities stipulated in this Article, they shall be examined and dealt with according to the provisions of the Law on Public Officials and Civil Servants and relevant laws.

Article 7. Responsibilities of other civil servants of the People's Committee of the Ward

1. Be responsible to the Chairperson of the People's Committee of the Ward, Deputy Chairpersons of the People's Committee of the Ward in charge, and to the law in performing tasks assigned by the Chairperson of the People's Committee of the Ward and tasks delegated according to the law.

2. Proactively advise and propose solutions to assigned work matters in accordance with timeframes, results, and authority; diligently serve the people without causing difficulties or inconvenience. For issues exceeding their authority, they must report to the Chairperson of the People's Committee of the Ward or Deputy Chairpersons of the People's Committee of the Ward in charge for consideration and decision.

3. Adhere to the Working Regulations of the People's Committee of the Ward, strictly comply with task assignments from the Chairperson of the People's Committee of the Ward; resolve work matters according to assigned functions and duties, ensuring progress and quality.

4. Fulfill the obligations of civil servants and comply with regulations on matters that civil servants are not allowed to do as stipulated in the Law on Public Officials and Civil Servants and other relevant laws.

5. If other civil servants of the People's Committee of the Ward violate responsibilities stipulated in this Article, they shall be examined and dealt with according to the provisions of the Law on Public Officials and Civil Servants and relevant laws.

Article 8. Organization of Meetings of the People's Committee of the Ward

1. The organization of meetings of the People's Committee of the Ward shall be carried out according to the Working Regulations of the People's Committee of the Ward, convened by the Chairperson of the People's Committee of the Ward to perform assigned functions and tasks.

2. The Chairperson of the People's Committee of the Ward may invite the Secretary of the Party Committee of the Ward, the Chairman of the Vietnam Fatherland Front Committee of the Ward, the heads of political and social organizations of the Ward, the Chief of Police of the Ward, the Secretaries of Branch Committees, Heads of Resident Groups, representatives of specialized agencies under the People's Committee of the District, City, or Municipality related to the meeting when the agenda includes issues related to them.

3. Conclusions of meetings concerning citizens must be published on the website of the People's Committee of the Ward (except for information classified as state secrets) in accordance with the law and the Working Regulations of the People's Committee of the Ward to inform agencies, organizations, and citizens promptly.

Chapter III

IMPLEMENTING PROVISIONS

Article 9. Effective Date

1. This Decree takes effect from January 1, 2025.

2. Decree No. 32/2021/NĐ-CP dated March 29, 2021 of the Government detailing and providing implementation measures for Resolution No. 97/2019/QH14 dated November 27, 2019 of the National Assembly on piloting urban administration models in Hanoi City ceases to be effective from the date this Decree takes effect.

Article 10. Transitional Provisions

1. Chairpersons and Deputy Chairpersons of the People's Committee of the Ward appointed before January 1, 2025 continue to perform tasks and exercise powers according to the regulations. The term of office is calculated based on the appointment decision.

2. The allowance for leadership positions and兼任职务补贴制度对于乡级人民委员会主席、副主席和其他在乡级人民委员会工作的公务员,按照政府关于乡级干部和公务员的规定执行。

Article 11. Responsibility for Implementation

1. The Ministry of Home Affairs is responsible for guiding, inspecting, and auditing the implementation of the provisions of the Decree.

2. The People's Councils and People's Committees of cities are responsible for implementing the Decree.

3. The People's Committee of the city is responsible for:

a) Issuing a model Working Regulation of the People's Committee of the Ward;

b) Issuing regulations on分级管理在乡镇工作的干部和公务员。

4. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, the Chairman of the People's Committee of Hanoi City, and related agencies, organizations, and individuals are responsible for enforcing this Decree.
