Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;
Pursuant to Decision No. 162/2007/QD-TTg dated October 19, 2007 of the Prime Minister promulgating the Regulation on the operation of the International Border Economic Zone Cau Treo, Ha Tinh Province;
Considering the proposal of the Chairman of the People's Committee of Ha Tinh Province at Document No. 264/TTr-UBND dated December 3, 2007; and that of the Minister of Home Affairs at Document No. 3567/TTr-BNV dated December 12, 2007,

DECISION:

Article 1. On establishment and provisions regarding the position and functions of the Management Board for the International Border Economic Zone Cau Treo, Ha Tinh Province

1. To establish the Management Board for the International Border Economic Zone Cau Treo, Ha Tinh Province (hereinafter referred to as the Management Board).

2. The Management Board is a state management agency under the People's Committee of Ha Tinh Province; it has the function of managing investment, construction, and development of the International Border Economic Zone Cau Treo, Ha Tinh Province according to the operational regulations, planning, plans, and implementation schedules approved by competent state authorities.

3. The Management Board has legal personality, bank accounts, office premises, and seals with the National Emblem; it serves as the focal point for the provincial budget plan; it is allocated separate development investment capital from the central budget; the operating expenses of the Management Board are funded by the state budget in accordance with the law.

Article 2. Duties and powers of the Management Board

The Management Board shall perform duties and exercise powers as prescribed in:

1. Article 81 of Decree No. 108/2006/ND-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law;

2. Article 29 of the Operational Regulations of the International Border Economic Zone Cau Treo, Ha Tinh Province issued together with Decision No. 162/2007/QD-TTg dated October 19, 2007 of Prime Minister;

3. Other relevant legal documents and additional duties and powers assigned by the People's Committee of Ha Tinh Province.

Article 3. Organizational structure and staffing of the Management Board

1. Organizational Structure:

a) The Management Board shall have a Director appointed and relieved of duty by the Chairman of the People's Committee of Ha Tinh Province; not more than three Deputy Directors and some members appointed and relieved of duty by the Chairman of the People's Committee of Ha Tinh Province upon the recommendation of the Director of the Management Board;

b) The Management Board shall have an administrative support staff, including: an office and specialized departments;

c) Affiliated public service units.

Based on the requirements and tasks for developing the border economic zone of Ha Tinh Province in each specific phase, the Director of the Management Board shall submit to the Chairman of the People's Committee of Ha Tinh Province for decision within the scope of authority regarding the organizational structure of the Management Board.

2. Staffing:

a) Staffing of the Management Board includes: the Director, specialized Deputy Directors, and the staffing of the office and specialized departments under the state management staff quota;

b) Staffing of the Management Board shall be decided by the Chairman of the People's Committee of Ha Tinh Province in accordance with the law on decentralization of administrative and public service staff management and the staffing mechanism for public service units of the State.

3. The Director of the Management Board shall submit to the People's Committee of Ha Tinh Province for detailed regulations on the functions, duties, powers, and organizational structure of the Management Board in accordance with the law.

Article 4. Effective date

This Decision takes effect from December 20, 2007.

Article 5. Responsibilities for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairman of the People's Committee of Ha Tinh Province, and Director of the Management Board for the International Border Economic Zone Cau Treo, Ha Tinh Province are responsible for implementing this Decision.
